IL PARLAMENTO EUROPEO E IL CONSIGLIO DELL'UNIONE EUROPEA,	THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,
visto il trattato che istituisce la Comunità europea, in particolare l'articolo 175, paragrafo 1,	Having regard to the Treaty establishing the European Community, and in particular Article 175(1) thereof,
vista la proposta della Commissione(1),	Having regard to the proposal from the Commission(1),

ai sensi della procedura di cui all'articolo 251 del trattato(3),	Acting in accordance with the procedure laid down in Article 251 of the Treaty(3),
considerando quanto segue:	Whereas:
(1) Il periodo di applicazione del regolamento (CEE) n. 3528/86(4), scadeva il 31 dicembre 1996. Tale regolamento è stato modificato dal regolamento (CE) n. 307/97 del Consiglio(5). Nella sentenza pronunciata il 25 febbraio 1999 nelle cause riunite C-164/97 e C-165/97(6) la Corte di giustizia delle Comunità europee ha annullato il regolamento (CE) n. 307/97 ma ne ha conservato gli effetti fino all'adozione di un nuovo regolamento che sostituisce quello annullato. È opportuno, al fine di garantire la certezza del diritto, assicurare che le misure adottate in applicazione del regolamento annullato permangano valide.	(1) The period of application of Regulation (EEC) No 3528/86(4) expired on 31 December 1996. The said Regulation was amended by Regulation (EC) No 307/97(5). In its judgment of 25 February 1999 in Joined Cases C-164/97 and C-165/97(6) the Court of Justice of the European Communities annulled Council Regulation (EC) No 307/97 but preserved its legal effects pending the adoption of a new Regulation which replaces the Regulation annulled. In order to guarantee legal certainty, the validity of the measures taken in application of the annulled Regulation should be ensured.
(2) Le foreste svolgono una funzione essenziale per preservare gli equilibri ecologici fondamentali, in particolare per quanto riguarda il suolo, il regime delle acque, il clima, la fauna e la flora. Tali equilibri ecologici sono indispensabili per un'agricoltura sostenibile e per la gestione dello spazio rurale.	(2) Forests play an essential part in maintaining fundamental ecological balances, particularly as regards the soil, water resources, climate, fauna and flora. Those ecological balances are indispensable for sustainable agriculture and the management of rural areas.
(3) È opportuno prendere in considerazione l'importanza della foresta negli ecosistemi degli Stati membri della Comunità.	(3) The importance of forests in the ecosystems of the Member States of the Community should be taken into account.
(4) La conservazione del patrimonio forestale è di grande importanza dal punto di vista economico, ecologico e sociale e contribuisce, in particolare, a salvaguardare la situazione sociale della popolazione attiva nel settore dell'agricoltura e nelle zone rurali.	(4) The conservation of the forest ecosystems reflects economic, ecological and social concerns and contributes, in particular, towards safeguarding the social function of those working in agriculture and in rural areas.
(5) La Comunità e gli Stati membri si sono impegnati a livello internazionale e in occasione delle tre conferenze ministeriali paneuropee sulla protezione delle foreste in Europa, svoltesi a Strasburgo nel 1990, a Helsinki nel 1993 e a Lisbona nel 1998 per una sorveglianza permanente dei danni subiti dalle foreste. L'azione comunitaria prevista dal regolamento (CEE) n. 3528/86 contribuisce a dar seguito a tali impegni.	(5) The Community and the Member States committed themselves at international level at the three pan-European Ministerial Conferences on the Protection of Forests in Europe, held in Strasbourg in 1990, in Helsinki in 1993 and in Lisbon in 1998, to continuous surveillance of forest damage. The Community scheme provided for by Regulation (EEC) No 3528/86 contributes to the fulfilment of this commitment.
(6) I risultati della rete di osservazione sistematica rivelano chiare tendenze nella ripartizione spazio-temporale dei danni subiti dalle foreste su tutto il territorio della Comunità.	(6) Results from the systematic survey network show obvious trends in spatial and temporal distribution of forest damage over the entire area of the Community.
(7) Gli Stati membri hanno creato piazzole di osservazione permanenti per la sorveglianza intensiva e continua degli ecosistemi forestali. Il proseguimento di queste attività di monitoraggio a più lungo termine contribuirà a una migliore comprensione del rapporto di causa-effetto tra le alterazioni degli ecosistemi forestali e i fattori che le determinano.	(7) Plots for the intensive and continuous monitoring of forest ecosystems have been set up by the Member States. A continuation of this monitoring activity over a longer period will improve understanding of the causal relationship between changes in forest ecosystems and the factors influencing them.
(8) I danni subiti dalle foreste dovuti a diversi fattori, in particolare all'inquinamento atmosferico e ad alcuni fattori meteorologici avversi, compromettono lo sviluppo di un'agricoltura sostenibile e la gestione delle zone rurali.	(8) Damage caused to forests by various factors, especially atmospheric pollution and certain unfavourable meteorological factors, hampers the development of sustainable agricultural activity and the management of rural areas.
(9) La protezione delle foreste dall'inquinamento atmosferico e da alcuni fattori avversi sfavorevoli contribuisce pertanto direttamente alla realizzazione degli obiettivi di cui all'articolo 33, paragrafo 1, lettera b), del trattato.	(9) The protection of forests against atmospheric pollution and other unfavourable meteorological factors therefore contributes directly to the achievement of the aims set out in Article 33(1)(b) of the Treaty.
(10) È pertanto opportuno proseguire l'azione prevista dal regolamento (CEE) n. 3528/86 e prorogarne la durata di cinque anni, per una durata complessiva di 15 anni a partire dal 1o gennaio 1987.	(10) Consequently the scheme provided for by Regulation (EEC) No 3528/86 should be continued and its duration extended for five years, its period of application thereby being extended to 15 years as from 1 January 1987.
(11) Le misure per l'esecuzione del regolamento (CEE) n. 3528/86 sono adottate in conformità della decisione 1999/468/CE del Consiglio, del 28 giugno 1999, recante modalità per l'esercizio delle competenze di esecuzione conferito alla Commissione(7).	(11) The measures necessary for the implementation of Regulation (EEC) No 3528/86 should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(7).
(12) Il presente regolamento stabilisce, per tutta la durata dell'azione, una dotazione finanziaria che costituisce per l'autorità di bilancio, nel quadro della procedura di bilancio annuale, il riferimento privilegiato ai sensi del punto 33 dell'accordo interistituzionale del 6 maggio 1999 tra il Parlamento europeo, il Consiglio e la Commissione sulla disciplina di bilancio e il miglioramento della procedura di bilancio(8).	(12) This Regulation establishes for the entire duration of the measure a financial framework which is to be the principal point of reference, within the meaning of point 33 of the Interinstitutional Agreement of 6 May 1999 between the European Parliament, the Council and the Commission on budgetary discipline and improvement of the budgetary procedure(8), for the budgetary authority under the annual budgetary procedure.

HANNO ADOTTATO IL PRESENTE REGOLAMENTO:	HAVE ADOPTED THIS REGULATION:
Articolo 1	Article 1
Il regolamento (CEE) n. 3528/86 è modificato come segue:	Regulation (EEC) No 3528/86 is hereby amended as follows:
1) Gli articoli 7, 8 e 9 sono sostituiti dagli articoli 7 e 8 seguenti:	1. Articles 7, 8 and 9 shall be replaced by Articles 7 and 8 as follows:

1. La Commissione è assistita dal comitato permanente forestale (in seguito denominato 'il comitato').	1. The Commission shall be assisted by the Standing Forestry Committee (hereinafter referred to as 'the Committee').
2. Nei casi in cui è fatto riferimento al presente paragrafo si applicano gli articoli 3 e 7 della decisione 1999/468/CE, tenendo conto delle disposizioni dell'articolo 8 della stessa.	2. Where reference is made to this paragraph, Articles 3 and 7 of Decision 1999/468/EC shall apply, having regard to the provisions of Article 8 thereof.
3. Nei casi in cui è fatto riferimento al presente paragrafo si applicano gli articoli 5 e 7 della decisione 1999/468/CE, tenendo conto delle disposizioni dell'articolo 8 della stessa.	3. Where reference is made to this paragraph, Articles 5 and 7 of Decision 1999/468/EC shall apply, having regard to the provisions of Article 8 thereof.
Il periodo di cui all'articolo 5, paragrafo 6, della decisione 1999/468/CE è fissato a tre mesi.	The period provided for in Article 5(6) of Decision 1999/468/EC shall be set at three months.
4. Il comitato adotta il proprio regolamento interno.	4. The Committee shall adopt its rules of procedure.
Articolo 8	Article 8
1. Le misure necessarie per l'attuazione del presente regolamento nelle seguenti materie sono adottate secondo la procedura consultiva di cui all'articolo 7, paragrafo 2:	1. The measures necessary for the implementation of this Regulation relating to the matters referred to below shall be adopted in accordance with the advisory procedure referred to in Article 7(2):
a) bilanci periodici di cui all'articolo 3;	(a) the periodic reports referred to in Article 3;
b) esperienze e progetti di cui all'articolo 4, anteriormente a qualsiasi decisione della Commissione in merito al loro finanziamento;	(b) the experiments and projects referred to in Article 4, before any Commission decision on their financing;
c) evoluzione delle attività di coordinamento e di supervisione dell'azione di cui all'articolo 5;	(c) the development of the coordination and monitoring activities referred to in Article 5;
d) adozione di un programma per la gestione sintetica delle informazioni sulle conoscenze acquisite concernenti l'inquinamento atmosferico nelle foreste e i suoi effetti.	(d) the establishment of a programme for the synoptic processing of information on knowledge of atmospheric pollution in woodland and its effects.
Il comitato può prendere in esame, secondo la medesima procedura, ogni altro problema riguardante il campo di applicazione del presente regolamento.	In accordance with the same procedure the Committee may examine any other question within the scope of this Regulation.
2. Le misure necessarie per l'attuazione del presente regolamento nelle seguenti materie sono adottate secondo la procedura di regolamentazione di cui all'articolo 7, paragrafo 3:	2. The measures necessary for the implementation of this Regulation relating to the matters referred to below shall be adopted in accordance with the regulatory procedure referred to in Article 7(3):
a) modalità d'applicazione dell'articolo 2, in particolare quelle relative alla raccolta, alla natura, alla comparabilità e alla trasmissione dei dati raccolti;	(a) the detailed rules for the implementation of Article 2 and in particular those relating to the gathering, type, comparability and transmission of the data collected;
b) modalità d'applicazione dell'articolo 3;	(b) the detailed rules for implementing Article 3;
c) modalità e criteri di applicazione dell'articolo 4."	(c) the detailed rules and criteria for implementing Article 4."
2) L'articolo 11 è sostituito dal seguente:	2. Article 11 shall be replaced by the following:
"Articolo 11	"Article 11
1. L'azione è prevista per una durata di quindici anni a partire dal 1o gennaio 1987.	1. The scheme shall run for 15 years from 1 January 1987.
2. La dotazione finanziaria per l'esecuzione dell'azione per il periodo 1997-2001 è pari a 35,1 milioni di EUR.	2. The financial allocation for the implementation of the scheme shall be EUR 35,1 million for the period 1997 to 2001.
Gli stanziamenti annui sono autorizzati dall'autorità di bilancio entro il limite delle prospettive finanziarie.	Annual appropriations shall be authorised by the budgetary authority within the limits of the financial perspective.
3. Prima dello scadere del periodo di cui al paragrafo 1, la Commissione presenta al Parlamento europeo e al Consiglio una relazione sull'applicazione del presente regolamento nonché una proposta di revisione attinente in particolare agli aspetti ecologici, economici e sociali (valutazione qualitativa) e ai risultati di un'analisi costi-benefici (valutazione quantitativa)."	3. Before expiry of the period referred to in paragraph 1, the Commission shall submit to the European Parliament and to the Council a report on the application of this Regulation and a proposal for revision covering in particular the ecological, economic and social aspects (qualitative assessment) and the results of a cost-benefit analysis (quantitative assessment)."
3) All'articolo 2, paragrafo 3, all'articolo 3, paragrafo 2, e all'articolo 4, paragrafo 4, i termini "procedura prevista all'articolo 7" sono sostituiti da "procedura prevista all'articolo 7, paragrafo 3".	3. In Article 2(3), Article 3(2) and Article 4(4) the words "procedure provided for in Article 7" or "procedure laid down in Article 7" shall be replaced by "procedure provided for in Article 7(3)".
4) All'articolo 4 bis, paragrafo 3, i termini "procedura prevista all'articolo 8" sono sostituiti da "procedura prevista all'articolo 7, paragrafo 2".	4. In Article 4a(3) the words "procedure laid down in Article 8" shall be replaced by "procedure laid down in Article 7(2).".
Articolo 2	Article 2
Qualunque riferimento a una misura adottata in applicazione del regolamento (CE) n. 307/97 va inteso come riferimento a una misura adottata in applicazione del presente regolamento, a decorrere dalla data di entrata in vigore di quest'ultimo.	Any reference to a measure taken in application of Regulation (EC) No 307/97 shall be taken as a reference to a measure taken in application of this Regulation from the day of the latter's entry into force.
Articolo 3	Article 3
Il presente regolamento entra in vigore il giorno successivo alla pubblicazione nella Gazzetta ufficiale delle Comunità europee.	This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Communities.
Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri.	This Regulation shall be binding in its entirety and directly applicable in all Member States.
