Comunicazione agli importatori della Comunità europea di sostanze controllate e di nuove sostanze che riducono lo strato di ozono, relativa al regolamento (CE) n. 2037/2000 del Parlamento europeo e del Consiglio sulle sostanze che riducono lo strato di ozono(1)

Notice to importers in the European Community of controlled and new substances that deplete the ozone layer, regarding regulation (EC) No 2037/2000 of the European Parliament and of the Council on substances that deplete the ozone layer(1)

I. La presente comunicazione è destinata alle imprese che nel 2002 intendono importare nell'Unione europea le seguenti sostanze da paesi terzi:

I. This notice is addressed to undertakings that intend to import the following substances into the European Union from sources outside the European Community in 2002.

Gruppo I: CFC 11, 12, 113, 114 o 115;

Group I: CFC 11, 12, 113, 114 or 115,

Gruppo II: altri CFC completamente alogenati;

Group II: other fully halogenated CFCs,

Gruppo III: halon 1211, 1301 o 2402;

Group III: halon 1211, 1301 or 2402,

Gruppo IV: tetracloruro di carbonio;

Group IV: carbon tetrachloride,

Gruppo V: 1,1,1 tricloroetano;

Group V: 1,1,1-trichloroethane,

Gruppo VI: bromuro di metile;

Group VI: methyl bromide,

Gruppo VII: idrobromofluorocarburi;

Group VII: hydrobromofluorocarbons,

Gruppo VIII: idroclorofluorocarburi;

Group VIII: hydrochlorofluorocarbons,

Nuove sostanze: Bromoclorometano.

New substances: bromochloromethane.

II. L'articolo 7 del regolamento (CE) n. 2037/2000 stabilisce che l'importazione delle sostanze elencate nei gruppi da I a VIII dell'allegato I della presente comunicazione è soggetta a limitazioni quantitative e che per tali sostanze sono assegnate ai produttori e agli importatori contingenti per il 2002(2).

II. Article 7 of Regulation (EC) No 2037/2000 requires that quantitative limits be set and quotas allocated to producers and importers for 2002 for the import of the substances listed under Groups I to VIII of Annex I to this Notice(2).

Sono assegnati contingenti per:

Quotas shall be allocated for:

a) bromuro di metile, compresi gli usi per quarantena e prima della spedizione, secondo quanto definito dalle parti del protocollo di Montreal;

(a) methyl bromide: including for quarantine and preshipment uses as defined by the Parties to the Montreal Protocol;

b) HCFC;

(b) HCFCs;

c) usi essenziali o critici: scopi considerati essenziali in conformità dei criteri specificati nella decisione IV/25 delle parti del Protocollo di Montreal e approvati dalla Commissione in conformità dell'articolo 18 del regolamento. È stata pubblicata un'apposita comunicazione riguardante gli usi essenziali. Le imprese che desiderano importare sostanze controllate per usi essenziali devono richiedere l'autorizzazione mediante il formulario accluso alla comunicazione stessa;

(c) essential or critical uses: purposes considered essential in accordance with the criteria set out in Decision IV/25 of the Parties to the Montreal Protocol and approved by the Commission pursuant to Article 18 of the Regulation. A separate notice regarding essential uses has been published. Undertakings wishing to import controlled substances for essential uses should apply for authorisation on the form supplied with that notice;

d) utilizzazione della materia prima: la trasformazione di una sostanza controllata mediante un processo durante il quale viene completamente modificata rispetto alla composizione originale;

(d) feedstock uses: transformation of a controlled substance in a process in which it is entirely converted from its original composition;

e) agenti di fabbricazione: sostanze controllate utilizzate come agenti chimici di fabbricazione negli impianti esistenti e le cui emissioni siano trascurabili;

(e) processing agents: controlled substances used as chemical processing agents in existing installations, where emissions are insignificant;

f) distruzione: sostanze controllate che devono essere distrutte mediante tecnologie approvate dalle parti del protocollo di Montreal e il cui risultato è la trasformazione permanente o la decomposizione, completa o di una parte significativa, della sostanza stessa.

(f) destruction: controlled substances that are to be destroyed by a technology approved by the Parties to the Montreal Protocol which results in the permanent transformation, or decomposition of all or a significant portion of the substance.

La quantità limitata che i produttori e gli importatori possono immettere sul mercato e/o utilizzare per proprio conto nella Comunità europea nel 2002 è calcolata in conformità dell'articolo 4, paragrafo 2, punto i), lettera b), del regolamento per quanto riguarda il bromuro di metile destinato ad usi diversi da quelli per quarantena o prima della spedizione e dall'articolo 4, paragrafo 3, punto i), lettera c), relativamente agli HCFC.

The quantitative limit, which producers and importers may place on the market and/or use for their own account within the European Community in 2002 is calculated according to Article 4(2)(i)(b) of the Regulation for methyl bromide for uses other than quarantine and preshipment and Article 4(3)(i)(c) for HCFCs.

Ai sensi dell'articolo 4, la Commissione, conformemente alla procedura di cui all'articolo 18, assegna a ciascun produttore o importatore un contingente entro i limiti quantitativi totali previsti per l'immissione sul mercato.

In accordance with Article 4, the Commission shall, under the Article 18 procedure, assign a quota to each producer or importer within the total quantitative limits for placing on the market.

III. Le imprese importatrici di HCFC si suddividono nelle seguenti categorie:

III. Undertakings engaged in the importation of HCFCs can be either:

- importatori che intendono immettere gli HCFC sul mercato comunitario e che non si occupano della produzione di HCFC,

- importers who wish to place HCFCs on the European Community market and who are not engaged in the production of HCFCs,

- produttori dell'Unione europea che importano per proprio conto quantità supplementari di HCFC da immettere sul mercato comunitario.

- European Community producers who import on their own account additional HCFCs to place on the European Community market.

IV. Le quantità importate sono oggetto di licenze di importazione per ciascuna spedizione di sostanze controllate e devono essere richieste nel corso del 2002. In conformità dell'articolo 6 del regolamento le imprese possono importare sostanze controllate solo se sono in possesso di una licenza di importazione rilasciata dalla Commissione. Le quantità importate verranno comparate ai contingenti individuali di immissione sul mercato che la Commissione assegnerà ai produttori e agli importatori per il 2002.

IV. The quantities imported are subject to import licences for each shipment of controlled substances, which should be applied for during 2002. In accordance with Article 6 of the Regulation, undertakings may import the controlled substances only if they are in possession of an import licence issued by the Commission. The quantities imported will be set against the individual placing on the market quotas for producers and importers for 2002.

V. A norma dell'articolo 22 del regolamento è vietata l'importazione di nuove sostanze (bromocromometano) elencate nell'allegato II del medesimo regolamento, ad eccezione dell'utilizzazione come materia prima.

V. Under Article 22 of the Regulation the importation of new substances (bromochloromethane) listed in Annex II to the Regulation is prohibited, except for feedstock uses.

VI. Ai fini del regolamento, le quantità delle sostanze vengono misurate in tonnellate PRO(3).

VI. For the purposes of the Regulation, quantities of substances are measured according to their ozone depleting potential(3).

VII. La Commissione informa le imprese che desiderano richiedere un contingente di importazione per un periodo di dodici mesi compreso tra il 1o gennaio 2002 e 31 dicembre 2002 che devono presentare la dichiarazione di cui all'allegato II entro un mese dalla pubblicazione della presente comunicazione:

VII. The Commission hereby gives notice to undertakings wishing to apply to the Commission for an import quota for the twelve month period 1 January 2002 to 31 December 2002, to make the declaration as in Annex II within one month of publication of this notice by

VIII. Dopo aver ricevuto le domande, la Commissione le esamina e attribuisce i contingenti per ogni importatore e produttore in consultazione con il comitato di gestione di cui all'articolo 18. I contingenti assegnati saranno pubblicati sul sito Europa e tutti i richiedenti saranno informati a mezzo posta.

VIII. Once the applications have been received, they will be considered by the European Commission and import quotas will be set for each importer and producer in consultation with the Article 18 Management Committee. The allocated quota will be available on the Europa site and all applicants will be informed by post.

Durante il 2002 le imprese cui è stato assegnato un contingente devono richiedere alla Commissione una licenza di importazione utilizzando gli appositi formulari. Se i servizi della Commissione constatano che la richiesta è conforme alla quota autorizzata, viene rilasciata una licenza di importazione. La Commissione si riserva il diritto di non concedere la licenza di importazione se la sostanza da importare non corrisponde alla descrizione o se rischia di non essere destinata all'uso autorizzato o ne è vietata l'importazione ai sensi del regolamento (CE) n. 3037/2000.

During the course of 2002, undertakings in receipt of a quota must apply to the Commission for an import licence using the import licence application form model. Provided the Commission services are satisfied that the request is in accordance with the quota authorised, an import licence will be issued. The Commission reserves the right to withhold an import licence when the substance to be imported is not as described or may not be used for the purposes authorised or cannot be imported in compliance with Regulation (EC) No 2037/2000.

IX. I produttori che importano sostanze recuperate o rigenerate sono pregati di fornire con ciascuna domanda di licenza ulteriori informazioni relativamente all'origine e alla destinazione della sostanza e al trattamento cui intendono sottoporla. Può anche essere richiesto un certificato di analisi.

IX. Producers who import recovered or reclaimed substances, if any, are required to submit additional information with each licence application regarding the source and destination of the substance, and the processing to be undertaken. A certificate of analysis may also be required.

X. Si ricordi che l'articolo 8 del regolamento (CE) n. 2037/2000 vieta l'immissione in libera pratica nella Comunità e il perfezionamento attivo di sostanze controllate importate da Stati che non sono parti del protocollo di Montreal.

X. Please note that the release for free circulation in the Community or inward processing of controlled substances imported from any State not Party to the Montreal Protocol is prohibited in accordance with Article 8 of Regulation (EC) No 2037/2000.

(2) Controlled substances or mixtures which are imported in a manufactured product other than a container used for the transport or storage of the substance are excluded from the scope of this notice.

(3) Per quanto riguarda le miscele, dev'essere inclusa nella quantità PRO unicamente la quantità di sostanze controllate contenuta nelle miscele. L'1,1,1-tricloroetano viene sempre immesso sul mercato con stabilizzatori. Il fornitore deve indicare all'importatore la percentuale di stabilizzatore da dedurre prima di calcolare il tonnellaggio ponderato di PRO.

(3) For mixtures: only the quantity of the controlled substances in the mixture should be included in the ODP quantity. 1,1,1-trichloroethane is always put on the market with stabilisers. Importers should establish from their supplier what is the percentage of stabiliser to be deducted before calculating the ODP-weighted tonnage.
