(1) Article 14 of the Treaty establishes an area without internal frontiers in which the free movement of goods, persons, services and capital is ensured.

(2) Le iniziative concernenti il mercato interno dovrebbero migliorare la qualità della vita, la tutela della salute e la sicurezza dei consumatori. La presente direttiva è conforme agli obblighi di garantire un livello elevato di protezione della salute e di tutela dei consumatori in sede di definizione e attuazione di tutte le politiche e attività comunitarie.

(2) Work on the internal market should improve the quality of life, health protection and consumer safety. This Directive complies with the requirements of ensuring a high level of health protection and of consumer protection in the definition and implementation of all Community policies and activities.

(3) L'impiego di certi ftalati in giocattoli o articoli di puericultura fabbricati in materiale plastificato o contenenti parti fabbricate in materiale plastificato dovrebbe essere vietato in quanto la presenza di certi ftalati comporta rischi effettivi o potenziali per la salute dei bambini.

(3) The use of certain phthalates in toys and childcare articles made of plasticised material or including parts made of plasticised material should be prohibited as the presence of certain phthalates presents or could potentially present risks related to the health of children.

(4) Il Comitato scientifico della tossicità, dell'ecotossicità e dell'ambiente (CSTEA), previamente consultato dalla Commissione, ha reso pareri sui rischi sanitari da tali ftalati.

(4) The Scientific Committee on Toxicity, Ecotoxicity and the Environment (SCTEE), after being consulted by the Commission, has delivered opinions on the health risks raised by these phthalates.

(5) La raccomandazione della Commissione 98/485/CEE del 1o luglio 1998 relativa agli articoli di puericultura ed ai giocattoli destinati ad essere messi in bocca da parte di bambini di età inferiore a tre anni, fabbricati in PVC morbido contenente determinati ftalati [4], ha esortato gli Stati membri a prendere misure necessarie per garantire un livello elevato di protezione della salute dei bambini in riferimento a questi prodotti.

(5) Commission Recommendation 98/485/EC of 1 July 1998 on childcare articles and toys intended to be placed in the mouth by children of less than three years of age, made of soft PVC containing certain phthalates [4], invited Member States to take measures to ensure a high level of child health protection with regard to these products.

(6) Dal 1999 l'impiego di sei ftalati in giocattoli e articoli di puericultura destinati ad essere messi in bocca da bambini di età inferiore a tre anni è oggetto di un divieto provvisorio in tutta l'Unione europea in seguito all'adozione della decisione 1999/815/CE della Commissione [5], nel quadro della direttiva 92/59/CEE del Consiglio, del 29 giugno 1992, relativa alla sicurezza generale dei prodotti [6]. Detta decisione è sottoposta periodicamente a rinnovo.

(6) Since 1999, the use of six phthalates in toys and childcare articles intended to be placed in the mouth by children under the age of three is subject to a temporary ban at European Union level following the adoption of Commission Decision 1999/815/EC [5] in the framework of Council Directive 92/59/EEC of 29 June 1992 on general product safety [6]. This Decision is being renewed regularly.

(7) Le disposizioni limitative già adottate da taluni Stati membri circa la commercializzazione di giocattoli e articoli di puericultura contenenti ftalati influiscono direttamente sul completamento e il funzionamento del mercato interno. È pertanto necessario ravvicinare le legislazioni degli Stati membri in questo campo e di conseguenza modificare l'allegato I della direttiva 76/769/CEE del Consiglio [7].

(7) Limitations already adopted by certain Member States on the placing on the market of toys and childcare articles because of their phthalate content directly affect the completion and functioning of the internal market. It is therefore necessary to approximate the laws of the Member States in this field and consequently to amend Annex I to Council Directive 76/769/EEC [7].

(8) Ove la valutazione scientifica non consenta di determinare i rischi con sufficiente certezza, andrebbe applicato il principio di precauzione al fine di assicurare un elevato grado di protezione della salute, specialmente riguardo ai bambini.

(8) The precautionary principle should be applied where scientific evaluation does not allow the risk to be determined with sufficient certainty in order to ensure a high level of protection of health, in particular for children.

(9) Essendo organismi in fase di sviluppo, i bambini sono particolarmente sensibili alle sostanze tossiche per la riproduzione. Per tale motivo, dovrebbe essere ridotta nella misura del possibile l'esposizione dei bambini a qualsiasi fonte concretamente evitabile di emissioni contenenti queste sostanze, specialmente ad articoli che i bambini introducono in bocca.

(9) Children as developing organisms are particularly vulnerable to reprotoxic substances. Therefore, the exposure of children to all practically avoidable sources of emissions of these substances, especially from articles which are put into the mouth by children, should be reduced as far as possible.

(10) Contestualmente alle valutazioni dei rischi e/o nel quadro della direttiva 67/548/CEE del Consiglio, del 27 giugno 1967, concernente il ravvicinamento delle disposizioni legislative, regolamentari ed amministrative relative alla classificazione, all'imballaggio e all'etichettatura delle sostanze pericolose [8], i DEHP, DBP e BBP sono stati individuati come sostanze tossiche per la riproduzione e pertanto sono state classificate come tali nella categoria 2.

(10) During risk assessments and/or within the framework of Council Directive 67/548/EEC of 27 June 1967 on the approximation of laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances [8], DEHP, DBP and BBP have been identified as reprotoxic substances and have therefore been classified as reprotoxic, category 2.

(11) Le informazioni scientifiche relative ai DINP, DIDP e DNOP sono insufficienti o contraddittorie, ma non può escludersi che tali sostanze siano potenzialmente rischiose se impiegate in giocattoli e articoli di puericultura la cui produzione è destinata per definizione ai bambini.

(11) Scientific information regarding DINP, DIDP and DNOP is either lacking or conflicting, but it can not be excluded that they pose a potential risk if used in toys and childcare articles, which are by definition produced for children.

(12) Date le incertezze nella valutazione dell'esposizione a questi ftalati, ad esempio riguardo ai tempi di introduzione in bocca e all'esposizione ad emissioni da altre fonti, occorre tenere conto di valutazioni di carattere cautelativo. Andrebbero pertanto introdotte restrizioni all'impiego di detti ftalati in giocattoli e articoli di puericultura e all'immissione sul mercato di siffatti articoli. Tuttavia, le restrizioni applicate ai DINP, DIDP e DNOP dovrebbero essere meno rigorose di quelle proposte per i DEHP, DBP e BBP per motivi di proporzionalità.

(12) The uncertainties in the evaluation of exposure to these phthalates, such as mouthing times and exposure to emissions from other sources, require that precautionary considerations be taken into account. Therefore, restrictions on the use of these phthalates for toys and childcare articles and on the placing on the market of such articles should be introduced. However, the restrictions for DINP, DIDP and DNOP should be less severe than the ones proposed for DEHP, DBP and BBP for reasons of proportionality.

(13) Conformemente alla comunicazione della Commissione sul principio di precauzione, le misure basate su questo principio dovrebbero essere soggette a revisione, alla luce dei nuovi dati scientifici.

(13) In line with the Commission Communication on the Precautionary Principle, the measures based on this principle should be subject to review in the light of new scientific information.

(14) La Commissione, in collaborazione con le autorità degli Stati membri preposte al controllo del mercato e all'applicazione della legge nel settore dei giocattoli e degli articoli di puericultura, e in consultazione con le pertinenti organizzazioni di produttori e importatori, sorveglia l'impiego di ftalati e altre sostanze presenti come plastificanti in giocattoli e articoli di puericultura.

(14) The Commission, in cooperation with the Member State authorities responsible for market surveillance and enforcement for toys and childcare articles, and in consultation with the relevant organisations of producers and importers, should monitor the use of phthalates and other substances as plasticisers in toys and childcare articles.

(15) È necessario definire, ai fini della direttiva 76/769/CEE, il termine "articoli di puericultura".

(15) For the purpose of Directive 76/769/EEC, the term "childcare article" should be defined.

(16) Il Consiglio, conformemente all'articolo 34 dell'Accordo interistituzionale "Legiferare meglio" [9] dovrebbe incoraggiare gli Stati membri a redigere e rendere pubblici, nell'interesse proprio e della Comunità, prospetti indicanti, per quanto possibile, la concordanza tra la presente direttiva e i provvedimenti di recepimento.

(16) The Council, in accordance with paragraph 34 of the Interinstitutional agreement on better law-making [9], should encourage Member States to draw up, for themselves and in the interest of the Community, their own tables, which will, as far as possible, illustrate the correlation between this Directive and the transposition measures and to make them public.

(17) La Commissione riesaminerà l'impiego degli ftalati elencati nell'allegato della direttiva 76/769/CEE in altri prodotti, una volta conclusa la valutazione dei rischi prevista dal regolamento (CEE) n. 793/93 del Consiglio, del 23 marzo 1993, relativo alla valutazione e al controllo dei rischi presentati dalle sostanze esistenti [10].

(17) The Commission will review the use of the phthalates listed in Annex I to Directive 76/769/EEC in other products when the risk evaluation under Council Regulation (EEC) No 793/93 of 23 March 1993 on the evaluation and control of the risks of existing substances [10] will have been concluded.

(18) La presente direttiva si applica senza pregiudizio delle disposizioni legislative comunitarie che stabiliscono i requisiti minimi in materia di protezione dei lavoratori di cui alla direttiva 89/391/CEE del Consiglio, del 12 giugno 1989, concernente l'attuazione di misure volte a promuovere il miglioramento della sicurezza e della salute dei lavoratori durante il lavoro [11] e ad altre direttive da essa derivate, in particolare la direttiva 90/394/CEE del Consiglio, del 28 giugno 1990, sulla protezione dei lavoratori contro i rischi derivanti da un'esposizione ad agenti cancerogeni durante il lavoro [12] e la direttiva 98/24/CE del Consiglio, del 7 aprile 1998, sulla protezione della salute e della sicurezza dei lavoratori contro i rischi derivanti da agenti chimici durante il lavoro [13],

(18) This Directive applies without prejudice to Community legislation laying down minimum requirements for the protection of workers contained in Council Directive 89/391/EEC of 12 June 1989 on the introduction of measures to encourage improvements in the safety and health of workers at work [11] and in individual directives based thereon, in particular Council Directive 90/394/EEC of 28 June 1990 on the protection of workers from the risks related to exposure to carcinogens at work [12] and Council Directive 98/24/EC of 7 April 1998 on protection of health and safety of workers from the risk related to chemical agents at work [13],

"(c) "childcare article" means any product intended to facilitate sleep, relaxation, the feeding of children or sucking on the part of children."

The Commission shall re-evaluate, by … [14] at the latest, the measures provided for in Directive 76/769/EEC as amended by this Directive in the light of new scientific information on substances described in the Annex to this Directive and their substitutes, and if justified, these measures shall be modified accordingly.

MOTIVAZIONE DEL CONSIGLIO

STATEMENT OF THE COUNCIL REASONS

La Commissione ha presentato il 24 novembre 1999 al Consiglio e al Parlamento europeo la sua proposta [1] che modifica per la ventiduesima volta la direttiva 76/769/CEE, che è basata sull'articolo 95 del trattato CE.

The Commission submitted to the Council and to the European Parliament its proposal for amending for the 22nd time Directive 76/769/EEC on 24 November 1999 [1], based on Article 95 of the EC Treaty.

Il Comitato economico e sociale ha emesso il suo parere [2] il 15 febbraio 2000.

The European Economic and Social Committee delivered an opinion on 15 February 2000 [2].

Il Parlamento europeo ha ultimato la prima lettura e formulato il suo parere [3] il 6 luglio 2000.

The European Parliament completed its first reading and delivered an opinion on 6 July 2000 [3].

Il 4 aprile 2004, il Consiglio ha adottato la posizione comune riportata nel doc. 5467/05.

On 4 April 2005, the Council adopted its Common Position as set out in Document 5467/05.

Il progetto di direttiva riguarda la commercializzazione e l'utilizzazione dei giocattoli e degli articoli di puericultura contenenti ftalati. Nella versione originaria esso prevedeva il divieto di impiegare sei diversi ftalati nei giocattoli e articoli di puericultura contenenti PVC e destinati ad essere messi in bocca da parte di bambini di età inferiore a tre anni.

The draft Directive relates to the marketing and use of toys and childcare articles containing phthalates. In its original form it foresaw prohibition of six different phthalates in toys and childcare articles containing PVC and intended to be put in the mouth by children under the age of three years.

- nel caso di giocattoli che contengono ftalati e sono destinati ai bambini di età compresa tra i tre e i sei anni, ma che possono essere introdotti in bocca da bambini di età inferiore ai tre anni è necessario che un'avvertenza figuri sulla confezione e sul giocattolo stesso;

- in the case of toys that contain phthalates and are intended for children between the ages of three and six, but which younger children could place in their mouths, warnings must be placed on the packaging and on the toy itself,

- il divieto va applicato a tutti gli ftalati e non esclusivamente ai sei indicati nella proposta della Commissione;

- the prohibition should apply to all phthalates and not only to the six contained in the Commission proposal,

- il divieto va esteso a tutti i giocattoli, non soltanto a quelli destinati ai bambini di età inferiore ai tre anni e non esclusivamente ai giocattoli che possono essere introdotti in bocca. In questi ultimi giocattoli sono ammesse concentrazioni non superiori allo 0,1 % anziché all'1 % come previsto nella proposta della Commissione.

- the ban should be extended to all toys, not just toys intended for children under three, and not only toys that are designed to be placed in the mouth. Toys which can be placed in the mouth by children may have concentrations no greater than 0.1 %, rather than 1 % as envisaged in the Commission proposal,

- non possono essere aggiunti aromi ai giocattoli contenenti ftalati, che potrebbero essere messi in bocca dai bambini;

- fragrances may not be added to toys, containing phthalates, which a child can place in its mouth.

Il 25 maggio 2000, il Consiglio ha esaminato il fascicolo senza però poter pervenire a un accordo su una posizione comune.

On 25 May 2000, the Council examined the file but was not able to reach agreement on a common position.

Nel frattempo sono stati messi a disposizione i risultati di nuove valutazioni dei rischi, alla luce dei quali sembra opportuno rafforzare alcune tra le disposizioni originarie, in linea con le conclusioni del Parlamento europeo. Il 24 settembre 2004, il Consiglio ha raggiunto un accordo politico all'unanimità sul progetto di direttiva recante ventiduesima modifica della direttiva 76/769/CEE, che figura nell'allegato I del documento 12469/04.

Meanwhile, the results of new risk assessments had become available, and it seemed desirable to strengthen some of the original provisions, in line with what the European Parliament had concluded. On 24 September 2004, the Council reached a political agreement by unanimity on the draft Directive, amending for the 22nd time Directive 76/769/EEC, as set out in Annex I to Document 12469/04.

1. Osservazioni generali

Benché non accolga tutti gli emendamenti del Parlamento europeo, la posizione comune amplia considerevolmente il campo di applicazione del divieto, sostituendo all'etichettatura un divieto totale, e garantisce la certezza giuridica dando una chiara definizione degli elementi che rientrano nel campo di applicazione del divieto (è stata aggiunta una definizione di articoli di puericultura, identica a quella contenuta nella decisione sui giocattoli [4]).

Though not incorporating all amendments of the European Parliament, the common position broadens considerably the scope of the ban, by replacing labelling with an outright ban and ensures legal certainty by clearly defining the items which fall within the scope of the ban (a definition of childcare article, identical to the one contained in the Toys Decision [4], has been added).

Gli emendamenti 1, 3, 4, 6 e 8 sono stati accolti in linea di massima, benché riformulati.

Amendments 1, 3, 4, 6 and 8 have been accepted in principle, though redrafted.

2. Nuovi elementi contenuti nella posizione comune rispetto alla proposta della Commissione

2. New elements contained in the Common Position as compared with the Commission proposal

I considerando 3, 4 e 7 hanno subito lievi modifiche di formulazione, per lo più di indole giuridica. Sono stati aggiunti i nuovi considerando 6 e da 9 a 15, per rilevare che è già in vigore un divieto temporaneo e chiarire la relazione tra gli ftalati da vietare, il principio di precauzione e le procedure di valutazione dei rischi.

Recitals 3, 4 and 7 have undergone minor drafting changes, mostly of a legal nature. New recitals 6 and 9 to 15 have been added, to indicate that a temporary ban is already in force and to clarify the relationship between the phthalates to be banned, the precautionary principle and the risk assessment procedures.

La definizione di "articoli di puericultura" è stata introdotta nel nuovo articolo 1, paragrafo 1.

The definition of 'childcare article' has been introduced in the new Article 1(1).

L'articolo 2 è stato riformulato per introdurvi l'obbligo per la Commissione di riesaminare tali misure entro quattro anni dalla loro entrata in vigore.

Article 2 has been redrafted to introduce the obligation for the Commission to review these measures within four years from their entry into force.

L'articolo 3 è stato riformulato per uniformarlo agli orientamenti per la redazione della legislazione e inserirvi l'obbligo per gli Stati membri di notificare alla Commissione le misure di recepimento.

Article 3 has been redrafted to comply with the guidelines on drafting legislative texts, and to add the obligation for Member States to notify the transposition measures to the Commission.

Nell'allegato è stato chiarito il campo di applicazione del divieto, estendendolo, per il DEHP, il DBP ed il BBP a tutti i giocattoli e articoli di puericultura. Per il DINP, il DIDP e il DNOP il divieto riguarda i giocattoli e gli articoli di puericultura destinati ai bambini al di sotto di tre anni e che potrebbero essere messi in bocca. Si è specificato che in entrambi i casi il limite di concentrazione della massa dello 0,1 % vale per la massa del materiale plastificato, in maniera tale che, nel caso di prodotti che assieme al materiale plastificato comprendono altri componenti, esso vale pienamente soltanto per la parte plastificata.

In the Annex, the scope of the ban has been clarified, by extending it, for DEHP, DBP and BBP, to all toys and childcare articles; for DINP, DIDP and DNOP, the ban will cover toys and childcare articles intended for children under three years of age and which can be placed in the mouth by them. In both cases, it has been clarified that the concentration limit of 0,1 % of the mass applies to the plasticised material mass, so that in case of items which include both plasticised material and other components, it remains applicable in full to the plasticised part only.

Il Consiglio con la sua posizione comune intende procedere nella stessa direzione del Parlamento europeo, ampliando significativamente il campo di applicazione del divieto e sostituendo un divieto totale all'etichettatura. Il Consiglio ritiene che ciò sia un decisivo contributo verso l'adozione di un divieto permanente, sulla scorta di un riesame ininterrotto, nella prospettiva di un divieto ancor più ampio eventualmente reso necessario da nuove valutazioni scientifiche effettuate successivamente all'entrata in vigore della direttiva.

The Council, through its Common Position, wishes to move forward in the same direction as the European Parliament, by significantly broadening the scope of the ban, replacing labelling with an outright ban. The Council believes that this will greatly assist towards adopting a permanent ban, subject to a continuous review, leading to an even broader ban, should new scientific evidence arise after its entry into force.
