Council Decision of 25 April 2002 concerning the approval, on behalf of the European Community, of the Kyoto Protocol to the United Nations Framework Convention on Climate Change and the joint fulfilment of commitments thereunder

Having regard to the Treaty establishing the European Community, and in particular Article 175(1) in conjunction with Article 300(2), first sentence of the first subparagraph, and Article 300(3), first subparagraph, thereof,

Whereas:

(1) L'obiettivo finale della convenzione quadro delle Nazioni Unite sui cambiamenti climatici (in seguito denominata "la convenzione"), approvata a nome della Comunità con decisione 94/69/CE del Consiglio, del 15 dicembre 1993, concernente la conclusione della convenzione quadro delle Nazioni Unite sui cambiamenti climatici(3), consiste nello stabilizzare le concentrazioni di gas ad effetto serra nell'atmosfera a un livello tale che escluda qualsiasi pericolosa interferenza antropica con il sistema climatico.

(1) The ultimate objective of the United Nations Framework Convention on Climate Change ("the Convention"), which was approved on behalf of the Community by Council Decision 94/69/EC of 15 December 1993 concerning the conclusion of the United Nations Framework Convention on Climate Change(3), is to achieve stabilisation of greenhouse-gas concentrations in the atmosphere at a level which prevents dangerous anthropogenic interference with the climate system.

(2) La conferenza delle parti della convenzione ha concluso, nella prima sessione, che l'impegno dei paesi sviluppati a riportare, entro il 2000, individualmente o congiuntamente ai livelli del 1990, le proprie emissioni di biossido di carbonio e di altri gas serra non inclusi nel protocollo di Montreal allegato alla convenzione di Vienna sulla protezione della ozonosfera, è insufficiente per il conseguimento dell'obiettivo di lungo termine della convenzione, consistente nella prevenzione delle interferenze antropiche pericolose con il sistema climatico. La conferenza ha convenuto inoltre di avviare un processo che consentisse, mediante l'adozione di un protocollo o di un altro idoneo atto giuridico(4), opportuni interventi nel periodo successivo al 2000.

(2) The Conference of the Parties to the Convention, at its first session, concluded that the commitment by developed countries to aim at returning, individually or jointly, their emissions of carbon dioxide and other greenhouse gases not controlled by the Montreal Protocol to the Convention for the Protection of the Ozone Layer to 1990 levels by the year 2000 was inadequate for achieving the Convention's long-term objective of preventing dangerous anthropogenic interference with the climate system. The Conference further agreed to begin a process to enable appropriate action to be taken for the period beyond 2000, through the adoption of a protocol or another legal instrument(4).

(3) Questo processo ha portato l'11 dicembre 1997 all'adozione del protocollo di Kyoto della convenzione quadro delle Nazioni Unite sui cambiamenti climatici (in seguito denominato: "il protocollo")(5).

(3) This process resulted in the adoption on 11 December 1997 of the Kyoto Protocol to the United Nations Framework Convention on Climate Change ("the Protocol")(5).

(4) La conferenza delle parti della convenzione, nella quarta sessione, ha deciso di adottare il piano di azione di Buenos Aires per il raggiungimento di un accordo sull'attuazione degli elementi essenziali del protocollo nella sesta sessione della conferenza delle parti(6).

(4) The Conference of the Parties to the Convention, at its fourth session, decided to adopt the Buenos Aires Plan of Action, to reach agreement on the implementation of key elements of the Protocol at the sixth session of the Conference of the Parties(6).

(5) Gli elementi essenziali per l'attuazione del piano di azione di Buenos Aires sono stati approvati all'unanimità dalla conferenza delle parti nella sesta sessione svoltasi a Bonn dal 19 al 27 luglio 2001(7).

(5) The core elements for the implementation of the Buenos Aires Plan of Action were agreed upon by consensus by the Conference of the Parties at its resumed sixth session in Bonn from 19 to 27 July 2001(7).

(8) The Protocol, under Article 4, provides for Parties to fulfil their commitments under Article 3 jointly, acting in the framework of and together with a regional economic integration organisation.

(9) Al momento della firma del protocollo a New York, il 29 aprile 1998, la Comunità europea ha dichiarato che essa e i suoi Stati membri avrebbero, ai sensi dell'articolo 4, adempiuto congiuntamente agli impegni assunti a norma dell'articolo 3, paragrafo 1 del protocollo.

(9) When the Protocol was signed in New York on 29 April 1998, the Community declared that it and its Member States would fulfil their respective commitments under Article 3(1) of the Protocol jointly in accordance with Article 4 thereof.

(10) Nel decidere di adempiere congiuntamente agli impegni assunti ai sensi dell'articolo 4 del protocollo di Kyoto, la Comunità e i suoi Stati membri sono congiuntamente responsabili, ai sensi dell'articolo 4, paragrafo 6 e a norma dell'articolo 24, paragrafo 2 del protocollo, dell'adempimento, da parte della Comunità, dell'impegno quantificato di riduzione delle emissioni assunto ai sensi dell'articolo 3, paragrafo 1 del protocollo. Di conseguenza, a norma dell'articolo 10 del trattato che istituisce la Comunità europea, gli Stati membri hanno collettivamente e individualmente l'obbligo di adottare tutte le opportune misure di carattere generale e particolare atte ad assicurare l'esecuzione degli obblighi risultanti dall'azione decisa dalle istituzioni della Comunità, incluso l'impegno quantificato di riduzione delle emissioni ai sensi del protocollo, di agevolare l'adempimento di tale impegno e di astenersi da qualsiasi misura che rischi di compromettere la realizzazione dello stesso.

(10) In deciding to fulfil their commitments jointly in accordance with article 4 of the Kyoto Protocol, the Community and the Member States are jointly responsible, under paragraph 6 of that article and in accordance with article 24(2) of the Protocol, for the fulfilment by the Community of its quantified emission reduction commitment under Article 3(1) of the Protocol. Consequently, and in accordance with Article 10 of the Treaty establishing the European Community, Member States individually and collectively have the obligation to take all appropriate measures, whether general or particular, to ensure fulfilment of the obligations resulting from action taken by the institutions of the Community, including the Community's quantified emission reduction commitment under the Protocol, to facilitate the achievement of this commitment and to abstain from any measure that could jeopardise the attainment of this commitment.

(11) La base giuridica di eventuali ulteriori decisioni in relazione all'approvazione da parte della Comunità di impegni futuri concernenti le riduzioni delle emissioni sarà stabilità in base al contenuto e agli effetti della decisione medesima.

(11) The legal base of any further Decision in relation to the approval by the Community of future commitments in respect of emission reductions will be determined by the content and effect of that Decision.

(12) Il Consiglio è giunto ad un accordo sui contributi dei singoli Stati membri all'adempimento dell'impegno globale di riduzione delle emissioni della Comunità nelle conclusioni del Consiglio del 16 giugno 1998(9). Taluni Stati membri hanno formulato ipotesi sulle emissioni dell'anno di riferimento e sulle politiche e sulle misure comuni e coordinate. I contributi sono stati differenziati in considerazione, fra l'altro, delle aspettative di crescita economica, della situazione in materia di energia e della struttura industriale di ciascuno Stato membro. Il Consiglio ha inoltre convenuto di inserire il contenuto dell'accordo nella decisione del Consiglio concernente l'approvazione del protocollo da parte della Comunità. L'articolo 4, paragrafo 2 del protocollo stabilisce che la Comunità e i suoi Stati membri notifichino al Segretariato, istituito dall'articolo 8 della convenzione, il contenuto dell'accordo alla data del deposito dei loro strumenti di ratifica o di approvazione. La Comunità e gli Stati membri sono tenuti ad adottare le misure necessarie affinché la Comunità possa adempiere ai suoi obblighi ai sensi del protocollo, fatta salva la responsabilità di ogni Stato membro nei confronti della Comunità e degli altri Stati membri per quanto riguarda l'adempimento dei suoi impegni.

(12) The Council agreed upon the contributions of each Member State to the overall Community reduction commitment in the Council conclusions of 16 June 1998(9). Certain Member States expressed assumptions concerning base year emissions and common and coordinated policies and measures. The contributions are differentiated to take account i.a. of expectations for economic growth, the energy mix and the industrial structure of the respective Member State. The Council further agreed that the terms of the agreement would be included in the Council Decision on the approval of the Protocol by the Community. Article 4(2) of the Protocol requires the Community and its Member States to notify the Secretariat, established by Article 8 of the Convention, of the terms of this agreement on the date of deposit of their instruments of ratification or approval. The Community and its Member States have an obligation to take measures in order to enable the Community to fulfil its obligations under the Protocol without prejudice to the responsibility of each Member State towards the Community and other Member States to fulfilling its own commitments.

(13) Le emissioni dell'anno di riferimento della Comunità e dei suoi Stati membri non saranno determinate in modo definitivo prima dell'entrata in vigore del protocollo. Una volta che le emissioni dell'anno di riferimento saranno state determinate in modo definitivo e, comunque, prima dell'inizio del periodo di adempimento, la Comunità e i suoi Stati membri fisseranno tali livelli di emissione in termini di tonnellate di biossido di carbonio equivalente, secondo la procedura di cui all'articolo 8 della decisione 93/389/CEE del Consiglio, del 24 giugno 1993, su un meccanismo di controllo delle emissioni di CO2 e di altri gas ad effetto serra nella Comunità(10).

(13) The base-year emissions of the Community and its Member States will not be established definitively before the entry into force of the Protocol. Once these base-year emissions are definitively established and at the latest before the start of the commitment period, the Community and its Member States shall determine these emission levels in terms of tonnes of carbon dioxide equivalent in accordance with the procedure referred to in Article 8 of Council Decision 93/389/EEC of 24 June 1993 for a monitoring mechanism of Community CO2 and other greenhouse gas emissions(10).

(14) Il Consiglio europeo di Göteborg del 15 e 16 giugno 2001 ha ribadito la determinazione della Comunità e degli Stati membri a rispettare gli impegni assunti nel protocollo e ha dichiarato che la Commissione avrebbe preparato una proposta di ratifica entro la fine del 2001 in modo da consentire alla Comunità e ai suoi Stati membri di osservare l'impegno di rapida ratifica del protocollo.

(14) The Gothenburg European Council on 15 and 16 June 2001 reaffirmed the determination of the Community and the Member States to meet their commitments under the Protocol, and stated that the Commission will prepare a proposal for ratification before the end of 2001 making it possible for the Community and its Member States to fulfil their commitment rapidly to ratify the Protocol.

(15) Il Consiglio europeo di Laeken del 14 e 15 dicembre 2001 ha confermato la determinazione dell'Unione ad onorare i suoi impegni nell'ambito del protocollo di Kyoto ed il suo auspicio che il protocollo entri in vigore prima del vertice mondiale di Johannesburg sullo sviluppo sostenibile che si svolgerà dal 26 agosto al 4 settembre 2002.

(15) The Laeken European Council on 14 and 15 December 2001 confirmed the Union's determination to honour its commitment under the Kyoto Protocol and its desire that the Protocol should come into force before the Johannesburg World Summit on Sustainable Development, 26 August to 4 September 2002.

(16) Le misure necessarie per l'attuazione della presente decisione sono adottate secondo la decisione 1999/468/CE del Consiglio, del 28 giugno 1999, recante modalità per l'esercizio delle competenze di esecuzione conferite alla Commissione(11),

(16) The measures necessary for the implementation of this Decision should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(11),

HA ADOTTATO LA PRESENTE DECISIONE:

HAS ADOPTED THIS DECISION:

Articolo 1

Article 1

Il protocollo di Kyoto allegato alla convenzione quadro delle Nazioni Unite sui cambiamenti climatici (in seguito denominato: "il protocollo"), firmato il 29 aprile 1998 a New York, è approvato a nome della Comunità europea.

The Kyoto Protocol to the United Nations Framework Convention on Climate Change ("the Protocol") signed on 29 April 1998 in New York is hereby approved on behalf of the European Community.

Il testo del protocollo è riportato nell'allegato I.

The text of the Protocol is set out in Annex I.

Articolo 2

Article 2

La Comunità europea e i suoi Stati membri adempiono congiuntamente, ai sensi dell'articolo 4 del protocollo, agli impegni assunti a norma dell'articolo 3, paragrafo 1 del protocollo stesso e nel pieno rispetto delle disposizioni dell'articolo 10 del trattato che istituisce la Comunità europea.

The European Community and its Member States shall fulfil their commitments under Article 3(1) of the Protocol jointly, in accordance with the provisions of Article 4 thereof, and with full regard to the provisions of Article 10 of the Treaty establishing the European Community.

Gli impegni quantificati di limitazione e di riduzione delle emissioni approvati dalla Comunità europea e dai suoi Stati membri al fine di stabilire i livelli di emissione assegnati rispettivamente a ciascuno di essi nel primo periodo di adempimento degli impegni quantificati di limitazione e riduzione delle emissioni, dal 2008 al 2012, sono stabiliti nell'allegato II.

The quantified emission limitation and reduction commitments agreed by the European Community and its Member States for the purpose of determining the respective emission levels allocated to each of them for the first quantified emission limitation and reduction commitment period, from 2008 to 2012, are set out in Annex II.

La Comunità europea e i suoi Stati membri adottano le misure necessarie per conformarsi ai livelli di emissione stabiliti nell'allegato II, previsti a norma dell'articolo 3 della presente decisione.

The European Community and its Member States shall take the necessary measures to comply with the emission levels set out in Annex II, as determined in accordance with Article 3 of this Decision.

Articolo 3

Entro il 31 dicembre 2006 e secondo la procedura di cui all'articolo 4, paragrafo 2 della presente decisione, la Commissione stabilisce i livelli di emissione assegnati rispettivamente alla Comunità europea e a ciascuno dei suoi Stati membri in termini di tonnellate equivalenti di biossido di carbonio, previa determinazione dei dati definitivi di emissione dell'anno di riferimento e in base agli impegni quantificati di limitazione o riduzione stabiliti nell'allegato II, tenendo conto delle metodologie per la stima delle emissioni antropiche dalle fonti e dall'assorbimento dei pozzi di cui all'articolo 5, paragrafo 2 del protocollo e delle modalità di calcolo delle quantità assegnate a norma dell'articolo 3, paragrafi 7 e 8 del protocollo.

The Commission shall, at the latest by 31 December 2006 and in accordance with the procedure referred to in Article 4(2) of this Decision, determine the respective emission levels allocated to the European Community and to each Member State in terms of tonnes of carbon dioxide equivalent following the establishment of definitive base-year emission figures and on the basis of the quantified emission limitation or reduction commitments set out in Annex II, taking into account the methodologies for estimating anthropogenic emissions by sources and removals by sinks referred to in Article 5(2) of the Protocol and the modalities for the calculation of assigned amount pursuant to Article 3(7) and (8) of the Protocol.

La quantità assegnata alla Comunità europea e a ciascuno dei suoi Stati membri è uguale ai livelli di emissione stabiliti rispettivamente per ognuno di essi a norma del presente articolo.

The assigned amount of the European Community and of each Member State shall be equal to its respective emission level determined in accordance with this Article.

Articolo 4

Article 4

1. La Commissione è assistita dal comitato istituito dall'articolo 8 della decisione 93/389/CE.

1. The Commission shall be assisted by the committee instituted by Article 8 of Decision 93/389/EEC.

2. Nei casi in cui è fatto riferimento al presente paragrafo, si applicano gli articoli 5 e 7 della decisione 1999/468/CE.

2. Where reference is made to this paragraph, Articles 5 and 7 of Decision 1999/468/EC shall apply.

Il periodo di cui all'articolo 5, paragrafo 6 della decisione 1999/468/CE è fissato a tre mesi.

The period laid down in Article 5(6) of Decision 1999/468/EC shall be set at three months.

3. Il comitato adotta il proprio regolamento interno.

1. The President of the Council is hereby authorised to designate the person or persons empowered to notify, on behalf of the European Community, this Decision to the Secretariat of the United Nations Framework Convention on Climate Change in accordance with Article 4(2) of the Protocol.

2. Il Presidente del Consiglio è autorizzato a designare la (le) persona (persone) abilitata (abilitate) a depositare lo strumento di approvazione, alla stessa data della notifica di cui al paragrafo 1, presso il Segretario Generale delle Nazioni Unite a norma dell'articolo 24, paragrafo 1 del protocollo, al fine di esprimere il consenso della Comunità ad essere vincolata dall'atto.

2. The President of the Council is hereby authorised to designate the person or persons empowered to deposit, on the same date as the notification referred to in paragraph 1, the instrument of approval with the Secretary-General of the United Nations in accordance with Article 24(1) of the Protocol, in order to express the consent of the Community to be bound.

3. Il Presidente del Consiglio è autorizzato a designare la (le) persona (persone) abilitata (abilitate) a depositare, alla stessa data della notifica di cui al paragrafo 1, la dichiarazione di competenza di cui all'allegato III, a norma dell'articolo 24, paragrafo 3 del protocollo.

3. The President of the Council is hereby authorised to designate the person or persons empowered to deposit, on the same date as the notification referred to in paragraph 1, the declaration of competence set out in Annex III, according to the provisions of Article 24(3) of the Protocol.

Quando depositano i loro strumenti di ratifica o di approvazione del protocollo, gli Stati membri notificano, nello stesso tempo e a proprio nome, la presente decisione al Segretariato della convenzione quadro delle Nazioni Unite sui cambiamenti climatici a norma dell'articolo 4, paragrafo 2 del protocollo.

1. When depositing their instruments of ratification or approval of the Protocol, Member States shall notify, at the same time and on their own behalf, this Decision to the Secretariat of the United Nations Framework Convention on Climate Change in accordance with Article 4(2) of the Protocol.

2. Gli Stati membri si adoperano per intraprendere le necessarie iniziative in vista del deposito dei loro strumenti di ratifica o di approvazione simultaneamente a quelli della Comunità europea e degli altri Stati membri e, per quanto possibile, entro il 1o giugno 2002.

2. Member States shall endeavour to take the necessary steps with a view to depositing their instruments of ratification or approval simultaneously with those of the European Community and the other Member States and as far as possible not later than 1 June 2002.

3. Gli Stati membri informano la Commissione, entro il 1o aprile 2002, delle loro decisioni di ratificare o approvare il protocollo ovvero a seconda della circostanza della probabile data di conclusione dei relativi procedimenti. La Commissione, in cooperazione con gli Stati membri, decide una data per il deposito simultaneo degli strumenti di ratifica o approvazione.

3. Member States shall inform the Commission not later than 1 April 2002 of their decisions to ratify or to approve the Protocol or, according to the circumstances, of the probable date of completion of the requisite procedures. The Commission shall, in cooperation with the Member States, arrange a date for depositing the instruments of ratification or approval simultaneously.
