Whereas:

(1) La direttiva 2000/29/CE del Consiglio, dell'8 maggio 2000, concernente le misure di protezione contro l'introduzione nella Comunità di organismi nocivi ai vegetali o ai prodotti vegetali e contro la loro diffusione nella Comunità(4) stabilisce il regime fitosanitario comunitario e specifica le condizioni, le procedure e le formalità in materia fitosanitaria alle quali sono soggette le importazioni o i movimenti di vegetali e di prodotti vegetali nella Comunità.

(1) Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community(4) sets out the Community plant health regime, specifying the phytosanitary conditions, procedures and formalities to which plants and plant products are subjected when introduced into, or moved within, the Community.

(2) Con riferimento alle procedure e alle formalità che devono essere rispettate per l'introduzione dei vegetali e dei prodotti vegetali nella Comunità appaiono necessari alcuni chiarimenti e, in certi settori, è necessario definire ulteriori modalità di applicazione.

(2) With respect to the procedures and formalities, to which plants and plant products are subjected when introduced in the Community, certain clarifications should be provided and further detailed provisions are required in certain areas.

(3) È opportuno che le procedure e le formalità fitosanitarie siano espletate prima dello sdoganamento. Poiché le spedizioni di vegetali o prodotti vegetali non sono necessariamente sottoposte alle procedure e alle formalità fitosanitarie nello stesso Stato membro in cui ha luogo lo sdoganamento, è necessario istituire un sistema di cooperazione per lo scambio di comunicazioni e informazioni tra gli organismi ufficiali responsabili e gli uffici doganali.

(3) The phytosanitary procedures and formalities should be completed before customs clearance takes place. Since consignments of plants or plant products do not necessarily undergo phytosanitary procedures and formalities in the same Member State as that in which customs clearance takes place, a system of cooperation in communication and information among the responsible official bodies and the customs offices should be established.

(4) Per migliorare la protezione contro l'introduzione nella Comunità di organismi nocivi ai vegetali o ai prodotti vegetali è opportuno che gli Stati membri intensifichino i controlli, i quali dovrebbero essere efficaci ed effettuati secondo modalità armonizzate nell'intera Comunità.

(4) In order to improve the protection against the introduction into the Community of organisms harmful to plants or plant products, Member States should intensify the checks required. Those checks should be effective and carried out in a harmonised manner throughout the Community.

(5) È inoltre opportuno che le tasse applicate per effettuare i controlli si basino su un calcolo dei costi trasparente e siano il più possibile armonizzate in tutti gli Stati membri.

(5) The fees charged for such checks should be based on a transparent cost calculation and aligned in all Member States as much as possible.

(6) Alla luce dell'esperienza è opportuno completare, chiarire o aggiornare varie altre disposizioni della direttiva 2000/29/CE.

(6) In the light of experience, several other provisions of Directive 2000/29/EC should be completed, clarified or amended in the light of developments.

(7) A partire dall'attuazione del mercato interno, i certificati fitosanitari istituiti dalla convenzione internazionale per la protezione dei vegetali (CIPV) dell'Organizzazione delle Nazioni Unite per l'alimentazione e l'agricoltura (FAO) non sono più utilizzati per la commercializzazione dei vegetali e dei prodotti vegetali all'interno della Comunità. È tuttavia importante conservare i certificati standardizzati rilasciati dagli Stati membri ai sensi della CIPV.

(7) Since the implementation of the conditions of the internal market, phytosanitary certificates as established in the International Plant Protection Convention (IPPC) of the Food and Agriculture Organisation (FAO) are no longer used for the marketing of plants or plant products within the Community. It is however important to keep standardised certificates issued by Member States under the IPPC.

(8) Alcune delle funzioni dell'"autorità unica" di ogni Stato membro in materia di coordinamento e di contatto per il funzionamento pratico del regime fitosanitario comunitario presuppongono specifiche conoscenze tecniche e scientifiche. È pertanto necessario prevedere la facoltà di delegare determinati compiti ad un altro servizio.

(8) Some of the functions of the "single authority" of each Member State for coordination and contact in the practical operations of the Community plant health regime require specific scientific or technical knowledge. It must therefore be made possible, to delegate specific tasks to another service.

(9) Le disposizioni vigenti in materia di modificazioni degli allegati della direttiva 2000/29/CE ad opera della Commissione e di adozione di decisioni di deroga comprendono determinati requisiti di carattere procedurale che non appaiono più giustificati né necessari. È altresì necessario basare in modo più esplicito le modifiche degli allegati su una giustificazione coerente con il rischio fitosanitario esistente. La procedura di adozione di misure di emergenza non permette attualmente l'adozione rapida di misure provvisorie commisurate al grado di urgenza che presentano determinati casi. Occorre quindi modificare le disposizioni relative a queste tre procedure.

(9) The current provisions on the procedure for the amendment of the Annexes of Directive 2000/29/EC by the Commission and for the adoption of derogation decisions include some procedural conditions which are no longer necessary or justified. It is also necessary to base amendments to the Annexes, more explicitly, on a technical justification consistent with the pest risk involved. The procedure for the adoption of emergency measures does not provide the possibility for a rapid adoption of interim measures consistent with the level of emergency in specific cases. The provisions on these three procedures should therefore be amended accordingly.

(10) Occorre ampliare la competenze della Commissione in materia di controlli fitosanitari da eseguire sotto la sua autorità per tener conto dell'ampliamento della portata delle attività fitosanitarie riconducibile a nuove pratiche e nuove esperienze.

(10) The list of tasks in respect of which the Commission may organise plant health checks under its authority, should be extended, to take into account the widening of the field of plant health activities through new practices and experiences.

(11) È opportuno chiarire taluni aspetti della procedura per il rimborso del contributo fitosanitario comunitario.

(11) It is appropriate to clarify certain aspects of the procedure for the refunding of the Community Phytosanitary contribution.

(12) Nella direttiva 2000/29/CE continuano a figurare alcune disposizioni (l'articolo 3, paragrafo 7, primo, secondo e quarto comma e gli articoli 7, 8 e 9) che erano state sostituite da altre disposizioni dal 1o giugno 1993 e sono pertanto obsolete. Occorre pertanto abrogarle.

(12) Some provisions of Directive 2000/29/EC (first, second and fourth subparagraphs of Article 3(7)), as well as Articles 7, 8 and 9 have been superseded by other provisions since 1 June 1993, and have therefore become redundant since then. They should consequently be deleted.

(13) A norma dell'articolo 4 dell'accordo sull'applicazione di misure sanitarie e fitosanitarie (accordo SPS) la Comunità è tenuta a riconoscere l'equivalenza delle misure fitosanitarie adottate dagli altri membri dell'accordo, a determinate condizioni. È opportuno precisare tali procedure di riconoscimento nel settore fitosanitario nel quadro della direttiva 2000/29/CE.

(13) Under Article 4 of the Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement), the Community must recognise, under certain conditions, the equivalence of phytosanitary measures of other Parties to that Agreement. The procedures for such recognition in the field of plant health should be specified in Directive 2000/29/EC.

(14) Le misure necessarie per l'attuazione della direttiva 2000/29/CE sono adottate secondo la decisione 1999/468/CE del Consiglio, del 28 giugno 1999, recante modalità per l'esercizio delle competenze di esecuzione conferite alla Commissione(5),

(14) The measures necessary for the implementation of Directive 2000/29/EC should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(5),

HA ADOTTATO LA PRESENTE DIRETTIVA:

HAS ADOPTED THIS DIRECTIVE:

Articolo 1

Article 1

La direttiva 2000/29/CE è modificata come segue:

Directive 2000/29/EC is hereby amended as follows:

1) l'articolo 1 è modificato come segue:

1. Article 1 shall be amended as follows:

a) al paragrafo 1, secondo comma è aggiunta la seguente lettera: "d) il modello dei 'certificati fitosanitari' e 'certificati fitosanitari di riesportazione' o i loro equivalenti elettronici rilasciati dagli Stati membri nell'ambito della convenzione internazionale per la protezione delle piante (CIPV).";

(a) in the second subparagraph of paragraph 1, the following point shall be added: "(d) the model of 'Phytosanitary Certificates' and 'phytosanitary certificates for Re-export' or their electronic equivalent issued by Member States under the International Plant Protection Convention (IPPC).";

b) il paragrafo 4 è sostituito dal seguente: "4. Gli Stati membri assicurano una stretta cooperazione, rapida, immediata ed efficace con gli altri Stati membri e con la Commissione per le materie fitosanitarie oggetto della presente direttiva. A tal fine, ciascuno Stato membro istituisce o designa un'autorità unica di coordinamento e di contatto per tali materie. È designata di preferenza l'autorità nazionale competente per la protezione dei vegetali istituita conformemente alla convenzione internazionale per la protezione dei vegetali (CIPV).

(b) Paragraph 4 shall be replaced by the following: "(4) The Member States shall ensure a close, rapid, immediate and effective cooperation between themselves and the Commission in relation to matters covered by this Directive. To this end, each Member State shall establish or designate a single authority, which shall be responsible, at least, for the coordination and contact in relation to such matters. The official plant protection organisation set up under the IPPC shall preferably be designated for this purpose.

Il nome di tale autorità ed eventuali ulteriori cambiamenti sono notificati agli Stati membri e alla Commissione.

This authority and any subsequent change shall be notified to the other Member States and to the Commission.

Secondo la procedura di cui all'articolo 18, paragrafo 2, all'autorità unica può essere conferita la facoltà di delegare o attribuire ad un altro servizio i suddetti compiti di coordinamento o di contatto, nella misura in cui essi si riferiscano a materie fitosanitarie distinte, oggetto della presente direttiva.";

In accordance with the procedure referred to in Article 18(2) the single authority may be authorised to assign or delegate tasks of coordination or contact, insofar as they relate to distinct plant health matters covered by this Directive, to another service.";

2) l'articolo 2, paragrafo 1, è modificato come segue:

- è aggiunto il seguente undicesimo trattino: "- qualsiasi altra parte di vegetali da specificarsi secondo la procedura di cui all'articolo 18, paragrafo 2.";

- the following eleventh indent shall be added: "- any other part of plants, which may be specified in accordance with the procedure referred to in Article 18(2).";

b) la lettera e) è sostituita dalla seguente: "e) organismi nocivi: qualsiasi specie, ceppo o biotipo di pianta, animale o agente patogeno dannoso per i vegetali o i prodotti vegetali";

(b) point (e) shall be replaced by the following: "(e) harmful organisms shall be considered to mean: any species, strain or biotype of plant, animal or pathogenic agent injurious to plants or plant products";

c) non riguarda la versione italiana;

(c) in point (f), third subparagraph, the terms "Article 8" shall be replaced by "Article 18(2)";

d) la lettera g) è modificata come segue:

(d) point (g), shall be amended as follows:

i) al primo comma, al punto i), i termini "la(e) autorità" sono sostituiti dai termini "la(e) organizzazione(i)";

(i) In the first subparagraph, in point (i), the word "services(s)" shall be replaced by the word "organisation(s)".

ii) il quinto comma è sostituito dal seguente: "L'autorità unica di cui all'articolo 1, paragrafo 4, comunica alla Commissione gli organismi ufficiali responsabili dello Stato membro in questione. La Commissione trasmette tale informazione agli altri Stati membri,";

(ii) The fifth subparagraph shall be replaced by the following: "The single authority referred to in Article 1(4) shall inform the Commission of the responsible official bodies in the Member State concerned. The Commission shall forward that information to the other Member States.";

e) alla lettera h), terzo comma, seconda frase e quinto comma, i termini "comunicata alla Commissione" sono sostituiti dai termini "notificata per iscritto alla Commissione";

(e) in point (h), third subparagraph, in the second sentence and in the fifth subparagraph, the words "in writing" shall be inserted between the words "notified" and "to the Commission";

f) alla lettera i), primo comma il primo trattino è sostituito dal seguente: "- da rappresentanti dell'organizzazione nazionale ufficiale per la protezione delle piante di un paese terzo o, sotto la loro responsabilità, da altri pubblici ufficiali tecnicamente qualificati e debitamente autorizzati da detto ufficio nazionale ufficiale per la protezione delle piante, nel caso di affermazioni o misure connesse con il rilascio di certificati fitosanitari e certificati fitosanitari di riesportazione, o il loro equivalente elettronico";

(f) in point (i), first subparagraph, the first indent shall be replaced by the following: "- by representatives of the official national plant protection organisation of a third country or, under their responsibility, by other public officers who are technically qualified and duly authorised by that official national plant protection organisation, in the case of statements or measures related to the issuing of the phytosanitary certificates and phytosanitary certificates for re-exports, or their electronic equivalent";

g) sono aggiunte le seguenti lettere: "j) punto di entrata: il luogo di introduzione per la prima volta nel territorio doganale nella Comunità dei vegetali, prodotti vegetali o altre voci. Può trattarsi dell'aeroporto in caso di trasporto aereo, del porto in caso di trasporto marittimo o fluviale, della stazione in caso di trasporto ferroviario e del luogo in cui si trova l'ufficio doganale competente della zona in cui è valicata la frontiera interna della Comunità, nel caso di qualsiasi altro tipo di trasporto;

(g) the following points shall be added: "(j) point of entry shall be considered to mean: the place where plants, plant products or other objects are brought for the first time into the customs territory of the Community: the airport in the case of air transport, the port in the case of maritime or fluvial transport, the station in the case of railway transport, and the place of the customs office responsible for the area where the Community inland frontier is crossed, in the case of any other transport;

k) organismo ufficiale del punto di entrata: l'organismo ufficiale in uno Stato membro competente per il punto di entrata;

(k) official body of point of entry shall be considered to mean: the responsible official body in a Member State in charge of the point of entry;

l) organismo ufficiale di destinazione: l'organismo ufficiale in uno Stato membro responsabile dell'area di competenza dell'ufficio doganale di destinazione;

(l) official body of destination shall be considered to mean: the responsible official body in a Member State in charge of the area where the 'customs office of destination' is situated;

m) ufficio doganale del punto di entrata: l'ufficio del punto di entrata quale definito alla lettera j) di cui sopra;

(m) customs office of point of entry shall be considered to mean: the office of the point of entry as defined in (j) above;

n) ufficio doganale di destinazione: l'ufficio di destinazione ai sensi dell'articolo 340 ter, paragrafo 3, del regolamento (CEE) n. 2454/93 della Commissione(6);

(n) customs office of destination shall be considered to mean: the office of destination within the meaning of Article 340b(3) of Commission Regulation (EEC) No 2454/93(6);

o) partita: un numero di unità di una singola merce, identificabile per l'omogeneità della composizione e dell'origine, e facente parte di una spedizione;

(o) lot shall be considered to mean: a number of units of a single commodity, identifiable by its homogeneity of composition and origin, and forming part of a consignment;

p) spedizione: quantitativo di merci contemplato da un unico documento necessario per le formalità doganali o per altre formalità, quale un certificato sanitario unico o un documento o marchi alternativi unici; la spedizione può essere composta da una o più partite;

(p) consignment shall be considered to mean: A quantity of goods being covered by a single document required for customs formalities or for other formalities, such as a single phytosanitary certificate or a single alternative document or mark; a consignment may be composed of one or more lots;

q) destinazione doganale: la destinazione doganale ai sensi dell'articolo 4, punto 15 del regolamento (CEE) n. 2913/92 del Consiglio, del 12 ottobre 1992, che istituisce un codice doganale comunitario(7) (in prosieguo: il codice doganale comunitario);

(q) customs-approved treatment or use shall be considered to mean: the customs-approved treatments or uses referred to in point 15 of Article 4 of Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code(7) (hereafter referred to as the Community Customs Code);

r) transito: la circolazione delle merci soggette a controllo doganale da un punto all'altro del territorio doganale della Comunità di cui all'articolo 91 del regolamento (CEE) n. 2913/92."

(r) transit shall be considered to mean: the movement of goods which are subject to customs supervision from one point to another within the customs territory of the Community as referred to in Article 91 of Regulation (EEC) No 2913/92.";

3) l'articolo 3 è modificato come segue:

3. Article 3 shall be amended as follows:

a) il paragrafo 3 è sostituito dal seguente: "3. I paragrafi 1 e 2 non si applicano, conformemente a condizioni che possono essere determinate secondo la procedura di cui all'articolo 18, paragrafo 2, nel caso di una contaminazione leggera di vegetali diversi da quelli destinati ad essere piantati, dovuta a organismi nocivi elencati nell'allegato I, parte A, o nell'allegato II, parte A, o nel caso di tolleranze appropriate stabilite per gli organismi nocivi elencati nell'allegato II, parte A, sezione II per quanto riguarda vegetali destinati ad essere piantati, precedentemente determinate d'intesa con le autorità rappresentanti gli Stati membri nel settore fitosanitario, e basate su una pertinente analisi del rischio fitosanitario.";

(a) paragraph 3 shall be replaced by the following: "3. Paragraphs 1 and 2 shall not apply in accordance with conditions which may be determined in accordance with the procedure referred to in Article 18(2), in the case of slight contamination of plants other than those intended for planting by harmful organisms listed in Annex I, Part A, or in Annex II, Part A, or in the case of appropriate tolerances established for harmful organisms listed in Annex II, Part A, Section II as regards plants intended for planting which have previously been selected in agreement with the authorities representing the Member States in the field of plant health, and based on a relevant pest risk analysis.";

b) il paragrafo 7 è sostituito dal seguente: "7. Secondo la procedura di cui all'articolo 18, paragrafo 2, possono essere adottate modalità d'attuazione per stabilire le condizioni per l'introduzione negli Stati membri e la diffusione nei loro territori di:

(b) paragraph 7 shall be replaced by the following paragraphs 7, 8 and 9: "7. In accordance with the procedure referred to in Article 18(2), implementing provisions may be adopted to lay down conditions for the introduction into the Member States and the spread within the Member States of:

a) organismi che si sospetta siano nocivi ai vegetali o ai prodotti vegetali ma non sono elencati negli allegati I e II;

(a) organisms which are suspected of being harmful to plants or plant products but are not listed in Annexes I and II;

b) organismi elencati nell'allegato II ma presenti in vegetali o prodotti vegetali diversi da quelli di cui allo stesso allegato e che si sospetta siano nocivi ai vegetali o ai prodotti vegetali;

(b) organisms, which are listed in Annex II, but which occur on plants or plant products other than those listed in that Annex, and which are suspected of being harmful to plants or plant products;

c) organismi elencati negli allegati I e II allo stato isolato e considerati nocivi in quello stato ai vegetali o ai prodotti vegetali.

(c) organisms, which are listed in Annexes I and II, which are in an isolated state and which are considered to be harmful in that state to plants or plant products.

8. Il paragrafo 1 e il paragrafo 5, lettera a), nonché il paragrafo 2 e il paragrafo 5, lettera b), e il paragrafo 4 non si applicano, conformemente alle condizioni fissate ai sensi della procedura di cui all'articolo 18, paragrafo 2, per prove o scopi scientifici nonché per lavori di selezione varietale.

8. Paragraphs 1 and 5(a) and paragraph 2 and 5(b) and paragraph 4 shall not apply, in accordance with the conditions which shall be determined pursuant to the procedure referred to in Article 18(2), for trial or scientific purposes and for work on varietal selections.

9. Dopo l'adozione delle misure di cui al paragrafo 7, tale paragrafo non si applica, conformemente alle condizioni fissate secondo la procedura di cui all'articolo 18, paragrafo 2, per prove o scopi scientifici nonché per lavori di selezione varietale.";

9. After the measures provided for in paragraph 7 have been adopted, that paragraph shall not apply, in accordance with the conditions which shall be determined pursuant to the procedure referred to in Article 18(2), for trial or scientific purposes and for work on varietal selections.";

4) gli articoli 7, 8 e 9 sono soppressi;

5) l'articolo 10 è modificato come segue:

i) al primo comma, sono soppressi i termini "in luogo del rilascio dei certificati fitosanitari di cui agli articoli 7 e 8";

(i) in the first subparagraph, the words "instead of the phytosanitary certificates referred to in Articles 7 or 8" shall be deleted;

ii) dopo il primo comma è aggiunto il comma seguente: "Tuttavia, nel caso delle sementi di cui all'articolo 6, paragrafo 4, non è necessario il rilascio di un passaporto delle piante qualora sia garantito, conformemente alle procedure di cui all'articolo 18, paragrafo 2, che i documenti rilasciati a norma delle disposizioni comunitarie applicabili alla commercializzazione delle sementi certificate comprovano il rispetto dei requisiti di cui all'articolo 6, paragrafo 4. In tal caso, tali documenti sono considerati costituire a tutti gli effetti il passaporto delle piante ai sensi dell'articolo 2, paragrafo 1, lettera f).";

(ii) the following subparagraph shall be inserted after the first subparagraph: "However, in the case of seeds mentioned in Article 6(4), a plant passport need not be issued, where it is ensured in accordance with the procedure referred to in Article 18(2) that the documents issued in accordance with the Community provisions applicable to the marketing of officially certified seed provide evidence for the compliance with the requirements referred to in Article 6(4). In such case, the documents shall be considered for all purposes to be plant passports within the meaning of Article 2(1)(f).";

b) al paragrafo 2, primo comma, dopo i termini "nell'allegato V, parte A, sezione I" sono inseriti i termini ", nonché le sementi di cui all'articolo 6, paragrafo 4" e al secondo comma, dopo i termini "nell'allegato V, parte A, sezione II" sono inseriti i termini ", nonché le sementi di cui all'articolo 6, paragrafo 4";

(b) in paragraph 2, in the first subparagraph, before the words "may not be moved" and in the second subparagraph, before the words "may not be introduced" the words "and seeds mentioned in Article 6(4)" shall be inserted;

6) all'articolo 11, paragrafo 2, infine è aggiunto il seguente testo: "Può essere utilizzato un passaporto delle piante.";

Gli Stati membri organizzano controlli ufficiali per assicurarsi che siano rispettate le disposizioni della presente direttiva, in particolare l'articolo 10, paragrafo 2; i controlli sono eseguiti a caso, senza discriminazioni in ordine all'origine dei vegetali, prodotti vegetali o altre voci e nel rispetto delle seguenti disposizioni:

1. Member States shall organise official checks to ensure compliance with the provisions of this Directive, in particular with Article 10(2), which shall be carried out at random and without any discrimination in respect of the origin of the plants, plant products or other objects, and in accordance with the following provisions:

- controlli saltuari in qualsiasi momento e luogo in cui vengano trasportati vegetali, prodotti vegetali o altre voci,

- occasional checks, at any time and at any place where plants, plant products or other objects are moved,

- controlli saltuari presso le aziende in cui sono coltivati, prodotti, immagazzinati o posti in vendita vegetali, prodotti vegetali o altre voci, nonché presso le aziende degli acquirenti,

- occasional checks on premises where plants, plant products or other objects are grown, produced, stored or offered for sale, as well as on the premises of purchasers,

- controlli saltuari contestualmente ad altri controlli documentali effettuati per motivi diversi da quelli fitosanitari.

- occasional checks at the same time as any other documentary check, which is carried out for reasons other than plant health.

I controlli devono essere regolari nelle aziende iscritte in un registro ufficiale conformemente all'articolo 10, paragrafo 3, e all'articolo 13 quater, paragrafo 1, lettera b) e possono essere regolari nelle aziende iscritte in un registro ufficiale conformemente all'articolo 6, paragrafo 6.

The checks must be regular in premises listed in an official register in accordance with Article 10(3) and Article 13c(1b), and may be regular in premises listed in an official register in accordance with Article 6(6).

I controlli devono essere puntuali qualora siano emersi elementi che lascino supporre l'inosservanza di una o più disposizioni della presente direttiva.

The checks must be targeted if facts have come to light to suggest that one or more provisions of this Directive have not been complied with.

2. I commercianti che acquistano vegetali, prodotti vegetali o altre voci conservano per almeno un anno, quali utenti finali impegnati per professione nella produzione di vegetali, i passaporti delle piante e ne iscrivono gli estremi nei propri registri.

2. Commercial purchasers of plants, plant products or other objects shall, as final users professionally engaged in plant production, retain the related plant passports for at least one year and enter the references in their records.

Gli ispettori hanno accesso ai vegetali, ai prodotti vegetali o alle altre voci in tutte le fasi della catena di produzione e di commercializzazione. Essi sono autorizzati ad effettuare tutte le indagini necessarie per i controlli ufficiali suddetti compresi quelli relativi ai registri ed ai passaporti delle piante.

Inspectors shall have access to the plants, plant products or other objects at all stages in the production and marketing chain. They shall be entitled to make any investigation necessary for the official checks concerned, including those related to the plant passports and the records.

3. Nell'esecuzione dei controlli ufficiali, gli Stati membri possono essere assistiti dagli esperti menzionati all'articolo 21.

3. The Member States may be assisted in the official checks by the experts referred to in Article 21.

4. Ove si accerti, nel corso dei controlli ufficiali eseguiti conformemente ai paragrafi 1 e 2, che i vegetali, i prodotti vegetali o le altre voci costituiscono un rischio di diffusione di organismi nocivi, essi devono formare oggetto di misure ufficiali quali previste all'articolo 11, paragrafo 3.

4. Where it is established, through the official checks carried out in accordance with paragraphs 1 and 2, that plants, plant products or other objects present a risk of spreading harmful organisms, they shall be the subject of official measures in accordance with Article 11(3).

Fatte salve le notifiche e le informazioni necessarie a norma dell'articolo 16, qualora tali vegetali, prodotti vegetali o altre voci provengano da un altro Stato membro, gli Stati membri provvedono a che l'autorità unica dello Stato membro ricevente informi immediatamente l'autorità unica dello Stato membro di provenienza e la Commissione delle risultanze e delle misure ufficiali che intende adottare o che ha già adottato. Secondo la procedura di cui all'articolo 18, paragrafo 2, può essere predisposto un sistema uniforme di trasmissione di informazioni.";

Without prejudice to the notifications and information required under Article 16, Member States shall ensure, where the plants, plant products or other objects concerned come from another Member State, that the single authority of the receiving Member State informs immediately the single authority of that Member State and the Commission of the findings and of the official measures which it intends to take or has taken. In accordance with the procedure referred to in Article 18(2), a standardised information system may be set up.";

8) l'articolo 13 è sostituito dai seguenti articoli 13, 13 bis, 13 ter, 13 quater, 13 quinquies e 13 sexties: "Articolo 13

1. Member States shall ensure, without prejudice to:

- fatte salve le disposizioni di cui all'articolo 3, paragrafo 3, articolo 13 ter, paragrafi 1, 2, 3, 4 e 5,

- the provisions of Article 3(3),13b(1), (2), (3), (4) and (5),

- fatti salvi le condizioni e i requisiti specifici connessi alle deroghe adottate ai sensi dell'articolo 15, paragrafo 1, al riconoscimento dell'equivalenza delle misure adottate ai sensi dell'articolo 15, paragrafo 2, o alle misure di emergenza adottate ai sensi dell'articolo 16, e

- the specific requirements and conditions laid down in derogations adopted pursuant to Article 15(1), in equivalency measures adopted pursuant to Article 15(2), or in emergency measures adopted pursuant to Article 16, and

- fatti salvi gli accordi specifici conclusi riguardo alle questioni trattate nel presente articolo tra la Comunità ed uno o più paesi terzi,

- specific agreements concluded on matters dealt with in this Article between the Community and one or more third countries,

i vegetali, i prodotti vegetali o le altre voci di cui all'allegato V, parte B, che vengono introdotti nel territorio doganale della Comunità in provenienza da un paese terzo, a partire dalla data della loro entrata siano sottoposti a vigilanza doganale ai sensi dell'articolo 37, paragrafo 1, del 'Codice doganale comunitario' e anche alla sorveglianza degli organismi ufficiali responsabili. Tali prodotti possono essere sottoposti ad uno dei regimi doganali di cui all'articolo 4, paragrafo 16 (lettere a, d, e, f, g) del suddetto 'Codice doganale comunitario', soltanto dopo che siano state espletate conformemente alle disposizioni dell'articolo 13 quater, paragrafo 2, le formalità di cui all'articolo 13 bis allo scopo di accertare, per quanto possibile:

that plants, plant products or other objects, listed in Annex V, Part B, which come from a third country and are brought into the customs territory of the Community, shall, from the time of their entry, be subject to customs supervision pursuant to Article 37(1) of the Community Customs Code and also to supervision by the responsible official bodies. They may only be placed under one of the customs procedures as specified in Article 4(16)(a), (d), (e), (f), (g) of the Community Customs Code, if the formalities as specified in Article 13a have been completed in accordance with the provisions of Article 13c(2), such as to conclude, as a result of these formalities and as far as can be determined:

i) - che i vegetali, i prodotti vegetali o le altre voci non sono contaminati dagli organismi nocivi elencati nell'allegato I, parte A, e

(i) - that the plants, plant products or other objects are not contaminated by harmful organisms listed in Annex I, Part A, and

- che i vegetali ed i prodotti vegetali specificati nell'allegato II, parte A, non sono contaminati dagli organismi nocivi che li riguardano, indicati in tale allegato, e

- in the case of plants or plant products listed in Annex II, Part A, that they are not contaminated by the relevant harmful organisms listed in that Annex, and

- che i vegetali, i prodotti vegetali o le altre voci elencati nell'allegato IV, parte A, sono conformi ai requisiti particolari che li riguardano, indicati in tale allegato o, se applicabile, all'opzione dichiarata nel certificato a norma dell'articolo 13 bis, paragrafo 4, lettera b), e

- in the case of plants, plant products or other objects listed in Annex IV, Part A, that they comply with the relevant special requirements indicated in that Annex, or, where applicable, with the option declared in the certificate pursuant to Article 13a(4)(b), and

ii) che i vegetali, i prodotti vegetali o le altre voci sono accompagnati dall'originale del 'certificato fitosanitario' ufficiale o del 'certificato fitosanitario di riesportazione' rilasciati conformemente alle disposizioni di cui all'articolo 13 bis, paragrafi 3 e 4, o, per quanto di ragione, l'originale o documenti alternativi o marchi, determinati ed autorizzati nell'ambito delle disposizioni di attuazione accompagnano o sono uniti o in altro modo collegati agli stessi.

(ii) that the plants, plant products or other objects are accompanied by the respective original of the required official 'phytosanitary certificate' or 'phytosanitary certificate for re-export' issued in accordance with the provisions laid down in Article 13a(3) and (4), or, where relevant, that the original of alternative documents or marks as specified and permitted in implementing provisions accompany, or are attached to, or otherwise put on, the object concerned.

Può essere riconosciuta la certificazione elettronica, purché siano rispettate le rispettive condizioni specificate nelle disposizioni di attuazione.

Electronic certification may be recognised, provided that the respective conditions specified in implementing provisions are met.

In casi eccezionali possono essere riconosciute le copie certificate conformi specificate nelle disposizioni di attuazione.

Officially certified copies may also be recognised in exceptional cases which shall be specified in implementing provisions.

Le disposizioni di attuazione di cui al punto ii) possono essere adottate secondo la procedura di cui all'articolo 18, paragrafo 2.

The implementing provisions referred to in (ii) above may be adopted in accordance with the procedure referred to in Article 18(2).

2. Il paragrafo 1 si applica in caso di vegetali, prodotti vegetali o altre voci destinati ad una zona protetta, in relazione agli organismi nocivi e ai requisiti speciali elencati rispettivamente nell'allegato I, parte B, nell'allegato II, parte B e nell'allegato IV, parte B per tale zona protetta.

2. Paragraph 1 shall apply, in cases of plants, plant products or other objects intended for a protected zone, in respect of harmful organisms and of special requirements listed in Annex I, Part B, Annex II, Part B and Annex IV, Part B respectively, for that protected zone.

3. Gli Stati membri provvedono a dare agli organismi ufficiali responsabili la facoltà di sottoporre a sorveglianza anche vegetali, prodotti vegetali o voci diversi da quelli di cui ai paragrafi 1 o 2, introdotti nel territorio doganale della Comunità in provenienza da un paese terzo, a partire dalla data di entrata, per accertare quanto disposto al paragrafo 1, punto i), primo, secondo o terzo trattino. Questi vegetali, prodotti vegetali o voci includono il legname che serve per la casseratura, la compartimentazione o la confezione di materiale da imballaggio effettivamente utilizzato nel trasporto di oggetti di qualsiasi natura.

3. Member States shall provide that plants, plant products or objects other than those referred to in paragraph 1 or 2, which come from a third country and are brought into the customs territory of the Community, may, from the time of their entry, be subject to supervision by the responsible official bodies, in respect of the first, second or third indent of paragraph 1(i). These plants, plant products or objects include wood in the form of dunnage, spacers, pallets or packing material, which are actually in use in the transport of objects of all kinds.

Qualora l'organismo ufficiale responsabile si avvalga di tale facoltà, i vegetali, i prodotti vegetali o le voci in questione rimangono sotto la sorveglianza di cui al paragrafo 1 fino al momento in cui sono state espletate le formalità prescritte e si è pervenuti alla conclusione, quale risultato di dette formalità e per quanto si possa stabilire, che essi sono conformi ai pertinenti requisiti fissati nella presente direttiva o a norma della stessa.

Where the responsible official body makes use of that faculty, the plants, plant products or objects concerned shall remain under the supervision referred to in paragraph 1, until the relevant formalities have been completed such as to conclude, as a result for these formalities and as far as can be determined, that they comply with the relevant requirements laid down in or under this Directive.

Le disposizioni di attuazione concernenti le informazioni e i relativi mezzi di trasmissione che devono essere fornite dagli importatori o dagli agenti doganali agli organismi ufficiali responsabili per quanto riguarda i vegetali, i prodotti vegetali o voci comprendenti vari tipi di legname come indicato al primo comma, sono adottate conformemente alla procedura di cui all'articolo 18, paragrafo 2.

Implementing provisions as regards type of information and the means of transmission thereof to be supplied by importers, or their customs representatives, to the responsible official bodies, as regards the plants, plant products or objects including the different types of wood, as referred to in the first subparagraph, shall be adopted in accordance with the procedure referred to in Article 18(2).

4. Fatto salvo l'articolo 13 quater, paragrafo 2, lettera a), gli Stati membri applicano, in caso di rischio di diffusione di organismi nocivi, le disposizioni di cui ai paragrafi 1, 2 e 3 ai vegetali, prodotti vegetali e altre voci contemplati da una delle destinazioni doganali come indicato all'articolo 4, paragrafo 15, lettere b), c), d), e) del 'Codice doganale comunitario' o dalle procedure doganali come specificato all'articolo 4, paragrafo 16, lettere b) e c), di detto codice.

4. Without prejudice to Article 13c(2)(a) Member States shall, if there is a risk of spread of harmful organisms, also apply paragraphs 1, 2 and 3 to plants, plant products or other objects being placed under one of the customs-approved treatments or uses as specified in Article 4(15)(b), (c), (d), (e) of the Community Customs Code or under the Customs procedures as specified in Article 4(16)(b), (c) of that Code.

Articolo 13 bis

Article 13a

1. a) Le formalità di cui all'articolo 13, paragrafo 1, comprendono ispezioni minuziose da effettuarsi da parte degli organismi ufficiali responsabili almeno:

1. (a) The formalities referred to in Article 13(1) shall consist of meticulous inspections by the responsible official bodies on at least:

i) su ciascuna spedizione per la quale è dichiarato, nell'ambito delle formalità doganali, che è costituita da o contiene vegetali, prodotti vegetali o altre voci di cui all'articolo 13, paragrafi 1, 2 o 3 alle rispettive condizioni; oppure

(i) each consignment declared, under the customs formalities, to consist of or to contain plants, plant products or other objects, referred to in Article 13(1), (2) or (3) under the respective conditions, or

ii) nel caso di una spedizione composta di diverse partite, su ogni partita per la quale è dichiarato, nell'ambito delle formalità doganali, che è costituita da o contiene tali vegetali, prodotti vegetali o altre voci.

(ii) in the case of a consignment which is composed of different lots, each lot declared, under the customs formalities, to consist of, or to contain, such plants, plant products or other objects.

b) Scopo dell'ispezione è stabilire se:

(b) The inspections shall determine whether:

i) la spedizione o la partita è accompagnata dai necessari certificati, documenti alternativi o marchi, come precisato all'articolo 13, paragrafo 1, punto ii) (controlli documentali);

(i) the consignment or lot is accompanied by the required certificates, alternative documents or marks, as specified in Article 13(1)(ii) (documentary checks),

ii) interamente o almeno per uno o più campioni rappresentativi la spedizione o la partita è costituita da o contiene i vegetali, prodotti vegetali o altre voci dichiarati nei relativi documenti (controlli di identità); e

(ii) in its entirety or on one or more representative samples, the consignment or lot consists of, or contains the plants, plant products or other objects, as declared on the required documents (identity checks), and

iii) interamente, o almeno per uno o più campioni rappresentativi, compreso l'imballaggio e, se del caso, i veicoli di trasporto, la spedizione o la partita o il materiale da imballaggio ligneo sono conformi ai requisiti fissati nella presente direttiva, di cui all'articolo 13, paragrafo 1, punto i) (controlli fitosanitari) e se si applica l'articolo 16, paragrafo 2.

(iii) in its entirety or on one or more representative samples, including the packaging and, where appropriate, the transport vehicles, the consignment or lot or their wood packing material comply with the requirements laid down in this Directive, as specified in Article 13(1)(i) (plant health checks), and whether Article 16(2) applies.

- activities of inspection on plants, plant products or other objects in the consignment or lot were already carried out in the consignor third country under technical arrangements referred to in Article 13b(6), or

- i vegetali, i prodotti vegetali o le altre voci di una spedizione o partita figurano negli elenchi a tal fine adottati nell'ambito delle disposizioni di attuazione a norma del paragrafo 5, lettera b), oppure

- the plants, plant products or other objects in the consignment or lot are listed in the implementing provisions adopted for this purpose pursuant to paragraph 5(b), or

- i vegetali, i prodotti vegetali o le altre voci della spedizione o della partita provengono da un paese terzo per il quale, nell'ambito o ai sensi di accordi fitosanitari globali internazionali basati sul principio del trattamento reciproco tra la Comunità e un paese terzo, sono previste disposizioni per controlli di identità e fitosanitari a intensità ridotta

- the plants, plant products or other objects in the consignment or lot came from a third country for which in or under comprehensive international phytosanitary agreements based on the principle of reciprocal treatment between the Community and a third country, provision for a reduced frequency of identity and plant health checks is mentioned,

a meno che non vi siano seri motivi di ritenere che i requisiti fissati nella presente direttiva non sono stati soddisfatti.

unless there is a serious reason to believe that the requirements laid down in this Directive are not complied with.

I controlli fitosanitari possono altresì essere effettuati con frequenza o intensità ridotta qualora ci siano prove, confrontate dalla Commissione, in base all'esperienza acquisita da precedenti immissioni di tali materiali della stessa origine nella Comunità, confermate da tutti gli Stati membri interessati, e previa consultazione del Comitato di cui all'articolo 18, che i vegetali, i prodotti vegetali o le altre voci facenti parte della spedizione o della partita sono conformi ai requisiti fissati nella presente direttiva, sempreché siano rispettate le condizioni particolari specificate nelle disposizioni di attuazione a norma del paragrafo 5, lettera c).

The plant health checks may also be carried out at reduced frequency, if there is evidence, collated by the Commission and based on experience gained from earlier introduction of such material of the same origin into the Community as confirmed by all Member States concerned, and after consultation within the Committee referred to in Article 18, to believe that the plants, plant products or other objects in the consignment or lot comply with the requirements laid down in this Directive, provided that the detailed conditions specified in implementing provisions pursuant to paragraph 5(c) are met.

3. Il 'certificato fitosanitario' o il 'certificato fitosanitario di riesportazione' ufficiali di cui all'articolo 13, paragrafo 1, punto ii), deve essere rilasciato in almeno una delle lingue ufficiali della Comunità e conformemente alle disposizioni legislative o regolamentari del paese terzo di esportazione o riesportazione adottate conformemente alla CIPV, a prescindere dall'adesione o meno di tale paese alla convenzione. I certificati suddetti sono indirizzati alle 'organizzazioni di protezione fitosanitaria degli Stati membri della Comunità europea', ai sensi dell'articolo 1, paragrafo 4, primo comma, ultima frase.

3. The official 'phytosanitary certificate' or 'phytosanitary certificate for re-export' referred to in Article 13(1)(ii) shall have been issued in at least one of the official languages of the Community and in accordance with the laws or regulations of the third country of export or re-export which have been adopted, whether a contracting party or not, in compliance with the provisions of the IPPC. It shall be addressed to the 'Plant Protection Organisations of the Member States of the European Community' as referred to in Article 1(4), first subparagraph, last sentence.

Il certificato non deve essere compilato più di 14 giorni prima della data alla quale i vegetali, i prodotti vegetali o altre voci coperti dallo stesso lasciano il paese terzo in cui è stato rilasciato.

The certificate shall not have been made out more than 14 days before the date on which the plants, plant products or other objects covered by it have left the third country in which it was issued.

Le informazioni contenute nel certificato sono conformi al modello riprodotto nell'allegato della CIPV, a prescindere dal formato.

It shall contain information in accordance with the models specified in the Annex to the IPPC, irrespective of its format.

Esso corrisponde al modello stabilito dalla Commissione a norma del paragrafo 4. Il certificato deve essere stato rilasciato dalle autorità a tal fine designate in virtù delle disposizioni legislative o regolamentari del paese terzo interessato comunicate, conformemente alle disposizioni della CIPV, al direttore generale della FAO oppure, in caso di paese terzo non membro della CIPV, alla Commissione. La Commissione informa gli Stati membri delle comunicazioni ricevute.

It shall be in one of the models determined by the Commission pursuant to paragraph 4. The certificate shall have been issued by authorities empowered to this effect on the basis of laws or regulations of the third country concerned, as submitted, in accordance with the provisions of the IPPC, to the Director General of FAO, or, in the case of third countries non-party to the IPPC, to the Commission. The Commission shall inform the Member States of the submissions received.

4. a) Secondo la procedura di cui all'articolo 18, paragrafo 2, sono stabiliti i modelli accettabili, specificati nelle diverse versioni dell'allegato della CIPV. Secondo la stessa procedura possono essere stabilite specificazioni alternative per i 'certificati fitosanitari' o i 'certificati fitosanitari di riesportazione' per paesi terzi non aderenti alla CIPV.

4. (a) In accordance with the procedure referred to in Article 18(2), the acceptable models as specified in the different versions of the Annex to the IPPC shall be determined. In accordance with the same procedure, alternative specifications for the 'phytosanitary certificates' or 'phytosanitary certificates for re-export' may be laid down for third countries non-party to the IPPC.

b) Fatto salvo il disposto dell'articolo 15, paragrafo 4, nel caso di vegetali, prodotti vegetali o altre voci elencati nell'allegato IV, parte A, sezione I o parte B, i certificati specificano, nella rubrica 'dichiarazioni supplementari' e, ove pertinente, i requisiti particolari, tra quelli elencati quali alternativi nella pertinente posizione nelle differenti parti dell'allegato IV, che sono rispettati. Tale specificazione avviene mediante riferimento alla pertinente posizione nell'allegato IV.

(b) Without prejudice to Article 15(4), the certificates, in the case of plants, plant products or other objects listed in Annex IV Part A section I or Part B, shall specify, under the heading 'Additional Declaration' and where relevant, which special requirement out of those listed as alternatives in the relevant position in the different parts of Annex IV have been complied with. This specification shall be given through reference to the relevant position in Annex IV.

c) Nel caso di vegetali, prodotti vegetali o altre voci ai quali si applicano i requisiti particolari stabiliti nell'allegato IV, parte A, o parte B, il 'certificato fitosanitario' ufficiale di cui all'articolo 13, paragrafo 1, punto ii), deve essere stato rilasciato nel paese terzo di cui sono originari ('paese di origine').

(c) In the case of plants, plant products or other objects, to which special requirements laid down in Annex IV, Part A, or Part B apply, the official 'phytosanitary certificate' referred to in Article 13(1)(ii) shall have been issued in the third country in which the plants, plant products or other objects originate (country of origin).

d) Tuttavia, nel caso in cui i pertinenti requisiti particolari possono essere soddisfatti anche in luoghi diversi da quello di origine oppure qualora non siano previsti requisiti particolari, il 'certificato fitosanitario' può essere stato rilasciato nel paese terzo di provenienza dei vegetali, dei prodotti vegetali o delle altre voci ('paese di provenienza').

(d) However, in the case where the relevant special requirements can be fulfilled also at places other than that of origin, or where no special requirement applies, the 'phytosanitary certificate' may have been issued in the third country where the plants, plant products or other objects come from (consignor country).

5. Secondo la procedura di cui all'articolo 18, paragrafo 2, possono essere adottate disposizioni di attuazione relative:

b) agli elenchi di vegetali, prodotti vegetali o altre voci sui quali i controlli fitosanitari sono eseguiti con frequenza ridotta a norma del paragrafo 2, primo comma, secondo trattino;

(b) establish lists of plants, plant products or other objects on which plant health checks shall be carried out at reduced frequency pursuant to paragraph 2, first subparagraph, second indent,

c) alle condizioni particolari riguardanti le prove di cui al paragrafo 2, secondo comma, e i criteri per il tipo ed il livello di riduzione dei controlli fitosanitari.

(c) specify the detailed conditions for the evidence referred to in paragraph 2, second subparagraph, and the criteria for the type and level of reduction of the plant health checks.

The Commission may include guidelines in respect of paragraph 2 in the recommendations referred to in Article 21(6).

Articolo 13 ter

Article 13b

1. Gli Stati membri si assicurano che le spedizioni o le partite provenienti da un paese terzo per le quali non è dichiarato, nell'ambito delle formalità doganali che consistano di o contengano vegetali, prodotti vegetali o altre voci elencati nell'allegato V, parte B, siano anche ispezionate dagli organismi ufficiali responsabili, ove vi siano seri motivi di ritenere che siffatti vegetali, prodotti vegetali o altre voci siano presenti.

1. Member States shall ensure that consignments or lots which come from a third country, but are not declared, under the customs formalities, to consist of, or to contain plants, plant products or other objects listed in Annex V, Part B are also inspected by the responsible official bodies, where there is serious reason to believe that such plants, plant products or other objects are present.

Gli Stati membri assicurano che qualora una ispezione doganale risulti che la spedizione o la partita proveniente da un paese terzo consiste o contiene vegetali, prodotti vegetali o altre voci non dichiarati e elencati nell'allegato V, parte B, l'ufficio doganale che effettua l'ispezione ne informa immediatamente l'organismo ufficiale responsabile dello Stato membro da cui dipende, nell'ambito della cooperazione di cui all'articolo 13 quater, paragrafo 4.

Member States shall ensure that whenever a customs inspection reveals that a consignment or lot coming from a third country consists of or contains non-declared plants, plant products or other objects listed in Annex V, Part B, the inspecting customs office shall immediately inform the official body of its Member State, under the cooperation referred to in Article 13c(4).

Se, al termine di un controllo da parte degli organismi ufficiali responsabili rimangono dubbi in merito all'identità del prodotto di base, in particolare per quanto riguarda il genere o, la specie dei vegetali o prodotti vegetali oppure la loro origine, si considera che la spedizione contenga vegetali, prodotti vegetali o altre voci elencati nell'allegato V, parte B.

If, at the outcome of the inspection by the responsible official bodies, doubts remain in respect of the identity of the commodity, in particular concerning the genus or species of plants or plant products or their origin, the consignment shall be considered to contain plants, plant products or other objects as listed in Annex V, Part B.

2. Sempreché non vi sia alcun rischio di diffusione di organismi nocivi nella Comunità:

(a) Article 13(1) shall not apply to the entry, into the Community, of plants, plant products or other objects which are moved from one point to another within the Community passing through the territory of a third country without any change in their customs status (internal transit),

b) il disposto dell'articolo 13, paragrafo 1, e dell'articolo 4, paragrafo 1, non si applica all'entrata nella Comunità di vegetali, prodotti vegetali o altre voci che sono spostati da un punto all'altro in uno o due paesi terzi passando attraverso il territorio della Comunità nell'ambito di procedure doganali appropriate, senza alcun cambiamento del loro status doganale.

(b) Article 13(1) and Article 4(1) shall not apply to the entry, into the Community, of plants, plant products or other objects which are moved from one point to another within one or two third countries passing through the territory of the Community under appropriate customs procedures without any change in their customs status.

3. Fatto salvo il disposto dell'articolo 4 rispetto all'allegato III e purché non ci sia rischio di diffusione di organismi nocivi nella Comunità, non è necessario applicare il disposto dell'articolo 13, paragrafo 1, all'entrata nella Comunità di piccoli quantitativi di vegetali, prodotti vegetali, prodotti alimentari o alimenti per animali se riguardano vegetali o prodotti vegetali, se destinati ad essere usati dal proprietario o dal ricevente a fini non industriali né commerciali, o ad essere consumati durante il trasporto.

Without prejudice to the provisions of Article 4 in respect of Annex III, and provided that there is no risk of harmful organisms spreading in the Community, Article 13(1) need not apply to the entry, into the Community, of small quantities of plants, plant products, foodstuffs or animal feedingstuffs as far as they relate to plants or plant products,where they are intended for use by the owner or recipient for non-industrial and non-commercial purposes, or for consumption during transport.

In accordance with the procedure referred to in Article 18(2) detailed rules may be adopted specifying the conditions for the implementation of this provision, including the determination of 'small quantities'.

4. In base a condizioni specifiche, il disposto dell'articolo 13, paragrafo 1, non si applica all'entrata nella Comunità di vegetali, prodotti vegetali o altre voci per prove, per scopi scientifici nonché per lavori di selezione varietale. 4. Article 13(1) shall not apply, under specified conditions, to the entry, into the Community, of plants, plant products or other objects for use in trials, for scientific purposes or for work on varietal selections. The specified conditions shall be determined in accordance with the procedure referred to in Article 18(2).

5. Sempreché non vi sia alcun rischio di diffusione di organismi nocivi, nella Comunità, uno Stato membro può adottare una deroga perché l'articolo 13, paragrafo 1, non si applichi in singoli casi determinati a vegetali, prodotti vegetali o altre voci che sono coltivati, ottenuti o utilizzati nella sua immediata zona di frontiera con un paese terzo e sono introdotti nello Stato membro per esservi lavorati in luoghi vicini, situati nella sua zona di frontiera.

5. Provided that there is no risk of harmful organisms spreading in the Community, a Member State may adopt a derogation that Article 13(1) shall not apply in specified individual cases to plants, plant products or other objects which are grown, produced or used in its immediate frontier zone with a third country and introduced into that Member State in order to be worked in nearby locations in the frontier zone of its territory.

Nel concedere tale deroga, lo Stato membro precisa il luogo e il nome della persona che procede alla lavorazione, e mette questi dati, regolarmente aggiornati, a disposizione della Commissione.

When granting such a derogation, the Member State shall specify the location and the name of the person working it. Such details, which shall be updated regularly, shall be made available to the Commission

I vegetali, i prodotti vegetali o altre voci oggetto di deroga in forza del primo comma sono accompagnati da una documentazione che comprova il loro luogo di origine nel paese terzo.

Plants, plant products and other objects which form the subject of a derogation under the first subparagraph shall be accompanied by documentary evidence of the location in the relevant third country from which the said plants, plant products and other objects originate.

6. Può essere concordato, nell'ambito di intese di tipo tecnico stipulate tra la Commissione e gli organismi competenti di taluni paesi terzi, approvate conformemente alla procedura di cui all'articolo 18, paragrafo 2, che le attività di cui all'articolo 13, paragrafo 1, punto i) possono anche essere eseguite, sotto l'autorità della Commissione e in conformità delle pertinenti disposizioni dell'articolo 21, nel paese terzo speditore interessato, in collaborazione con l'organizzazione ufficiale di protezione fitosanitaria di tale paese.

6. It may be agreed, in technical arrangements made between the Commission and the competent bodies in certain third countries and approved in accordance with the procedure referred to in Article 18(2), that activities referred to in Article 13(1)(i) may also be carried out under the authority of the Commission and in accordance with the relevant provisions of Article 21 in the consignor third country, in cooperation with the official plant protection organisation of that country.

Articolo 13 quater

Article 13c

1. a) Le formalità precisate all'articolo 13 bis, paragrafo 1, le ispezioni di cui all'articolo 13 ter, paragrafo 1, e i controlli relativi al rispetto delle disposizioni dell'articolo 4, con riguardo all'allegato III, sono espletati, come precisato al paragrafo 2, congiuntamente alle formalità necessarie per l'assoggettamento al regime doganale di cui all'articolo 13, paragrafo 1 o all'articolo 13, paragrafo 4.

1. (a) The formalities as specified in Article 13a(1), the inspections as provided for in Article 13b(1) and the checks for compliance with the provisions of Article 4 in respect of Annex III shall be carried out in connection with, as specified in paragraph 2, the formalities required for the placing under a customs procedure as referred to in Article 13(1) or Article 13(4).

Esse sono espletate conformemente alle disposizioni della convenzione internazionale sull'armonizzazione dei controlli delle merci alle frontiere, in particolare dell'allegato 4, quale approvata dal regolamento (CEE) n. 1262/84 del Consiglio(8).

They shall be carried out in compliance with the provisions of the International Convention on the Harmonisation of Frontier Controls of Goods, in particular Annex 4 thereof, as approved by Council Regulation (EEC) No 1262/84(8).

b) Gli Stati membri prescrivono l'obbligo di iscrizione in un albo ufficiale di uno Stato membro con un numero ufficiale di iscrizione per gli importatori, produttori o non produttori, di vegetali, prodotti vegetali o altre voci elencati nell'allegato V, parte B. A tali importatori si applicano, per quanto di ragione, le disposizioni dell'articolo 6, paragrafo 5, terzo e quarto comma.

(b) Member States shall provide that importers, whether or not producers, of plants, plant products or other objects, listed in Annex V, Part B, must be included in an official register of a Member State under an official registration number. The provisions of Article 6(5), third and fourth subparagraphs, shall apply accordingly to such importers.

c) Gli Stati membri prescrivono anche:

i) l'obbligo per gli importatori, o per i loro agenti in dogana, di assicurare che per le spedizioni costituite da, o contenenti, vegetali, prodotti vegetali o altre voci, elencati nell'allegato V, parte B, sia fatto riferimento alla composizione della spedizione su almeno uno dei documenti necessari per l'assoggettamento al regime doganale di cui all'articolo 13, paragrafo 1 o all'articolo 13, paragrafo 4, attraverso le seguenti informazioni:

(i) importers, or their customs representatives, of consignments consisting of, or containing, plants, plant products or other objects, listed in Annex V, Part B, shall make reference, on at least one of the documents required for the placing under a customs procedure as referred to in Article 13(1) or Article 13(4) to such composition of the consignment by means of the following information:

- riferimento al tipo di vegetali, prodotti vegetali o altre voci avvalendosi dei codici della 'tariffa doganale integrata delle Comunità europee (TARIC)',

- reference to the type of plants, plant products or other objects, in using the code of the 'Integrated tariff of the European Communities (Taric)',

- dichiarazione 'La presente spedizione contiene prodotti di rilevanza fitosanitaria', o qualsiasi alternativo equivalente convenuto tra l'ufficio doganale del punto di entrata e l'organismo ufficiale del punto di entrata,

- statement 'This consignment contains produce of phytosanitary relevance', or any equivalent alternative mark as agreed between the customs office of point of entry and the official body of point of entry,

- numero(i) di riferimento della necessaria documentazione fitosanitaria,

- reference number(s) of the required phytosanitary documentation,

- numero ufficiale di iscrizione dell'importatore, di cui alla lettera b);

- official registration number of the importer, as referred to in (b) above;

ii) l'obbligo per le autorità aeroportuali, portuali o anche gli importatori o gli operatori, in base agli accordi intercorsi tra loro, di dare notifica preventiva all'ufficio doganale del punto di entrata e all'organismo ufficiale del punto di entrata dell'imminente arrivo di tali spedizioni non appena ne siano a conoscenza.

(ii) airport authorities, harbour authorities or either importers or operators, as arranged between them, give, as soon as they are aware of the imminent arrival of such consignments, advance notice thereof to the customs office of point of entry and to the official body of point of entry.

Gli Stati membri possono applicare la presente disposizione, mutatis mutandis, ai casi di trasporto terrestre, in particolare quando l'arrivo è previsto al di fuori del normale orario di lavoro dell'organismo ufficiale competente o degli altri uffici specificati nel paragrafo 2.

Member States may apply this provision, mutatis mutandis, to cases of land transport, in particular where the arrival is expected outside normal working hours of the relevant official body or other office as specified in paragraph 2.

2. a) I 'controlli documentali' e le ispezioni di cui all'articolo 13 ter, paragrafo 1, nonché i controlli dell'osservanza del disposto dell'articolo 4 con riguardo all'allegato III devono essere espletati dall'organismo ufficiale del punto di entrata o, d'intesa tra l'organismo ufficiale responsabile e le autorità doganali dello Stato membro interessato, dall'ufficio doganale del punto di entrata.

2. (a) 'Documentary checks' and also the inspections as provided for in Article 13b(1) and the checks for compliance with the provisions of Article 4 in respect of Annex III must be made by the official body of point of entry or, in agreement between the responsible official body and the customs authorities of that Member State, by the customs office of point of entry.

b) I 'controlli di identità' e i 'controlli fitosanitari' devono essere compiuti, fatto salvo il disposto delle lettere c) e d), dall'organismo ufficiale del punto di entrata unitamente alle formalità doganali necessarie per l'assoggettamento al regime doganale di cui all'articolo 13, paragrafo 1 o all'articolo 13, paragrafo 4, nello stesso luogo in cui sono compiute tali formalità presso l'organismo ufficiale del punto di entrata o in qualsiasi altro luogo vicino scelto o approvato dalle autorità doganali e dall'organismo ufficiale responsabile, diverso dal luogo di destinazione come specificato alla lettera d).

(b) 'Identity checks' and 'plant health checks' must be made, without prejudice to (c) and (d) below, by the official body of point of entry in connection with the customs formalities required for placing under a customs procedure as referred to in Article 13(1) or Article 13(4), and either at the same place as these formalities, on the premises of the official body of point of entry or at any other place close by and designated or approved by the customs authorities and by the responsible official body, other than the place of destination as specified under (d).

(c) However, in case of transit of non-Community goods, the official body of point of entry may decide, in agreement with the official body or bodies of destination, that all or part of the 'identity checks' or 'plant health checks' shall be made by the official body of destination, either on its premises or at any other place close by and designated or approved by the customs authorities and by the responsible official body, other than the place of destination as specified under (d). If no such agreement is made, the entire 'identity check' or 'plant health check' shall be made by the official body of the point of entry at either of the places specified in (b).

d) Secondo la procedura di cui all'articolo 18, paragrafo 2, possono essere precisati alcuni casi o circostanze in cui i 'controlli di identità' e i 'controlli fitosanitari' possono essere compiuti sul luogo di destinazione, come un sito di produzione approvato dall'organismo ufficiale e dalle autorità doganali responsabili per l'area in cui tale luogo di destinazione è situato, invece degli altri luoghi summenzionati, purché siano rispettate le garanzie specifiche e i documenti per quanto riguarda il trasporto di vegetali, prodotti vegetali e altre voci.

(d) In accordance with the procedure referred to in Article 18(2), certain cases or circumstances may be specified in which 'identity checks' and 'plant health checks' may be carried out at the place of destination, such as a place of production, approved by the official body and customs authorities responsible for the area where that place of destination is located, instead of the aforesaid other places, provided that specific guarantees and documents as regards the transport of plants, plant products and other objects are complied with.

e) Secondo la procedura di cui all'articolo 18, paragrafo 2, sono adottate disposizioni di attuazione le quali prevedono:

(e) In accordance with the procedure referred to in Article 18(2), implementing provisions shall be laid down concerning:

- condizioni minime per lo svolgimento dei 'controlli fitosanitari' di cui alle lettere b), c) e d),

- the minimum conditions for the carrying out of the 'plant health checks' under (b), (c) and (d),

- le garanzie specifiche e i documenti per quanto riguarda il trasporto di vegetali, prodotti vegetali o altre voci nei luoghi specificati nelle lettere c) e d), per assicurare che non ci sia il rischio di diffusione di organismi nocivi durante il trasporto,

- the specific guarantees and documents as regards the transport of the plants, plant products or other objects to the places specified in (c) and (d), to ensure that there is no risk of harmful organisms spreading during transport,

- congiuntamente alla specificazione di casi di cui alla lettera d), garanzie specifiche e condizioni minime per la qualifica del luogo di destinazione per l'immagazzinamento e per le condizioni ad esso relative.

- together with the specification of cases under (d), specific guarantees and minimum conditions concerning the qualification of the place of destination for storage and concerning the storage conditions.

f) In tutti i casi i 'controlli fitosanitari' sono considerati parte integrante delle formalità di cui all'articolo 13, paragrafo 1.

(f) In all cases, the plant 'health checks' shall be considered to be an integral part of the formalities referred to in Article 13(1).

3. Gli Stati membri prescrivono che gli originali dei certificati, o la versione elettronica di questi o dei documenti alternativi diversi dai marchi, quali specificati all'articolo 13, paragrafo 1, punto ii), presentati all'organismo ufficiale responsabile ai fini dei 'controlli documentali' a norma dell'articolo 13 bis, paragrafo 1, lettera b), punto i), a seguito dell'ispezione rechino il visto di tale organismo con l'indicazione almeno del suo nome e della data di presentazione del documento.

3. Member States shall lay down that the respective original, or the electronic form of the certificates or of the alternative documents other than marks, as specified in Article 13(1)(ii), which is produced to the responsible official body for 'documentary checks' in accordance with the provisions of Article 13a(1)(b)(i), upon inspection shall be marked with a 'visa' of that body, together with its denomination and the date of presentation of the document.

Conformemente alla procedura di cui all'articolo 18, paragrafo 2, può essere istituito un sistema standardizzato per garantire che le informazioni contenute nel certificato, nel caso di vegetali specifici destinati all'impianto, siano inviate all'organismo ufficiale responsabile di ciascuno Stato membro o di ciascuna area in cui le piante della spedizione devono essere impiantate.

In accordance with the procedure referred to in Article 18(2), a standardised system may be set up to ensure that information included in the certificate, in case of specified plants intended for planting, shall be forwarded to the official body in charge of each Member State or area where plants from the consignment are to be destined or planted.

4. Gli Stati membri trasmettono, per iscritto, alla Commissione e agli altri Stati membri l'elenco dei luoghi designati come punti di entrata. Qualsiasi modifica all'elenco deve parimenti essere notificata per iscritto, senza indugio.

4. The Member States shall forward to the Commission and the other Member States in writing the list of places designated as points of entry. Any changes to this list shall also be forwarded in writing without delay.

Gli Stati membri elaborano, sotto la loro responsabilità, un elenco di luoghi di cui al paragrafo 2, lettere b) e c), nonché dei luoghi di destinazione di cui al paragrafo 2, lettera d). Gli elenchi in questione sono accessibili alla Commissione.

The Member States shall establish a list of the places as specified under 2(b) and 2(c) and places of destinations as identified under 2(d) under their respective responsibility. These lists shall be accessible to the Commission.

Gli organismi ufficiali del punto di entrata e gli organismi ufficiali di destinazione che effettuino controlli di identità o fitosanitari sono tenuti a soddisfare determinate condizioni minime per quanto riguarda l'infrastruttura, il personale e l'attrezzatura.

Each official body of point of entry, and each official body of destination carrying out identity or plant health checks, must satisfy certain minimum conditions in respect of infrastructure, staffing and equipment.

Secondo la procedura di cui all'articolo 18, paragrafo 2, le suddette condizioni minime sono prescritte nell'ambito delle disposizioni di attuazione.

In accordance with the procedure referred to in Article 18(2), the aforesaid minimum conditions shall be laid down in implementing provisions.

Secondo la stessa procedura, sono adottate norme dettagliate concernenti:

In accordance with the same procedure, detailed rules shall be laid down concerning:

a) il tipo di documenti richiesti per l'assoggettamento a un regime doganale, in cui sono riportate le informazioni di cui al paragrafo 1, lettera c), punto i);

(a) the type of documents required for the placing under a customs procedure, on which the information specified in paragraph 1(c)(i) shall be made,

b) la cooperazione tra:

(b) the cooperation between:

i) l'organismo ufficiale del punto di entrata e l'organismo ufficiale di destinazione;

(i) the official body of point of entry and the official body of destination,

ii) l'organismo ufficiale del punto di entrata e l'ufficio doganale del punto di partenza;

(ii) the official body of point of entry and the customs office of point of entry,

iii) l'organismo ufficiale di destinazione e l'ufficio doganale di destinazione; e

(iii) the official body of destination and the customs office of destination, and

iv) l'organismo ufficiale del punto di entrata e l'ufficio doganale di destinazione.

(iv) the official body of point of entry and the customs office of destination.

Le disposizioni di attuazione riguardano i moduli dei documenti da utilizzare nell'ambito di tale cooperazione, le modalità di trasmissione degli stessi, le procedure per lo scambio di informazioni tra organismi ufficiali e uffici summenzionati, nonché le misure da adottare per garantire l'identità delle partite e delle spedizioni e per tutelarsi contro il rischio di diffusione di organismi nocivi, in particolare durante il trasporto, fino all'espletamento delle necessarie formalità doganali.

Those rules shall include model forms of documents to be used in that cooperation, the means of transmission of these documents, the procedures for exchange of information between the official bodies and offices above, as well as the measures which must be taken to maintain the identity of the lots and consignments and to safeguard against the risk of spreading harmful organisms, in particular during transport, until the completion of the required customs formalities.

5. È prevista una partecipazione finanziaria della Comunità agli Stati membri al fine di rafforzare le infrastrutture di ispezione per l'effettuazione dei controlli fitosanitari di cui al paragrafo 2, lettere b) o c).

5. There shall be a Community financial contribution to Member States in order to strengthen inspection infrastructures in so far as they relate to plant health checks carried out in accordance with paragraph 2(b) or (c).

Tale partecipazione mira a migliorare, nei centri di ispezione che non siano quelli del luogo di destinazione, gli strumenti e gli impianti necessari per le attività di ispezione e di esame e, all'occorrenza, per le misure previste al paragrafo 7, oltre al livello già raggiunto rispettando le condizioni minime previste dalle disposizioni di attuazione di cui al paragrafo 2, lettera e).

The purpose of this contribution shall be to improve the provision, at inspection posts other than those at the place of destination, of the equipment and the facilities required to carry out inspection and examination and, where necessary, to carry out the measures provided for in paragraph 7, beyond the level already achieved by complying with the minimum conditions stipulated in the implementing provisions pursuant to paragraph 2(e).

La Commissione propone di iscrivere nel bilancio generale dell'Unione europea gli stanziamenti all'uopo necessari.

The Commission shall propose the entry of suitable appropriations for that purpose in the general budget of the European Union.

Nei limiti degli stanziamenti a tal fine disponibili, la partecipazione della Comunità copre una quota non superiore al 50 % delle spese direttamente connesse con il miglioramento degli strumenti e degli impianti.

Within the limits set by the appropriations available for these purposes, the Community contribution shall cover up to 50 % of expenditure relating directly to improving equipment and facilities.

Le modalità relative alla partecipazione finanziaria della Comunità sono stabilite in un regolamento di applicazione secondo la procedura prevista all'articolo 18, paragrafo 2.

Detailed rules concerning the Community financial contribution shall be laid down in an implementing Regulation adopted in accordance with the procedure referred to in Article 18(2).

L'assegnazione della partecipazione finanziaria della Comunità ed il relativo importo vengono decisi secondo la stessa procedura, sulla scorta delle informazioni e dei documenti forniti dallo Stato membro interessato e, se del caso, dei risultati di inchieste effettuate sotto l'autorità della Commissione dagli esperti di cui all'articolo 21, nonché in funzione degli stanziamenti disponibili a tal fine.

The allocation and the amount of the Community financial contribution shall be decided in accordance with the procedure referred to in Article 18(2), in the light of the information and documents submitted by the Member State concerned and, where appropriate, of the results of investigations carried out under the Commission's authority by the experts referred to in Article 21, and depending on the appropriations available for the purposes concerned.

6. Il disposto dell'articolo 10, paragrafi 1 e 3, si applica mutatis mutandis ai vegetali, ai prodotti vegetali o alle altre voci di cui all'articolo 13, purché siano elencati nell'allegato V, parte A, e qualora, in esito alle formalità di cui all'articolo 13, paragrafo 1, le condizioni ivi previste si ritengano rispettate.

6. Article 10(1) and (3) shall apply mutatis mutandis to plants, plant products or other objects referred to in Article 13 insofar as they are listed in Annex V, Part A, and where it is considered, on the basis of the formalities referred to in Article 13(1), that the conditions laid down therein are fulfilled.

7. Qualora in esito alle formalità di cui all'articolo 13, paragrafo 1, non si ritengano rispettate le condizioni ivi previste, vengono immediatamente adottate una o più delle seguenti misure ufficiali:

7. Where it is not considered on the basis of the formalities referred to in Article 13(1), that the conditions laid down therein are fulfilled, one or more of the following official measures shall be taken immediately:

a) rifiuto dell'entrata nella Comunità di tutti o di una parte dei prodotti;

(a) refusal of entry into the Community of all or part of the consignment,

b) trasporto verso una destinazione esterna alle Comunità, conformemente ad appropriate procedure doganali durante il tragitto all'interno della Comunità e sotto sorveglianza ufficiale;

(b) movement, under official supervision, in accordance with the appropriate customs procedure, during their movement within the Community, to a destination outside the Community,

c) ritiro dei prodotti infetti/infestati dalla spedizione;

(c) removal of infected/infested produce from the consignment,

d) distruzione;

(d) destruction,

e) imposizione di un periodo di quarantena, finché non siano disponibili i risultati degli esami o delle prove ufficiali;

(e) imposition of a quarantine period until the results of the examinations or official tests are available,

f) eccezionalmente e soltanto in determinate circostanze, trattamento adeguato se l'organismo responsabile dello Stato membro ritiene che, come conseguenza del trattamento, le condizioni siano rispettate e il rischio di diffusione di organismi nocivi non sussista; la misura del trattamento adeguato può essere adottata anche rispetto ad organismi nocivi non elencati nell'allegato I o nell'allegato II.

(f) exceptionally and only in specific circumstances, appropriate treatment where it is considered by the responsible official body of the Member State that, as a result of the treatment, the conditions will be fulfilled and the risk of spreading harmful organisms is obviated; the measure of appropriate treatment may also be taken in respect of harmful organisms not listed in Annex I or Annex II.

L'articolo 11, paragrafo 3, secondo comma, si applica mutatis mutandis.

Article 11(3), second subparagraph, shall apply mutatis mutandis.

In caso di rifiuto di cui alla lettera a), o di trasporto verso una destinazione esterna alle Comunità di cui alla lettera b), o di ritiro di cui alla lettera c), gli Stati membri prescrivono che i certificati fitosanitari o i certificati fitosanitari di riesportazione, e qualsiasi altro documento presentato al momento dell'introduzione nel loro territorio di vegetali, prodotti vegetali o altre voci, siano annullati dall'organismo ufficiale responsabile. All'atto dell'annullamento sul certificato o sul documento viene apposto in prima pagina e in posizione visibile un timbro triangolare in rosso con la dicitura 'certificato annullato' o 'documento annullato' da detto organismo ufficiale, con la sua denominazione e la data del rifiuto, dell'inizio del trasporto verso una destinazione esterna alle Comunità o del ritiro. La dicitura figurerà in stampatello in almeno una delle lingue ufficiali della Comunità.

In the case of a refusal referred to in (a) or movement to a destination outside the Community referred to in (b) or of a removal referred to in (c), the Member States shall lay down that the phytosanitary certificates or the phytosanitary certificates for re-export, and any other document which have been produced when the plants, plant products or other objects were submitted for introduction into their territory, be cancelled by the responsible official body. Upon cancellation, the said certificates or documents shall bear on their face and in a prominent position a triangular stamp in red, marked 'certificate cancelled' or 'document cancelled' from the said official body, together with its denomination and the date of refusal, of the start of the movement to a destination outside the Community or of removal. It shall be in capital letters, and in at least one of the official languages, of the Community.

8. Fatte salve le notifiche e le informazioni necessarie a norma dell'articolo 16, gli Stati membri provvedono a che gli organismi ufficiali responsabili informino l'omologo servizio per la protezione dei vegetali del paese terzo di origine o speditore e la Commissione di tutti i casi in cui siano stati intercettati vegetali, prodotti vegetali o altre voci provenienti da tale paese terzo non conformi ai requisiti fitosanitari prescritti, e dei motivi di tale intercettazione, ferme restando le misure che lo Stato membro ritenga di adottare o abbia adottato nei confronti della spedizione intercettata. Queste informazioni sono trasmesse al più presto in modo che il servizio per la protezione dei vegetali interessato e, se del caso, anche la Commissione, possano esaminare il caso, in particolare per prendere le misure necessarie ad evitare che si verifichino in futuro casi analoghi. 8. Without prejudice to the notifications and information required under Article 16, Member States shall ensure that the responsible official bodies inform the plant protection organisation of the third country of origin or consignor third country and the Commission of all cases where plants, plant products or other objects coming from the relevant third country have been intercepted as not complying with the plant health requirements, and the reasons of the interception, without prejudice to the action which the Member State may take or has taken in respect of the intercepted consignment. The information shall be given as soon as possible so that the plant protection organisations concerned and, where appropriate, also the Commission, may study the case with a view, in particular, to taking the steps necessary to prevent further occurrences similar to the intercepted one. In accordance with the procedure referred to in Article 18(2), a standardised information system may be set up.

Articolo 13 quinquies

Article 13d

1. Gli Stati membri provvedono alla riscossione di una tassa ('tassa fitosanitaria') destinata a coprire le spese sostenute per i controlli documentali, i controlli di identità e i controlli fitosanitari di cui all'articolo 13 bis, paragrafo 1, eseguiti a norma dell'articolo 13. Il livello della tassa rispecchia:

1. Member States shall ensure the collection of fees (Phytosanitary fee) to cover the costs occasioned by the documentary checks, identity checks and plant health checks provided for in Article 13a(1), which are carried out pursuant to Article 13. The level of the fee shall reflect:

a) la retribuzione degli ispettori che eseguono i controlli summenzionati, compresi gli oneri sociali;

(a) the salaries, including social security, of the inspectors involved in the above checks;

b) l'ufficio, le infrastrutture, gli strumenti e le attrezzature messe a disposizione di tali ispettori;

(b) the office, other facilities, tools and equipment for these inspectors;

c) il prelievo di campioni per l'ispezione visiva o l'esecuzione di prove di laboratorio;

(c) the sampling for visual inspection or for laboratory testing;

d) le prove di laboratorio;

(d) laboratory testing;

e) l'attività amministrativa (comprese le spese generali di funzionamento) necessaria per l'esecuzione efficace dei controlli, che può comprendere le spese di formazione degli ispettori, sia prima che dopo la loro entrata in servizio.

(e) the administrative activities (including operational overheads) required for carrying out the checks concerned effectively, which may include the expenditure required for pre- and in-service training of inspectors.

2. Gli Stati membri hanno la facoltà di fissare il livello della tassa fitosanitaria in base ad un calcolo particolareggiato dei costi a norma del paragrafo 1, oppure di applicare la tassa standard indicata nell'allegato VIII bis.

2. Member States may either set the level of the Phytosanitary fee on the basis of a detailed cost calculation carried out in accordance with paragraph 1, or apply the standard fee as specified in Annex VIIIa.

Allorché, ai sensi dell'articolo 13 bis, paragrafo 2, i controlli di identità e i controlli fitosanitari per un determinato gruppo di vegetali, prodotti vegetali o altre voci originari di taluni paesi terzi, sono effettuati con frequenza ridotta, gli Stati membri riscuotono una tassa fitosanitaria ridotta in maniera proporzionale da tutte le spedizioni e partite di tale gruppo, a prescindere dal fatto che esse siano sottoposte o meno alle ispezioni.

When, pursuant to Article 13a(2), for a certain group of plants, plant products or other objects originating in certain third countries, identity checks and plant health checks are being carried out at reduced frequency, Member States shall collect a proportionally reduced Phytosanitary fee from all consignments and lots of that group, whether subjected to inspection or not.

Conformemente alle procedure di cui all'articolo 18, paragrafo 2, possono essere adottate misure di attuazione al fine di precisare il livello di detta tassa fitosanitaria ridotta.

In accordance with the procedure referred to in Article 18(2), implementing measures may be adopted to specify the level of this reduced Phytosanitary fee.

3. Allorché la tassa fitosanitaria è fissata da uno Stato membro in base alle spese sostenute dall'organismo ufficiale responsabile dello stesso Stato membro, gli Stati membri interessati trasmettono alla Commissione relazioni concernenti il metodo di calcolo delle tasse in relazione agli elementi elencati nel paragrafo 1.

3. When the Phytosanitary fee is set by a Member State on the basis of the costs borne by the responsible official body of that Member State, the Member States concerned shall communicate to the Commission reports specifying the method for calculating the fees in relation to the elements listed in paragraph 1.

Ogni tassa imposta a norma del primo comma non è superiore al costo effettivo sostenuto dall'organismo ufficiale responsabile dello Stato membro.

Any fee imposed in accordance with the first subparagraph shall be no higher than the actual cost borne by the responsible official body of the Member State.

4. Non è autorizzato il rimborso diretto o indiretto della tassa prevista dalla presente direttiva. Tuttavia, non è considerato rimborso indiretto l'eventuale applicazione della tassa standard di cui all'allegato VIII bis da parte di uno Stato membro.

4. No direct or indirect refund of the fees provided for in this Directive shall be permitted. However the possible application by a Member State of the standard fee as specified in Annex VIIIa shall not be considered an indirect refund.

5. La tassa standard di cui all'allegato VIII bis non pregiudica la riscossione di altre tasse destinate a coprire spese supplementari sostenute per attività particolari connesse ai controlli, quali le spese eccezionali di trasferta o i periodi di attesa degli ispettori dovuti a ritardi imprevisti nell'arrivo delle spedizioni, i controlli effettuati fuori dall'orario normale di lavoro, i controlli supplementari o le analisi di laboratorio supplementari rispetto a quelli previsti all'articolo 13, per confermare le conclusioni desunte dai controlli, misure fitosanitarie particolari da adottarsi in virtù di atti comunitari che si fondano sugli articoli 15 o 16, misure adottate a norma dell'articolo 13 quater, paragrafo 7, o la traduzione dei documenti richiesti.

5. The standard fee as specified in Annex VIIIa is without prejudice to extra charges to cover additional costs incurred in special activities relating to the checks, such as exceptional travelling by inspectors or waiting periods of inspectors due to delays in the arrival of consignments out of schedule, checks carried out outside normal working hours, supplementary checks or laboratory testing required in addition to those provided for in Article 13 for confirmation of conclusions drawn from the checks, special phytosanitary measures as required under Community acts based on Articles 15 or 16, measures taken pursuant to Article 13c(7), or the translation of required documents.

6. Gli Stati membri designano le autorità competenti per l'esazione della tassa fitosanitaria. La tassa è pagata dall'importatore o dal suo agente doganale.

6. Member States shall designate the authorities empowered to charge the Phytosanitary fee. The fee shall be payable by the importer, or his customs representatives.

7. La tassa fitosanitaria sostituisce tutte le altre tasse o gli altri diritti riscossi negli Stati membri a livello nazionale, regionale o locale, per l'esecuzione dei controlli di cui al paragrafo 1 e per la loro attestazione.

7. The Phytosanitary fee shall replace all other charges or fees levied in the Member States at national, regional or local level for the checks referred to in paragraph 1, and the attestation thereof.

Articolo 13 sexies

Article 13e

I 'certificati fitosanitari' e i 'certificati fitosanitari di riesportazione' rilasciati dagli Stati membri conformemente alle norme della CIPV, sono conformi al modello standard riportato nell'allegato VII.";

'Phytosanitary certificates' and 'phytosanitary certificates for re-export', which Member States issue under the IPPC shall be in the format of the standardised model given in Annex VII".

In accordance with the procedures referred to in the first subparagraph of paragraph 1, phytosanitary measures adopted by a third country for export into the Community shall be recognised as equivalent to the phytosanitary measures laid down in this Directive, in particular to those specified in Annex IV, if that third country objectively demonstrates to the Community that its measures achieve the Community's appropriate level of phytosanitary protection and if this is confirmed by the conclusions resulting from findings made on the occasion of reasonable access of the experts referred to in Article 21 for inspection, testing and other relevant procedures in the relevant third country.

Upon request by a third country, the Commission will enter into consultations with the aim of achieving bilateral or multilateral agreements on recognition of the equivalence of specified phytosanitary measures.

3. Nelle decisioni relative alla concessione di deroghe a norma del paragrafo 1, primo comma o al riconoscimento dell'equivalenza a norma del paragrafo 2 si prescrive che il paese esportatore deve aver dimostrato ufficialmente per iscritto, per ciascun caso specifico, la conformità alle condizioni ivi previste e si specifica inoltre quali dati deve contenere la dichiarazione ufficiale che conferma tale conformità.

3. Decisions providing for derogations pursuant to the first subparagraph of paragraph 1 or recognition of equivalence pursuant to paragraph 2, shall require that compliance with the conditions laid down therein has been officially established in writing by the exporting country for each individual case of use, and shall set out the details of the official statement confirming compliance.

4. Nelle decisioni di cui al paragrafo 3 si specifica se e in quale maniera gli Stati membri informano gli altri Stati membri e la Commissione di ciascun caso o gruppo di casi di ricorso a tali deroghe.";

(d) the following paragraph 5 shall be added: "5. If the Commission has not been informed of measures taken under paragraphs 1 or 2, or if it considers the measures taken to be inadequate, it may, pending the meeting of the Standing Committee on Plant Health, take interim protective measures based on a preliminary pest risk analysis to eradicate, or if that is not possible, inhibit the spread of the harmful organism concerned. These measures shall be submitted to the Standing Committee on Plant Health as soon as possible to be confirmed, amended or cancelled in accordance with the procedure referred to in Article 18(2).";

(b) in paragraph 5, in the second subparagraph, the following sentence shall be added after the third sentence: "This provision shall not apply to expenses resulting from the following types of requests made on the occasion of the participation of the said experts in the Member States' import inspections: laboratory testing and sampling for visual inspection or for laboratory testing, and already covered by the fees referred to in Article 13d.";

20) gli eventuali rinvii alla "procedura di cui all'articolo 17" o alla "procedura di cui all'articolo 18", contenuti in disposizioni diverse da quelle modificate dai precedenti punti da 1 a 18, si intendono fatti alla procedura di cui all'articolo 18, paragrafo 2.

When in any provision other than those amended in paragraph 1 to 18 reference is made to "in accordance with the procedure laid down in Article 17" or to "in accordance with the procedure laid down in Article 18", these words shall be replaced by the words "in accordance with the procedure referred to in Article 18(2)."

Gli Stati membri adottano e pubblicano anteriormente al 1o gennaio 2005 le disposizioni necessarie per conformarsi alla presente direttiva. Esse ne informano immediatamente la Commissione.

Member States shall adopt and publish before 1 January 2005, the provisions necessary to comply with this Directive. They shall forthwith inform the Commission thereof.

Tali disposizioni si applicano a decorrere dal 1o gennaio 2005.

They shall apply those provisions from 1 January 2005.

Quando gli Stati membri adottano tali disposizioni, queste contengono un riferimento alla presente direttiva o sono corredate di un siffatto riferimento all'atto della pubblicazione ufficiale. Le modalità del riferimento sono decise dagli Stati membri.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. The methods of making such a reference shall be laid down by the Member States.

Gli Stati membri comunicano alla Commissione il testo delle principali disposizioni di diritto interno che essi adottano nel settore disciplinato dalla presente direttiva.

Member States shall communicate to the Commission the text of the main provisions of national law, which they adopt in the field governed by this Directive.

La presente direttiva entra in vigore il giorno della pubblicazione nella Gazzetta ufficiale delle Comunità europee.

This Directive shall enter into force on the day of its publication in the Official Journal of the European Communities.
