visto il trattato che istituisce la Comunità europea,	Having regard to the Treaty establishing the European Community,
visto il regolamento (CEE) n. 3528/86 del Consiglio, del 17 novembre 1986, relativo alla protezione delle foreste nella Comunità contro l'inquinamento atmosferico(1), modificato da ultimo dal regolamento (CE) n. 307/97(2), in particolare gli articoli 2 e 4,	Having regard to Council Regulation (EEC) No 3528/86 of 17 November 1986 on the protection of the Community's forests against atmospheric pollution(1), as last amended by Regulation (EC) No 307/97(2), and in particular Articles 2 and 4 thereof,
considerando quanto segue:	Whereas:
(1) il regolamento (CEE) n. 3528/86 prevede una partecipazione finanziaria della Comunità alle misure che l'azione comunitaria comporta per la protezione delle foreste contro l'inquinamento atmosferico;	(1) Regulation (EEC) No 3528/86 provides for a financial contribution from the Community to measures under the Community scheme for the protection of forests against atmospheric pollution.
(2) l'articolo 12 del citato regolamento prevede che tale partecipazione verte sull'inventario periodico dei danni cagionati alle foreste, segnatamente dall'inquinamento atmosferico, sulla rete dei posti d'osservazione per la sorveglianza intensiva e continua degli ecosistemi forestali, delle esperienze, dei progetti pilota e delle dimostrazioni per accrescere la protezione delle foreste contro l'inquinamento atmosferico;	(2) Article 12 of that Regulation stipulates that the Community's contribution is to cover the periodic inventory of damage caused to forests, in particular by atmospheric pollution, the network of observation points for intensive and continuous monitoring of the forest ecosystems, experiments, and pilot and demonstration projects to improve the protection of forests against atmospheric pollution.
(3) nell'intento di garantire l'efficacia, la semplificazione e la razionalizzazione delle procedure a livello nazionale e comunitario, occorre raggruppare ogni anno, a livello dello Stato membro e sotto forma di un programma nazionale, le varie azioni per le quali è chiesto un contributo finanziario comunitario;	(3) In the interests of effectiveness and in order to simplify and rationalise procedures at national and Community level, the various measures for which Community financial assistance is requested should be brought together in an annual national programme for each Member State.
(4) occorre stabilire, per il programma nazionale, le modalità di presentazione della domanda di contributo e gli elementi che il programma stesso deve includere onde agevolarne l'istruzione;	(4) Detailed rules should be adopted on how aid applications under the national programmes should be presented and the information they must contain in order to expedite examination thereof.
(5) occorre prevedere un sistema di anticipi del contributo finanziario della Comunità affinché lo Stato membro possa garantire una gestione finanziaria appropriata del programma nazionale;	(5) A system of advance payments of Community assistance should be introduced to assist Member States in the proper financial management of their national programmes.
(6) le domande di anticipi e di pagamento del saldo del programma nazionale presentate dalle autorità competenti alla Commissione devono includere taluni dati intesi ad agevolare l'esame della regolarità delle spese;	(6) The applications submitted to the Commission by the competent authority for the payment of advances and balances under the national programme must contain certain information to help establish the regularity of expenditure.
(7) la Commissione deve essere informata che la realizzazione delle azioni si svolge nelle condizioni e nei tempi previsti dalla decisione di concessione del contributo;	(7) The Commission must be informed that the measures are being implemented in accordance with the conditions and within the time limit laid down in the decision granting aid.
(8) gli Stati membri devono adottare le disposizioni necessarie per garantire un controllo efficace della realizzazione delle azioni del programma nazionale;	(8) The Member States must adopt the provisions necessary to ensure that effective checks are carried out on the implementation of measures under the national programmes.
(9) a norma dell'articolo 14 del regolamento (CEE) n. 3528/86 e del regolamento (CE, Euratom) n. 2988/95 del Consiglio, del 18 dicembre 1995, relativo alla tutela degli interessi finanziari delle Comunità(3), gli Stati membri devono accertarsi dell'effettiva e regolare esecuzione delle operazioni finanziate dalla Comunità e recuperare le somme perdute a seguito di irregolarità o negligenze. Detti importi rappresentano spese non giustificate per il bilancio comunitario che vanno quindi rimborsate alla Comunità;	(9) Article 14 of Regulation (EEC) No 3528/86 and Council Regulation (EC, Euratom) No 2988/95 of 18 December 1995 on the protection of the European Communities' financial interests(3) require the Member States to ascertain the effective and regular nature of the operations financed by the Community and to recover sums lost as a result of irregularities or negligence. Such sums represent unjustified expenditure from the Community budget and must therefore be reimbursed to the Community.
(10) se i controlli della Commissione previsti all'articolo 14 del regolamento (CEE) n. 3528/86 mettono in luce un'irregolarità, lo Stato membro dovrebbe avere la possibilità di pronunciarsi sulla situazione riscontrata. Se si ha conferma dell'irregolarità e che quindi gli importi di cui trattasi costituiscono spese non giustificate per il bilancio comunitario, questi ultimi dovrebbero essere rimborsati alla Comunità;	(10) If the checks provided for in Article 14 of Regulation (EEC) No 3528/86 carried out by the Commission reveal an irregularity, the Member State must be able to express its opinion on the situation noted. Where the irregularity is confirmed and the sums concerned represent unjustified expenditure from the Community budget, they should be reimbursed to the Community.
(11) occorre pertanto abrogare il regolamento (CEE) n. 526/87 della Commissione(4), l'articolo 2 del regolamento (CEE) n. 1696/87 della Commissione(5), modificato da ultimo dal regolamento (CE) n. 1398/95(6), e l'articolo 2 del regolamento (CE) n. 1091/94 della Commissione(7), modificato da ultimo dal regolamento (CE) n. 1545/1999(8);	(11) Commission Regulation (EEC) No 526/87(4), Article 2 of Commission Regulation (EEC) No 1696/87(5) as last amended by Regulation (EC) No 1398/95(6) and Article 2 of Commission Regulation (EC) No 1091/94(7), as last amended by Regulation (EC) No 1545/1999(8) should be repealed.
(12) occorre altresì abrogare il regolamento (CEE) n. 1697/87 della Commissione(9). Quest'ultimo regolamento resta tuttavia applicabile ai pagamenti delle partecipazioni finanziarie della Comunità a norma del regolamento (CEE) n. 3528/86 decise anteriormente al 1o novembre 1999;	(12) The Commission Regulation (EEC) No 1697/87(9) of 10 June 1987 should also be repealed. That Regulation remains applicable to the payment of Community financial contributions under Regulation (EEC) No 3528/86 decided before 1 November 1999.

HA ADOTTATO IL PRESENTE REGOLAMENTO:	HAS ADOPTED THIS REGULATION:
Articolo 1	Article 1
1. Le misure di cui agli articoli 2 e 4 del regolamento CEE n. 3528/86 sono raggruppate nell'ambito dei programmi che devono essere elaborati ogni anno a livello nazionale. Il programma nazionale deve includere l'insieme delle domande di contributo presentate a norma dei precitati articoli. Esso deve contenere i dati e i documenti elencati all'allegato I del presente regolamento e vertere sugli elementi di cui all'articolo 2. Ogni anno, anteriormente al 1o novembre, lo Stato membro presenta alla Commissione il programma per l'anno successivo, in duplice copia.	1. The measures provided for in Articles 2 and 4 of Regulation (EEC) No 3528/86 shall be implemented under programmes to be drawn up each year by the Member States. National programmes must cover all the applications for assistance submitted under those Articles. They must contain the information and supporting documents indicated in Annex I to this Regulation and relate to the information specified in Article 2. Each year, before 1 November, the Member States shall send the Commission their programmes for the next year in duplicate.
2. La realizzazione del programma nazionale di cui al paragrafo 1 del presente articolo deve essere conclusa entro tre anni dalla data di notifica della decisione della Commissione relativa al suo finanziamento, senza possibilità di proroga.	2. National programmes as referred to in paragraph 1 must be completed not later than three years after the date of notification of the Commission Decision on financing and may not be extended.
Articolo 2	Article 2
Il programma di cui all'articolo 1 deve inoltre includere:	Programmes as referred to in Article 1 must also comprise:
- una descrizione dei documenti giustificativi che i beneficiari sono tenuti a fornire; per documenti giustificativi si intendono tutti quei documenti, redatti conformemente alle disposizioni legislative o regolamentari dello Stato membro interessato, o conformemente alle misure adottate dall'autorità competente, atte a provare che le condizioni prescritte per ciascuna domanda individuale sono state soddisfatte. La descrizione contiene la designazione dei documenti giustificativi e il riferimento alle disposizioni o misure in base alle quali sono stati elaborati nonché una sintesi del contenuto di tali documenti.	- a schedule of the supporting documents to be provided by beneficiaries; "supporting documents" means any document drawn up in accordance either with the laws or regulations of the Member State concerned, or with measures adopted by the competent authority, which afford evidence that the conditions attached to each individual application have been met. The schedule shall give the description of each document and the provisions or measures under which it is drawn up and a brief description of the content of such documents;
- il modello dei formulari con i quali i beneficiari presentano la loro domanda di pagamento. - una descrizione dei metodi di controllo e di gestione definiti per garantire l'attuazione efficace delle azioni del programma, in applicazione dell'articolo 14 del regolamento (CEE) n. 3528/86.	- a description of the checking and management methods put in place to ensure the effective implementation of measures under the programme, pursuant to Article 14 of Regulation (EEC) No 3528/86.
Lo Stato membro comunica inoltre alla Commissione gli aggiornamenti successivi della documentazione di cui al presente paragrafo.	Member States shall also notify the Commission of subsequent updates of the documentation referred to in this Article.
Articolo 3	Article 3
1. Conformemente all'articolo 13 del regolamento (CEE) n. 3528/86, lo Stato membro designa l'autorità competente responsabile dell'esecuzione del programma.	1. In accordance with Article 13 of Regulation (EEC) No 3528/86, the Member State shall designate the competent authority empowered to carry out the programme.
2. L'autorità competente può chiedere un anticipo pari al massimo al 50 % del contributo finanziario comunitario del programma nazionale al più presto il 1o gennaio dell'anno successivo alla data di notifica della decisione della Commissione relativa al finanziamento del programma.	2. The competent authorities may apply for an advance of up to 50 % of the Community assistance to the national programme not earlier than 1 January of the year following the date of notification of the Commission Decision on the financing of the programme.
3. Un secondo anticipo del 30 % al massimo può essere chiesto dall'autorità competente quando quest'ultima fornisce la prova che il 60 % del primo anticipo relativo al medesimo programma è stato utilizzato.	3. Competent authorities may apply for a second advance of not more than 30 % once they have furnished proof that 60 % of the first advance for the same programme has been utilised.
4. Il pagamento del saldo sarà effettuato previo ricevimento e approvazione, da parte della Commissione, della relazione finale, di un riepilogo finanziario definitivo e della domanda di pagamento finale del programma nazionale.	4. The balance shall be paid after the Commission has received and approved the final report, a definitive financial statement and the application for the final payment for the national programme.
Articolo 4	Article 4
1. L'autorità competente trasmette, ogni semestre, a decorrere dal 1o luglio dell'anno successivo alla data di notifica della decisione della Commissione relativa al finanziamento del programma, un riepilogo dei versamenti effettuati ai beneficiari, conformemente all'allegato II, unitamente ad uno stato di avanzamento dei lavori.	1. From 1 July of the year following the date of notification of the Commission Decision on the financing of the programme, the competent authorities shall forward six-monthly statements of the payments made to beneficiaries, in accordance with Annex II and accompanied by a statement describing the state of progress of the work.
2. Le domande di pagamento di anticipi e del saldo relativi al programma nazionale vanno presentati alla Commissione, in duplice copia, dall'autorità competente, conformemente all'allegato III del presente regolamento.	2. The competent authorities must submit applications for the payment of advances and balances for the national programme to the Commission, in duplicate, in accordance with Annex III hereto.
Articolo 5	Article 5
1. Quando recupera somme perdute a seguito di irregolarità o negligenze, lo Stato membro è tenuto a rimborsarle alla Comunità.	1. Any amounts lost through irregularities or negligence and recovered by a Member State shall be reimbursed to the Community.
2. Quando la Commissione constata, nel termine di quattro anni dal pagamento del saldo, un'irregolarità concernente un'operazione finanziata dalla Comunità e la somma in questione non è stata rimborsata alla Comunità a norma del paragrafo 1, essa presenta la situazione allo Stato membro in questione dandogli la facoltà di presentare le sue osservazioni.	2. Should the Commission, within four years following payment of the balance, note any irregularity in an operation financed by the Community where the amount concerned has not been reimbursed to the Community under paragraph 1, it shall inform the Member State thereof and give it an opportunity to comment.
3. Se, dopo aver esaminato la situazione e le eventuali osservazioni dello Stato membro in questione, la Commissione constata che l'irregolarità è confermata, lo Stato membro deve rimborsare le somme di cui trattasi.	3. If analysis of the situation and any comments by the Member State result in the Commission confirming the irregularity, the Member State shall reimburse the amounts concerned.
Articolo 6	Article 6
Il regolamento (CEE) n. 526/87, l'articolo 2 del regolamento (CEE) n. 1696/87 e l'articolo 2 del regolamento (CE) n. 1091/94 sono abrogati.	Regulation (EEC) No 526/87, Article 2 of Regulation (EEC) No 1696/87 and Article 2 of Regulation (EC) No 1091/94 are repealed.
Articolo 7	Article 7
Il regolamento (CEE) n. 1697/87 è abrogato. Esso rimane tuttavia applicabile ai pagamenti delle partecipazioni finanziarie della Comunità a norma del regolamento (CEE) n. 3528/86 decise anteriormente al 1o novembre 1999.	Regulation (EEC) No 1697/87 is repealed. However, it shall continue to apply to the payment of Community financial contributions under Regulation (EEC) No 3528/86 decided before 1 November 1999.
Articolo 8	Article 8
Il presente regolamento entra in vigore il terzo giorno successivo alla pubblicazione nella Gazzetta ufficiale delle Comunità europee.	This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Communities.
Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri.	This Regulation shall be binding in its entirety and directly applicable in all Member States.

Experiments and monitoring activities presented to the Commission with a view to their part-financing under Regulation (EEC) No 3528/86 on the protection of the Community's forests against atmospheric pollution are to be collected together each year in one programme per Member State, Community financial assistance will be paid per programme to the competent authorities designated by the Member States which will then reimburse the respective responsible bodies.

Formulari:	Forms
I seguenti formulari devono essere utilizzati per la presentazione dei programmi:	The following forms must be used for the prersentation of the programmes:
- una scheda di sintesi del programma (formulario 1),	- a short description of the programme (form 1);
- una scheda di programmazione finanziaria (formulario 1b),	- a financial plan for the programme (form 1b);
- schede di informazione generale (formulari 2 e 3),	- general information (forms 2 and 3);
- schede di informazione specifica (formulari 2a, 2b, 2c, 2d).	- specific information (forms 2a, 2b, 2c and 2d).
La scheda di sintesi del programma contiene informazioni amministrative sull'autorità nazionale competente e informazioni sintetiche su tutte le domande individuali allegate, incluso un calendario. La scheda di sintesi del programma deve essere debitamente datata, firmata e timbrata dall'autorità nazionale richiedente. Il nome del firmatario deve figurare sotto la firma in caratteri leggibili. La scheda di programmazione finanziaria contiene informazioni relative all'impiego del contributo finanziario comunitario. A ciascuna domanda individuale di cofinanziamento sono allegate una scheda di informazione generale (formulario 2 per le azioni di cui all'articolo 2, formulario 3 per le azioni di cui all'articolo 4), contenente informazioni generali sulle domande individuali e una scheda di informazione specifica (formulari 2a e/o 2b, e/o 2c, e/o 2d), contenente informazioni tecniche. Le schede di informazione generale devono essere debitamente datate, firmate e timbrate dal rappresentante del richiedente. Il nome del firmatario deve figurare sotto la firma in caratteri leggibili.	The programme description form contains administrative information on the competent national authority and summary information on the various individual applications in the programme, along with a timetable. The form must bear the stamp of the competent national authority and be duly signed and dated by it, with the name of the signatory indicated below the signature. The financial plan for the programme contains information on the planned use of the Community financial assistance. A general information form (containing general information on the individual applications) and a specific information form (containing technical information on the individual applications) must be completed for each individual application for assistance (form 2 for Article 2 activities, form 3 for Article 4; forms 2a and/or 2b, and/or 2c, and/or 2d for technical information). The general information forms must bear the seal of the competent national authority and be duly signed and dated by it, with the name of the signatory indicated below the signature.
