LA COMMISSIONE DELLE COMUNITÀ EUROPEE,	THE COMMISSION OF THE EUROPEAN COMMUNITIES,
visto il trattato che istituisce la Comunità europea,	Having regard to the Treaty establishing the European Community,
vista la direttiva 89/109/CEE del Consiglio, del 21 dicembre 1988, relativa al ravvicinamento delle legislazioni degli Stati membri concernenti i materiali e gli oggetti destinati a venire in contatto con i prodotti alimentari(1) , in particolare l' articolo 3,	Having regard to Council Directive 89/109/EEC of 21 December 1988 on the approximation of the laws of the Member States relating to materials and articles intended to come into contact with foodstuffs(1) and in particular Article 3 thereof,
sentito il comitato scientifico dell' alimentazione umana,	After consulting the Scientific Committee on Food,
considerando quanto segue:	Whereas:
(1) l' articolo 3 della direttiva 90/128/CEE della Commissione(2) , modificata da ultimo dalla direttiva 96/11/CE(3) , prevede una revisione dell' allegato II;	(1) Commission Directive 90/128/EEC(2) , as last amended by Directive 96/11/EC(3) , provides in Article 3(2) for the revision of Annex II thereto.
(2) in base alle informazioni disponibili, alcuni monomeri provvisoriamente ammessi a livello nazionale possono essere inclusi nell' elenco comunitario;	(2) On the basis of the information available, certain monomers provisionally admitted at national level may be included in the Community list.
(3) successivamente all' adozione della direttiva 90/128/CEE è stato chiesto l' uso di altri monomeri i cui dati tecnici disponibili ne consentono l' inserimento nell' elenco comunitario;	(3) Other monomers have been requested for use following the adoption of Directive 90/128/EEC: the technical data supplied permit their inclusion in the Community list.
(4) l' allegato III della direttiva 90/128/CEE contiene un elenco incompleto degli additivi che dovrebbe essere modificato al fine di aggiungere altri additivi valutati approfonditamente dal comitato scientifico dell' alimentazione umana;	(4) Annex III to Directive 90/128/EEC includes a list of additives, which should be amended so as to include other additives fully evaluated by the Scientific Committee on Food.
(5) per alcune sostanze le restrizioni già esistenti dovrebbero essere modificate in base alle informazioni disponibili;	(5) For certain substances, the restrictions already set out should be amended according to the information available.
(6) l' attuale elenco complessivo degli additivi è incompleto e non contiene quindi tutte le sostanze attualmente accettate in almeno uno Stato membro e che tali sostanze possono continuare ad essere disciplinate dalle legislazioni nazionali in attesa di una decisione sulla loro inclusione nell' elenco comunitario;	(6) The current total list of additives is an incomplete list inasmuch as it does not contain all the substances which are currently accepted in one or more Member States; accordingly, these substances continue to be regulated by national laws pending a decision on inclusion in the Community list.
(7) la presente direttiva deve stabilire i criteri di purezza solamente per alcune sostanze e pertanto le altre sostanze che potrebbero richiedere criteri di purezza continuano ad essere disciplinate al riguardo dalla legislazione nazionale in attesa di una decisione a livello comunitario;	(7) This Directive establishes purity criteria for only a few substances, and therefore the other substances which may require purity criteria remain regulated in this respect by national laws pending a decision at Community level.
(8) le misure comunitarie previste dalla presente direttiva non vanno oltre quanto necessario per raggiungere gli obiettivi già stabiliti nella direttiva 89/109/CEE;	(8) The measures contained in this Directive do not go beyond what is necessary to achieve the objectives already provided for in Directive 89/109/EEC.

HA ADOTTATO LA PRESENTE DIRETTIVA:	HAS ADOPTED THIS DIRECTIVE:
Articolo 1	Article 1
La direttiva 90/128/CEE è così modificata:	Directive 90/128/EEC is amended as follows:
1) All' articolo 3, paragrafo 5, il quarto trattino è soppresso.	1. the fourth indent of Article 3(5) is deleted;
2) L' articolo 3 bis è sostituito dal seguente:	2. Article 3a is replaced by the following:

L' allegato III contiene un elenco incompleto di additivi che possono essere utilizzati nella fabbricazione di materiali e oggetti di materia plastica conformemente alle restrizioni in esso specificate" .	An incomplete list of additives which may be used for the manufacture of plastic materials and articles, together with the restrictions on their use, is set out in Annex III" ;
3) Sono inseriti i seguenti articoli 3 ter e 3 quater:	3. the following Articles 3b and 3c are inserted:

Come prodotti ottenuti mediante fermentazione batterica, solamente quelli elencati nell' allegato IV possono venire a contatto con i prodotti alimentari.	Only the products obtained by means of bacterial fermentation listed in Annex IV may be used in contact with foodstuffs.
Articolo 3 quater	Article 3c
1. Le specifiche relative ad alcune sostanze elencate negli allegati II, III e IV figurano nell' allegato V.	1. The specifications relating to some substances appearing in Annexes II, III and IV are laid down in Annex V.
2. Il significato dei numeri indicati tra parentesi nella colonna ' Restrizioni e/o specifiche' figura nell' allegato VI."	2. The meaning of the numbers between brackets appearing in the Column ' Restrictions and/or specifications' is explained in Annex VI" ;
4) L' allegato II è modificato conformemente all' allegato I della presente direttiva.	4. Annex II is amended as shown in Annex I to this Directive;
5) L' allegato III è modificato conformemente all' allegato II della presente direttiva.	5. Annex III is amended as shown in Annex II to this Directive;

Articolo 2	Article 2
1. Gli Stati membri mettono in vigore le disposizioni legislative, regolamentari ed amministrative necessarie per conformarsi alla presente direttiva entro il 31 dicembre 2000. Essi ne informano immediatamente la Commissione.	1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive not later than 31 December 2000. They shall immediately inform the Commission thereof.
Gli Stati membri autorizzano, a decorrere dal 1o gennaio 2002, il commercio e l' uso di materiali e oggetti in materia plastica destinati a venire in contatto con i prodotti alimentari conformi alle disposizioni della presente direttiva.	Member States shall permit, as from 1 January 2002, the trade in and use of plastic materials and articles intended to come into contact with foodstuffs and complying with this Directive.
Essi vietano, a decorrere dal 1o gennaio 2003, la fabbricazione e l' importazione nella Comunità di materiali e oggetti in materia plastica destinati a venire in contatto con i prodotti alimentari e non conformi alla presente direttiva.	They shall prohibit, as from 1 January 2003, the manufacture and importation into the Community of plastic materials and articles intended to come into contact with foodstuffs and which do not comply with this Directive.
2. Quando gli Stati membri adottano le disposizioni di cui al paragrafo 1, queste contengono un riferimento alla presente direttiva o sono corredate di siffatto riferimento all' atto della pubblicazione ufficiale. Le modalità di tale riferimento sono decise dagli Stati membri.	2. When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.
Articolo 3	Article 3
La presente direttiva entra in vigore il ventesimo giorno successivo alla pubblicazione nella Gazzetta ufficiale delle Comunità europee.	This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Communities.
Articolo 4	Article 4
Gli Stati membri sono destinatari della presente direttiva.	This Directive is addressed to the Member States.

Tuttavia, per i simulanti degli alimenti acquosi, l' LMS(T) dovrebbe includere anche il Badge.2H20 (c) a meno che l' etichetta del materiale o del prodotto indichi la possibilità di utilizzarlo soltanto a contatto con quel tipo di alimenti e/o bevande per i quali è stato dimostrato che la somma dei livelli di migrazione delle cinque succitate sostanze a) , b) , d) e f) , non può superare 1 mg/kg.	However in aqueous food simulants, the SML(T) should also include Badge.2H2O (c) unless the material or article is labelled for use in contact only with those foods and/or beverages for which it has been demonstrated that the sum of the migration levels of the five abovementioned substances (a) (b) (d) (e) (f) cannot exceed 1 mg/kg.
