IL PARLAMENTO EUROPEO E IL CONSIGLIO DELL’UNIONE EUROPEA,

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

visto il trattato che istituisce la Comunità Europea, in particolare l'articolo 71, paragrafo 1,

considerando quanto segue:

(1) La prima direttiva del Consiglio, del 23 luglio 1962, relativa all'emanazione di talune norme comuni in materia di trasporti internazionali (trasporti di merci su strada per conto terzi) [3], ha subito varie e sostanziali modificazioni [4]. È opportuno, per ragioni di razionalità e di chiarezza, procedere alla sua codificazione.

(1) The First Council Directive of 23 July 1962 on the establishment of certain common rules for international transport (carriage of goods by road for hire or reward) [3] has been substantially amended several times [4]. In the interests of clarity and rationality the said Directive should be codified.

(2) Una politica comune dei trasporti comporta, tra l'altro, l'emanazione di norme comuni applicabili ai trasporti internazionali di merci su strada in partenza dal territorio di uno Stato membro o a destinazione di questo o in transito sul territorio di uno o più Stati membri. Tali norme devono essere fissate in modo da contribuire al buon funzionamento del mercato interno dei trasporti.

(2) A common transport policy involves inter alia laying down common rules for the international carriage of goods by road to or from the territory of a Member State or passing across the territory of one or more Member States. Those rules must be laid down in such a way as to contribute to the smooth operation of the internal transport market.

(3) È necessario assicurare una progressiva espansione dei trasporti internazionali di merci su strada tenendo conto dello sviluppo degli scambi e dei traffici all'interno della Comunità.

(3) It is necessary to ensure a progressive expansion of the international carriage of goods by road, bearing in mind developments in trade and movement of goods within the Community.

(4) Taluni trasporti erano esentati da qualsivoglia regime di contingentamento e di autorizzazione di trasporto. Nell'ambito dell'organizzazione del mercato istituita con il regolamento (CEE) n. 881/92 del Consiglio, del 26 marzo 1992, relativo all'accesso al mercato dei trasporti di merci su strada nella Comunità effettuati in partenza dal territorio di uno Stato membro o a destinazione di questo, o in transito sul territorio di uno o più Stati membri [5], è opportuno mantenere un regime di esenzione dalla licenza comunitaria e da qualsiasi altra autorizzazione di trasporto per alcuni di questi trasporti, dato il loro carattere particolare.

(4) A certain number of types of carriage were exempt from any quota and carriage authorisation system. Within the framework of the organisation of the market introduced by Council Regulation (EEC) No 881/92 of 26 March 1992 on access to the market in the carriage of goods by road within the Community to or from the territory of a Member State or passing across the territory of one or more Member States [5], a system of exemption from Community authorisation and from any other carriage authorisation should be maintained for some of those types of transport, because of their special nature.

(5) La presente direttiva dovrebbe far salvi gli obblighi degli Stati membri relativi ai termini di recepimento nel diritto nazionale e di applicazione delle direttive di cui all'allegato II, parte B,

(5) This Directive should be without prejudice to the obligations of the Member States relating to the time-limits for transposition into national law and application of the Directives set out in Annex II, Part B,

HANNO ADOTTATO LA PRESENTE DIRETTIVA:

HAVE ADOPTED THIS DIRECTIVE:

1. Gli Stati membri liberalizzano, alle condizioni definite nel paragrafo 2, i trasporti internazionali di merci su strada per conto terzi e per conto proprio, elencati nell'allegato I, che sono effettuati verso il loro territorio o in partenza dal medesimo o che lo attraversano in transito.

1. Under the conditions laid down in paragraph 2, Member States shall liberalise the types of international carriage of goods by road for hire or reward and on own account listed in Annex I where such carriage is performed to or from or in transit through their territory.

2. I trasporti e gli spostamenti a vuoto relativi ai trasporti elencati nell'allegato I sono esentati dalla licenza comunitaria e da qualsiasi autorizzazione di trasporto.

2. The types of carriage and unladen journeys made in conjunction with the carriage listed in Annex I shall be exempted from Community authorisation and from any carriage authorisation.

La presente direttiva non modifica le condizioni alle quali ogni Stato membro subordina l'autorizzazione dei suoi cittadini a svolgere le attività in essa contemplate.

This Directive shall not affect the conditions under which any Member State authorises its own nationals to engage in the activities mentioned in this Directive.

La prima direttiva del Consiglio, del 23 luglio 1962, relativa all'emanazione di talune norme comuni in materia di trasporti di merci su strada, è abrogata, fatti salvi gli obblighi degli Stati membri relativi ai termini di recepimento nel diritto nazionale e di applicazione delle direttive di cui all'allegato II, parte B.

The First Council Directive of 23 July 1962 on the establishment of common rules for certain types of carriage of goods by road is hereby repealed, without prejudice to the obligations of the Member States relating to the time-limits for transposition into national law and application of the Directives set out in Annex II, Part B.

I riferimenti alla direttiva abrogata si intendono fatti alla presente direttiva e vanno letti secondo la tavola di concordanza riportata di cui all'allegato III.

References made to the repealed Directive shall be construed as being made to this Directive and should be read in accordance with the correlation table in Annex III.

La presente direttiva entra in vigore il ventesimo giorno successivo alla pubblicazione nella Gazzetta ufficiale dell’Unione europea.

This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

Gli Stati membri sono destinatari della presente direttiva.

This Directive is addressed to the Member States.

Trasporti che devono essere esentati da ogni licenza comunitaria e da qualsiasi autorizzazione di trasporto

Types of carriage to be exempted from any Community authorisation and from any carriage authorisation

1. Trasporti postali effettuati nell'ambito di un regime di servizio pubblico.

1. Carriage of mail as a public service.

2. Trasporti di veicoli danneggiati o da riparare.

2. Carriage of vehicles which have suffered damage or breakdown.

3. Trasporti di merci con autoveicoli il cui peso totale a carico autorizzato, compreso quello dei rimorchi, non superi le 6 tonnellate o il cui carico utile autorizzato, compreso quello dei rimorchi, non superi le 3,5 tonnellate.

3. Carriage of goods in motor vehicles the permissible laden weight of which, including that of trailers, does not exceed six tonnes or the permissible payload of which, including that of trailers, does not exceed 3,5 tonnes.

4. Trasporti di merci con autoveicoli sempreché siano soddisfatte le condizioni seguenti:

4. Carriage of goods in motor vehicles provided the following conditions are fulfilled:

a) le merci trasportate devono essere di proprietà dell'impresa o essere state da essa vendute, acquistate, date o prese in affitto, prodotte, estratte, trasformate o riparate;

(a) the goods carried must be the property of the undertaking or must have been sold, bought, let out on hire or hired, produced, extracted, processed or repaired by the undertaking;

b) il trasporto deve servire a far affluire le merci all'impresa, o a spedirle dall'impresa stessa, oppure a spostarle all'interno dell'impresa o, per esigenze aziendali, all'esterno dell'impresa stessa;

(b) the purpose of the journey must be to carry the goods to or from the undertaking or to move them, either inside the undertaking or outside for its own requirements;

c) gli autoveicoli adibiti a tale trasporto deveono essere guidati dal personale dell'impresa;

d) i veicoli che trasportano le merci debbono essere di proprietà dell'impresa o essere stati da questa acquistati a credito o noleggiati, a condizione che in quest'ultimo caso essi soddisfino le condizioni previste dalla direttiva 2006/1/CE del Parlamento europeo e del Consiglio, del 18 gennaio 2006, relativa all'utilizzazione di veicoli noleggiati senza conducente per il trasporto di merci su strada [1].

(d) the vehicles carrying the goods must be owned by the undertaking or have been bought by it on deferred terms or hired provided that in the latter case they meet the conditions of Directive 2006/1/EC of the European Parliament and of the Council of 18 January 2006 on the use of vehicles hired without drivers for the carriage of goods by road [1].

Questa disposizione non si applica in caso di utilizzazione di un veicolo sostitutivo durante un guasto di breve durata del veicolo usato normalmente;

This provision shall not apply to the use of a replacement vehicle during a short breakdown of the vehicle normally used;

e) il trasporto deve costituire soltanto un'attività accessoria nell'ambito dell'insieme delle attività dell'impresa.

(e) carriage must be no more than ancillary to the overall activities of the undertaking.
