vista la direttiva 91/414/CEE [5] del Consiglio, del 15 luglio 1991, relativa all'immissione in commercio dei prodotti fitosanitari, in particolare l'articolo 4, paragrafo 1, lettera f),

Having regard to Council Directive 91/414/EEC of 15 July 1991 concerning the placing of plant protection products on the market [5] and in particular Article 4(1)(f) thereof,

considerando quanto segue:

Whereas:

(1) All'allegato I della direttiva 91/414/CEE sono state iscritte le seguenti sostanze attive esistenti: glifosato con la direttiva 2001/99/CE [6] della Commissione, clorprofam con la direttiva 2004/20/CE [7] della Commissione; bromoxynil e ioxynil con la direttiva 2004/58/CE [8] della Commissione.

(1) The following existing active substances have been included in Annex I to Directive 91/414/EEC: glyphosate by Commission Directive 2001/99/EC [6], chlorpropham by Commission Directive 2004/20/EC [7] and bromoxynil, and ioxinyl by Commission Directive 2004/58/EC [8].

(2) All'allegato I della direttiva 91/414/CEE sono state iscritte le seguenti sostanze attive nuove: dimethenamid-p e flurtamone con la direttiva 2003/84/CE [9] della Commissione; propoxycarbazone e zoxamide con la direttiva 2003/119/CE [10] della Commissione; flazasulfuron e pyraclostrobin con la direttiva 2004/30/CE [11] della Commissione; quinoxifen con la direttiva 2004/60/CE [12] della Commissione; mepanipyrim con la direttiva 2004/62/CE [13] della Commissione.

(2) The following new active substances have been included in Annex I to Directive 91/414/EEC: dimethenamid-P and flurtamone by Commission Directive 2003/84/EC [9] propoxycarbazone and zoxamide by Commission Directive 2003/119/EC [10], flazasulfuron and pyraclostrobin by Commission Directive 2004/30/EC [11], quinoxyfen by Commission Directive 2004/60/EC [12] and mepanipyrim, by Commission Directive 2004/62/EC [13].

(3) L'iscrizione nell'allegato I della direttiva 91/414/CEE delle sostanze attive in questione è stata basata sulla valutazione delle informazioni fornite in merito all'utilizzazione proposta. Alcuni Stati membri hanno trasmesso informazioni relative a tale utilizzazione conformemente all'articolo 4, paragrafo 1, lettera f), della direttiva 91/414/CEE. Le informazioni disponibili sono state riesaminate e risultano sufficienti per fissare alcuni limiti massimi di residui (LMR).

(3) The inclusion in Annex I to Directive 91/414/EEC of the active substances concerned was based on the assessment of the information submitted concerning their proposed use. Information relating to that use has been submitted by certain Member States in accordance with Article 4(1)(f) of Directive 91/414/EEC. The information available has been reviewed and is sufficient to allow certain maximum residue levels (MRLs) to be fixed.

(4) I limiti massimi di residui comunitari e i valori raccomandati dal Codex alimentarius sono stabiliti e valutati in base a procedure simili. Il Codex prevede diversi limiti massimi di residui per il clorprofam e il glifosato. Nella direttiva 76/895/CEE sono già stati fissati a livello comunitario limiti massimi di residui per il clorprofam (con la direttiva 82/528/CEE del Consiglio) [14]. Inoltre, nelle direttive 86/362/CEE, 86/363/CEE e 90/642/CEE sono già stati fissati limiti massimi di residui per il glifosato (con la direttiva 1998/82/CE del Consiglio) [15]. Tali limiti sono stati presi in considerazione nel determinare i limiti massimi di residui oggetto delle modifiche di cui alla presente direttiva. Non sono stati presi in considerazione i limiti massimi di residui del Codex la cui revoca sarà raccomandata in un prossimo futuro. I limiti massimi di residui basati sui LMR del Codex sono stati valutati tenendo conto dei rischi per i consumatori. In base ai risultati della valutazione non è stato stabilito alcun rischio nel quadro dei parametri tossicologici fondati sugli studi di cui dispone la Commissione.

(4) Community MRLs and the levels recommended by the Codex Alimentarius are fixed and evaluated following similar procedures. There are a number of Codex MRLs for chlorpropham, and glyphosate. There are already Community MRLs in Directive 76/895/EEC for chlorpropham (Council Directive 82/528/EEC [14]) and in Directives 86/362/EEC, 86/363/EEC and 90/642/EEC for glyphosate (Council Directive 1998/82/EC [15]). These have been taken into consideration when setting the MRLs concerned by the adaptations made by this Directive. Codex MRLs that will be recommended for withdrawal in the near future were not taken into account. The MRLs based on Codex MRLs have been evaluated in the light of the risks for the consumers. No risk was established when using the toxicological end points based on the studies available to the Commission.

(5) I rapporti di riesame della Commissione preparati per l'iscrizione all'allegato I della direttiva 91/414/CEE delle sostanze attive in questione fissano la dose giornaliera ammissibile (DGA) e, all'occorrenza, la dose acuta di riferimento (DAR) per tali sostanze. L'esposizione dei consumatori di prodotti alimentari trattati con le sostanze attive in questione è stata esaminata e valutata conformemente alle procedure comunitarie. Si è inoltre tenuto conto degli orientamenti pubblicati dall'Organizzazione mondiale della sanità [16], nonché del parere del comitato scientifico per le piante [17] sulla metodologia applicata. Si è concluso che i limiti massimi di residui proposti non comportano il superamento di dette DGA o DAR.

(5) The Commission review reports which were prepared for the inclusion in Annex I to Directive 91/414/EEC of the active substances concerned fixed the Acceptable Daily Intake (ADI) and, if necessary, the Acute Reference Dose (ARfD) for those substances. The exposure of consumers of food products treated with the active substances concerned has been assessed in accordance with Community procedures. Account has also been taken of guidelines published by the World Health Organisation [16] and the opinion of the Scientific Committee for Plants [17] on the methodology employed. It is concluded that MRLs proposed will not lead to those ADIs or ARfD being exceeded.

(6) Per garantire un'adeguata tutela del consumatore contro l'esposizione a residui derivanti da impieghi non autorizzati di prodotti fitosanitari, occorre fissare limiti massimi di residui provvisori al limite inferiore di determinazione analitica per le corrispondenti combinazioni di prodotto/antiparassitario.

(6) In order to ensure that the consumer is adequately protected from exposure to residues resulting from unauthorised uses of plant protection products, provisional MRLs should be set for the relevant product/pesticide combinations at the lower limit of analytical determination.

(7) La fissazione a livello comunitario di tali limiti massimi provvisori non impedisce agli Stati membri di stabilire limiti massimi provvisori per le sostanze in questione conformemente all'articolo 4, paragrafo 1, lettera f), della direttiva 91/414/CEE e al suo allegato VI. Un periodo di quattro anni è considerato sufficiente per consentire ulteriori impieghi delle sostanze attive in questione. Dopodiché i limiti massimi di residui provvisori dovrebbero diventare definitivi.

(7) The setting at Community level of such provisional MRLs does not prevent the Member States from establishing provisional MRLs for the substances concerned in accordance with Article 4(1)(f) of Directive 91/414/EEC and Annex VI thereto. It is considered that a period of four years is sufficient to permit further uses of the active substance concerned. The provisional MRL should then become definitive.

(8) È pertanto necessario inserire o sostituire negli allegati delle direttive 86/362/CEE, 86/363/CEE e 90/642/CEE tutti i limiti massimi di residui derivanti dall'impiego di detti prodotti fitosanitari, in modo da consentire una sorveglianza e un controllo adeguati del divieto d'impiego e tutelare il consumatore. È inoltre opportuno modificare i limiti massimi di residui già definiti negli allegati delle suddette direttive. Qualora i limiti massimi di residui non siano ancora stati definiti, occorre fissarli per la prima volta.

(8) It is therefore necessary to add or replace all of the MRLs arising from the use of these plant protection products to the Annexes to Directives 86/362/EEC, 86/363/EEC and 90/642/EEC to allow for proper surveillance and control of the prohibition of their uses and to protect the consumer. Where MRLs have already been defined in the Annexes to those Directives it is appropriate to modify them. Where MRLs have not been defined until now, it is appropriate to set them for the first time.

(9) Il glifosato è usato in forma di etere o sale. Nel caso del sale di glifosato trimesium, il residuo di trimethylsulfonium cation è anch’esso rilevante sul piano tossicologico. È pertanto necessario fissare anche per tale catione limiti massimi di residui.

(9) Glyphosate is used as ester or salt. In case of glyphosate trimesium salt, the residue of trimethylsulfonium cation is also of toxicological relevance. It is therefore necessary to set MRLs for that cation.

(10) È pertanto opportuno sopprimere le disposizioni della direttiva 76/895/CEE che fissa limiti massimi di residui per il clorprofam.

(10) Provisions of Directive 76/895/EEC which set MRLs for chlorpropham should consequently be deleted.

(11) È pertanto opportuno modificare le direttive 76/895/CEE, 86/362/CEE, 86/363/CEE e 90/642/CEE.

(11) Directives 76/895/EEC, 86/362/EEC, 86/363/EEC and 90/642/EEC should therefore be amended accordingly.

1) nell'allegato II, parte A, sono aggiunte, conformemente all'allegato I della presente direttiva, le righe relative a: bromoxynil, clorprofam, dimethenamid-P, flazasulfuron, flurtamone, ioxinyl, mepanipyrim, propoxycarbazone, pyraclostrobin, quinoxyfen, trimethylsulfonium cation e zoxamide;

1. In Part A of Annex II, the lines for bromoxynil, chlorpropham, dimethenamid-P, flazasulfuron, flurtamone, ioxinyl, mepanipyrim, propoxycarbazone, pyraclostrobin, quinoxyfen, trimethylsulfonium cation and zoxamide as set out in Annex I to this Directive are added.

1. Gli Stati membri adottano e pubblicano le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva entro il 21 aprile 2006. Essi comunicano immediatamente alla Commissione il testo di tali disposizioni nonché una tavola di concordanza tra queste ultime e la presente direttiva.

1. Member States shall adopt and publish, by 21 April 2006 at the latest, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

Essi applicano tali disposizioni a decorrere dal 21 aprile 2007.

They shall apply those provisions from 21 April 2007.

Quando gli Stati membri adottano tali disposizioni, queste contengono un riferimento alla presente direttiva o sono corredate di un siffatto riferimento all'atto della pubblicazione ufficiale. Le modalità del riferimento sono decise dagli Stati membri.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

2. Gli Stati membri comunicano alla Commissione il testo delle principali disposizioni di diritto nazionale che essi adottano nel settore disciplinato dalla presente direttiva.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

La presente direttiva entra in vigore il ventesimo giorno successivo alla pubblicazione nella Gazzetta ufficiale dell'Unione europea.

This Directive shall enter into force on the twentieth day following its publication in the Official Journal of the European Union.
