Having regard to Regulation (EC) No
2037/2000 of the European Parliament and of the Council of 29
June 2000 on substances that deplete the ozone layer(1), as
amended by Regulation (EC) No 2038/2000(2), and Regulation
(EC) 2039/2000(3), and in particular to Article 7
thereof, |

Whereas: |
(1) L'articolo 7 stabilisce che
l'immissione in libera pratica nella Comunità di sostanze
controllate importate da paesi terzi è soggetta a restrizioni
quantitative. Le restrizioni sono fissate e alle imprese sono
assegnate quote per il periodo compreso tra il 1o gennaio e il
31 dicembre 1999 e per ciascun periodo successivo di dodici
mesi secondo la procedura di cui all'articolo 18, paragrafo 2.
Le quote sono assegnate solo per il bromuro di metile e gli
idroclorofluorocarburi (HCFC), nonché per le sostanze
controllate impiegate per usi essenziali o critici o per
applicazioni di quarantena o trattamento anteriore al
trasporto, per le sostanze usate come materie prime o come
agenti di fabbricazione o destinate alla distruzione. |
(1) Article 7 requires that the
release for free circulation in the Community of controlled
substances imported from third countries shall be subject to
quantitative limits. Those limits shall be determined and
quotas allocated to undertakings for the period 1 January to
31 December 1999 and for each 12-month period thereafter in
accordance with the procedure referred to in Article 18(2).
Such quotas shall only be set for methyl bromide and
hydrochlorofluorocarbons (HCFCs), and for controlled
substances used for essential or critical uses, in quarantine
and pre-shipment applications, as feedstock, as process agents
or for destruction. |
(2) I limiti quantitativi
all'immissione di sostanze controllate sul mercato comunitario
sono stabiliti all'articolo 4 e nell'allegato III. |

placing on the market in the Community of controlled
substances are set out in Article 4 and Annex III. |
(3) Eventuali modifiche dei
suddetti limiti non devono comportare, a livello comunitario,
un consumo di sostanze controllate superiore ai limiti
stabiliti dal protocollo di Montreal sulle sostanze che
riducono lo strato di ozono. |
(3) Any modification of these
quantitative limits may not lead to Community consumption of
controlled substances exceeding the quantitative limits
established according to the Montreal Protocol on substances
that deplete the ozone layer. |

che i produttori e gli importatori possono immettere sul
mercato o usare per proprio conto per un determinato periodo

calculated level of methyl bromide which producers and
importers may place on the market or use for their own account
for a given 12-month period, from 1 January to 31 December
2002. |

della quale ha ricevuto le dichiarazioni relative alle

notice to importers in the European Community of controlled
substances that deplete the ozone layer(4) and has thereby
received declarations on intended imports in 2002. |
(7) Per il bromuro di metile
destinato ad usi diversi dall'applicazione di quarantena e da
trattamenti anteriori al trasporto le quote di importazione
sono assegnate agli importatori primari, e per tali la
Commissione intende gli importatori che trattano direttamente,
fatturando, con i produttori al di fuori della Comunità. Sulla
quota di bromuro di metile di ciascun importatore è trattenuta
una riserva del 3,75 % ed una riserva di emergenza dell'1,25 %
da assegnare nel 2002 secondo la procedura di cui all'articolo
18, paragrafo 2. |
(7) For non quarantine and
pre-shipment uses of methyl bromide, the import quotas are
allocated to the primary importers, considered by the
Commission to be the importers who deal directly by way of
invoicing with the producers outside the Community; whereas a
reserve of 3,75 % and an emergency reserve of 1,25 % of each
importer's quota of methyl bromide is retained for allocation
during 2002 in accordance with the Article 18(2)
procedure. |
(8) Per il bromuro di metile
destinato all'applicazione di quarantena e a trattamenti
anteriori al trasporto, le quote di importazione sono
assegnate agli importatori primari, e per tali la Commissione
intende gli importatori che trattano direttamente, fatturando,
con i produttori al di fuori della Comunità. Sulla quota di
bromuro di metile di ciascun importatore è trattenuta una
riserva del 10 %, da assegnare nel 2002 secondo la procedura
di cui all'articolo 18, paragrafo 2. |
(8) For quarantine and pre-shipment
uses of methyl bromide, the import quotas are allocated to the
primary importers, considered by the Commission to be the
importers who deal directly by way of invoicing with the
producers outside the Community; whereas a reserve of 10 % of
each importer's quota of methyl bromide is retained for

(9) Per gli HCFC, l'assegnazione di
quote individuali ai produttori ed agli importatori si basa
sui principi di continuità, uguaglianza e proporzionalità. Nel
fissare le quote la Commissione ha tenuto conto della
necessità di ridurre ulteriormente la produzione,
l'importazione e l'uso di sostanze che riducono l'ozono e di
interferire il meno possibile con il funzionamento del
mercato. |
(9) For HCFCs the allocation of
individual quotas to producers and importers is based on the
principles of continuity, equality and proportionality. In
establishing quotas, the Commission has been guided by the
need to reduce further the production, import and use of
ozone-depleting substances and interfering in the market as
little as possible. |
(10) È opportuno riservare una
parte del livello calcolato totale di HCFC che può essere
immesso sul mercato agli importatori comunitari che non
producono HCFC. Nel 1998, nel 1999, nel 2000 e nel 2001 il
livello delle importazioni è stato pari al 4 % del livello
calcolato totale di HCFC disponibile per l'immissione sul
mercato. Per il 2002 è opportuno riservare il 4 % del
quantitativo totale di HCFC disponibile per l'immissione sul
mercato agli importatori che non producono HCFC. Tale
percentuale corrisponde ad un quantitativo di 227040 kg PRO
(Potenziale di riduzione dell'ozono - Ozone Depletion
Potential - ODP), da assegnare in base alle rispettive quote
di mercato del 1999 agli importatori che nello stesso anno
hanno ottenuto una quota, tenendo inoltre conto degli
effettivi quantitativi richiesti. |
(10) It is appropriate to retain
part of the total calculated level of HCFC that can be placed
on the market for allocation to importers in the Community who
are not engaged in the production of HCFCs. In 1998, 1999,
2000 and 2001, the level of imports was 4 % of the total
calculated level of HCFCs available to be placed on the
market. It is appropriate in 2002 to retain 4 % of the total
quantity of HCFCs available to place on the market for
allocation to importers who are not engaged in the production
of HCFCs. This corresponds to a quantity of 227040 ODP
kilograms to be allocated based on the relative market quota
share in 1999 of those importers who received a quota in that
year and also take account of the actual amounts
requested. |

sono autorizzate con apposita decisione della Commissione. |

authorised by a separate Commission Decision. |
(12) La Commissione rilascia le
licenze d'importazione ai sensi dell'articolo 6, previa
verifica del rispetto da parte dell'importatore delle
disposizioni di cui agli articoli 6, 7, 8 e 13. |
(12) Import licences shall be
issued by the Commission in accordance with Article 6, after
verification of compliance by the importer with Articles 6, 7,
8 and 13. |
(13) L'articolo 8 vieta
l'immissione in libera pratica nella Comunità o il
perfezionamento attivo di sostanze controllate importate da
Stati non parti del protocollo. |
(13) The release for free
circulation in the Community or inward processing of
controlled substances imported from any State not Party to the
Protocol is prohibited in accordance with Article 8. |
(14) Le misure previste dalla
presente decisione sono conformi al parere del comitato
istituito ai sensi dell'articolo 18, paragrafo 2, |

PRO. |

controllate del gruppo V (1,1,1-tricloroetano), oggetto del
regolamento (CE) n. 2037/2000, provenienti da fonti esterne e
che possono essere immesse in libera pratica nella Comunità
europea nel 2002 è di 400060 kg PRO. |

substances of group V (1,1,1-trichloroethane) subject to
Regulation (EC) No 2037/2000 that may be released for free
