considerando quanto segue:

(1) La direttiva 2000/29/CE concerne le misure di protezione contro l'introduzione negli Stati membri, da altri Stati membri o da paesi terzi, di organismi nocivi ai vegetali o ai prodotti vegetali, nonché l'istituzione di zone protette.

(1) Directive 2000/29/EC provides for certain measures against the introduction into the Member States from other Member States or third countries of organisms which are harmful to plants or plant products. It also provides for certain zones to be designed as protection zones.

(2) Per un errore materiale nell'atto di adesione del 2003, l'elenco delle contee della Svezia riconosciute come zone protette nei confronti di Leptinotarsa decemlineata Say à¨ errato e deve essere corretto.

(2) Due to a clerical error in the 2003 Act of Accession, the list of counties in Sweden recognised as a protected zone in respect of Leptinotarsa decemlineata Say was incorrect and needs to be rectified.

(3) Da informazioni fornite dalla Danimarca, risulta che questo Stato membro non deve pià¹ essere riconosciuto come zona protetta nei confronti del virus del giallume della barbabietola, essendosi questo organismo nocivo ivi radicato.

(3) From information supplied by Denmark, that Member State should no longer be recognised as a protected zone in respect of Beet necrotic yellow vein virus as it appears that that harmful organism is now established in Denmark.

(4) Da informazioni fornite dal Regno Unito, risulta che Dendroctonus micans Kugelan à¨ ormai radicato in alcune zone del paese. La zona protetta nei confronti di Dendroctonus micans Kugelan deve pertanto essere limitata all'Irlanda del Nord, all'Isola di Man e a Jersey.

(4) From information supplied by the United Kingdom, it appears that Dendroctonus micans Kugelan is now established in some parts of the United Kingdom. Accordingly, the protected zone in respect of Dendroctonus micans Kugelan should be restricted to Northern Ireland. In addition, the protected zone in respect of that organism should also be restricted to the Isle of Man and Jersey.

(5) Da informazioni fornite dall'Estonia, risulta che non si riscontra in quello Stato membro la presenza di Erwinia amylovora (Burr.) Winsl. et al. L'Estonia può pertanto essere riconosciuta come zona protetta nei confronti di questo organismo nocivo.

(5) From information supplied by Estonia, it appears that Erwinia amylovora (Burr.) Winsl. et al. is not present in that Member State. Estonia may therefore be recognised as a protected zone for that organism.

(6) Da informazioni fornite dall'Italia e da altre informazioni raccolte dall'Ufficio alimentare e veterinario della Commissione nel corso di una missione effettuata in Italia nel maggio 2004, risulta che il virus Citrus tristeza à¨ ormai radicato in quello Stato membro. L'Italia non può pertanto essere riconosciuta come zona protetta nei confronti del virus Citrus tristeza.

(6) From information supplied by Italy and from additional information collected by the Food and Veterinary Office during a mission in Italy in May 2004, it appears that Citrus tristeza virus is now established in that Member State. Italy should therefore no longer be recognised as a protected zone in respect of Citrus tristeza virus.

(7) Dalla legislazione svizzera in materia di fitoprotezione, risulta che il Canton Ticino non à¨ pià¹ riconosciuto come zona protetta nei confronti di Erwinia amylovora (Burr.) Winsl. et al. La normativa sull'importazione nella Comunità deve pertanto essere modificata, sopprimendo il trattamento speciale riservato alle piante originarie del Canton Ticino.

(7) From the Swiss legislation on plant protection, it appears that the Canton of Ticino is no longer recognised as a protected zone for Erwinia amylovora (Burr.) Winsl. et al. in Switzerland. The rules on imports to the Community should be adjusted to remove special treatment given to plants originating in Ticino.

(8) Per un errore materiale nella redazione della direttiva 2004/31/CE della Commissione [2], i requisiti particolari per l'introduzione e il movimento di vegetali di Vitis a Cipro, definiti al punto 21.1 della parte B dell'allegato IV della direttiva 2000/29/CE, sono stati erroneamente soppressi. L'allegato in questione deve pertanto essere modificato.

(8) Due to a clerical error in the preparation of Commission Directive 2004/31/EC [2], the special requirements for the introduction and movement of Vitis plants in Cyprus as laid down in point 21.1 of Part B of Annex IV to Directive 2000/29/EC were erroneously deleted. Accordingly, that Annex should be amended.

(9) Per potenziare la protezione fitosanitaria delle sementi comunitarie di Medicago sativa L. e delle sementi certificate comunitarie di Helianthus annuus L., Lycopersicon lycopersicum (L.) Karsten ex Farw. e Phaseolus L., occorre che tali sementi siano accompagnate da un passaporto fitosanitario nei movimenti non locali all'interno della Comunità .

(9) In order to enhance the phytosanitary protection of the Community seeds of Medicago sativa L. and the Community certified seeds of Helianthus annuus L., Lycopersicon lycopersicum (L.) Karsten ex Farw. and Phaseolus L., those seeds need to be accompanied by a plant passport when moving, other than locally, within the Community.

(10) Occorre pertanto modificare di conseguenza gli allegati pertinenti della direttiva 2000/29/CE.

(10) The relevant Annexes to Directive 2000/29/EC should therefore be amended accordingly.

1. Gli Stati membri adottano e pubblicano entro il 14 maggio 2005 le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva. Essi comunicano immediatamente alla Commissione il testo di tali disposizioni, nonché una tavola di corrispondenza tra queste ultime e la presente direttiva.

1. Member States shall adopt and publish, by 14 May 2005 at the latest, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

They shall apply those provisions from 15 May 2005.

Gli allegati I, II, III, IV e V della direttiva 2000/29/CE sono modificati conformemente all'allegato della presente direttiva.		Annexes I, II, III, IV and V to Directive 2000/29/EC are amended in accordance with the text in the Annex to this Directive.

1. Gli Stati membri adottano e pubblicano entro il 14 maggio 2005 le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva. Essi comunicano immediatamente alla Commissione il testo di tali disposizioni, nonché una tavola di corrispondenza tra queste ultime e la presente direttiva.		1. Member States shall adopt and publish, by 14 May 2005 at the latest, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.
Essi applicano dette disposizioni dal 15 maggio 2005.		They shall apply those provisions from 15 May 2005.
Quando gli Stati membri adottano tali disposizioni, queste contengono un riferimento alla presente direttiva o sono corredate di un siffatto riferimento all'atto della pubblicazione ufficiale. When Member States adopt those provisions, they shall contain a reference to this Directive or shall be accompanied by such a reference on the occasion of their official publication.
