In view of the adoption of Regulation (EC) No 1907/2006 [3], Directive 67/548/EEC [4] should be adapted and its rules on the notification and risk assessment of chemicals deleted,

HANNO ADOTTATO LA PRESENTE DIRETTIVA:

HAVE ADOPTED THIS DIRECTIVE:

La direttiva 67/548/CEE è modificata come segue:

Directive 67/548/EEC is hereby amended as follows:

1) all'articolo 1, paragrafo 1, sono soppresse le lettere a), b) e c);

(1) in Article 1, paragraph 1, points (a), (b) and (c) shall be deleted;

2) all'articolo 2, paragrafo 1, sono soppresse le lettere c), d), f) e g);

(2) in Article 2, paragraph 1, points (c), (d), (f) and (g) shall be deleted;

3) l'articolo 3 è sostituito dal seguente:

(3) Article 3 shall be replaced by the following:

Sperimentazione e valutazione delle proprietà delle sostanze

Testing and assessment of the properties of substances

I test relativi alle sostanze realizzati nell'ambito della presente direttiva sono effettuati conformemente alle prescrizioni dell'articolo 13 del regolamento (CE) n. 1907/2006 del Parlamento europeo e del Consiglio, del 18 dicembre 2006, concernente la registrazione, la valutazione, l'autorizzazione e la restrizione delle sostanze chimiche (REACH) e che istituisce un'agenzia europea per le sostanze chimiche [*****].

Tests on substances carried out within the framework of this Directive shall be conducted according to the requirements of Article 13 of Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) and establishing a European Chemicals Agency [*****].

4) l'articolo 5 è modificato come segue:

a) al paragrafo 1, il primo comma è sostituito dal seguente:

(a) in paragraph 1, the first subparagraph shall be replaced by the following:

"Gli Stati membri adottano tutti i provvedimenti necessari ad assicurare che le sostanze, in quanto tali o sotto forma di preparati, possano essere immesse sul mercato soltanto se sono state imballate ed etichettate a norma degli articoli da 22 a 25 della presente direttiva e dei criteri di cui all'allegato VI della presente direttiva e, per le sostanze registrate, in base alle informazioni ottenute mediante l'applicazione degli articoli 12 e 13 del regolamento (CE) n. 1907/2006, salvo se trattasi di preparati per i quali altre direttive prevedono disposizioni specifiche.";

"Member States shall take all the necessary measures to ensure that substances cannot be placed on the market on their own or in preparations unless they have been packaged and labelled in accordance with Articles 22 to 25 of this Directive and with the criteria in Annex VI of this Directive, and, for registered substances, in accordance with the information obtained through the application of Articles 12 and 13 of Regulation (EC) No 1907/2006, save in the case of preparations where provisions exist in other Directives.";

b) il paragrafo 2 è sostituito dal seguente:

(b) paragraph 2 shall be replaced by the following:

"2. Le misure di cui al paragrafo 1, primo comma, si applicano fino al momento dell'inserimento della sostanza nell'allegato I o sino al momento in cui è adottata, secondo la procedura di cui all'articolo 29, la decisione di non inserirla nello stesso allegato.";

"2. The measures referred to in the first subparagraph of paragraph 1 shall apply until the substance is listed in Annex I or until a decision not to list it has been taken in accordance with the procedure laid down in Article 29.";

5) gli articoli da 7 a 15 sono soppressi;

I riferimenti agli allegati VIIA, VIIB, VIIC, VIID e VIII della presente direttiva sono da intendersi come riferimenti ai corrispondenti allegati VI, VII, VIII, IX, X e XI del regolamento (CE) n. 1907/2006.";

References to Annexes VII A, VII B, VII C, VII D and VIII of this Directive shall be construed as references to the corresponding Annexes VI, VII, VIII, IX, X and XI of Regulation (EC) No 1907/2006.";

10) l'allegato V è soppresso;

a) ai punti 1.6.2, 1.7.2, 1.7.3, 2.1, 2.2.1, 2.2.2, 2.2.2.1, 2.2.3, 2.2.4, 2.2.5, 3.1.1, 3.1.5.1, 3.1.5.2, 3.2.1, 3.2.2, 3.2.3, 3.2.5, 3.2.6.1, 3.2.6.2, 3.2.7.2, 4.2.3.3, 5.1.3, 9.1.1.1, 9.1.1.2, 9.3 e 9.5 del presente allegato, le parole "allegato V "e "allegato V della presente direttiva "sono sostituite dalle parole "regolamento della Commissione sui metodi di prova di cui all'articolo 13, paragrafo 2, del regolamento (CE) n. 1907/2006";

(a) in sections 1.6.2, 1.7.2, 1.7.3, 2.1, 2.2.1, 2.2.2, 2.2.2.1, 2.2.3, 2.2.4, 2.2.5, 3.1.1, 3.1.5.1, 3.1.5.2, 3.2.1, 3.2.2, 3.2.3, 3.2.5, 3.2.6.1, 3.2.6.2, 3.2.7.2, 4.2.3.3, 5.1.3, 9.1.1.1, 9.1.1.2, 9.3 and 9.5 of this Annex, the words "Annex V "and "Annex V to this Directive", shall be replaced by the words "the Commission Regulation on test methods as specified in Article 13(2) of Regulation (EC) No 1907/2006";

b) il punto 1.6.1, lettera a), è sostituto dal seguente:

"(a) as regards substances for which the information specified in Annexes VI, VII and VIII of Regulation (EC) No 1907/2006 is required, most of the necessary data for classification and labelling appear in the base set. This classification and labelling must be reviewed, if necessary, when further information is available (Annexes IX and X of Regulation (EC) No 1907/2006)";

c) al punto 5.1, il secondo comma è sostituito dal seguente:

"I criteri descritti in appresso derivano direttamente dai metodi di prova stabiliti nel regolamento della Commissione sui metodi di prova di cui all'articolo 13, paragrafo 2, del regolamento (CE) n. 1907/2006, per quanto ivi citati. I metodi di prova richiesti per il "fascicolo di base "di cui agli allegati VII e VIII del regolamento (CE) n. 1907/2006 sono limitati, pertanto le informazioni che forniscono possono risultare insufficienti per una classificazione adeguata, per la quale sarebbe invece necessario disporre di ulteriori dati ottenuti dagli allegati IX o X del regolamento (CE) n. 1907/2006 o da altri studi equivalenti. Inoltre, le sostanze classificate possono essere oggetto di revisione alla luce di nuovi dati.";

"The criteria set out below follow directly from the test methods set out in the Commission Regulation on test methods as specified in Article 13(2) of Regulation (EC) No 1907/2006 in so far as they are mentioned. The test methods required for the base set referred to in Annexes VII and VIII of Regulation (EC) No 1907/2006 are limited and the information derived from them may be insufficient for an appropriate classification. Classification may require additional data derived from Annexes IX or X of Regulation (EC) No 1907/2006 or other equivalent studies. Furthermore, classified substances may be subject to review in the light of other new data.";

d) al punto 5.2.1.2, secondo comma, la seconda frase è sostituita dalla seguente:

(d) in section 5.2.1.2, second paragraph, the second sentence shall be replaced by the following:

"Tali ulteriori prove scientifiche dovrebbero normalmente basarsi sugli studi di cui all'allegato IX del regolamento (CE) n. 1907/2006, o su studi di equivalente valore e possono comprendere tra l'altro:";

12) gli allegati VIIA, VIIB, VIIC, VIID e VIII sono soppressi.

1. Gli Stati membri mettono in vigore le disposizioni legislative, regolamentari ed amministrative necessarie per conformarsi alla presente direttiva a decorrere dal 1o giugno 2008. Essi ne informano immediatamente la Commissione.

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive with effect from 1 June 2008. They shall forthwith inform the Commission thereof.

Quando gli Stati membri adottano tali disposizioni, queste contengono un riferimento alla presente direttiva o sono corredate di un siffatto riferimento all'atto della pubblicazione ufficiale. Le modalità di tale riferimento sono decise dagli Stati membri.

When Member States adopt these measures, they shall contain a reference to this Directive or shall be accompanied by such reference on the occasion of their official publication. The methods of making such reference shall be laid down by the Member States.

2. Gli Stati membri comunicano alla Commissione il testo delle disposizioni di diritto interno che essi adottano nel settore disciplinato dalla presente direttiva.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

La presente direttiva entra in vigore il ventesimo giorno successivo alla pubblicazione nella Gazzetta ufficiale dell'Unione europea.

This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Union.

Essa si applica a decorrere dal 1o giugno 2008.

It shall apply from 1 June 2008.

Fatto salvo il secondo comma del presente articolo, l'articolo 1, punto 6, si applica a decorrere dal 1o agosto 2008.

Notwithstanding the second paragraph of this Article, Article 1 point 6 shall apply from 1 August 2008.

Gli Stati membri sono destinatari della presente direttiva.

This Directive is addressed to the Member States.
