vista la direttiva 91/414/CEE del Consiglio del 15 luglio 1991 relativa all'immissione in commercio dei prodotti fitosanitari [1], in particolare l'articolo 6, paragrafo 1,

Having regard to Council Directive 91/414 /EEC of 15 July 1991 concerning the placing of plant protection products on the market [1], and in particular Article 6(1) thereof,

considerando quanto segue:

(1) Il regolamento (CEE) n. 3600/92 della Commissione dell' 11 dicembre 1992, recante disposizioni di attuazione della prima fase del programma di lavoro di cui all'articolo 8, paragrafo 2, della direttiva del Consiglio 91/414/CEE relativa all'immissione in commercio dei prodotti fitosanitari [2], fissa un elenco di sostanze attive da valutare ai fini della loro eventuale iscrizione all'allegato I della direttiva 91/414/CEE. In tale elenco figurano le sostanze MCPA e MCPB.

(1) Commission Regulation (EEC) No 3600/92 of 11 December 1992 laying down the detailed rules for the implementation of the first stage of the programme of work referred to in Article 8(2) of Council Directive 91/414 /EEC concerning the placing of plant protection products on the market [2] establishes a list of active substances to be assessed, with a view to their possible inclusion in Annex I to Directive 91/414 /EEC. That list includes MCPA and MCPB.

(2) Gli effetti di tali sostanze attive sulla salute umana e sull'ambiente sono stati valutati in conformità delle prescrizioni del regolamento (CEE) n. 3600/92 per quanto concerne gli impieghi proposti dai richiedenti. Con il regolamento (CE) n. 933/94 della Commissione, del 27 aprile 1994, che determina le sostanze attive dei prodotti fitosanitari e designa lo Stato membro relatore per l'attuazione del regolamento (CEE) n. 3600/92 [3], l'Italia è stata designata Stato membro relatore. Il 5 aprile 2001 e il 19 dicembre 2001 l'Italia ha presentato alla Commissione i relativi rapporti di valutazione e le raccomandazioni in conformità dell'articolo 7, paragrafo 1, lettera c), del regolamento (CEE) n. 3600/92.

(2) For those active substances the effects on human health and the environment have been assessed in accordance with the provisions laid down in Regulation (EEC) No 3600/92 for a range of uses proposed by the notifiers. By Commission Regulation (EC) No 933/94 of 27 April 1994 laying down the active substances of plant protection products and designating the rapporteur Member State for the implementation of Regulation (EEC) No 3600/92 [3], Italy was designated as rapporteur Member State. On 5 April 2001 and 19 December 2001 Italy submitted the relevant assessment reports and recommendations to the Commission in accordance with Article 7(1)(c) of Regulation (EEC) No 3600/92.

(3) I rapporti di valutazione sono stati esaminati dagli Stati membri e dalla Commissione nell'ambito del comitato permanente per la catena alimentare e la salute degli animali. Gli esami si sono conclusi il 15 aprile 2005 sotto forma di rapporti di riesame della Commissione concernenti le sostanze MCPA e MCPB.

(3) The assessment reports have been reviewed by the Member States and the Commission within the Standing Committee on the Food Chain and Animal Health. The reviews were finalised on 15 April 2005 in the format of the Commission review reports for MCPA and MCPB.

(4) Dal riesame delle sostanze MCPA e MCPB non sono emerse questioni irrisolte da deferire al comitato scientifico sulle piante o all'Autorità europea per la sicurezza alimentare (AESA), che ha assunto il ruolo di quest'ultimo.

(4) The reviews of MCPA and MCPB did not reveal any open question to be addressed by the Scientific Committee on Plants or the European Food Safety Authority (EFSA) which has taken over the role of the latter.

(5) Sulla scorta dei vari esami effettuati è lecito supporre che i prodotti fitosanitari contenenti le sostanze MCPA o MCPB soddisfino in generale le prescrizioni di cui all'articolo 5, paragrafo 1, lettere a) e b) della direttiva 91/414/CEE, in particolare per quanto riguarda gli impieghi esaminati e descritti nei rapporti di riesame della Commissione. È quindi opportuno iscrivere le sostanze attive di cui trattasi nell'allegato I, affinché in tutti gli Stati membri le autorizzazioni per i prodotti fitosanitari contenenti tali sostanze attive possano essere concesse conformemente alle prescrizioni di tale direttiva.

(5) It has appeared from the various examinations made that plant protection products containing MCPA or MCPB may be expected to satisfy, in general, the requirements laid down in Article 5(1)(a) and (b) of Directive 91/414 /EEC, in particular with regard to the uses which were examined and detailed in the Commission review reports. It is therefore appropriate to include these active substances in Annex I, in order to ensure that in all Member States the authorisations of plant protection products containing these active substances can be granted in accordance with the provisions of that Directive.

(6) È opportuno accordare un lasso di tempo ragionevole prima che una sostanza attiva venga iscritta nell'allegato I, onde consentire agli Stati membri e alle parti interessate di prepararsi a ottemperare alle nuove prescrizioni derivanti dall'iscrizione.

(6) A reasonable period should be allowed to elapse before an active substance is included in Annex I in order to permit Member States and the interested parties to prepare themselves to meet the new requirements which will result from the inclusion.

(7) Fermi restando gli obblighi sanciti dalla direttiva 91/414 come conseguenza dell'iscrizione di una sostanza attiva nell'allegato I, agli Stati membri va concesso un periodo di sei mesi a decorrere dall'iscrizione, affinché possano rivedere le autorizzazioni esistenti per fitofarmaci contenenti le sostanze MCPA o MCPB in modo da garantire il rispetto delle prescrizioni di cui alla direttiva 91/414/CEE, segnatamente dell'articolo 13 e delle pertinenti condizioni elencate nell'allegato I. Gli Stati membri devono modificare o ritirare, se del caso, le autorizzazioni esistenti o rilasciare nuove autorizzazioni conformi alle prescrizioni della direttiva 91/414/CEE. In deroga alla scadenza indicata, occorre prevedere un periodo più lungo per la presentazione e la valutazione del fascicolo completo, previsto dall'allegato III, relativo a ciascun prodotto fitosanitario e ad ogni suo impiego previsto, conformemente ai principi uniformi di cui alla direttiva 91/414/CEE.

(7) Without prejudice to the obligations defined by Directive 91/414 as a consequence of including an active substance in Annex I, Member States should be allowed a period of six months after inclusion to review existing authorisations of plant protection products containing MCPA or MCPB to ensure that the requirements laid down by Directive 91/414 /EEC, in particular in its Article 13 and the relevant conditions set out in Annex I, are satisfied. Member States should vary, replace or withdraw, as appropriate, existing authorisations in accordance with the provisions of Directive 91/414 /EEC. By derogation from the above deadline, a longer period should be provided for the submission and assessment of the complete Annex III dossier of each plant protection product for each intended use in accordance with the uniform principles laid down in Directive 91/414 /EEC.

(8) Le esperienze acquisite con le precedenti iscrizioni all'allegato I della direttiva 91/414/CEE di sostanze attive valutate ai sensi del regolamento (CEE) n. 3600/92 hanno mostrato che possono presentarsi difficoltà di interpretazione degli obblighi di chi detiene autorizzazioni esistenti in relazione all'accesso ai dati. Per evitare ulteriori difficoltà è quindi necessario chiarire gli obblighi degli Stati membri, specialmente quello di verificare che il titolare di un'autorizzazione dimostri l'accesso a un fascicolo conforme alle prescrizioni dell'allegato II alla stessa direttiva. Tale chiarimento non impone tuttavia nessun nuovo obbligo agli Stati membri o ai detentori di autorizzazioni rispetto alle direttive finora adottate e che emendano l'allegato I.

(8) The experience gained from previous inclusions in Annex I to Directive 91/414 /EEC of active substances assessed in the framework of Regulation (EEC) No 3600/92 has shown that difficulties can arise in interpreting the duties of holders of existing authorisations in relation to access to data. In order to avoid further difficulties it therefore appears necessary to clarify the duties of the Member States, especially the duty to verify that the holder of an authorisation demonstrates access to a dossier satisfying the requirements of Annex II to that Directive. However, this clarification does not impose any new obligations on Member States or holders of authorisations compared to the directives which have been adopted until now amending Annex I.

HA ADOTTATO LA PRESENTE DIRETTIVA:

HAS ADOPTED THIS DIRECTIVE:

L'allegato I della direttiva 91/414/CEE è modificato conformemente all'allegato alla presente direttiva.

Annex I to Directive 91/414 /EEC is amended as set out in the Annex to this Directive.

Gli Stati membri adottano e pubblicano, entro e non oltre il 31 ottobre 2006, le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva. Essi comunicano immediatamente alla Commissione il testo di tali disposizioni, nonché una tavola di concordanza tra queste ultime e la presente direttiva.

Member States shall adopt and publish by 31 October 2006 at the latest the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

Gli Stati membri applicano tali disposizioni a decorrere dal 1o novembre 2006.

They shall apply those provisions from 1 November 2006.

Le disposizioni adottate dagli Stati membri conterranno un riferimento alla presente direttiva o saranno corredate di un siffatto riferimento all'atto della loro pubblicazione ufficiale. Le modalità del riferimento sono stabilite dagli Stati membri.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

1. In applicazione della direttiva 91/414/CEE gli Stati membri modificano o ritirano, se del caso, le autorizzazioni esistenti per fitofarmaci contenenti come sostanze attive MCPA o MCPB entro il 31 ottobre 2006. Entro tale data essi verificano il rispetto delle condizioni di cui all’allegato I alla suddetta direttiva riguardanti le sostanze MCPA e MCPB, ad eccezione di quelle della parte B sull’iscrizione relativa alle sostanze attive in questione; gli Stati membri verificano anche che il titolare dell'autorizzazione possegga o possa accedere ad un fascicolo conforme alle prescrizioni dell'allegato II alla direttiva di cui sopra, conformemente alle condizioni specificate all'articolo 13 della stessa.

1. Member States shall in accordance with Directive 91/414 /EEC, where necessary, amend or withdraw existing authorisations for plant protection products containing MCPA or MCPB as active substances by 31 October 2006. By that date, they shall in particular verify that the conditions in Annex I to that Directive relating to MCPA and MCPB respectively are met, with the exception of those identified in part B of the entry concerning those active substances, and that the holder of the authorisation has, or has access to, a dossier satisfying the requirements of Annex II to that Directive in accordance with the conditions of Article 13.

2. In deroga al paragrafo 1, ciascun prodotto fitosanitario autorizzato contenente MCPA o MCPB come unica sostanza attiva presente o come una di più sostanze attive iscritte entro il 30 aprile 2006 nell'allegato I della direttiva 91/414/CEE forma oggetto di riesame da parte degli Stati membri conformemente ai principi uniformi di cui all'allegato VI della direttiva 91/414/CEE, sulla base di un fascicolo conforme alle prescrizioni dell'allegato III della suddetta direttiva e tenendo conto della parte B dell'iscrizione nell'allegato I alla suddetta direttiva riguardante le sostanze MCPA e MCPB. In base a tale riesame essi stabiliscono se il prodotto è conforme o meno alle condizioni di cui all'articolo 4, paragrafo 1, lettere b), c), d) ed e) della direttiva 91/414/CEE.

2. By derogation from paragraph 1, for each authorised plant protection product containing MCPA or MCPB as either the only active substance or as one of several active substances all of which were listed in Annex I to Directive 91/414 /EEC by 30 April 2006 at the latest, Member States shall re-evaluate the product in accordance with the uniform principles provided for in Annex VI to Directive 91/414 /EEC, on the basis of a dossier satisfying the requirements of Annex III to that Directive and taking into account part B of the entry in Annex I to that Directive concerning MCPA and MCPB respectively. On the basis of that evaluation, they shall determine whether the product satisfies the conditions set out in Article 4(1)(b), (c), (d) and (e) of Directive 91/414 /EEC.

Following that determination Member States shall:

a) nel caso di prodotti contenenti MCPA o MCPB come unica sostanza attiva modificano o revocano, ove necessario, l'autorizzazione entro il 30 aprile 2010, o

(a) in the case of a product containing MCPA or MCPB as the only active substance, where necessary, amend or withdraw the authorisation by 30 April 2010 at the latest; or

b) nel caso di prodotti contenenti MCPA o MCPB come sostanze attive in combinazione con altre modificano o revocano, ove necessario, l'autorizzazione entro il 30 aprile 2010 ovvero entro il termine, qualora più esteso, fissato per la modifica o la revoca rispettivamente dalla direttiva o dalle direttive che hanno iscritto la sostanza o le sostanze nell'allegato I alla direttiva 91/414/CEE.

(b) in the case of a product containing MCPA or MCPB as one of several active substances, where necessary, amend or withdraw the authorisation by 30 April 2010 or by the date fixed for such an amendment or withdrawal in the respective Directive or Directives which added the relevant substance or substances to Annex I to Directive 91/414 /EEC, whichever is the latest.

La presente direttiva entra in vigore il 1o maggio 2006.

This Directive shall enter into force on 1 May 2006.
