LA COMMISSIONE DELLE COMUNITÀ EUROPEE,

Having regard to the Treaty establishing the European Community,

vista la direttiva 90/642/CEE del Consiglio, del 27 novembre 1990, che fissa le percentuali massime di residui di antiparassitari su e in alcuni prodotti di origine vegetale, compresi gli ortofrutticoli [1], in particolare l'articolo 7,

Having regard to Council Directive 90/642/EEC of 27 November 1990 on the fixing of maximum levels for pesticide residues in and on certain products of plant origin including fruit and vegetables [1], and in particular Article 7 thereof,

vista la direttiva 91/414/CEE del Consiglio, del 15 luglio 1991, relativa all’immissione in commercio dei prodotti fitosanitari [2], in particolare l’articolo 4, paragrafo 1, lettera f),

Having regard to Council Directive 91/414/EEC of 15 July 1991 concerning the placing of plant protection products on the market [2], and in particular Article 4(1)(f) thereof,

considerando quanto segue:

(1) Conformemente alle disposizioni della direttiva 91/414/CEE le autorizzazioni dei prodotti fitosanitari da utilizzare su colture specifiche sono di competenza degli Stati membri. Tali autorizzazioni devono essere basate sulla valutazione degli effetti sulla salute umana e degli animali nonché sull’ambiente. Tra gli elementi da prendere in considerazione per tali valutazioni si deve tener conto dell’esposizione degli operatori e degli astanti nonché dell’impatto sugli ambienti terrestre, acquatico e atmosferico ed inoltre dell’impatto sulle persone e sugli animali derivante dal consumo di residui presenti nelle colture trattate.

(1) In accordance with Directive 91/414/EEC, authorisations of plant protection products for use on specific crops are the responsibility of the Member States. Such authorisations have to be based on the evaluation of effects on human and animal health and influence on the environment. Elements to be taken into account in such evaluations include operator and bystander exposure and impact on the terrestrial, aquatic and aerial environments, as well as impact on humans and animals through consumption of residues on treated crops.

(2) Le quantità massime di residui corrispondono all’uso delle quantità minime di antiparassitari necessarie ad ottenere un’efficace protezione delle piante, applicate in modo tale che la quantità di residui risulti la minima possibile e accettabile dal punto di vista tossicologico, in particolare in termini di quantità stimata assunta con la dieta alimentare.

(2) Maximum residue levels (MRLs) reflect the use of minimum quantities of pesticides to achieve effective protection of plants, applied in such a manner that the amount of residue is the smallest practicable and is toxicologically acceptable, in particular in terms of estimated dietary intake.

(3) I livelli massimi di residui (LMR) di antiparassitari disciplinati dalla direttiva 90/642/CEE devono essere rivisti periodicamente e possono essere modificati per tener conto di utilizzi nuovi o modificati. Alla Commissione sono state comunicate informazioni su impieghi nuovi o modificati di fenbutatin ossido, fenexamid, ciazofamid, linuron, triadimefon/triadimenol, pimetrozina e pyraclostrobin.

(3) Maximum residue levels (MRLs) for pesticides covered by Directive 90/642/EEC are to be kept under review and may be modified to take account of new or changed uses. Information about new or changed uses has been communicated to the Commission with respect to fenbutatin oxide, fenhexamid, cyazofamid, linuron, triadimephon/triadimenol, pymetrozine, and pyraclostrobin.

(4) L'esposizione in vita dei consumatori a detti antiparassitari attraverso prodotti alimentari che possono contenere residui di tali antiparassitari è stata esaminata e valutata secondo le procedure e le prassi in uso nella Comunità europea, tenendo conto degli orientamenti pubblicati dall'Organizzazione mondiale della sanità [3]. Sulla base di tali esami e valutazioni, occorre stabilire le quantità massime di tali residui di antiparassitari per impedire il superamento delle assunzioni giornaliere accettabili.

(4) The lifetime exposure of consumers to these pesticides via food products that may contain residues of these pesticides has been assessed and evaluated in accordance with the procedures and practices used within the Community, taking account of guidelines published by the World Health Organisation [3]. Based on those assessment and evaluations, the MRLs for those pesticides should be set so as to ensure that the acceptable daily intake is not exceeded.

(5) L’esposizione acuta dei consumatori a pimetrozina, linuron, triadimenol, pyraclostrobin e fenbutatin ossido, per i quali esiste una dose acuta di riferimento (DAR), attraverso prodotti alimentari che possono contenere residui di tali antiparassitari è stata esaminata e valutata secondo le procedure e le prassi in uso nella Comunità europea, tenendo conto degli orientamenti pubblicati dall’Organizzazione mondiale della sanità. Si è tenuto conto del parere del comitato scientifico per le piante, in particolare del parere e delle raccomandazioni concernenti la tutela dei consumatori di prodotti alimentari trattati con antiparassitari [4]. Sulla base della valutazione dell’assunzione di pimetrozina, linuron, triadimenol, pyraclostrobin e fenbutatin ossido, occorre fissare le quantità massime di residui di tali antiparassitari per garantire che non sia superata la dose acuta di riferimento. Nel caso di altre sostanze, l'esame delle informazioni disponibili ha evidenziato che non è necessaria alcuna dose acuta di riferimento e che pertanto una valutazione a breve termine non ha motivo di essere.

(5) In the case of pymetrozine, linuron, triadimenol, pyraclostrobine and fenbutatin oxide for which an acute reference dose (ARfD) exists, the acute exposure of consumers via each of the food products that may contain residues of these pesticides has been assessed and evaluated in accordance with the procedures and practices currently used within the Community, taking account of guidelines published by the World Health Organisation. The opinions of the Scientific Committee on Plants, in particular advice and recommendations concerning the protection of consumers of food products treated with pesticides [4], have been taken into account. Based on the intake assessment of pymetrozine, linuron, triadimenol, pyraclostrobine and fenbutatin oxide, the MRLs for those five pesticides should be fixed so as to ensure that the ARfD will not be exceeded. In the case of the other substances, an assessment of the available information has shown that no ARfD is required and that therefore a short term assessment is not needed.

(6) Le quantità massime di residui sono fissate al limite inferiore di determinazione analitica, quando gli impieghi autorizzati di prodotti fitosanitari non producono livelli rilevabili di residui di antiparassitari in o su prodotti alimentari, quando non vi sono impieghi autorizzati, quando gli impieghi autorizzati dagli Stati membri non sono stati suffragati dai dati necessari oppure quando gli impieghi in paesi terzi che determinano la presenza di residui in o su prodotti alimentari commercializzabili sul mercato comunitario non sono stati suffragati dai dati necessari in oggetto.

(6) Where authorised uses of plant protection products do not result in detectable levels of pesticide residues in or on the food product, or where there are no authorised uses, or where uses which have been authorised by Member States have not been supported by the necessary data, or where uses in third countries resulting in residues in or on food products which may enter into circulation in the Community market have not been supported with such necessary data, MRLs should be fixed at the lower limit of analytical determination.

(7) È quindi opportuno fissare nuove quantità massime di residui per tali antiparassitari.

(7) Therefore it is appropriate to fix new MRLs for those pesticides.

(8) La fissazione o la modifica a livello comunitario di quantità massime provvisorie di residui non impedisce che gli Stati membri stabiliscano quantità massime provvisorie per fenexamid, ciazofamid, linuron, pimetrozina e pyraclostrobin conformemente all’articolo 4, paragrafo 1, lettera f), della direttiva 91/414/CEE e al suo allegato VI. Si ritiene che un periodo di quattro anni sia sufficiente per permettere altre utilizzazioni di tali sostanze. Trascorso questo periodo è opportuno che le quantità massime di residui provvisorie diventino definitive.

(8) The setting or modification at Community level of provisional MRLs does not prevent the Member States from establishing provisional MRLs for fenhexamid, cyazofamid, linuron, pymetrozine, and pyraclostrobin in accordance with Article 4(1)(f) of Directive 91/414/EEC and Annex VI thereto. It is considered that a period of four years is sufficient to permit further uses of these substances. The provisional Community MRL should then become definitive.

(9) La direttiva 90/642/CEE deve essere modificata di conseguenza.

(9) Directive 90/642/EEC should therefore be amended accordingly.

HA ADOTTATO LA PRESENTE DIRETTIVA:

HAS ADOPTED THIS DIRECTIVE:

Nell’allegato I della direttiva 90/642/CEE, nella categoria "2. Ortaggi, freschi o non cotti, congelati o secchi", "v) Ortaggi a foglia ed erbe fresche, a) Lattughe e simili", tra le voci "Scarola" e "Altri" sono inserite le voci "Foglie e steli di brassica" e "Rucola".

In Annex I to Directive 90/642/EEC in the category "2. Vegetables, fresh or uncooked, frozen or dry, (v) Leaf vegetables and fresh herbs, (a) Lettuce and similar", the entries "leaves and stems of brassica" and "ruccola" are added between the entries "Scarole" and "others".

L’allegato II, parte A, della direttiva 90/642/CEE è modificato conformemente all’allegato della presente direttiva.

Part A of Annex II to Directive 90/642/EEC is amended in accordance with the Annex to this Directive.

1. Gli Stati membri adottano e pubblicano, entro l’ 8 dicembre 2006, le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva. Essi comunicano immediatamente alla Commissione il testo di tali disposizioni nonché una tavola di concordanza tra queste ultime e la presente direttiva.

1. Member States shall adopt and publish, by 8 December 2006 at the latest, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

Gli Stati membri applicano tali disposizioni a decorrere dal 9 dicembre 2006, fatta eccezione per le disposizioni in materia di pyraclostrobin che si applicano a decorrere dal 21 aprile 2007.

They shall apply those provisions from 9 December 2006 except for pyraclostrobine where they shall apply the provisions from 21 April 2007.

Quando gli Stati membri adottano tali disposizioni, queste contengono un riferimento alla presente direttiva oppure sono corredate di tale riferimento all'atto della loro pubblicazione ufficiale. Le modalità del riferimento sono decise dagli Stati membri.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

2. Gli Stati membri comunicano alla Commissione il testo delle disposizioni essenziali di diritto interno che essi adottano nel settore disciplinato dalla presente direttiva.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

La presente direttiva entra in vigore il ventesimo giorno successivo alla pubblicazione nella Gazzetta ufficiale dell'Unione europea.

This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Union.

This Directive is addressed to the Member States.
