Having regard to the Treaty establishing the European Community,

visto il regolamento (CE) n. 814/2000 del Consiglio, del 17 aprile 2000, relativo alle azioni di informazione riguardanti la politica agricola comune(1), in particolare l'articolo 9,

Having regard to Council Regulation (EC) No 814/2000 of 17 April 2000 on information measures relating to the common agricultural policy(1), and in particular Article 9 thereof,

Whereas:

(1) Il regolamento (CE) n. 814/2000 definisce il tipo e il contenuto delle azioni di informazione riguardanti la politica agricola comune. Occorre adottare modalità di applicazione di tale regolamento alla luce segnatamente dell'esperienza acquisita.

(1) Regulation (EC) No 814/2000 defines the type and content of information measures relating to the common agricultural policy. Measures to implement that Regulation should be laid down, in the light, in particular, of past experience.

(2) L'invito a presentare proposte costituisce il mezzo più efficace e più trasparente per garantire che le possibilità di sovvenzione offerte dal regolamento (CE) n. 814/2000 beneficino della pubblicità più ampia possibile e affinché siano selezionate le azioni migliori.

(2) A call for proposals is the most efficient and most transparent way of ensuring that the grants provided for in Regulation (EC) No 814/2000 receive the widest publicity and that the best measures are selected.

(3) Occorre precisare in modo dettagliato le condizioni di ammissibilità degli offerenti e le cause di esclusione, nonché i criteri generali di selezione delle azioni menzionati all'articolo 3, paragrafo 2, del regolamento (CE) n. 814/2000.

(3) The eligibility criteria for applicants' the grounds for exclusion, and also the general selection criteria for the measures referred to in Article 3(2) of Regulation (EC) No 814/2000 should be laid down in detail.

(4) Fra i destinatari del finanziamento previsto dal regolamento (CE) n. 814/2000 figurano organizzazioni che non hanno uno stato giuridico ben definito. Per garantire la tutela degli interessi finanziari della Comunità occorre quindi esigere, in caso di versamento di un anticipo sul pagamento della sovvenzione, la costituzione di una garanzia di importo equivalente.

(4) The recipients of the financing under Regulation (EC) No 814/2000 include organisations without any well-defined legal status; for the purpose of protecting the Community's financial interests, therefore, provision of a guarantee of an equivalent amount should be demanded whenever payment of an advance on the grant is approved.

(5) In order to make the financial resources available to the largest number possible, a financing rate of more than 50 % must be an exception.

(6) L'informazione del comitato del Fondo europeo agricolo di orientamento e di garanzia (FEAOG), istituito dal regolamento (CE) n. 1258/1999, del 17 maggio 1999, relativo al finanziamento della politica agricola comune(2), sulle azioni finanziate in applicazione del presente regolamento, può favorire il coordinamento fra le azioni condotte dagli Stati membri e quelle sovvenzionate dalla Comunità.

(6) Notifying the Committee for the European Agricultural Guidance and Guarantee Fund (EAGGF), established by Council Regulation (EC) No 1258/1999 of 17 May 1999 on the financing of the common agricultural policy(2), of measures financed under this Regulation will facilitate the coordination of measures implemented by the Member States and those supported by the Community.

(7) As far as the year 2000 is concerned, the time limits attaching to any call for proposals necessitate a derogation from the provisions governing such call, albeit without disturbing the application of the other provisions of this Regulation, in order to permit applications to be selected according to their date of presentation.

Il presente regolamento reca le modalità di applicazione relative alle azioni di informazione sulla politica agricola comune, in forma di programmi d'attività e di azioni specifiche di cui all'articolo 2, paragrafo 1, lettere a) e b), del regolamento (CE) n. 814/2000.

This Regulation lays down detailed rules for the application of the information measures relating to the common agricultural policy, in the form of work programmes and specific measures, referred to in Article 2(1)(a) and (b) of Regulation (EC) No 814/2000.

Call for proposals

La Commissione pubblica nella Gazzetta ufficiale delle Comunità europee un invito a presentare proposte entro il 31 luglio di ogni anno con indicazione segnatamente dei temi e dei tipi di azioni prioritarie, la ripartizione indicativa degli stanziamenti disponibili e i termini per la presentazione delle domande e l'inizio delle azioni.

The Commission shall publish in the Official Journal of the European Communities by 31 July each year a call for proposals, specifying, inter alia, the priority topics and measures, the indicative allocation of the budget appropriations available and the deadlines for the submission of applications and the commencement of the measures concerned.

Condizioni di ammissibilità degli offerenti

Eligibility criteria for applicants

1. Le organizzazioni e le associazioni di cui all'articolo 2, paragrafo 1, lettera a), del regolamento (CE) n. 814/2000 devono soddisfare le seguenti condizioni:

1. The organisations and associations referred to in Article 2(1)(a) of Regulation (EC) No 814/2000 must meet the following conditions:

a) essere non governative;

(a) be non-governmental;

b) non avere scopo di lucro;

(b) be non-profit-making;

c) essere stabilite in uno Stato membro da almeno due anni.

(c) have been established in a Member State for at least two years.

2. Le persone di cui all'articolo 2, paragrafo 1, lettera b), del regolamento (CE) n. 814/2000 devono essere persone giuridiche legalmente costituite in uno Stato membro da almeno due anni, fatta eccezione per le autorità pubbliche degli Stati membri, nonché gli istituti universitari e i mezzi di comunicazione di massa che tuttavia soddisfino le condizioni di cui al paragrafo 1, lettera c), del presente articolo.

The parties referred to in Article 2(1)(b) of Regulation (EC) No 814/2000 must be legal persons legally constituted in a Member State for 'at least two years, with the exception of the public authorities of Member States, or universities or the media, provided that they fulfil the condition laid down in paragraph 1(c) of this Article.

3. Where the agreement referred to in Article 10 provides for the payment of an advance on the grant, the applicant shall provide a bank guarantee of an equivalent amount.

Applicants shall be excluded in the following cases:

a) se è in stato di fallimento, di liquidazione, di cessazione o di sospensione di attività, oggetto di procedure di concordato o di misure analoghe o sia stato oggetto di procedure analoghe;

(a) if they are in a state of bankruptcy, liquidation, cessation or suspension of activities, judicial winding-up, composition or similar arrangement, or if they are the subject of such proceedings;

b) se è stato condannato per un reato che incida sulla sua moralità professionale, con sentenza passata in giudicato;

(b) if they have received a sentence, passed by final judgment, for an offence against professional ethics;

c) se ha commesso una grave violazione dei doveri professionali;

(c) if they are guilty of serious professional misconduct;

d) se non è in regola con gli obblighi relativi al pagamento dei contributi assistenziali e previdenziali, d'imposte e di tasse;

(d) if they are in breach of the rules regarding the payment of social security contributions, taxes or dues;

e) se non dispone della capacità finanziaria, tecnica e professionale necessaria per realizzare l'azione in base alle informazioni precisate all'allegato I, punto 3, lettere c) e d).

(e) if they do not have the financial, technical or professional capacity required to implement the measure in the light of the information given in Annex I(3)(c) and (d).

Oltre alle azioni di cui all'articolo 2, paragrafo 3, del regolamento (CE) n. 814/2000, non sono ammesse le seguenti azioni:

Besides the measures set out in Article 2(3) of Regulation (EC) No 814/2000, the following shall not be eligible:

a) le azioni che hanno scopo di lucro;

(a) profit-making measures;

1. I programmi d'attività sono esclusi nei casi seguenti:

1. Work programmes shall be excluded where they:

a) se iniziano prima della data indicata nell'invito a presentare proposte;

(a) commence before the date specified in the call for proposals;

b) se si concludono dopo il 30 aprile dell'anno successivo a quello del contributo finanziario;

(b) end after 30 April of the year following that of the financial contribution;

c) se comportano una domanda di sovvenzione inferiore a 25000 EUR e superiore a 500000 EUR.

(c) involve an application for a grant of less than EUR 25000 or more than EUR 500000

2. Le azioni specifiche sono escluse nei casi seguenti:

a) se iniziano meno di tre mesi dopo l'inoltro alla Commissione della domanda di sovvenzione;

(a) commence less than three months after submission of the grant application to the Commission;

(b) end after 30 April of the year following that of the financial contribution;

c) se comportano una domanda di sovvenzione inferiore a 5000 EUR e superiore a 100000 EUR.

Criteri di selezione delle azioni

Selection criteria for measures

1. La Commissione seleziona le domande ammesse al beneficio del finanziamento comunitario in base ai criteri della qualità del progetto e di un buon rapporto costo-efficacia, previsti dall'articolo 3, paragrafo 2, del regolamento (CE) n. 814/2000.

1. The Commission shall select the applications to receive Community financing on the basis of the quality of the project and its cost-effectiveness, as laid down in Article 3(2) of Regulation (EC) No 814/2000.

2. La qualità del progetto è valutata segnatamente tenendo conto di quanto segue:

2. The quality of projects shall be appraised, inter alia, on the basis of:

a) pertinenza ed interesse generale delle azioni;

(a) their relevance and general interest;

b) dimensione e plusvalore comunitario;

(b) their Community dimension and added value;

c) effetto moltiplicatore durevole a livello comunitario, nazionale e regionale;

(c) their lasting multiplier effect at Community, national and regional level;

d) contributo allo sviluppo di una cooperazione multinazionale, interregionale o intersettoriale durevole;

(d) their contribution to the development of lasting multinational, interregional or intersectoral cooperation;

e) mezzi previsti per la valutazione delle azioni.

(e) the means contemplated for evaluating the measures.

3. Un buon rapporto costo-efficacia è valutato segnatamente tenendo conto di quanto segue:

3. Cost-effectiveness shall be appraised, inter alia, on the basis of:

a) congruità dei fondi presentati nella domanda;

(a) whether the budget submitted is reasonable;

b) contributo chiesto alla Commissione;

(b) the contribution requested from the Commission;

c) capacità dell'offerente di mobilitare altre fonti di finanziamento.

(c) the ability of the applicant to mobilise other sources of financing.

Tasso di contributo finanziario

Rate of financial assistance

1. Il tasso massimo del finanziamento comunitario per le azioni selezionate è del 50 % dei costi ammissibili come definiti all'allegato III.

1. The maximum rate of Community financing for the measures selected shall be 50 % of the eligible cost as defined in Annex III.

2. Il tasso massimo di finanziamento comunitario può essere aumentato fino al 75 % dei costi ammissibili per un'azione specifica o una o più attività di un programma, purché queste presentino un interesse eccezionale in relazione ai criteri di selezione e implichino quanto segue:

2. The maximum rate of Community financing may be increased to 75 % of the eligible costs for a specific measure or for one or more measures contained in a programme, on condition that they are of exceptional interest in terms of the selection criteria, and that they entail:

a) costi di interpretazione o di traduzione, in almeno quattro lingue ufficiali della Comunità o dei paesi candidati all'adesione, che rappresentino oltre il 20 % delle spese ammissibili e purché, con riguardo alle spese di interpretazione, vi siano almeno cinque partecipanti per lingua;

(a) costs of interpretation or translation into at least four of the official languages of the Community or of the applicant countries representing more than 20 % of the eligible costs, subject, in the case of interpretation, to there being at least five participants per language;

The applications selected shall be the subject of an agreement between the Commission and the beneficiaries covering the rights and obligations resulting from the Commission decision to award a grant.

Grants shall be awarded on a strictly annual basis and shall confer no right in subsequent years, even where the measure concerned forms part of a multiannual strategy.

Valutazione

Evaluation

Ai fini della valutazione delle azioni finanziate, prevista dall'articolo 7 del regolamento (CE) n. 814/2000, i beneficiari sono tenuti a fornire tutti gli elementi necessari e segnatamente di rispondere ai questionari e alle griglie di valutazione uniti ai formulari di domanda messi a loro disposizione dalla Commissione.

Beneficiaries shall provide everything required for the evaluation of financed measures pursuant to Article 7 of Regulation (EC) No 814/2000, and shall in particular complete the questionnaires and evaluation forms enclosed by the Commission with the application forms.

La Commissione procede alla valutazione entro quattro anni dall'entrata in vigore del presente regolamento.

The Commission shall carry out the evaluation four years at the latest after the entry into force of this Regulation.

Misure transitorie

Transitional measures

1. Per l'anno 2000 e in deroga all'articolo 2, le persone che desiderano beneficiare di una sovvenzione comunitaria in forza dell'articolo 2, paragrafo 1, lettere a) o b), del regolamento (CE) n. 814/2000 ne presentano domanda alla Commissione, secondo le disposizioni del presente regolamento. La domanda deve essere trasmessa alla Commissione almeno tre mesi prima dell'inizio dell'azione e comunque non oltre il 30 settembre 2000.

1. For 2000 and notwithstanding Article 2, persons wishing to receive a Community grant Article 2(1)(a) or (b) of Regulation (EC) No 814/2000 must submit a grant application to the Commission in accordance with this Regulation. The applications must be sent to the Commission at least three months before the commencement of the measures concerned, and in any event no later than 30 September 2000.

PRESENTAZIONE E CONTENUTO DELLE DOMANDE DI SOVVENZIONE

SUBMISSION AND CONTENT OF GRANT APPLICATIONS

1. Le domande di sovvenzione devono:

a) essere presentate nei termini impartiti;

(a) submitted within the time limit laid down;

b) essere completamente e correttamente compilate e dattiloscritte;

(b) fully and correctly completed, and typewritten;

c) essere trasmesse in cinque copie, tutte firmate e datate dalla persona responsabile dell'azione(1), utilizzando i formulari di domanda di sovvenzione originali ottenibili presso i servizi della Commissione; qualora l'azione abbia luogo in tutto o in parte al di fuori della Comunità, deve essere presentata una copia supplementare;

(c) submitted in five copies, all signed and dated by the person responsible for the measure(1), using the original grant application forms available from the Commission; where all or part of the measure is to be implemented outside the Community, an additional copy must be supplied;

COSTI AMMISSIBILI

ELIGIBLE COSTS

1. Per essere ammissibili, le spese devono rispondere ai seguenti criteri:

b) devono essere indispensabili per realizzare l'azione e devono rispettare le migliori condizioni disponibili sul mercato.

b) alla realizzazione delle azioni (costi di produzione, onorari dei conferenzieri, locazione degli impianti e delle attrezzature, interpretazione, stampa dei documenti, spese di partecipazione, spese di viaggio, ecc.);

(b) implementing of the measures (production costs, speakers' fees, hire of facilities and equipment, interpretation, printing of documents, participation in events, travel expenses, etc.);

c) alla sorveglianza (rassegna stampa, divulgazione dei resoconti, valutazione ex-post, ecc.).

- le spese di prenotazione e di viaggio in seconda classe, per ferrovia, secondo l'itinerario più breve, su presentazione del titolo di trasporto(1),

- booking fees and the cost of second-class travel by train using the shortest route, on presentation of the ticket(1),

- le spese di viaggio in aereo, per gli spostamenti superiori a 800 km andata e ritorno, in classe economica, con applicazione delle tariffe promozionali più interessanti disponibili sul mercato (APEX, PEX, turistica, ...) e su presentazione del biglietto e della carta d'imbarco(2),

- the cost of air travel for return journeys of more than 800 km, in economy class, using the lowest available promotional fare (APEX, PEX, Excursion, etc.), on presentation of the ticket and boarding cards(2),

- le spese di viaggio interurbano in autobus, secondo l'itinerario più breve e su presentazione del titolo di trasporto o della fattura,

- the cost of intercity journeys by coach, using the shortest route, on presentation of the ticket or invoice,

- le spese di noleggio di autobus o di autovettura, a condizione che siano iscritte nel bilancio di previsione e siano debitamente giustificate, su presentazione della fattura,

- the cost of coach or car hire, provided that it is included in the forwarded budget and duly justified, on presentation of the invoice,

- le spese di viaggio con l'autovettura personale, in base alla tariffa applicabile per il viaggio per ferrovia in seconda classe o in autobus, secondo l'itinerario più breve, escluso qualsiasi supplemento; tali spese sono ammissibili su presentazione di una dichiarazione firmata dall'utente che indica le date di partenza e di ritorno, il luogo di partenza e di destinazione e un attestato di una compagnia ferroviaria o di trasporto su strada che specifica il costo di tale viaggio(3); le spese di benzina, parcheggio, pedaggio e vitto sostenute dalla persona che utilizza la propria autovettura non sono ammissibili,

- the cost of travel in a private car, based on second class rail or coach travel, using the shortest route, supplements excluded; such costs are eligible on presentation of a declaration signed by the user specifying the dates of departure and return and the point of departure and the destination and an attestation from a rail or coach company indicating the cost of such a journey(3); expenditure incurred by the user of a private car on petrol, parking, road tolls and meals is not eligible,

- nel limite di un importo massimo per giorno e per persona, ottenibile presso i servizi della Commissione; tale importo copre le spese di vitto e alloggio in gruppo nel quadro dell'azione, su presentazione delle fatture,

- up to a maximum amount per person per day (available from the Commission); this amount covers the cost of accomodation and of group meals taken in connection with implementation of the measure, on presentation of the invoices,

- nel limite di un importo forfetario pro capite, per pasto e per prima colazione, ottenibile presso i servizi della Commissione, nel caso in cui sia previsto che tutti o parte dei pasti non vengono consumati in gruppo,

- up to a maximum amount per person per meal (available from the Commission); where provision is made for some or all meals not to be taken together,

- le fatture d'albergo comuni sono ammissibili solo se indicano il numero di camera, i nomi delle persone e il numero di notti; le fatture del ristorante devono indicare il numero di coperti e un elenco dei commensali;

- joint hotels bills are eligible only where they indicate the number of rooms, the names of the persons concerned and the number of nights; restaurant bills must specifiy the number of diners and a list of diners must be attached;

d) le spese di interpretazione e di traduzione alle medesime condizioni delle spese di personale e nel limite di massimali ottenibili presso i servizi della Commissione;

(d) the cost of interpretation and translation, on the same conditions as personnel costs, up to maximum amounts (available from the Commission);

e) gli onorari di esperti o di conferenziali nel limite di un massimale ottenibile presso i servizi della Commissione, su presentazione di una fattura e della prova del pagamento e nella misura in cui non facciano parte di un'amministrazione pubblica nazionale, comunitaria o internazionale e non siano né membri né dipendenti dell'organizzazione beneficiaria della sovvenzione o di un'organizzazione ad essa associata o affiliata;

(e) the fees of experts or speakers, up to a maximum amount (available from the Commission), on presentation of an invoice and proof of payment, provided that the persons concerned are not national, Community or international civil servants or members or employees of the organisation receiving the grant or an associated or affiliated organisation;

f) la locazione della sala di conferenza e del materiale, su presentazione della fattura;

(f) the hire of conference halls and equipment, on presentation of the invoice;

g) la subfornitura, ma esclusivamente per i casi esplicitamente indicati nella convenzione; il beneficiario deve disporre almeno di tre proposte nel caso in cui il contratto verta su un importo superiore a 10000 EUR, deve fornire ai servizi della Commissione gli elementi che consentano di provare che il subfornitore scelto proponeva il miglior rapporto qualità-prezzo e giustificare la scelta se non si tratta del prezzo più conveniente; il subfornitore è soggetto alle medesime regole del beneficiario;

(g) subcontracting, but only in those cases stipulated in the agreement; where the contract is for an amount of more than EUR 10000, the beneficiary must obtain three tenders, provide the Commission with proof that the subcontractor selected represents the best value and justify that choice where the tender selected is not the cheapest; the subcontractor is subjet to the same rules as the beneficiary;

h) i costi di pubblicazione e spese di spedizione, le spese di produzioni audiovisive nonché le spese di personale, su presentazione delle fatture;

i) le altre spese derivanti da esigenze della convenzione di sovvenzione (revisione contabile, valutazioni specifiche dell'azione, rapporti, relazioni, traduzioni, cauzioni), su presentazione delle fatture;

(i) other costs arising from the requirements of the grant agreement (audits, specific valuations of the measure, reports, translations, securities, etc.), on presentation of the invoices;

j) un importo forfetario, nel limite del 7 % dei costi diretti ammissibili, che copre i costi di materiale consumabile, di forniture e di altre spese (sono incluse segnatamente fra queste spese: le spese per telefono, telecopia, Internet, fotocopie e l'insieme del materiale d'ufficio), nella misura in cui il beneficiario non riceva da altra parte sovvenzioni di funzionamento della Comunità;

(j) a fixed amount of up to 7 % of the direct eligible costs to cover the cost of consumables, supplies and other costs (including telephone, fax, couriers, Internet, photocopies and all office supplies), provided that the beneficiary is in receipt of no other operating costs grant from the European Community;

k) una riserva per imprevisti con un massimale del 5 % dei costi diretti ammissibili.

4. Non sono ammissibili:

c) i costi indiretti (affitto, elettricità, acqua, gas, assicurazioni, importe e tasse);

(c) indirect cost (rent, electricity, water, gas, insurance, taxes, etc.);

d) i costi per investimenti di capitale, le provvigioni, gli interessi debitori, le perdite di cambio, i regali e le spese voluttuarie.

(d) invested capital costs, contingency reserves, interest on debts owed, exchange rate losses, gifts and expenditure on luxuries.

5. Le date considerate per l'ammissibilità delle spese sono quelle che corrispondono al fatto generatore e non quelle che corrispondono al rilascio dei documenti contabili.

5. The dates taken into account for the eligibility of costs are the dates when the costs are generated and not the dates when the accounting documents are drawn up.

Non può essere presa in considerazione nessuna spesa generata prima della data d'inizio dell'azione come indicata nella convenzione di sovvenzione.

No expenditure generated before the date on which the measure commences as specified in the grant agreement may be taken into consideration.

6. Tutte le fatture devono essere redatte in debita forma, conformemente alla legislazione e alle regole del paese di cui trattasi e indicare l'importo e la percentuale dell'IVA. Le copie di cattiva qualità non saranno prese in considerazione.

6. All invoices must be made out in due and proper form in accordance with the legislation or rules of the country concerned and must specify the amount and percentage of VAT. Poor quality copies will not be taken into consideraiton.

7. Non potrà essere presa in considerazione nessuna spesa ingiustificata.

7. No unjustified item of expenditure will be taken into account.

8. Le spese devono essere state effettivamente sostenute, essere registrate nella contabilità o nei documenti fiscali del beneficiario ed essere identificabili e controllabili.

8. Costs must have actually been incurred, be recorded in the beneficiary's accounts or tax documents and be identifibale and verifiable.

9. Nel caso in cui fossero direttamente prese a carico da un altro finanziatore, eventuali spese ammissibili devono essere indicate nel bilancio di previsione e nel rendiconto finale alla voce "altri contributi" e devono essere conformi alle esigenze di cui ai punti 6, 7 e 8.

9. Where eligible costs are directly covered by another provider of funds, this must be specified in the forward budget and in the final accounts under "Other contributions" and fulfil the conditions laid down in paragraphs 6, 7 and 8.

(2) Se il trasporto ha luogo in un'altra classe, i costi sostenuti non sono ammissibili a meno che non sia presentato un attestato della compagnia di trasporto che precisa il costo in seconda classe: in tal caso le spese ammissibili sono limitate a detto importo.

(2) Where another class is used, expenses are eligible only on presentation of an attestation by the transport company indicating the cost of second class travel, in which case the eligible expenditure will be limited to that amount.

(3) In deroga, per i casi in cui non esistano trasporti pubblici e nel limite di 300 km per andata e ritorno, i costi ammissibili sono rimborsati a concorrenza di 0,25 EUR/km.

(3) By derogation, where there is no public transport link and for a return journey of up to 300 kilometres, the eligible cost shall be EUR 0,25 per kilometre.
