LA COMMISSIONE EUROPEA,

Having regard to the Treaty on the Functioning of the European Union,

visto il regolamento (CE) n. 1007/2009 del Parlamento europeo e del Consiglio, del 16 settembre 2009, sul commercio dei prodotti derivati dalla foca [1], in particolare l’articolo 3, paragrafo 4,

Having regard to Regulation (EC) No 1007/2009 of the European Parliament and of the Council of 16 September 2009 on trade in seal products [1], and in particular Article 3(4) thereof,

considerando quanto segue:

Whereas:

(1) Il regolamento (CE) n. 1007/2009 consente l’immissione sul mercato di prodotti derivati dalla foca che provengono dalla caccia praticata tradizionalmente dalle comunità Inuit e da altre comunità indigene e contribuiscono alla loro sussistenza. Il regolamento consente inoltre l’immissione sul mercato di prodotti derivati dalla foca quando la caccia viene praticata al solo scopo di garantire una gestione sostenibile delle risorse marine e quando l’importazione di prodotti derivati dalla foca ha natura occasionale ed è costituita esclusivamente da merci destinate all’uso personale dei viaggiatori o dei loro familiari.

(1) Regulation (EC) No 1007/2009 allows for the placing on the market of seal products which result from hunts traditionally conducted by Inuit and other indigenous communities and which contribute to their subsistence. It also allows for the placing on the market of seal products where the hunt was conducted with the sole purpose of the sustainable management of marine resources and where the import of seal products are occasional in nature and consist exclusively of goods for the personal use of travellers and their families.

(2) Occorre pertanto specificare le modalità per l’importazione e l’immissione sul mercato dell’Unione di prodotti derivati dalla foca, ai fini dell’applicazione uniforme del regolamento (CE) n. 1007/2009.

(2) It is therefore necessary to specify detailed requirements for the import and the placing on the Union market of those seal products in order to ensure a uniform application of Regulation (EC) No 1007/2009.

(3) È opportuno autorizzare l’immissione sul mercato di prodotti derivati dalla foca provenienti dalla caccia praticata tradizionalmente da comunità Inuit e da altre comunità indigene, i quali contribuiscono al sostentamento di tali comunità, se tale pratica fa parte del loro patrimonio culturale e se i prodotti derivati dalla foca sono almeno in parte utilizzati, consumati o trasformati all’interno delle comunità secondo le loro tradizioni.

(3) The placing on the market of seal products which result from hunts traditionally conducted by Inuit and other indigenous communities and which contribute to their subsistence should be allowed where such hunts are part of the cultural heritage of the community and where the seal products are at least partly used, consumed or processed within the communities according to their traditions.

(4) È altresì opportuno stabilire le condizioni che disciplinano l’immissione sul mercato di prodotti derivati dalla foca se la caccia è stata praticata al solo scopo di garantire una gestione sostenibile delle risorse marine, nonché le condizioni che disciplinano l’importazione di prodotti derivati dalla foca destinati all’uso personale dei viaggiatori o dei loro familiari.

(4) The conditions for the placing on the market of seal products resulting from by-products of hunting that is conducted for the sole purpose of the sustainable management of marine resources, and for the importation of seal products for the personal use of travellers or their families, should also be laid down.

(5) Nell’ambito di tale normativa eccezionale, è opportuno istituire un meccanismo efficace che consenta di verificare il rispetto delle suddette condizioni senza produrre effetti restrittivi degli scambi in misura superiore al necessario.

(5) Within this exceptional framework, an effective mechanism to ensure an adequate verification of compliance with those requirements should be introduced. That mechanism should not be more trade-restrictive than necessary.

(6) Altre soluzioni non sarebbero sufficienti per conseguire tali obiettivi. Occorre pertanto disporre di un meccanismo che consenta agli organismi riconosciuti di rilasciare attestazioni certificanti la conformità dei prodotti derivati dalla foca ai requisiti stabiliti nel regolamento (CE) n. 1007/2009, eccetto per le importazioni destinate all’uso personale dei viaggiatori o dei loro familiari.

(6) Other options would not be sufficient to achieve these aims. Therefore, a mechanism should exist by which recognised bodies issue documents attesting that seal products are compliant with the requirements laid down in Regulation (EC) No 1007/2009, unless the import is for the personal use of travellers or their families.

(7) È opportuno disporre che gli organismi conformi a determinati requisiti siano inclusi in un elenco degli organismi riconosciuti per il rilascio delle suddette attestazioni.

(7) It is appropriate to provide that entities which comply with certain requirements should be included in a list of recognised bodies issuing such attesting documents.

(8) Occorre definire i modelli delle attestazioni e delle relative copie, al fine di agevolare la gestione e la verifica delle attestazioni stesse.

(8) Models should be set out for the attesting document and its copies in order to facilitate the management and verification of attesting documents.

(9) Occorre definire le procedure di controllo delle attestazioni. Tali procedure devono essere quanto più possibile semplici e maneggevoli, e garantire nel contempo l’affidabilità e la coerenza del sistema.

(9) Procedures for the control of attesting documents should be set out. Those procedures should be as simple and as practical as possible, without compromising the credibility and consistency of the system.

(10) È opportuno autorizzare l’utilizzo di sistemi elettronici al fine di agevolare lo scambio dei dati tra le autorità competenti, la Commissione e gli organismi riconosciuti.

(10) The use of electronic systems should be allowed in order to facilitate the exchange of data between competent authorities, the Commission and the recognised bodies.

(11) Il trattamento dei dati personali ai fini del presente regolamento, con particolare riguardo al trattamento dei dati personali contenuti nelle attestazioni, deve essere conforme alla direttiva 95/46/CE del Parlamento europeo e del Consiglio, del 24 ottobre 1995, relativa alla tutela delle persone fisiche con riguardo al trattamento dei dati personali, nonché alla libera circolazione di tali dati [2], e al regolamento (CE) n. 45/2001 del Parlamento europeo e del Consiglio, del 18 dicembre 2000, concernente la tutela delle persone fisiche in relazione al trattamento dei dati personali da parte delle istituzioni e degli organismi comunitari, nonché la libera circolazione di tali dati [3].

(11) The processing of personal data for the purposes of this Regulation, in particular as regards the processing of personal data contained in attesting documents, should comply with Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data [2] and Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data [3].

(12) Poiché il presente regolamento stabilisce le modalità di applicazione dell’articolo 3 del regolamento (CE) n. 1007/2009, che è applicabile a decorrere dal 20 agosto 2010, l’entrata in vigore del presente regolamento riveste carattere di urgenza.

(12) Since this Regulation lays down detailed rules for the implementation of Article 3 of Regulation (EC) No 1007/2009 which applies on 20 August 2010, it should enter into force as a matter of urgency.

HA ADOTTATO IL PRESENTE REGOLAMENTO:

HAS ADOPTED THIS REGULATION:

Articolo 1

Article 1

Il presente regolamento stabilisce le modalità di immissione sul mercato di prodotti derivati dalla foca ai sensi dell’articolo 3 del regolamento (CE) n. 1007/2009.

This Regulation lays down detailed rules for the placing on the market of seal products pursuant to Article 3 of Regulation (EC) No 1007/2009.

Articolo 2

Article 2

Ai fini del presente regolamento, si intende per:

For the purposes of this Regulation, the following definitions shall apply:

1) "altre comunità indigene" : comunità stabilite in paesi indipendenti che sono considerate indigene in virtù della loro discendenza da popolazioni che abitavano il paese, o una regione geografica cui esso appartiene, al momento della conquista, della colonizzazione o della definizione degli attuali confini di Stato e che, a prescindere dal loro status giuridico, hanno conservato tutte le loro istituzioni sociali, economiche, culturali e politiche o parte di esse.

1. "other indigenous communities" means communities in independent countries who are regarded as indigenous on account of their descent from the populations which inhabited the country, or a geographical region to which the country belongs, at the time of conquest or colonisation or the establishment of present State boundaries and who, irrespective of their legal status, retain some or all of their own social, economic, cultural and political institutions;

2) "immissione sul mercato senza scopi di lucro" : l’immissione sul mercato a un prezzo pari o inferiore ai costi sostenuti dal cacciatore, ridotto dell’importo corrispondente ad eventuali sovvenzioni ricevute in relazione all’attività di caccia.

2. "placing on the market on a non-profit basis" means placing on the market for a price less than or equal to the recovery of the costs borne by the hunter reduced by the amount of any subsidies received in relation to the hunt.

Articolo 3

Article 3

1. I prodotti derivati dalla foca provenienti dalla caccia praticata da comunità Inuit o da altre comunità indigene possono essere immessi sul mercato soltanto se è possibile dimostrare che provengono da attività di caccia alla foca che soddisfano tutte le seguenti condizioni:

1. Seal products resulting from hunts by Inuit or other indigenous communities may only be placed on the market where it can be established that they originate from seal hunts which satisfy all of the following conditions:

a) sono praticate da comunità Inuit o da altre comunità indigene tradizionalmente dedite alla caccia alla foca nella regione geografica;

(a) seal hunts conducted by Inuit or other indigenous communities which have a tradition of seal hunting in the community and in the geographical region;

b) i prodotti da esse ottenuti sono almeno in parte utilizzati, consumati o trasformati all’interno delle comunità secondo le loro tradizioni;

(b) seal hunts the products of which are at least partly used, consumed or processed within the communities according to their traditions;

c) contribuiscono al sostentamento della comunità.

(c) seal hunts which contribute to the subsistence of the community.

2. All’atto dell’immissione sul mercato i prodotti derivati dalla foca sono accompagnati dall’attestazione di cui all’articolo 7, paragrafo 1.

2. At the time of the placing on the market, the seal product shall be accompanied by the attesting document referred to in Article 7(1).

Articolo 4

Article 4

I prodotti derivati dalla foca destinati all’uso personale dei viaggiatori o dei loro familiari possono essere importati unicamente se è soddisfatto uno dei seguenti requisiti:

Seal products for the personal use of travellers or their families may only be imported where one of the following requirements is fulfilled:

1) sono indossati dai viaggiatori, o portati a mano o contenuti nei loro bagagli personali;

1. the seal products are either worn by the travellers, or carried or contained in their personal luggage;

2) fanno parte dei beni personali di una persona fisica che stia trasferendo il luogo abituale di residenza da un paese terzo all’Unione;

2. the seal products are contained in the personal property of a natural person transferring his normal place of residence from a third country to the Union;

3) sono acquisiti sul posto in un paese terzo dai viaggiatori e da essi importati ad una data successiva, purché, all’ingresso nel territorio dell’Unione, tali viaggiatori presentino alle autorità doganali dello Stato membro interessato i seguenti documenti:

3. the seal products are acquired on site in a third country by travellers and imported by those travellers at a later date, provided that, upon arrival in the Union territory, those travellers present to the customs authorities of the Member State concerned the following documents:

a) una dichiarazione scritta di importazione;

(a) a written notification of import;

b) un documento comprovante l’acquisizione dei prodotti in tale paese terzo.

(b) a document giving evidence that the products were acquired in the third country concerned.

Ai fini del punto 3, la dichiarazione scritta e il documento sono vistati dalle autorità doganali e restituiti ai viaggiatori. All’atto dell’importazione, la dichiarazione scritta e il documento sono presentati alle autorità doganali unitamente alla dichiarazione in dogana per i prodotti considerati.

For the purposes of point 3, the written notification and the document shall be endorsed by the customs authorities and returned to the travellers. On import, the notification and document shall be presented to the customs authorities together with the customs declaration for the products concerned.

Articolo 5

Article 5

1. I prodotti derivati dalla foca ottenuti nell’ambito dalla gestione delle risorse marine possono essere immessi sul mercato soltanto se è possibile dimostrare che provengono da attività di caccia alla foca che soddisfano tutte le seguenti condizioni:

1. Seal products resulting from marine resources management may only be placed on the market where it can be established that they originate from seal hunts which satisfy all of the following conditions:

a) sono praticate nell’ambito di un piano nazionale o regionale di gestione delle risorse naturali che utilizzi modelli di popolazione scientifici delle risorse naturali e applichi l’approccio ecosistemico;

(a) seal hunts conducted under a national or regional natural resources management plan which uses scientific population models of marine resources and applies the ecosystem-based approach;

b) non superano il totale ammissibile di catture stabilito in conformità del piano di cui alla lettera a);

(b) seal hunts which does not exceed the total allowable catch quota established in accordance with the plan referred to in point (a);

c) i sottoprodotti della caccia alla foca sono immessi sul mercato in modo non sistematico e senza scopo di lucro.

(c) seal hunts the by-products of which are placed on the market in a non-systematic way on a non-profit basis.

2. All’atto dell’immissione sul mercato i prodotti derivati dalla foca sono accompagnati dall’attestazione di cui all’articolo 7, paragrafo 1.

2. At the time of the placing on the market, the seal product shall be accompanied by the attesting document referred to in Article 7(1).

Articolo 6

Article 6

1. Un organismo è inserito nell’elenco degli organismi riconosciuti se dimostra di essere conforme ai seguenti requisiti:

1. An entity shall be included in a list of recognised bodies where it demonstrates that it fulfils the following requirements:

a) è dotato di personalità giuridica;

(a) it has legal personality;

b) è in grado di accertare la conformità ai requisiti stabiliti all’articolo 3 o all’articolo 5;

(b) it has the capacity to ascertain that the requirements of Article 3 or 5 are met;

c) è in grado di rilasciare e gestire le attestazioni di cui all’articolo 7, paragrafo 1, nonché di trattare e archiviare i dati;

(c) it has the capacity to issue and manage attesting documents referred to in Article 7(1), as well as process and archive records;

d) è in grado di espletare le sue funzioni in modo tale da evitare conflitti di interesse;

(d) it has the ability to carry out its functions in a manner that avoids conflict of interest;

e) è in grado di controllare il rispetto dei requisiti stabiliti agli articoli 3 e 5;

(e) it has the ability to monitor compliance with the requirements set out in Articles 3 and 5;

f) è in grado di revocare l’attestazione di cui all’articolo 7, paragrafo 1, o di sospenderne la validità in caso di inosservanza dei requisiti del presente regolamento e di prendere opportune misure per informarne le autorità competenti e le autorità doganali degli Stati membri;

(f) it has the capacity to withdraw attesting documents referred to in Article 7(1) or suspend their validity in case of non-compliance with the requirements of this Regulation, and to take measures to inform competent authorities and customs authorities of Member States thereof;

g) è sottoposto a revisione contabile da parte di un soggetto terzo indipendente;

(g) it is subject to an independent third party audit;

h) opera a livello nazionale o regionale.

(h) it operates at national or regional level.

2. Ai fini dell’inclusione nell’elenco di cui al paragrafo 1, l’organismo trasmette alla Commissione una domanda corredata di prove documentali che ne dimostrino la conformità ai requisiti di cui al paragrafo 1.

2. In order to be included in the list referred to in paragraph 1, an entity shall submit to the Commission a request accompanied by documentary evidence that it fulfils the requirements set out in paragraph 1.

3. L’organismo riconosciuto presenta alla Commissione i rapporti di revisione contabile elaborati dal soggetto terzo indipendente di cui al paragrafo 1, lettera g), al termine di ogni ciclo di rendicontazione.

3. The recognised body shall submit audit reports produced by the independent third party referred to in paragraph 1(g) to the Commission at the end of each reporting cycle.

Articolo 7

Article 7

1. Se sono soddisfatte le condizioni per l’immissione sul mercato previste all’articolo 3, paragrafo 1, o all’articolo 5, paragrafo 1, un organismo riconosciuto rilascia, su richiesta, un’attestazione conforme ai modelli figuranti nell’allegato.

1. Upon request, where the requirements for placing on the market set out in Article 3(1) or 5(1) are met, a recognised body shall issue an attesting document conforming to the models set out in the Annex.

2. L’organismo riconosciuto rilascia l’attestazione al richiedente e ne conserva una copia per tre anni a fini di archiviazione.

2. The recognised body shall deliver the attesting document to the applicant and shall keep a copy for three years for record-keeping purposes.

3. Fatto salvo l’articolo 8, paragrafo 2, quando un prodotto derivato dalla foca è immesso sul mercato, l’originale dell’attestazione è consegnato unitamente al prodotto derivato dalla foca all’atto dell’immissione sul mercato. Il richiedente può conservare copia dell’attestazione.

3. Subject to Article 8(2), when a seal product is placed on the market, the original attesting document shall be delivered with the seal product. The applicant may keep a copy of the attesting document.

4. Qualsiasi fattura successiva dovrà recare un riferimento al numero dell’attestazione.

4. A reference to the attesting document number shall be included in any further invoice.

5. I prodotti derivati dalla foca accompagnati da un’attestazione rilasciata in conformità del paragrafo 1 sono considerati conformi alle disposizioni dell’articolo 3, paragrafo 1, o dell’articolo 5, paragrafo 1.

5. A seal product accompanied by an attesting document issued in accordance with paragraph 1 shall be deemed to comply with Article 3(1) or 5(1).

6. L’accettazione della dichiarazione in dogana di immissione in libera pratica di prodotti derivati dalla foca, ai sensi dell’articolo 79 del regolamento (CEE) n. 2913/92 del Consiglio [5], è soggetta alla presentazione di un’attestazione rilasciata in conformità del paragrafo 1 del presente articolo. Fatto salvo l’articolo 77, paragrafo 2, del regolamento (CEE) n. 2913/92, le autorità doganali conservano una copia dell’attestazione nei loro archivi.

6. Acceptance of a customs declaration for release for free circulation pursuant to Article 79 of Council Regulation (EEC) No 2913/92 [5] of a seal product shall be subject to the presentation of an attesting document issued in accordance with paragraph 1 of this Article. Without prejudice to Article 77(2) of Regulation (EEC) No 2913/92, the customs authorities shall keep a copy of the attesting document in their records.

7. Nel caso in cui sussistano dubbi riguardo all’autenticità o all’esattezza di un’attestazione rilasciata in conformità del paragrafo 1 o siano necessari ulteriori pareri, le autorità doganali e gli altri agenti delle forze dell’ordine contattano le autorità competenti dello Stato membro interessato di cui all’articolo 9. Le autorità competenti stabiliscono i provvedimenti da adottare.

7. In case of doubts relating to the authenticity or correctness of an attesting document issued in accordance with paragraph 1 as well as when further advice is required, the customs authorities and other enforcement officers shall contact the competent authorities designated by the Member State concerned in accordance with Article 9. The competent authorities shall decide on the measures to be taken.

1. Le attestazioni di cui all’articolo 7, paragrafo 1, sono rilasciate su supporto cartaceo o elettronico.

1. The attesting document referred to in Article 7(1) shall be paper-based or in electronic form.

2. In caso di attestazione elettronica, una versione stampata di tale attestazione accompagna i prodotti derivati dalla foca all’atto dell’immissione sul mercato.

2. In case of an electronic attesting document, a printed copy of that attesting document shall accompany the seal product at the time of placing on the market.

3. L’uso dell’attestazione non dispensa dall’espletamento di eventuali altre formalità relative all’immissione sul mercato.

3. The use of the attesting document shall be without prejudice to any other formalities relating to the placing on the market.

4. L’autorità competente designata in conformità dell’articolo 9 può chiedere che l’attestazione sia tradotta nella lingua ufficiale dello Stato membro di immissione sul mercato.

4. The competent authority designated in accordance with Article 9 may require that the attesting document be translated into the official language of the Member State where the product is to be placed on the market.

Articolo 9

Article 9

1. Gli Stati membri designano una o più autorità competenti incaricate dello svolgimento delle seguenti mansioni:

1. Each Member State shall designate one or several competent authorities responsible for the following tasks:

a) verifica, su richiesta delle autorità doganali ai sensi dell’articolo 7, paragrafo 7, delle attestazioni che accompagnano i prodotti derivati dalla foca importati;

(a) verification upon request of the customs authorities pursuant to Article 7(7) of attesting documents for imported seal products;

b) verifica che le attestazioni siano state rilasciate da un organismo stabilito e operante nello Stato membro considerato;

(b) control of the issuing of attesting documents by recognised bodies established and active in that Member State;

c) conservazione di una copia delle attestazioni rilasciate per i prodotti derivati dalla foca provenienti da attività di caccia alla foca praticate nello Stato membro considerato.

(c) preservation of a copy of attesting documents issued for seal products originating from seal hunts in that Member State.

2. Gli Stati membri comunicano alla Commissione il nome delle autorità competenti designate in conformità del paragrafo 1.

2. Member States shall notify the Commission of the competent authorities designated in accordance with paragraph 1.

3. La Commissione pubblica sul suo sito Internet l’elenco delle autorità competenti designate in conformità del paragrafo 1. L’elenco è aggiornato periodicamente.

3. The Commission shall make the list of competent authorities designated in accordance with paragraph 1 available on its website. The list shall be regularly updated.

Articolo 10

1. Le autorità competenti possono utilizzare sistemi elettronici per lo scambio e la registrazione dei dati contenuti nelle attestazioni.

1. Competent authorities may use electronic systems for the exchange and recording of data contained in attesting documents.

2. Gli Stati membri tengono in considerazione gli aspetti di complementarità, compatibilità e interoperabilità dei sistemi elettronici di cui al paragrafo 1.

2. Member States shall take into account the complementarity, compatibility and interoperability of the electronic systems referred to in paragraph 1.

Articolo 11

Article 11

Il presente regolamento lascia inalterato il livello di tutela delle persone fisiche riguardo al trattamento dei dati personali nell’ambito del diritto dell’Unione e di quello nazionale e non modifica, in particolare, i diritti e gli obblighi previsti dalla direttiva 95/46/CE e dal regolamento (CE) n. 45/2001. La tutela delle persone fisiche con riguardo al trattamento dei dati personali è garantita, in particolare, per quanto attiene alla divulgazione o alla comunicazione dei dati personali contenuti nelle attestazioni.

This Regulation is without prejudice to the level of protection of individuals with regard to the processing of personal data under Union law and national law, and in particular does not alter the obligations and rights set out in Directive 95/46/EC and Regulation (EC) No 45/2001. The protection of individuals with regard to the processing of personal data shall be ensured in particular with regard to any disclosure or communication of personal data in an attesting document.

Il presente regolamento entra in vigore il terzo giorno successivo alla pubblicazione nella Gazzetta ufficiale dell’Unione europea.

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Union.

Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
