Whereas

(1) Le foreste sono fonte di numerosi benefici ambientali, economici e sociali, tra cui la produzione di legno e di prodotti forestali non legnosi e l'offerta di servizi ambientali.

(1) Forests provide a broad variety of environmental, economic and social benefits including timber and non-timber forest products and environmental services.

(2) Dato l'aumento della domanda mondiale di legno e prodotti da esso derivati e le lacune istituzionali e di gestione nel settore forestale in un certo numero di paesi produttori di legname, il disboscamento illegale e il connesso commercio di legname ottenuto illegalmente sono divenuti problemi sempre più preoccupanti.

(2) Due to the growing demand for timber and timber products worldwide, in combination with the institutional and governance deficiencies that are present in the forest sector in a number of timber-producing countries, illegal logging and the associated trade have become matters of ever greater concern.

(3) Il disboscamento illegale è un problema diffuso che suscita notevoli preoccupazioni a livello internazionale. Esso rappresenta una seria minaccia per le foreste in quanto contribuisce al processo di deforestazione, responsabile di circa il 20% delle emissioni di CO2, minaccia la biodiversità e compromette la gestione e lo sviluppo sostenibili delle foreste, compresa la redditività commerciale per gli operatori che agiscono conformemente alla legislazione applicabile. Esso presenta inoltre anche implicazioni di tipo sociale, politico ed economico.

(3) Illegal logging is a pervasive problem of major international concern. It poses a significant threat to forests as it contributes to the process of deforestation, which is responsible for about 20 % of CO2 emissions, threatens biodiversity, and undermines sustainable forest management and development including the commercial viability of operators acting in accordance with applicable legislation. In addition, it also has social, political and economic implications.

(4) La comunicazione della Commissione al Parlamento europeo e al Consiglio, del 21 maggio 2003, intitolata "L'applicazione delle normative, la governance e il commercio nel settore forestale (FLEGT) - Proposta di un piano d'azione dell'Unione europea" ha proposto un pacchetto di misure per sostenere l'impegno internazionale per affrontare il problema del disboscamento illegale e del relativo commercio di legname.

(4) The Communication of the Commission to the European Parliament and to the Council of 21 May 2003 entitled "Forest Law Enforcement, Governance and Trade (FLEGT): Proposal for an EU Action Plan" proposed a package of measures to support international efforts to tackle the problem of illegal logging and associated trade.

(5) Il Parlamento europeo e il Consiglio hanno accolto con favore tale comunicazione e hanno riconosciuto la necessità che l'Unione contribuisca agli interventi in atto a livello mondiale per contrastare il fenomeno del disboscamento illegale.

(5) The European Parliament and the Council welcomed that Communication and recognised the need for the Union to contribute to global efforts to address the problem of illegal logging.

(6) In linea con l'obiettivo della comunicazione, vale a dire assicurare che solo il legno e prodotti da esso derivati ottenuti in conformità della legislazione nazionale del paese produttore possano entrare nell'Unione, quest'ultima ha negoziato accordi volontari di partenariato (VPA) con paesi produttori di legname (paesi partner), che hanno istituito un obbligo giuridicamente vincolante per le parti di attuare un regime di licenze e di regolamentare il commercio del legno e prodotti da esso derivati individuati in detti VPA.

(6) In accordance with the aim of that Communication, namely to ensure that only timber products which have been produced in accordance with the national legislation of the producing country enter the Union, the Union has been negotiating Voluntary Partnership Agreements (VPAs) with timber producing countries (partner countries), which create a legally binding obligation for the parties to implement a licensing scheme and to regulate trade in timber and timber products identified in those VPAs.

(7) Data la notevole portata e l'urgenza del problema, è necessario sostenere attivamente le iniziative internazionali per combattere il disboscamento illegale e il relativo commercio di legname, integrare e rafforzare le iniziative VPA e migliorare le sinergie tra le politiche mirate alla conservazione delle foreste e al raggiungimento di un livello elevato di protezione dell'ambiente, contrastando i cambiamenti climatici e la perdita di biodiversità.

(7) Given the major scale and urgency of the problem, it is necessary to actively support the fight against illegal logging and related trade, to complement and strengthen the VPA initiative and to improve synergies between policies aimed at the conservation of forests and the achievement of a high level of environmental protection, including combating climate change and biodiversity loss.

(8) È opportuno riconoscere gli sforzi compiuti dai paesi che hanno concluso VPA FLEGT con l'Unione e i principi sanciti da tali accordi, in particolare per quanto riguarda la definizione di legname di provenienza legale. È opportuno inoltre tenere in considerazione che, nel quadro del regime di licenze FLEGT, solo il legno ottenuto conformemente alla pertinente legislazione nazionale e i prodotti da esso derivati sono esportati verso l'Unione. I prodotti del legno elencati negli allegati II e III del regolamento (CE) n. 2173/2005 del Consiglio, del 20 dicembre 2005, relativo all'istituzione di un sistema di licenze FLEGT per le importazioni di legname nella Comunità europea [4], originari dei paesi partner di cui all'allegato I di tale regolamento, dovrebbero pertanto essere considerati come ottenuti legalmente, purché conformi a tale regolamento e alle eventuali disposizioni di esecuzione.

(8) The efforts made by countries which have concluded FLEGT VPAs with the Union and the principles incorporated in them, in particular with regard to the definition of legally produced timber, should be recognised. It should be also taken into account that under the FLEGT licensing scheme only timber harvested in accordance with the relevant national legislation and timber products derived from such timber are exported into the Union. Therefore, timber embedded in timber products listed in Annexes II and III to Council Regulation (EC) No 2173/2005 of 20 December 2005 on the establishment of a FLEGT licensing scheme for imports of timber into the European Community [4], originating in partner countries listed in Annex I to Council Regulation (EC) No 2173/2005, should be considered to have been legally harvested provided those timber products comply with that Regulation and any implementing provisions.

(9) È opportuno inoltre tenere conto del fatto che la convenzione sul commercio internazionale delle specie di flora e di fauna selvatiche minacciate di estinzione (CITES) richiede alle parti contraenti di rilasciare un permesso di esportazione CITES solo quando una delle specie presenti nell'elenco CITES è stata ottenuta conformemente, tra l'altro, alla legislazione nazionale del paese di esportazione. Pertanto, è opportuno che il legname delle specie di cui agli allegati A, B o C del regolamento (CE) n. 338/97 del Consiglio, del 9 dicembre 1996, relativo alla protezione di specie della flora e della fauna selvatiche mediante il controllo del loro commercio [5], sia considerato come ottenuto legalmente se conforme a tale regolamento e alle eventuali disposizioni di esecuzione.

(9) Account should also be taken of the fact that the Convention on International Trade of Endangered Species of Fauna and Flora (CITES) places a requirement on parties to the Convention only to grant a CITES permit for export when a CITES-listed species has been harvested, inter alia, in compliance with national legislation in the exporting country. Therefore timber of species listed in Annexes A, B or C to Council Regulation (EC) No 338/97 of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein [5] should be considered to have been legally harvested provided it complies with that Regulation and any implementing provisions.

(10) Tenendo conto della complessità del fenomeno del disboscamento illegale per quanto riguarda i fattori soggiacenti e le conseguenze, è opportuno intervenire sul comportamento degli operatori e ridurre i fattori che incentivano comportamenti illegali.

(10) Taking into account the complexity of illegal logging as regards the underlying factors and the impacts, the incentives for illegal behaviour should be reduced by targeting the behaviour of operators.

(11) In assenza di una definizione accettata a livello internazionale, per definire il concetto di disboscamento illegale è opportuno fare riferimento alla legislazione del paese di produzione.

(11) In the absence of an internationally agreed definition, the legislation of the country where the timber was harvested should be the basis for defining what constitutes illegal logging.

(12) Molti prodotti derivati dal legno sono soggetti a numerosi processi prima e dopo la loro prima immissione sul mercato. Per evitare di imporre oneri amministrativi non necessari, è opportuno assoggettare alle disposizioni del presente regolamento solo gli operatori che commercializzano per la prima volta legno e prodotti da esso derivati sul mercato interno e non tutti gli operatori attivi nella catena di distribuzione.

(12) Many timber products undergo numerous processes before and after they are placed on the market for the first time. In order to avoid imposing any unnecessary administrative burden, only those operators that place timber and timber products on the internal market for the first time, rather than all operators involved in the distribution chain, should be subject to the requirements laid down in this Regulation.

(13) Tenendo presente che l'obbligo di fornire informazioni sull'origine del legno nei prodotti realizzati con legno riciclato costituirebbe un onere sproporzionato per gli operatori, detti prodotti dovrebbero essere esclusi dall'ambito d'applicazione del presente regolamento.

(13) Bearing in mind that it would place a disproportionate burden on operators if they were required to provide information on the origin of timber in products made of recycled timber, such products should be excluded from the scope of this Regulation.

(14) È opportuno che gli operatori che commercializzano per la prima volta legno e prodotti da esso derivati sul mercato interno esercitino la dovuta diligenza nell'ambito di un sistema di misure e procedure (il sistema di dovuta diligenza) che consenta loro di minimizzare il rischio di commercializzare sul mercato interno legno e prodotti da esso derivati di provenienza illegale.

(14) Operators placing timber and timber products for the first time on the internal market should exercise due diligence through a system of measures and procedures (due diligence system) to minimise the risk of placing illegally harvested timber and timber products derived from such timber on the internal market.

(15) Il sistema della dovuta diligenza comprende tre elementi inerenti alla gestione del rischio: accesso alle informazioni, valutazione del rischio e attenuazione del rischio individuato. È opportuno che il sistema di dovuta diligenza permetta di accedere alle informazioni circa le fonti e i fornitori di legno e prodotti da esso derivati commercializzati sul mercato interno per la prima volta, comprese le informazioni pertinenti, per esempio riguardo alla conformità con la legislazione applicabile. In base a tali informazioni gli operatori dovrebbero effettuare una valutazione del rischio. Individuato un rischio, gli operatori dovrebbero attenuarlo in misura proporzionale al rischio individuato, al fine di evitare che il legno e i prodotti da esso derivati di provenienza illegale siano immessi sul mercato.

(15) The due diligence system includes three elements inherent to risk management: access to information, risk assessment and mitigation of the risk identified. The due diligence system should provide access to information about the sources and suppliers of the timber and timber products being placed on the internal market for the first time, including relevant information such as compliance with the applicable legislation. On the basis of this information, operators should carry out a risk assessment. Where a risk is identified, operators should mitigate such risk in a manner proportionate to the risk identified, with a view to preventing illegally harvested timber and timber products derived from such timber from being placed on the market.

(16) Per evitare indebiti oneri amministrativi, gli operatori che stanno già usando sistemi o procedure che rispettano le prescrizioni del presente regolamento non dovrebbero essere obbligati a mettere a punto nuovi sistemi.

(16) In order to avoid any undue administrative burden, operators already using systems or procedures which comply with the requirements of this Regulation should not be required to set up new systems.

(17) Al fine di riconoscere le buone pratiche nel settore forestale, nella procedura di valutazione dei rischi possono essere usati la certificazione o altri schemi verificati da parti terze che includono la verifica della conformità con la legislazione applicabile.

(17) In order to recognise good practice in the forestry sector, certification or other third party verified schemes that include verification of compliance with applicable legislation may be used in the risk assessment procedure.

(18) La filiera del legno riveste notevole importanza per l'economia dell'Unione. Le associazioni degli operatori sono attori importanti nella filiera perché ne rappresentano gli interessi su larga scala e interagiscono con tutta una serie di soggetti interessati. Tali associazioni hanno inoltre le competenze e la capacità di analizzare la legislazione pertinente e di aiutare i loro membri a conformarvisi, ma non dovrebbero fare uso di queste competenze per acquisire una posizione dominante sul mercato. Per facilitare l'attuazione del presente regolamento e contribuire allo sviluppo di buone pratiche è opportuno riconoscere gli organismi che hanno elaborato un sistema di dovuta diligenza che sia conforme alle prescrizioni del presente regolamento. Dovrebbe essere reso pubblico un elenco degli organismi riconosciuti in modo da permettere che gli operatori ne facciano uso.

(18) The timber sector is of major importance for the economy of the Union. Organisations of operators are important actors in the sector as they represent the interests of the latter on a large scale and interact with a diverse range of stakeholders. Those organisations also have the expertise and capacity to analyse relevant legislation and facilitate the compliance of their members, but should not use this competence to dominate the market. In order to facilitate the implementation of this Regulation and to contribute to the development of good practices it is appropriate to recognise organisations which have developed due diligence systems meeting the requirements of this Regulation. A list of such recognised organisations should be made public in order to enable operators' use of such recognised monitoring organisations.

(19) È opportuno che le autorità competenti verifichino il rispetto effettivo degli obblighi di cui al presente regolamento e che, se del caso, effettuino al tal fine controlli ufficiali, compresi eventuali controlli nei locali dell'operatore, e che siano in grado di obbligare gli operatori a intervenire per porre rimedio alla situazione laddove necessario.

(19) Competent authorities should monitor that operators effectively fulfil the obligations laid down in this Regulation. For that purpose the competent authorities should carry out official checks, as appropriate, which may include checks on the premises of the operator, and should be able to require operators to take remedial actions where necessary.

(20) È opportuno che le autorità competenti tengano un registro dei controlli e che le informazioni pertinenti siano rese accessibili a qualsiasi richiedente, conformemente alla direttiva 2003/4/CE del Parlamento europeo e del Consiglio, del 28 gennaio 2003, sull'accesso del pubblico all'informazione ambientale [6].

(20) Competent authorities should keep records of the checks and the relevant information should be made available to any applicant in accordance with Directive 2003/4/EC of the European Parliament and of the Council of 28 January 2003 on public access to environmental information [6].

(21) Tenendo conto della dimensione internazionale del disboscamento illegale e del connesso commercio di legname, è opportuno che le autorità competenti collaborino tra di loro e con le autorità amministrative di paesi terzi e con la Commissione.

(21) Taking into account the international character of illegal logging and related trade, competent authorities should cooperate with each other and with the administrative authorities of third countries and the Commission.

(22) È opportuno che gli Stati membri garantiscano che le violazioni del presente regolamento siano sanzionate in modo effettivo, proporzionato e dissuasivo.

(22) Member States should ensure that infringements of this Regulation are sanctioned by effective, proportionate and dissuasive penalties.

(23) La Commissione dovrebbe avere il potere di adottare atti delegati ai sensi dell'articolo 290 del trattato sul funzionamento dell'Unione europea (TFUE) in relazione alle procedure per il riconoscimento e la revoca del riconoscimento degli organismi di controllo, con riferimento ad ulteriori criteri di valutazione del rischio eventualmente necessari a integrazione di quelli già previsti dal presente regolamento e con riferimento all'elenco del legno e dei prodotti da esso derivati cui si applica il presente regolamento. È particolarmente importante che la Commissione consulti esperti nella fase preparatoria conformemente all'impegno da essa assunto nella comunicazione del 9 dicembre 2009 sull'attuazione dell'articolo 290 del TFUE.

(23) The Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Union (TFEU) concerning the procedures for the recognition and withdrawal of recognition of monitoring organisations, concerning further relevant risk assessment criteria that may be necessary to supplement those already provided for in this Regulation and concerning the list of timber and timber products to which this Regulation applies. It is of particular importance that the Commission consult experts in the preparatory phase in accordance with the commitment of the Commission undertaken in the Communication of 9 December 2009 on the implementation of Article 290 of the TFEU.

(24) Le misure necessarie per l'esecuzione del presente regolamento dovrebbero essere adottate secondo la decisione 1999/468/CE del Consiglio, del 28 giugno 1999, recante modalità per l'esercizio delle competenze di esecuzione conferite alla Commissione [7].

(24) The measures necessary for the implementation of this Regulation should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission [7].

(25) Agli operatori e alle autorità competenti dovrebbe essere assegnato un ragionevole periodo di tempo per prepararsi al rispetto delle disposizioni del presente regolamento.

(25) Operators and competent authorities should be given a reasonable period in order to prepare themselves to meet the requirements of this Regulation.

(26) Poiché l'obiettivo del presente regolamento, vale a dire combattere il disboscamento illegale e il commercio collegato a tale attività, non può essere realizzato dai singoli Stati membri e può invece, in ragione della sua portata, essere realizzato meglio a livello dell'Unione, questa può intervenire in base al principio di sussidiarietà sancito dall'articolo 5 del trattato sull'Unione europea. Il presente regolamento si limita a quanto è necessario per conseguire tali obiettivi in ottemperanza al principio di proporzionalità enunciato nello stesso articolo,

(26) Since the objective of this Regulation, namely the fight against illegal logging and related trade, cannot be achieved by the Member States individually and can therefore, by reason of its scale, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out on Article 5 of the Treaty on European Union. In accordance with the principle of proportionality, as set out in that Article, this Regulation does not go beyond what is necessary in order to achieve that objective,

Il presente regolamento stabilisce gli obblighi degli operatori che commercializzano per la prima volta legno e prodotti da esso derivati sul mercato interno, per minimizzare il rischio di commercializzare legno e prodotti da esso derivati di provenienza illegale.

This Regulation lays down the obligations of operators who place timber and timber products on the internal market for the first time, to minimise the risk of placing illegally harvested timber or timber products derived from such timber on the market.

Definizioni

Definitions

Ai fini del presente regolamento si intende per:

For the purposes of this Regulation, the following definitions shall apply:

a) "legno e prodotti da esso derivati" : il legno e i prodotti da esso derivati riportati nell'allegato, con l'eccezione dei prodotti derivati da legno o da prodotti da esso derivati che sono già stati commercializzati nonché prodotti derivati dal legno o componenti di tali prodotti ottenuti dal legno ovvero prodotti derivati dal legno che hanno completato il loro ciclo di vita e sarebbero altrimenti smaltiti come rifiuti;

(a) "timber and timber products" means the timber and timber products set out in the Annex, with the exception of timber products derived from timber or from timber products which have already been placed on the market as well as timber products or components of such products manufactured from timber or timber products that have completed their life cycle and would otherwise be disposed of as waste;

b) "commercializzazione" : la prima immissione sul mercato interno, attraverso qualsiasi mezzo, qualunque sia la tecnica di vendita, di legno e prodotti da esso derivati destinati alla distribuzione o all'uso nell'ambito di un'attività commerciale a titolo oneroso o gratuito. È altresì compresa la vendita mediante tecniche di comunicazione a distanza ai sensi della direttiva 97/7/CE del Parlamento europeo e del Consiglio, del 20 maggio 1997, riguardante la protezione dei consumatori in materia di contratti a distanza [8];

(b) "placing on the market" means the supply by any means, irrespective of the selling technique used, of timber or timber products, for the first time on the internal market for distribution or use in the course of a commercial activity, whether in return for payment or free of charge. It also includes the supply by means of distance communication as defined in Directive 97/7/ EC of the European Parliament and of the Council of 20 May 1997 on the protection of consumers in respect of distance contracts [8];

c) "operatore" : una persona fisica o giuridica che commercializza legno o prodotti da esso derivati;

(c) "operator" means any natural or legal person that places timber or timber products on the market;

d) "paese di produzione" : il paese o il territorio in cui è stato prodotto il legname o il legno contenuto in prodotti da esso derivati;

(d) "country of harvest" means the country or territory where the timber or the timber embedded in the timber products was harvested;

e) "di provenienza legale" : ottenuto conformemente alla legislazione applicabile nel paese di produzione;

(e) "legally harvested" means harvested in accordance with the applicable legislation in the country of harvest;

f) "di provenienza illegale" : ottenuto violando la legislazione applicabile nel paese di produzione;

(f) "illegally harvested" means harvested in contravention of the applicable legislation in the country of harvest;

g) "legislazione applicabile" :

(g) "applicable legislation" means the legislation in force in the country of harvest covering the following matters:

la legislazione in vigore nel paese di produzione per quanto concerne le seguenti materie:

- rights to harvest timber within gazetted boundaries;

- i diritti di prelievo di legname entro i confini ufficialmente pubblicati;

- payments for harvest rights and timber including duties related to timber harvesting;

- i pagamenti relativi ai diritti di prelievo di legname, comprese le imposte sul prelievo di legname;

- timber harvesting, including directly related environmental and forest legislation;

- il prelievo del legname, compresa la normativa in materia ambientale e forestale di immediata pertinenza;

- third parties' legal rights concerning use and tenure that is affected by timber harvesting; and

- i diritti legittimi di terzi relativi all'uso e alla proprietà che sono lesi dalla produzione di legname; e

- trade and customs legislation, in so far as the forest sector is concerned.

Article 3

Status of timber and timber products covered by FLEGT and CITES

Regime applicabile al legno e ai prodotti da esso derivati contemplati da FLEGT e CITES

Timber embedded in timber products listed in Annexes II and III to Regulation (EC) No 2173/2005 which originate in partner countries listed in Annex I of Regulation (EC) No 2173/2005 and which comply with that Regulation and its implementing provisions shall be considered to have been legally harvested for the purposes of this Regulation.

Il legname utilizzato nei prodotti derivati dal legno elencati negli allegati II e III del regolamento (CE) n. 2173/2005 che hanno origine nei paesi partner di cui all'allegato I del regolamento (CE) n. 2173/2005 e che sono conformi al predetto regolamento e alle sue disposizioni di esecuzione, si considerano ottenuti legalmente ai fini del presente regolamento.

Timber of species listed in Annexes A, B or C to Regulation (EC) No 338/97 and which complies with that Regulation and its implementing provisions shall be considered to have been legally harvested for the purposes of this Regulation.

Il legname ottenuto dalle specie elencate negli allegati A, B o C del regolamento (CE) n. 338/97 e conforme a tale regolamento e alle sue disposizioni di esecuzione, si considera ottenuto legalmente ai fini del presente regolamento.

Article 4

Obligations of operators

Obblighi degli operatori

1. Operators shall exercise due diligence to minimise the risk of placing illegally harvested timber or timber products derived from such timber on the market. To that end, they shall use a framework of procedures and measures, hereinafter referred to as a "due diligence system", as set out in Article 5.

1. Gli operatori esercitano la dovuta diligenza per minimizzare il rischio di commercializzare legname illegalmente ottenuto o prodotti da esso derivati. A tal fine utilizzano un insieme di procedure e misure, "sistema di dovuta diligenza", di cui all'articolo 5.

2. Each operator shall maintain and regularly evaluate the due diligence system which it uses, except where the operator makes use of a due diligence system established by a monitoring organisation referred to in Article 7.

2. Ciascun operatore mantiene e valuta periodicamente il sistema di dovuta diligenza che utilizza, salvo il caso in cui ricorra ad un sistema di dovuta diligenza messo a punto da un organismo di controllo di cui all'articolo 7.

1. The due diligence system referred to in Article 4(1) shall contain the following elements:

- description, including the full scientific name or common name of tree species, trade name and type of product;

- country of harvest, and where applicable sub-national region where the timber was harvested;

- name and address of the supplier to the operator;

- documents or other information indicating compliance of those timber and timber products with the applicable legislation;

(b) risk assessment procedures enabling the operator to analyse and evaluate the risk of illegally harvested timber or timber products derived from such timber being placed on the market.

Such procedures shall take into account the information set out in point (a) as well as relevant risk assessment criteria, including:

- assurance of compliance with applicable legislation, which may include certification or other third-party-verified schemes which cover compliance with applicable legislation;

- prevalence of illegal harvesting of specific tree species;

(c) Except where the risk identified in course of the risk assessment procedures referred to in point (b) is negligible, risk mitigation procedures which consist of a set of measures and procedures that are adequate and proportionate to minimise effectively that risk and which may include requiring additional information or documents and/or requiring third party verification.

Detailed rules necessary to ensure the uniform implementation of paragraph 1, except as regards further relevant risk assessment criteria referred to in the second paragraph of point (b) of paragraph 1 of this Article, shall be adopted in accordance with the regulatory procedure referred to in Article 16(2). In order to take into account market developments and the experience gained in the implementation of this Regulation, in particular as identified through the reporting referred to in Article 18(3), the Commission may adopt delegated acts in accordance with Article 290 of the TFEU as regards further relevant risk assessment criteria that may be necessary to supplement those referred to in the second paragraph of point (b) of paragraph 1 of this Article. When adopting such delegated acts, the Commission shall act in accordance with the relevant provisions of this Regulation.

Competent authorities

1. Each Member State shall designate one or more competent authorities responsible for the application of this Regulation.

Monitoring organisations

1. A monitoring organisation shall exercise the following functions:

(a) maintain and regularly evaluate a due diligence system in accordance with Article 5 and grant operators the right to use it;

(b) verify the proper use of its due diligence system by such operators;

(c) take appropriate action in the event of failure by an operator to properly use its due diligence system, including notification of competent authorities in the event of serious or repeated failure by the operator.

2. An organisation may apply for recognition as a monitoring organisation, if it complies with the following requirements:

(a) it has legal personality and is legally established within the Union;

3. An applicant that fulfils the requirements set out in paragraph 2 shall be recognised as a monitoring organisation, in one of the following ways:

4. The competent authorities shall carry out checks at regular intervals to verify that the monitoring organisations operating within the competent authorities' jurisdiction continue to fulfil the functions laid down in paragraph 1 and comply with the requirements laid down in paragraph 2.

5. If a competent authority determines that a monitoring organisation that has been recognised by the Commission either no longer fulfils the functions laid down in paragraph 1 or no longer complies with the requirements laid down in paragraph 2, it shall without delay inform the Commission.

The competent authorities or the Commission may withdraw a recognition when the competent authority or the Commission has determined that a monitoring organisation no longer fulfils the functions laid down in paragraph 1 or the requirements laid down in paragraph 2. The competent authority or the Commission may only withdraw a recognition that it has itself issued. Before withdrawal of a recognition, the Commission shall inform the Member States concerned. Member States shall inform the Commission of the withdrawal of a recognition.

In order to supplement the procedural rules with regard to the recognition and withdrawal of recognition of monitoring organisations and, if experience so requires, to amend them, the Commission may adopt delegated acts in accordance with Article 290 of the TFEU. When adopting such delegated acts, the Commission shall act in accordance with the relevant provisions of this Regulation.

7. The Commission shall publish the list of the monitoring organisations in the Official Journal of the European Union, C series, and shall make it available on its website. The list shall be regularly updated.

Checks on operators

1. The competent authorities shall carry out checks to verify if operators comply with the requirements set out in Articles 4 and 5.

2. Operators shall offer all assistance necessary to facilitate the performance of the checks referred to in paragraph 1.

3. Where, following the checks referred to in paragraph 1, shortcomings have been detected, the competent authorities may issue a notice of remedial actions to be taken by the operator. Any failure by the operator to take such remedial action may give rise to penalties in accordance with Article 17.

Se, in seguito ai controlli di cui al paragrafo 1, sono state riscontrate carenze, le autorità competenti possono rilasciare una comunicazione concernente gli interventi correttivi che l'operatore dovrà compiere. Il mancato rispetto dell'obbligo imposto all'operatore di compiere detti interventi correttivi può dar luogo a sanzioni a norma dell'articolo 17.

Records of checks

1. The competent authorities shall keep records of the checks referred to in Article 9(1), indicating in particular their nature and results, as well as of any notice of remedial actions issued under Article 9(3). Records of all checks shall be kept for at least 5 years.

1. Competent authorities shall cooperate with each other, with the administrative authorities of third countries and with the Commission in order to ensure compliance with this Regulation.

2. The competent authorities shall exchange information on serious shortcomings detected through the checks referred to in Articles 7(4) and 9(1) and on the types of penalties imposed in accordance with Article 17 with the competent authorities of other Member States and with the Commission.

Amendments of the Annex

In order to take into account the experience gained in implementation of this Regulation, in particular as identified through the reporting referred to in Article 18(3), and developments with regard to technical characteristics, end-users and production processes of timber and timber products, the Commission may adopt delegated acts in accordance with Article 290 of the TFEU by amending and supplementing the list of timber and timber products set out in the Annex. Such acts shall not create a disproportionate burden on operators. When adopting such delegated acts, the Commission shall act in accordance with the relevant provisions of this Regulation.

Per tener conto dell'esperienza acquisita nell'attuazione del presente regolamento, evidenziata in particolare nelle relazioni di cui all'articolo 18, paragrafo 3, e degli sviluppi riguardanti le caratteristiche tecniche, gli utenti finali e i processi di produzione del legno e dei prodotti da esso derivati, la Commissione può adottare atti delegati a norma dell'articolo 290 del TFUE modificando e integrando l'elenco del legno e dei prodotti da esso derivati di cui all'allegato. Tali atti non creano oneri sproporzionati per gli operatori. Nell'adottare tali atti delegati, la Commissione agisce conformemente alle pertinenti disposizioni del presente regolamento.

Article 13

Exercise of the delegation

1. The powers to adopt the delegated acts referred to in Articles 5(3), 7(7) and 12 shall be conferred on the Commission for a period of seven years following the entry into force of this Regulation. The Commission shall make a report in respect of the delegated powers at the latest three months before the end of a three-year period after the date of application of this Regulation. The delegation of power shall be automatically extended for periods of an identical duration, unless the European Parliament or the Council revokes it in accordance with Article 14.

I poteri di adottare gli atti delegati di cui all'articolo 5, paragrafo 3, all'articolo 7, paragrafo 7, e all'articolo 12 sono conferiti alla Commissione per un periodo di sette anni a decorrere dall'entrata in vigore del presente regolamento. La Commissione presenta una relazione sui poteri delegati non oltre tre mesi prima che giunga a scadenza il periodo di tre anni dalla data di applicazione del presente regolamento. La delega di potere è automaticamente prorogata per periodi di identica durata, tranne in caso di revoca da parte del Parlamento europeo o del Consiglio ai sensi dell'articolo 14.

2. As soon as it adopts a delegated act, the Commission shall notify it simultaneously to the European Parliament and to the Council.

3. The powers to adopt delegated acts are conferred on the Commission subject to the conditions laid down in Articles 14 and 15.

Revocation of the delegation

1. The delegation of power referred to in Articles 5(3), 7(7) and 12 may be revoked by the European Parliament or by the Council.

2. The institution which has commenced an internal procedure for deciding whether to revoke the delegation of power shall inform the other legislator and the Commission at the latest one month before the final decision is taken, stating the delegated powers which could be subject to revocation and the reasons for the revocation.

3. The decision of revocation shall put an end to the delegation of the powers specified in that decision. It shall take effect immediately or at a later date specified therein. It shall not affect the validity of the delegated acts already in force. It shall be published in the Official Journal of the European Union.

Objections to delegated acts

1. The European Parliament and the Council may object to the delegated act within a period of three months from the date of notification.

2. If, on expiry of that period, neither the European Parliament nor the Council has objected to the delegated act, or if, before that date, the European Parliament and the Council have both informed the Commission that they have decided not to raise objections, the delegated act shall enter into force at the date stated in its provisions.

Se allo scadere di tale termine né il Parlamento europeo né il Consiglio hanno mosso obiezioni all'atto delegato ovvero se, anteriormente a tale data, il Parlamento europeo e il Consiglio hanno entrambi informato la Commissione della propria decisione di non muovere obiezioni, l'atto delegato entra in vigore alla data fissata nell'atto medesimo.

3. If the European Parliament or the Council objects to the adopted delegated act, the act shall not enter into force. The institution which objects shall state its reasons for objecting to the delegated act.

3. Se il Parlamento europeo o il Consiglio muovono obiezioni all'atto delegato adottato, quest'ultimo non entra in vigore. L'istituzione che muove obiezioni all'atto delegato ne illustra le ragioni.

1. The Commission shall be assisted by the Forest Law Enforcement Governance and Trade (FLEGT) Committee established under Article 11 of Regulation (EC) No 2173/2005.

The Member States shall lay down the rules on penalties applicable to infringements of the provisions of this Regulation and shall take all measures necessary to ensure that they are implemented. The penalties provided for must be effective, proportionate and dissuasive. The Member States shall notify those provisions to the Commission and shall notify it without delay of any subsequent amendments affecting them.

Gli Stati membri determinano le sanzioni da irrogare in caso di violazione delle disposizioni del presente regolamento e adottano ogni provvedimento necessario per assicurarne l’applicazione. Le sanzioni previste devono essere effettive, proporzionate e dissuasive. Gli Stati membri notificano le relative disposizioni alla Commissione e provvedono a notificare immediatamente le eventuali modifiche.

Reporting

1. Member States shall submit to the Commission, by 30 April of every second year following the date of application of this Regulation, a report on the application of this Regulation during the previous two years.

2. On the basis of those reports the Commission shall draw up a report to be submitted to the European Parliament and to the Council every two years.

3. By … [] and every six years thereafter, the Commission shall, on the basis of reporting on and experience with the application of this Regulation, review the functioning and effectiveness of this Regulation, in particular with respect to administrative consequences for small and medium-sized enterprises and product coverage. This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

STATEMENT OF THE COUNCIL'S REASONS

I. INTRODUZIONE

1. Il 17 ottobre 2008 la Commissione ha presentato una proposta di regolamento del Parlamento europeo e del Consiglio che stabilisce gli obblighi degli operatori che commercializzano legname e prodotti del legno. La proposta di regolamento è basata sull'articolo 192, paragrafo 1 del trattato sul funzionamento dell'Unione europea (trattato FUE).

On 17 October 2008, the Commission submitted a proposal for a Regulation of the European Parliament and of the Council laying down the obligations of operators who place timber and timber products on the market. The proposal is based on Article 192 (1) of the Treaty on the Functioning of the European Union (TFEU).

II. OBIETTIVI

Il regolamento mira a minimizzare il rischio di commercializzazione sul mercato interno di legname disboscato illegalmente. Si basa sul principio della dovuta diligenza ed è incentrato sulla prima commercializzazione sul mercato interno di legname e prodotti del legno. Il Consiglio ha mantenuto lo spirito dell'approccio sistemico della Commissione. Si è pertanto concentrato sull'elaborazione degli obblighi giuridici che impongono un approccio proattivo all'operatore.

The purpose of the Regulation is to minimize the risk of placing illegally logged timber on the internal market. It is based on the principle of due diligence and focuses on the first time that timber and timber products are placed on the internal market. The Council has maintained the spirit of the Commission's systemic approach. It has therefore focused on elaborating the legal requirements for a proactive behaviour on the part of the operator.

Il Parlamento europeo (PE), nella sua prima lettura del 22 aprile 2009, ha adottato 75 emendamenti.

In its first reading on 22 April 2009, the European Parliament (EP) adopted 75 amendments.

La posizione del Consiglio in prima lettura incorpora una serie di emendamenti del Parlamento europeo, in parte o nello spirito, in base ai quali segnatamente dovrebbe essere prestata particolare attenzione all'impatto del regolamento sulle piccole e medie imprese (emm. 22, 29, 47, 72), il campo di applicazione del regolamento non dovrebbe escludere legname e prodotti del legno soggetti ai criteri obbligatori di sostenibilità (emm. 21, 32) e la Commissione dovrebbe riconoscere gli organismi di controllo che intendono svolgere le loro attività in più Stati membri (emm. 51, 56).

The Council's position at first reading incorporates a number of the European Parliament's amendments, in part or in spirit. Notable among them is that particular attention should be made to the impact of the Regulation on small and medium-sized enterprises (AM 22, 29, 47, 72), that the scope of the Regulation should not exclude timber and timber products which are subject to mandatory sustainability criteria (AM 21, 32) and that the Commission should recognise monitoring organisations which intend to carry out its activities in more than one Member State (AM 51-56).

Tuttavia altri emendamenti non sono stati ripresi nella posizione del Consiglio in prima lettura in quanto il Consiglio ha ritenuto fossero diventati inutili alla luce dell'evoluzione del testo. Il Consiglio ha introdotto varie modifiche derivanti dall'entrata in vigore del trattato di Lisbona, il 1o dicembre 2009, in particolare dal quadro giuridico che sarà costruito per subentrare al sistema di procedura di comitato. However, other amendments were not reflected in the Council's position at first reading because the Council considered that they were rendered unnecessary in the light of the way in which the text had evolved. The Council introduced a number of changes resulting from the entry into force of the Lisbon Treaty on 1 December 2009, in particular the legal framework that will be constructed to replace the comitology system. As the EP position at first reading was delivered approximately seven months before the entry into force of the Lisbon Treaty the amendments related to comitology were not taken into account as they were no longer relevant.

La definizione di legislazione applicabile è una delle questioni centrali del progetto di regolamento in quanto l'operatore sarebbe obbligato ad avere accesso alle informazioni relative alla conformità del legname e prodotti del legno con la legislazione applicabile. Il Consiglio si è sforzato di trovare il giusto equilibrio tra un elenco esteso di settori legislativi e un elenco che enumera i settori pertinenti in termini generali. Il Consiglio ha ampliato la definizione presentata nella proposta della Commissione per includere la normativa in materia forestale, comprese la normativa in materia ambientale di immediata pertinenza e la normativa in materia commerciale e doganale, per quanto riguarda il settore forestale. Il Consiglio ha aggiunto "i diritti legittimi di terzi relativi all'uso e alla proprietà …" avvicinandosi alla linea seguita dal PE quando menziona i "diritti di proprietà" e "diritti delle popolazioni indigene" (em. 38). Tuttavia il Consiglio ha ritenuto problematici, dal punto di vista giuridico e pratico, gli emendamenti del PE concernenti l'inclusione della legislazione del lavoro e della legislazione sociale.

The definition of applicable legislation is one of the core issues of the draft Regulation since the operator would be obliged to have access to information about the compliance of timber and timber products with the applicable legislation. The Council has endeavoured to strike the right balance between an extended list of areas of legislation and a list that enumerated the relevant areas of legislation in general terms. The Council has broadened the definition put forward in the Commission proposal to include forest-related legislation, including directly environmental legislation as well as trade and customs legislation, as far as the forest sector is concerned. The Council has added "third parties' legal rights concerning use and tenure …" which can be seen as approaching the line taken by the EP when it mentions "property tenure and rights of indigenous people" (AM 38). However, the Council considered the EP's amendments concerning the inclusion of labour and community welfare legislation to be problematic from a legal and practical point of view.

Il Consiglio ha ritenuto importante chiarire i principali elementi del progetto di regolamento. Ha pertanto elaborato tre elementi del sistema di dovuta diligenza: l'accesso a talune informazioni, la procedura di valutazione del rischio e la procedura di attenuazione del rischio. Nell'em. 37, anche il PE ha ravvisato la necessità di indicare chiaramente i due elementi di identificazione del rischio e di minimizzazione del rischio.

The Council considered it important that the main elements in the draft Regulation were clarified. Therefore it has elaborated three elements of the due diligence system: access to certain information, the risk assessment procedure and the risk mitigation procedure. In its AM 37 the EP also saw the need to clearly set out the two elements of risk identification and the risk minimisation.

Per le procedure di valutazione del rischio il Consiglio ha precisato quattro criteri di valutazione del rischio che possono essere integrati a norma dell'articolo 290 del trattato FUE.

For the risk assessment procedures the Council set out four risk assessment criteria that can be supplemented pursuant to Article 290 of the TFEU.

All'articolo 5, paragrafo 1, lettere b) e c) il Consiglio ha cercato di operare una distinzione tra le procedure di valutazione del rischio e le procedure di attenuazione del rischio, in base a diversi fattori quali la complessità del prodotto e la sua origine, senza prevedere esplicitamente situazioni che richiedono attenzione particolare, in forma di obblighi più rigorosi o meno rigorosi (em. 47).

In its Article 5 (1) (b) and (c) the Council endeavoured to distinguish between the risk assessment and the risk mitigation procedures, according to different factors such as the complexity of the product and its origin, without explicitly indicating situations which require special attention, in the form of either stricter or lighter requirements (AM 47).

Diversamente dal PE, il Consiglio non ha esteso l'obbligo di dovuta diligenza ad operatori diversi da quelli che commercializzano per la prima volta legname e prodotti del legno sul mercato interno (emm. 15, 17, 19, 20, 31, 33, 35, 41, 42, 43, 50). Tale estensione è stata ritenuta eccessivamente onerosa.

Unlike the EP, the Council did not extend the obligation of due diligence to operators other than those who place timber and timber products on the internal market for the first time (AM 15, 17, 19, 20, 31, 33, 35, 41, 42, 43, 50). Such an extension was considered to be unduly burdensome.

Il Consiglio ha introdotto la possibilità per l'operatore di scegliere tra tre diversi sistemi di dovuta diligenza: il proprio, un sistema di dovuta diligenza fornito da un organismo di controllo o un sistema fornito da un terzo.

The Council introduced the possibility for the operator to choose between three different due diligence systems, their own, a due diligence system provided by a monitoring organisation or a system provided by a third party.

Anche il Consiglio, analogamente al PE, ha soppresso l'eccezione proposta per il legname soggetto ai criteri obbligatori di sostenibilità (emm. 21, 32).

Like the EP, the Council also deleted the proposed exemption for timber subject to mandatory sustainability criteria in the Commission proposal (AM 21, 32).

Allegato

Annex

Il Consiglio ha riordinato i prodotti del legno elencati nell'allegato secondo la numerazione dei codici NC ed ha aggiunto nuove categorie di prodotti. Ha ritenuto che in questa fase se fossero aggiunte altre categorie (emm. 74, 75) diventerebbe eccessivo l'onere gravante sugli operatori.

The Council rearranged the timber products in the Annex according to the numbering of the CN codes and added some product categories. It considered that at this stage the burden on operators would be too heavy if other categories are added (AM 74, 75).

Organismi di controllo

Monitoring organisations

Il Consiglio condivide il parere del PE secondo cui è importante disporre di norme armonizzate in tutta l'UE e ha proposto che la Commissione riconosca anche gli organismi di controllo. Il Consiglio ha operato una distinzione tra organismi di controllo che intendono svolgere le proprie attività in uno Stato membro e quelli che intendono svolgerle in vari Stati membri. Ha convenuto che la Commissione dovrebbe riconoscere gli organismi che svolgono le proprie attività in vari Stati membri (emm. 51, 53, 54, 55, 56) (cfr. articolo 7, paragrafo 3). Ha tuttavia considerato più pratico che l'autorità competente di uno Stato membro sia responsabile per il riconoscimento di organismi di controllo che svolgono le proprie attività esclusivamente in quello Stato membro. Il Consiglio, analogamente al PE, ritiene sia importante che gli organismi di controllo espletino le proprie funzioni in modo tale da evitare conflitti di interesse (em. 51) (cfr. articolo 7, paragrafo 2, lettera c)). Il Consiglio non ha ritenuto necessario distinguere tra organismi di controllo a seconda che siano enti pubblici o privati (emm. 51, 52).

The Council shared the view of the EP that it was important to have harmonised standards across the EU and suggested that the Commission should also recognise monitoring organisations. The Council distinguished between monitoring organisations which intend to carry out activities in one Member State or in several Member States. It agreed that the Commission should recognise those organisations carrying out their activities in several Member States (AM 51, 53, 54, 55, 56) cf. (Article 7(3)). However it was considered more practical for a Member State's competent authority to be responsible for recognising monitoring organisations carrying out their activities only in that Member State. Like the EP, the Council considered it important that the monitoring organisation should carry out its functions in a manner to avoid any conflict of interest (AM 51) (cf. Article 7(2)(c)). It was not deemed necessary to distinguish between the monitoring organisation being a public or a private entity (AM 51, 52).

Sanzioni

Penalties

Il Consiglio ha preso in considerazione l'aggiunta di un elenco di sanzioni (em. 69) ma, dopo un'ampia discussione ha deciso di mantenere il testo della proposta della Commissione che è un testo concordato per la legislazione dell'UE. Molti Stati membri ritengono che il livello e il contenuto delle sanzioni rientrino nella sfera di competenze degli Stati membri. Inoltre la compilazione di un elenco di sanzioni solleva alcune questioni pratiche quali l'esaustività dell'elenco e la difficile identificazione in questa fase di tutte le possibili infrazioni.

The Council considered adding a list of penalties (AM 69) but after extensive discussion decided to retain the language of the Commission's proposal which is agreed language for EU legislation. Many Member States were of the opinion that the level and content of penalties were within the sphere of Member States' competence. Furthermore the setting out of a list of penalties raised some practical issues such as the exhaustiveness of the list and difficulties in identifying at this stage all possible infractions.

Il Consiglio ha mantenuto lo spirito della proposta di approccio sistemico della Commissione. Il Consiglio non condivide il parere del PE secondo cui si dovrebbero introdurre un divieto per assicurare la legalità (emm. 17, 19, 31, 42 (per quanto riguarda l'articolo 3, paragrafo1), 43, 50, 71). Una siffatta estensione del campo di applicazione non è ritenuta compatibile con lo spirito della proposta e non è pertanto accettabile.

The Council has kept the spirit of the Commission proposal for a systemic approach. Operators should use a due diligence system to minimise the risk of placing illegally harvested timber or timber products on the market. The Council does not concur with the view of the EP that a prohibition should be introduced to ensure legality (AM 17, 19, 31, 42 (as regards Article 3(1)), 43, 50, 71). Such an extension of the scope was not considered to be in line with the spirit of the proposal and is therefore unacceptable.

Il Consiglio ritiene irrealistico, a prescindere da quanto auspicabile, rendere il regolamento applicabile soltanto un anno dopo l'entrata in vigore (em. 73). Pertanto al fine di dare agli operatori il tempo di adeguarsi alla nuova situazione e di consentire l'adozione delle modalità di esecuzione, il Consiglio ha proposto di iniziare l'applicazione del regolamento 30 mesi dopo l'entrata in vigore.

The Council considered that it would be unrealistic, to make the Regulation applicable only a year after its entry into force, no matter how desirable (AM 73). Therefore, and in order to give the operators time to adjust to the new situation and for the implementing measures to be adopted it was suggested that the Regulation should begin to apply 30 months after its entry into force.

Il Consiglio, analogamente al PE, ha tenuto conto della situazione specifica delle piccole e medie imprese e dei piccoli e medi operatori (emm. 22, 29, 47, 72). Ha ad esempio introdotto la nozione di rischio trascurabile all'articolo 5, paragrafo 1, lettera c). All'articolo 12 si prevede che gli atti delegati che modificheranno e integreranno l'elenco del legname e dei prodotti del legno di cui all'allegato non creino oneri sproporzionati per gli operatori. All'articolo 18 sulle relazioni, il Consiglio ha aggiunto che l'esame dovrebbe in particolare tener conto delle conseguenze amministrative per le piccole e medie imprese.

Like the EP, the Council has taken into account the special situation of small and medium-sized enterprises and operators (AM 22, 29, 47, 72). It has for example introduced the notion of negligible risk in Article 5(1)(c). It is set out in Article 12 that the delegated acts which will amend and supplement the list of timber and timber products set out in the Annex should not create a disproportionate burden on operators. In Article 18 on reporting, the Council added that the review should in particular take into account the administrative consequences for small and medium-sized enterprises.

Recitals and references to environmental issues (sustainable forest management)

Il PE ha aggiunto numerosi considerando per tener conto dell'ambiente forestale, della biodiversità, degli ecosistemi forestali e della gestione sostenibile delle foreste (emm. 2-8, 10, 11, 14). Il Consiglio ritiene che tali riferimenti, per quanto auspicabili siano i loro obiettivi, siano superflui in quanto il sistema di dovuta diligenza e il comportamento degli operatori volti a ridurre al minimo il rischio di commercializzare legname e prodotti del legno di provenienza illegale sono al centro del regolamento. Inoltre i considerando servono a giustificare le disposizioni del regolamento, mentre in questo caso non sono previste disposizioni operative a cui poterli allegare.

The EP has added a considerable number of recitals to take account of the forest environment, biodiversity, forest ecosystems and sustainable forest management (AM 2-8, 10, 11, 14). The Council considers that since the due diligence system and the behaviour of the operators to minimise the risk of placing illegally logged timber and timber products on the market is at the heart of the Regulation, such references are superfluous, however desirable the objectives. In addition, recitals serve to justify the provisions of the Regulation while here there are no operational provisions to which such recitals could be linked.

Review

Il Consiglio conviene con il PE sulla necessità che la Commissione effettui un riesame del regolamento, che dovrebbe in particolare riguardare le conseguenze amministrative sulle piccole e medie imprese (em. 72).

The Council concurred with the EP that it is necessary that the Commission carries out a review of the Regulation and that this review should in particular address the administrative consequences for small and medium-sized enterprises (AM 72).

Status of timber products covered by FLEGT and CITES

La disposizione sul legname e i prodotti del legno contemplati da FLEGT e CITES è stata inserita in un articolo separato in quanto il regolamento considera che le licenze FLEGT e i requisiti CITES siano prove sufficienti di raccolta legale.

The provision on timber and timber products covered by FLEGT and CITES was set out in a separate Article because the Regulation considers FLEGT licenses and CITES certificates to be sufficient evidence of legal harvesting.

Cooperazione tra le autorità competenti

Cooperation between competent authorities

Il Consiglio ritiene che soltanto le gravi carenze debbano essere soggette allo scambio di informazioni di cui all'articolo 11. Il Consiglio ha inoltre specificato che i tipi di sanzioni inflitte dovrebbero essere contemplati dallo scambio di informazioni.

The Council was of the opinion that only serious shortcomings needed to be subject to an exchange of information in Article 11. The Council also specified that the types of penalties imposed should be covered by the exchange of information.

Per chiarire lo scopo degli obblighi previsti nel regolamento, il Consiglio ha aggiunto che l'obiettivo è minimizzare il rischio di commercializzare legname e prodotti derivati di provenienza illegale.

In order to clarify the purpose of the obligations laid down in the Regulation the Council has added that the aim is to minimise the risk of placing illegally timber or timber products derived from such timber on the market.

Lisbon Treaty changes

Il Consiglio, poiché ritiene che debbano essere delegati poteri alla Commissione ai sensi dell'articolo 290 del trattato sul funzionamento dell'Unione europea, ha aggiunto tre nuove disposizioni necessarie per l'adozione di tali atti delegati (articolo 5, paragrafo 3, articolo 7, paragrafo 7 e articolo 12) nonché un nuovo considerando. Analogamente il Consiglio ha adottato disposizioni per l'adozione di modalità di esecuzione ai sensi dell'articolo 291 del trattato FUE.

Since the Council considers that powers should be delegated to the Commission pursuant to Article 290 of the Treaty on the Functioning of the European Union, it added three new Articles necessary for such delegated acts in Articles 5(3) and 7(7) and 12 as well as a new recital. Similarly, the Council adapted the provisions for the adoption of implementing measures pursuant to Article 291 TFEU.

Il Consiglio ritiene che la sua posizione in prima lettura sia in linea con gli obiettivi fondamentali della proposta della Commissione. Essa rappresenta un pacchetto equilibrato di misure che contribuiranno al perseguimento degli obiettivi di lotta al disboscamento illegale.

The Council believes that its position at first reading is in line with the fundamental objectives of the Commission's proposal. It represents a balanced package of measures that would contribute to the pursuit of the objectives of combating illegal logging.

Il Consiglio confida in una discussione costruttiva con il Parlamento europeo in vista di un accordo praticabile su questo regolamento.

The Council looks forward to constructive discussion with the European Parliament with a view to achieving a workable agreement on this Regulation.
