IL PARLAMENTO EUROPEO E IL CONSIGLIO DELL'UNIONE EUROPEA,	THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

considerando quanto segue:	Whereas:
(1) Nell'ambito della politica comunitaria deve essere conseguito un elevato livello di tutela della salute e dell'ambiente ed uno degli obiettivi da perseguire in tale contesto è la protezione dall'inquinamento acustico. Nel Libro verde sulle politiche future in materia di inquinamento acustico la Commissione definisce il rumore ambientale uno dei maggiori problemi ambientali in Europa.	(1) It is part of Community policy to achieve a high level of health and environmental protection, and one of the objectives to be pursued is protection against noise. In the Green Paper on Future Noise Policy, the Commission addressed noise in the environment as one of the main environmental problems in Europe.
(2) La risoluzione del Parlamento europeo, del 10 giugno 1997, relativa al Libro verde della Commissione(5), esprimendo il suo sostegno a tale documento, sottolinea l'urgente necessità di mettere a punto misure ed iniziative specifiche da inserire in una direttiva sul contenimento del rumore ambientale e lamenta l'assenza di dati affidabili e confrontabili relativi alle diverse sorgenti di rumore.	(2) In its resolution of 10 June 1997(5) on the Commission Green Paper, the European Parliament expressed its support for that Green Paper, urged that specific measures and initiatives should be laid down in a Directive on the reduction of environmental noise, and noted the lack of reliable, comparable data regarding the situation of the various noise sources.
(3) La comunicazione della Commissione, del 1o dicembre 1999, su trasporti aerei e ambiente individua un descrittore comune e una comune metodologia di calcolo e misurazione del rumore in prossimità degli aeroporti. Essa trova riscontro nel disposto della presente direttiva.	(3) A common noise indicator and a common methodology for noise calculation and measurement around airports were identified in the Commission communication of 1 December 1999 on air transport and the environment. This communication has been taken into account in the provisions of this Directive.
(4) Talune categorie di emissioni acustiche dei prodotti sono già disciplinate dalla normativa comunitaria, quali la direttiva 70/157/CEE del Consiglio, del 6 febbraio 1970, concernente il ravvicinamento delle legislazioni degli Stati membri relative al livello sonoro ammissibile e al dispositivo di scappamento dei veicoli a motore(6), la direttiva 77/311/CEE del Consiglio, del 29 marzo 1977, concernente il ravvicinamento delle legislazioni degli Stati membri relative al livello sonoro all'orecchio dei conducenti dei trattori agricoli o forestali a ruote(7), la direttiva 80/51/CEE del Consiglio, del 20 dicembre 1979, per la limitazione delle emissioni sonore degli aeromobili subsonici(8) e le direttive complementari, la direttiva 92/61/CEE del Consiglio, del 30 giugno 1992, relativa all'omologazione dei veicoli a motore a due o a tre ruote(9), nonché la direttiva 2000/14/CE del Parlamento europeo e del Consiglio, dell'8 maggio 2000, sul ravvicinamento delle legislazioni degli Stati membri concernenti l'emissione acustica ambientale delle macchine ed attrezzature destinate a funzionare all'aperto(10). La presente direttiva dovrebbe tra l'altro servire da base per sviluppare e completare l'attuale serie da misure comunitarie relative alle emissioni sonore prodotte da talune sorgenti specifiche e per elaborare misure complementari a breve, medio e lungo termine.	(4) Certain categories of noise emissions from products are already covered by Community legislation, such as Council Directive 70/157/EEC of 6 February 1970 on the approximation of the laws of the Member States relating to the permissible sound level and the exhaust system of motor vehicles(6), Council Directive 77/311/EEC of 29 March 1977 on the approximation of the laws of the Member States relating to the driver-perceived noise level of wheeled agricultural or forestry tractors(7), Council Directive 80/51/EEC of 20 December 1979 on the limitation of noise emissions from subsonic aircraft(8) and its complementary directives, Council Directive 92/61/EEC of 30 June 1992 relating to the type-approval of two or three-wheel motor vehicles(9) and Directive 2000/14/EC of the European Parliament and of the Council of 8 May 2000 on the approximation of the laws of the Member States relating to the noise emission in the environment by equipment for use outdoors(10). This Directive should, inter alia, provide a basis for developing and completing the existing set of Community measures concerning noise emitted by certain specific sources and for developing additional measures in the short, medium and long term.
(5) Talune categorie di rumori quali quelli generati all'interno dei mezzi di trasporto e quelli delle attività domestiche dovrebbero esulare dall'ambito di applicazione della presente direttiva.	(5) Certain categories of noise such as noise created inside means of transport and noise from domestic activities should not be subject to this Directive.
(6) Nel rispetto del principio di sussidiarietà di cui all'articolo 5 del trattato, l'obiettivo del trattato di un elevato livello di tutela della salute e dell'ambiente può essere realizzato meglio integrando l'azione degli Stati membri mediante un'iniziativa comunitaria per giungere a un concetto comune della problematica dei rumori. I dati relativi ai livelli di inquinamento acustico dovrebbero quindi essere rilevati, ordinati e presentati secondo criteri confrontabili. Ciò presuppone l'utilizzazione di descrittori e metodi di determinazione armonizzati e criteri per allineare la mappatura acustica, criteri e metodi che possono essere definiti meglio a livello comunitario.	(6) In accordance with the principle of subsidiarity as set out in Article 5 of the Treaty, the Treaty objectives of achieving a high level of protection of the environment and of health will be better reached by complementing the action of the Member States by a Community action achieving a common understanding of the noise problem. Data about environmental noise levels should therefore be collected, collated or reported in accordance with comparable criteria. This implies the use of harmonised indicators and evaluation methods, as well as criteria for the alignment of noise-mapping. Such criteria and methods can best be established by the Community.
(7) È altresì necessario fissare metodi comuni di valutazione del "rumore ambientale" e una definizione dei "valori limite", in base a descrittori armonizzati atti alla determinazione dei livelli sonori. Tocca agli Stati membri stabilire concretamente tali valori limite tenendo conto tra l'altro della necessità di applicare il principio della prevenzione per preservare zone silenziose negli agglomerati.	(7) It is also necessary to establish common assessment methods for "environmental noise" and a definition for "limit values", in terms of harmonised indicators for the determination of noise levels. The concrete figures of any limit values are to be determined by the Member States, taking into account, inter alia, the need to apply the principle of prevention in order to preserve quiet areas in agglomerations.
(8) I descrittori acustici comuni selezionati sono Lden per determinare il fastidio e Lnight per determinare i disturbi del sonno. È anche utile consentire agli Stati membri di avvalersi di descrittori complementari per seguire o controllare particolari situazioni di emissioni acustiche.	(8) The selected common noise indicators are Lden, to assess annoyance, and Lnight, to assess sleep disturbance. It is also useful to allow Member States to use supplementary indicators in order to monitor or control special noise situations.
(9) La mappatura acustica strategica dovrebbe essere imposta in determinate zone di interesse in quanto consente di raggruppare i dati in modo da ottenere una rappresentazione dei livelli sonori nella zona in esame.	(9) Strategic noise mapping should be imposed in certain areas of interest as it can capture the data needed to provide a representation of the noise levels perceived within that area.
(10) Le priorità delle suddette zone di interesse dovrebbero essere oggetto di piani di azione elaborati dalle autorità competenti previa consultazione dei cittadini.	(10) Action plans should address priorities in those areas of interest and should be drawn up by the competent authorities in consultation with the public.
(11) Per disporre della più ampia diffusione dell'informazione destinata ai cittadini occorrerebbe selezionare i canali di informazione più adatti.	(11) In order to have a wide spread of information for the public, the most appropriate information channels should be selected.
(12) Risulta necessario raccogliere i dati e consolidarli in pertinenti relazioni a livello comunitario come base della futura politica comunitaria e di una maggiore informazione dei cittadini.	(12) Data collection and the consolidation of suitable Community-wide reports are required as a basis for future Community policy and for further information of the public.
(13) La Commissione valuta periodicamente l'applicazione della presente direttiva.	(13) An evaluation of the implementation of this Directive should be carried out regularly by the Commission.
(14) Le norme tecniche concernenti le tecniche di determinazione devono essere completate ed aggiornate in funzione dei progressi della scienza e della tecnica, nonché della normazione europea.	(14) The technical provisions governing the assessment methods should be supplemented and adapted as necessary to technical and scientific progress and to progress in European standardisation.
(15) Le misure necessarie per l'attuazione della presente direttiva sono adottate secondo la decisione 1999/468/CE del Consiglio, del 28 giugno 1999, recante modalità per l'esercizio delle competenze di esecuzione conferite alla Commissione(11),	(15) The measures necessary for the implementation of this Directive should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(11),
HANNO ADOTTATO LA PRESENTE DIRETTIVA:	HAVE ADOPTED THIS DIRECTIVE:
Articolo 1	Article 1
Obiettivi	Objectives
1. La presente direttiva definisce un approccio comune volto a lottare contro i vari effetti dell'esposizione al rumore ambientale secondo le rispettive priorità. A tal fine sono progressivamente attuate le seguenti azioni:	1. The aim of this Directive shall be to define a common approach intended to combat on a prioritised basis the effects of exposure to environmental noise. To that end the following actions shall be implemented progressively:
a) la determinazione dell'esposizione al rumore ambientale mediante la mappatura acustica realizzata sulla base di metodi di determinazione comuni agli Stati membri;	(a) the determination of exposure to environmental noise, through noise mapping, by methods of assessment common to the Member States;
b) l'informazione del pubblico in merito al rumore ambientale e ai relativi effetti;	(b) ensuring that information on environmental noise and its effects is made available to the public;
c) l'adozione da parte degli Stati membri di piani d'azione, in base ai risultati della mappatura del rumore, allo scopo di evitare e ridurre il rumore ambientale laddove necessario e, in particolare, allorché i livelli di esposizione possono avere effetti nocivi per la salute umana, nonché di conservare la qualità acustica dell'ambiente quando questa è buona.	(c) adoption of action plans by the Member States, based on noise mapping results, with a view to preventing and reducing environmental noise where necessary and particularly where exposure levels can induce harmful effects on human health and to preserving environmental noise quality where it is good.
2. La presente direttiva è inoltre destinata a fornire una base per lo sviluppo di misure comunitarie di contenimento del rumore generato da sorgenti specifiche, in particolare da mezzi di trasporto e da attrezzature utilizzate all'aperto.	2. This Directive shall also aim at providing a basis for developing Community measures to reduce noise emitted by specific sources, in particular means of transport and outdoor equipment.
Articolo 2	Article 2
Ambito di applicazione	Scope
1. La presente direttiva riguarda il rumore ambientale cui è esposto l'essere umano in particolare nelle zone edificate, nei parchi pubblici o in altre zone silenziose degli agglomerati, nelle zone silenziose in aperta campagna, nei pressi delle scuole, degli ospedali e di altri edifici e zone particolarmente sensibili al rumore.	1. This Directive shall apply to environmental noise to which humans are exposed in particular in built-up areas, in public parks or other quiet areas in an agglomeration, in quiet areas in open country, near schools, hospitals and other noise-sensitive buildings and areas.
2. La presente direttiva non riguarda il rumore generato dalla persona esposta stessa, dalle attività domestiche o dal vicinato, né il rumore percepito sul posto di lavoro o a bordo dei mezzi di trasporto o dovuto ad attività militari svolte nelle zone militari.	2. This Directive shall not apply to noise that is caused by the exposed person himself, noise from domestic activities, noise created by neighbours, noise at workplaces or noise inside means of transport or due to military activities in military areas.
Articolo 3	Article 3
Definizioni	Definitions
Ai fini della presente direttiva valgono le seguenti definizioni:	For the purposes of this Directive:
a) "rumore ambientale", i suoni indesiderati o nocivi in ambiente esterno prodotti dalle attività umane, compreso il rumore emesso da mezzi di trasporto, dovuto al traffico veicolare, al traffico ferroviario, al traffico aereo e proveniente da siti di attività industriali, quali quelle definite nell'allegato I della direttiva 96/61/CE del Consiglio, del 24 settembre 1996, sulla prevenzione e la riduzione integrate dell'inquinamento(12);	(a) "environmental noise" shall mean unwanted or harmful outdoor sound created by human activities, including noise emitted by means of transport, road traffic, rail traffic, air traffic, and from sites of industrial activity such as those defined in Annex I to Council Directive 96/61/EC of 24 September 1996 concerning integrated pollution prevention and control(12);
b) "effetti nocivi", gli effetti negativi per la salute umana;	(b) "harmful effects" shall mean negative effects on human health;
c) "fastidio", la misura in cui, in base a indagini sul campo, il rumore risulta sgradevole a una comunità di persone;	(c) "annoyance" shall mean the degree of community noise annoyance as determined by means of field surveys;
d) "descrittore acustico", la quantità fisica che descrive il rumore ambientale avente un rapporto con un effetto nocivo;	(d) "noise indicator" shall mean a physical scale for the description of environmental noise, which has a relationship with a harmful effect;
e) "determinazione", qualsiasi metodo per calcolare, predire, stimare o misurare il valore di un descrittore acustico o i relativi effetti nocivi;	(e) "assessment" shall mean any method used to calculate, predict, estimate or measure the value of a noise indicator or the related harmful effects;
f) "Lden" (descrittore acustico giorno-sera-notte), il descrittore acustico correlato al fastidio globale, ulteriormente definito nell'allegato I;	(f) "Lden" (day-evening-night noise indicator) shall mean the noise indicator for overall annoyance, as further defined in Annex I;
g) "Lday" (descrittore acustico diurno), il descrittore acustico per il fastidio durante il periodo diurno, ulteriormente definito nell'allegato I;	(g) "Lday" (day-noise indicator) shall mean the noise indicator for annoyance during the day period, as further defined in Annex I;
h) "Levening" (descrittore acustico serale), il descrittore acustico per il fastidio durante il periodo serale, ulteriormente definito nell'allegato I;	(h) "Levening" (evening-noise indicator) shall mean the noise indicator for annoyance during the evening period, as further defined in Annex I;
i) "Lnight" (descrittore acustico notturno), il descrittore acustico relativo ai disturbi del sonno, ulteriormente definito nell'allegato I;	(i) "Lnight" (night-time noise indicator) shall mean the noise indicator for sleep disturbance, as further defined in Annex I;
j) "relazione dose-effetto", la relazione fra il valore di un descrittore acustico e un effetto nocivo;	(j) "dose-effect relation" shall mean the relationship between the value of a noise indicator and a harmful effect;
k) "agglomerato", una parte di territorio, delimitata dallo Stato membro, la cui popolazione è superiore a 100000 abitanti e la cui densità di popolazione è tale che lo Stato membro la considera un'area urbanizzata;	(k) "agglomeration" shall mean part of a territory, delimited by the Member State, having a population in excess of 100000 and a population density such that the Member State considers it to be an urbanised area;
l) "zona silenziosa di un agglomerato", una zona, delimitata dalla competente autorità che non sia esposta a valori di Lden o di un altro descrittore acustico appropriato provenienti da qualsiasi sorgente superiori a un determinato livello, fissato dallo Stato membro;	(l) "quiet area in an agglomeration" shall mean an area, delimited by the competent authority, for instance which is not exposed to a value of Lden or of another appropriate noise indicator greater than a certain value set by the Member State, from any noise source;
m) "zona silenziosa in aperta campagna", una zona, delimitata dalla competente autorità, che non risente del rumore del traffico, dell'attività industriale o di attività ricreative;	(m) "quiet area in open country" shall mean an area, delimited by the competent authority, that is undisturbed by noise from traffic, industry or recreational activities;
n) "asse stradale principale", una strada regionale, nazionale o internazionale, designata dallo Stato membro, su cui transitano ogni anno più di tre milioni di veicoli;	(n) "major road" shall mean a regional, national or international road, designated by the Member State, which has more than three million vehicle passages a year;
o) "asse ferroviario principale", una ferrovia, designata dallo Stato membro, su cui transitano ogni anno più di 30000 treni;	(o) "major railway" shall mean a railway, designated by the Member State, which has more than 30000 train passages per year;
p) "aeroporto principale", un aeroporto civile, designato dallo Stato membro, in cui si svolgono più di 50000 movimenti all'anno (per movimento si intende un'operazione di decollo o di atterraggio), esclusi i movimenti a fini di addestramento su aeromobili leggeri;	(p) "major airport" shall mean a civil airport, designated by the Member State, which has more than 50000 movements per year (a movement being a take-off or a landing), excluding those purely for training purposes on light aircraft;
q) "mappatura acustica", la rappresentazione di dati relativi a una situazione di rumore esistente o prevista in funzione di un descrittore acustico, che indichi il superamento di pertinenti valori limite vigenti, il numero di persone esposte in una determinata area o il numero di abitazioni esposte a determinati valori di un descrittore acustico in una certa zona;	(q) "noise mapping" shall mean the presentation of data on an existing or predicted noise situation in terms of a noise indicator, indicating breaches of any relevant limit value in force, the number of people affected in a certain area, or the number of dwellings exposed to certain values of a noise indicator in a certain area;
r) "mappa acustica strategica", una mappa finalizzata alla determinazione globale dell'esposizione al rumore in una certa zona a causa di varie sorgenti di rumore, ovvero alla definizione di previsioni generali per tale zona;	(r) "strategic noise map" shall mean a map designed for the global assessment of noise exposure in a given area due to different noise sources or for overall predictions for such an area;
s) "valore limite", un valore di Lden o Lnight, e, se del caso, di Lday e Levening stabilito dallo Stato membro, il cui superamento induce le autorità competenti a esaminare o applicare provvedimenti di attenuazione del rumore; i valori limite possono variare a seconda della tipologia di rumore (rumore del traffico veicolare, ferroviario, aereo, dell'attività industriale ecc.), dell'ambiente circostante e della diversa sensibilità al rumore delle popolazioni; essi possono anche variare riguardo a situazioni esistenti o nuove (nel caso in cui cambi la sorgente di rumore o la destinazione d'uso dell'ambiente circostante);	(s) "limit value" shall mean a value of Lden or Lnight, and where appropriate Lday and Levening, as determined by the Member State, the exceeding of which causes competent authorities to consider or enforce mitigation measures; limit values may be different for different types of noise (road-, rail-, air-traffic noise, industrial noise, etc.), different surroundings and different noise sensitiveness of the populations; they may also be different for existing situations and for new situations (where there is a change in the situation regarding the noise source or the use of the surrounding);
t) "piani d'azione", i piani destinati a gestire i problemi di rumore e i relativi effetti, compresa, se necessario, la sua riduzione;	(t) "action plans" shall mean plans designed to manage noise issues and effects, including noise reduction if necessary;
u) "pianificazione acustica", il controllo dell'inquinamento acustico futuro mediante attività di programmazione quali la pianificazione territoriale, l'ingegneria dei sistemi per il traffico, la pianificazione dei trasporti, l'attenuazione del rumore mediante tecniche di insonorizzazione e il controllo dell'emissione acustica delle sorgenti;	(u) "acoustical planning" shall mean controlling future noise by planned measures, such as land-use planning, systems engineering for traffic, traffic planning, abatement by sound-insulation measures and noise control of sources;
v) "pubblico", una o più persone fisiche o giuridiche e, secondo le legislazioni o prassi nazionali, le associazioni, organizzazioni o gruppi di tali persone.	(v) "the public" shall mean one or more natural or legal persons and, in accordance with national legislation or practice, their associations, organisations or groups.
Articolo 4	Article 4
Attuazione e competenze	Implementation and responsibilities
1. Gli Stati membri designano agli opportuni livelli le autorità e gli enti competenti per l'attuazione della presente direttiva, comprese le autorità responsabili di quanto segue:	1. Member States shall designate at the appropriate levels the competent authorities and bodies responsible for implementing this Directive, including the authorities responsible for:
a) elaborazione e, se del caso, adozione di mappe acustiche e piani d'azione per gli agglomerati, gli assi stradali e ferroviari principali e gli aeroporti principali;	(a) making and, where relevant, approving noise maps and action plans for agglomerations, major roads, major railways and major airports;
b) raccolta delle mappe acustiche e dei piani d'azione.	(b) collecting noise maps and action plans.
2. Gli Stati membri mettono a disposizione della Commissione e del pubblico le informazioni di cui al paragrafo 1 entro ...(13).	2. The Member States shall make the information referred to in paragraph 1 available to the Commission and to the public no later than ...(13).
Articolo 5	Article 5
Descrittori acustici e loro applicazione	Noise indicators and their application
1. Gli Stati membri utilizzano i descrittori acustici Lden e Lnight di cui all'allegato I per l'elaborazione e la revisione della mappatura acustica strategica a norma dell'articolo 7.	1. Member States shall apply the noise indicators Lden and Lnight as referred to in Annex I for the preparation and revision of strategic noise mapping in accordance with Article 7.
Fino al momento in cui l'elaborazione delle tecniche di determinazione comuni per la definizione di Lden e Lnight sarà resa obbligatoria, gli Stati membri possono usare a tal fine suddetti descrittori acustici nazionali esistenti e i relativi dati, convertendoli nei descrittori suddetti. Tali dati non devono avere più di tre anni.	Until the use of common assessment methods for the determination of Lden and Lnight is made obligatory, existing national noise indicators and related data may be used by Member States for this purpose and should be converted into the indicators mentioned above. These data must not be more than three years old.
2. In alcuni casi particolari, quali quelli elencati nell'allegato I, punto 3, gli Stati membri possono utilizzare descrittori acustici supplementari.	2. Member States may use supplementary noise indicators for special cases such as those listed in Annex I(3).
3. Per la pianificazione acustica e la delimitazione delle zone acustiche gli Stati membri possono utilizzare descrittori acustici diversi da Lden e Lnight.	3. For acoustical planning and noise zoning, Member States may use other noise indicators than Lden and Lnight.
4. Entro ...(14), gli Stati membri trasmettono alla Commissione informazioni sui valori limite pertinenti, espressi in Lden e Lnight, in vigore o in preparazione nel loro territorio e, se del caso, i valori Lday e Levening per il rumore del traffico veicolare, ferroviario e aereo in prossimità degli aeroporti, nonché il rumore nei siti di attività industriali. Tali informazioni sono accompagnate da spiegazioni relative all'applicazione dei valori limite.	4. No later than ...(14), Member States shall communicate information to the Commission on any relevant limit values in force within their territories or under preparation, expressed in terms of Lden and Lnight and where appropriate, Lday and Levening, for road-traffic noise, rail-traffic noise, aircraft noise around airports and noise on industrial activity sites, together with explanations about the implementation of the limit values.
Articolo 6	Article 6

1. I valori di Lden e Lnight sono stabiliti secondo i metodi di determinazione definiti nell'allegato II.	1. The values of Lden and Lnight shall be determined by means of the assessment methods defined in Annex II.
2. I metodi comuni per la determinazione dei valori di Lden e Lnight sono definiti dalla Commissione secondo la procedura di cui all'articolo 13, paragrafo 2, mediante revisione dell'allegato II. Finché tali metodi non saranno adottati, gli Stati membri possono usare metodi adeguati ai sensi dell'allegato II e basati sui metodi autorizzati dalle loro rispettive legislazioni. In tal caso essi devono dimostrare che gli stessi forniscono risultati equivalenti a quelli ottenuti con i metodi di cui al punto 2.2 dell'allegato II.	2. Common assessment methods for the determination of Lden and Lnight shall be established by the Commission in accordance with the procedure laid down in Article 13(2) through a revision of Annex II. Until these methods are adopted, Member States may use assessment methods adapted in accordance with Annex II and based on the methods laid down in their own legislation. In such case, they must demonstrate that those methods give equivalent results to the results obtained with the methods set out in paragraph 2(2) of Annex II.

a) gli assi stradali principali su cui transitano più di sei milioni di veicoli all'anno, gli assi ferroviari principali su cui transitano più di 60000 convogli all'anno e gli aeroporti principali;	(a) places near the major roads which have more than 6 million vehicle passages a year, major railways which have more than 60000 train passages per year and major airports;

Sono previsti calendari ragionevoli in modo da garantire tempi sufficienti per ciascuna fase della partecipazione dei cittadini.	7. Member States shall ensure that the public is consulted about proposals for action plans, given early and effective opportunities to participate in the preparation and review of the action plans, that the results of that participation are taken into account and that the public is informed on the decisions taken. Reasonable time-frames shall be provided allowing sufficient time for each stage of public participation.
Qualora l'obbligo di avviare una procedura di partecipazione dei cittadini sancito dalla presente direttiva coincida con quello di un'altra normativa comunitaria, gli Stati membri possono prevedere procedure congiunte al fine di evitare sovrapposizioni. La relazione comprende un esame della qualità dell'ambiente acustico nella Comunità sulla base dei dati di cui all'articolo 10 e tiene conto dei progressi tecnici e scientifici e di qualsiasi altra informazione pertinente. The report shall include a review of the acoustic environment quality in the Community based on the data referred to in Article 10 and shall take account of scientific and technical progress and any other relevant information. The reduction of harmful effects and the cost-effectiveness ratio shall be the main criteria for the selection of the strategies and measures proposed.

MOTIVAZIONE DEL CONSIGLIO	STATEMENT OF THE COUNCIL'S REASONS

In data 26 luglio 2000 la Commissione ha presentato al Consiglio una proposta di direttiva del Parlamento europeo e del Consiglio relativa alla determinazione e alla gestione del rumore ambientale(1).	The Commission submitted to the Council, on 26 July 2000, its proposal for a Directive of the European Parliament and the Council relating to the assessment and management of environmental noise(1).
Il Parlamento europeo ha espresso il suo parere il 14 dicembre 2000.	The European Parliament delivered its opinion on 14 December 2000.
Il Comitato economico e sociale ha reso il suo parere il 29 novembre 2000(2).	The Economic and Social Committee issued its opinion on 29 November 2000(2).
Il Comitato delle regioni ha espresso il suo parere il 15 febbraio 2001(3).	The Committee of the Regions issued its opinion on 15 February 2001(3).

II. OBIETTIVO DELLA PROPOSTA	II. OBJECTIVE OF THE PROPOSAL
La proposta si prefigge di:	The proposal aims at:
- introdurre descrittori acustici comuni per la determinazione dei fastidi causati dall'esposizione a lungo termine dell'essere umano al rumore ambientale,	- introducing common noise indicators for assessing the long-term exposure of humans to environmental noise,
- obbligare gli Stati membri a creare, per i grandi agglomerati e gli assi stradali, gli assi ferroviari e gli aeroporti principali, mappe acustiche strategiche che rispecchino la situazione di rumore nei loro territori, utilizzando almeno i descrittori comuni Lden e Lnight, che determinano i fastidi e i disturbi del sonno,	- obliging the Member States to establish, for large agglomerations and major roads, railways and airports, strategic noise maps reflecting the noise situation in their territories, using at least the common indicators Lden and Lnight, which assess annoyance and sleep disturbance,
- obbligare gli Stati membri a creare, in base a tali mappe, piani d'azione volti ad evitare e ridurre il rumore,	- obliging the Member States to establish, in the light of those maps, action plans with a view to preventing and reducing noise,
- diffondere informazioni riguardo all'esposizione al rumore ed ai suoi effetti sul pubblico, nonché prevedere la partecipazione del pubblico nella definizione dei piani d'azione,	- spreading information about noise exposure and its effects among the public and providing for public participation in the establishment of the action plans,
- fornire una base per ulteriori lavori della Comunità relativi alle norme applicabili al rumore emesso da fonti specifiche, nonché per esaminare ulterioriormente la necessità di azioni comunitarie volte a ridurre il rumore ambientale.	- providing a basis for further Community work concerning standards for noise emitted by specific sources and for further consideration of the need for Community actions aiming at reducing environmental noise.

III. ANALISI DELLA POSIZIONE COMUNE	III. ANALYSIS OF THE COMMON POSITION
1. La posizione comune del Consiglio prevede una metodologia per la determinazione e l'attenuazione dell'esposizione a lungo termine dell'essere umano al rumore ambientale esterno causato dall'attività dell'uomo nell'ambiente di vita (zone edificate, parchi, zone silenziose, scuole ed altri edifici e zone particolarmente sensibili al rumore).	1. The Council's Common Position provides for a methodology for the assessment and abatement of long-term exposure of humans to environmental outdoor noise created by human activity in their domestic environment (built-up areas, parks, quiet areas, schools and other noise-sensitive buildings and areas).
2. Riguardo alla determinazione, la posizione comune prevede, nel caso della mappatura acustica strategica di grandi agglomerati e degli assi stradali, assi ferroviari ed aeroporti principali, di descrittori acustici comuni, ossia Lden, che determinano il fastidio medio causato dal rumore durante il periodo diurno, e Lnight, che determina i disturbi del sonno causati dall'esposizione al rumore durante la notte. Inoltre, gli Stati membri possono utilizzare descrittori supplementari per misurare il fastidio in talune situazioni specifiche, quali picchi di rumore, periodi specifici dell'anno o zone silenziose. Tali descrittori supplementari potrebbero essere sviluppati ulteriormente in base alla procedura di comitato. I descrittori comuni consentirebbero di giungere ad una conoscenza comparabile del fastidio e dei disturbi del sonno causati dal rumore all'interno della Comunità.	2. Concerning assessment, the Common Position provides for the use, regarding strategic noise mapping in large agglomerations and major roads, railways and airports, of common noise indicators, i.e. Lden, which assesses the average annoyance caused by noise over a day, and Lnight, which assesses the sleep disturbances caused by exposure during the night. In addition, the Member States may use supplementary indicators for measuring the annoyance in certain specific situations such as noise peaks, specific periods of the year or quiet areas. Such supplementary indicators could be further developed under the comitology procedure. The common indicators would produce a comparable understanding of the annoyance and sleep disturbance caused by noise across the Community.
3. Riguardo all'attenuazione del rumore, la posizione comune obbliga gli Stati membri a creare, per i principali agglomerati o assi stradali, assi ferroviari e aeroporti principali:	3. Concerning abatement, the Common Position obliges the Member States to establish, for major agglomerations or major roads, railways and airports:
- mappe acustiche strategiche: le mappe, definite mediante i descrittori comuni Lden e Lnight, che forniscono una determinazione globale del rumore in una certa zona e contengono previsioni generali circa lo sviluppo del rumore per tale zona,	- strategic noise maps: strategic noise maps, established with the common indicators Lden and Lnight, give a global assessment about the noise in a given area and contain general previsions of the development of noise in that same area,
- piani d'azione: i piani destinati a gestire i problemi di rumore e i relativi effetti, tra cui, se necessario la prevenzione e la riduzione del rumore, e stabiliti previa consultazione del pubblico. Le misure previste da tali piani sono adottate a discrezione delle autorità competenti ma dovrebbero tener conto in particolare delle priorità eventualmente individuate con il superamento di uno qualsiasi dei valori limite espressi in termini di Lden e Lnight), o con altri criteri scelti dagli Stati membri. Le misure dovrebbero segnatamente applicarsi alle zone più importanti determinate dalla mappatura acustica strategica. La posizione comune fa altresì riferimento alla possibilità per gli Stati membri di impegnarsi nella pianificazione acustica - ossia il controllo del rumore mediante la pianificazione territoriale, la pianificazione dei trasporti, il controllo dell'emissione acustica delle sorgenti - e nella delimitazione delle zone acustiche - ossia la pianificazione acustica nella zona circostante o in prossimità di una sorgente di rumore. In tali casi possono essere utilizzati descrittori diversi da Lden e Lnight, a discrezione degli Stati membri.	- action plans: action plans aim at managing noise issues and effects, including noise prevention or reduction if necessary, and are established in consultation with the public. The measures within these plans are at the discretion of the competent authorities, but they should notably address priorities which may be identified by the exceedance of any limit value (expressed in terms of Lden or Lnight) or by other criteria chosen by the Member States. The measures should in particular apply to the most important areas as established by the strategic noise mapping. The Common Position also refers to the possibility for the Member States to engage into acoustical planning, i.e. controlling noise by land-use planning, traffic-planning, noise control of sources, and into noise zoning, i.e. acoustical planning in a zone around or along a noise source. In these cases, indicators other than Lden and Lnight may be used, at the Member States' discretion.
4. La posizione comune intende inoltre diffondere le informazioni riguardo all mappe acustiche ed ai piani d'azione tra il pubblico, nonché prevedere la partecipazione del pubblico nella definizione dei piani d'azione. La comparabilità tra le mappe acustiche ed i piani d'azione può fornire un forte incentivo per il pubblico e per le autorità competenti a livello locale e nazionale affinché siano adottate le norme di attenuazione del rumore più rigorose a livello della Comunità.	4. In addition, the Common Position aims at spreading information about noise maps and action plans among the public and at providing for public participation in the establishment of action plans. The comparability between the noise maps and the action plans may provide a strong incentive for the public and the competent local and national authorities to provide the strictest noise abatement standards found in the Community.
5. La Commissione sarà altresì informata in merito alle mappe acustiche strategiche ed ai piani d'azione degli Stati membri. Le informazioni dovrebbero fornire in particolare una base per il completamento, a breve e lungo termine, delle misure comunitarie esistenti relative al rumore emesso da prodotti, mezzi ed infrastrutture di trasporto, attrezzature esterne, attività edili ed altre sorgenti specifiche. Tali informazioni dovrebbero tra l'altro aiutare la Commissione a determinare la necessità di strategie comunitarie al fine di ridurre il numero di persone colpite dagli effetti nocivi del rumore e proteggere le zone silenziose in aperta campagna.	5. The Commission will equally be informed about the Member States' strategic noise maps and action plans. That information should in particular provide a basis for completing, in the short and long term, the existing Community measures concerning noise emitted by products, means and infrastructures of transport, outdoor equipment, building activities and other specific sources. That information should also help the Commission to assess the need for Community strategies with a view to reducing the number of people harmfully affected by noise and to protecting quiet areas in open country.

Nell'emendamento 4 relativo a un nuovo considerando 7 bis il Parlamento ha proposto di motivare l'inserimento del descrittore Lnight. Poiché i considerando proposti dalla Commissione non contenevano alcun riferimento ai descrittori, il Consiglio ha inserito un nuovo considerando 8, che motiva l'utilizzazione non solo del descrittore Lden, ma anche di Lnight, nonché dei descrittori supplementari qualora gli Stati membri intendessero avvalersene.	In Amendment 4 for a new recital 7a, Parliament proposed motivating the insertion of Lnight. As the recitals proposed by the Commission did not contain any reference to the indicators, the Council inserted a new recital 8, which motivates the use, not only of Lden, but also of Lnight and the supplementary indicators as well if Member States wish to use them.

Emendamento 28 relativo all'articolo 9, paragrafo 1: piuttosto che creare un sistema di informazione specifico, come proposto dalla Commissione, e precisare i dettagli del sistema stesso, come proposto dal Parlamento, il Consiglio ha preferito fare riferimento al sistema generale di cui alla direttiva 90/313/CEE e, implicitamente, alla direttiva che la modificherà(4). La direttiva 90/313/CEE garantisce che qualsiasi persona abbia il diritto di accedere all'informazione ambientale detenuta dalle autorità pubbliche ed obbliga queste ultime a fornire al pubblico informazioni ambientali di carattere generali. La proposta relativa ad una direttiva di sostituzione descrive un sistema di informazioni assai elaborato che include tutti gli elementi proposti dal Parlamento.	Amendment 28 concerning Article 9(1): rather than creating a specific information system as proposed by the Commission and specifying the details of that system as proposed by Parliament, the Council chose to refer to the general system of Directive 90/313/EEC and, implicitly, to the Directive that will amend it(4). Directive 90/313/EEC enables any person to obtain environmental information from public authorities and obliges those authorities to provide the public with general environmental information. The proposal for a replacing directive contains a very elaborate information system that includes all the elements proposed by Parliament.

- ha modificato il considerando 4 sostituendo il riferimento alle norme comunitarie di immissione con un elenco di direttive relative alle emissioni acustiche derivanti da prodotti e mezzi di trasporto; il Consiglio ha inoltre aggiunto che le direttive relative alle sorgenti acustiche dovrebbero servire da base per sviluppare e completare tali misure a breve, medio e lungo termine,	- amended recital 4 by replacing the quotation of Community emission standards and by a series of directives on noise emissions from products and means of transport. The Council however maintained the necessity for exposure to humans, and did not delete the emphasis on the protection of quiet areas in agglomerations.

The Council however maintained the committee procedure for the following matters:

- definizione di relazioni di dose-effetto per determinare gli effetti rumore sulla popolazione (allegato III).	- establishing dose/effects relations to assess the effect of noise on populations (Annex III).
VII. EMENDAMENTI DEL PARLAMENTO NON ACCETTATI DAL CONSIGLIO	VII. AMENDMENTS BY PARLIAMENT NOT ACCEPTED BY THE COUNCIL
Emendamento 1 sull'aggiunta nel titolo dei termini "che istituisce un quadro comunitario" (accettata con un'interpretazione diversa dalla Commissione): tale emendamento è inteso a chiarire che la direttiva servirà da base per direttive analoghe sui prodotti, e affronta le stesse questioni di cui agli emendamenti 5, 8, 38 e 11, precedentemente trattati. Il Consiglio non ha accettato l'emendamento 1 poiché esso faceva riferimento a direttive analoghe fondate sui lavori già in fase di svolgimento, in una dichiarazione a verbale e non nel testo della direttiva.	Amendment 1 on adding to the title the words "setting up a Community framework for" (accepted with a different interpretation by the Commission): this amendment aims at clarifying that the Directive will form the basis for subsidiary directives on products, and deals with the same subject as amendments 5, 8, 38 and 11 that were discussed above. The Council could not accept amendment 1 since it referred to subsidiary directives, based on the work already being done, in a statement for the minutes and not in the text of the Directive.
Emendamento 6 relativo ad un nuovo considerando 9 bis (considerato superfluo dalla Commissione): il Consiglio non ha incluso questo emendamento poiché si limitava a ripetere l'emendamento 21 (accettato dal Consiglio) senza motivarlo.	Amendment 6 for a new recital 9a (regarded as unnecessary by the Commission): the Council did not include this amendment as it merely repeated amendment 21 (accepted by the Council) without motivating it.
Emendamento 8 (ultima frase) relativo ad un nuovo considerando 10 bis e emendamento 10 relativo ad un nuovo articolo 1, paragrafo 1, lettera b bis, indicante che lo scopo della direttiva è di fissare valori limite per i rumori ambientali in prossimità degli aeroporti (entrambi respinti dalla Commissione): da un punto di vista procedurale, il Consiglio osserva che tale considerando e tale obiettivo non sono ripresi in nessun articolo corrispondente. Inoltre, i limiti di rumore non rientrano nel campo di applicazione della proposta e né il Consiglio né il Parlamento sono autorizzati a stabilire norme al di là di tale campo di applicazione. Da un punto di vista sostanziale, il Consiglio ritiene che la necessità di stabilire valori limite debba essere considerata nel quadro dell'articolo 11. Non si dispone di informazioni comparabili sufficienti né riguardo al rumore in prossimità degli aeroporti in Europa né riguardo alla sensibilità al rumore delle varie popolazioni della Comunità che consentano di fissare dei valori limite partendo da una solida base scientifica. Amendment 8 (last sentence) regarding a new recital 10a and amendment 10 regarding a new Article 1(1)(ba) indicating that the aim of the Directive is to set limit values for environmental noise around airports (both rejected by the Commission): from a procedural point of view, the Council notes that this recital and this objective lack a corresponding article. Moreover, noise limits are not part of the scope of the proposal and neither the Council nor Parliament are allowed to regulate beyond that scope. From a substantive point of view, the Council considers that the need for limit values should be considered in the framework of Article 11. There is not enough comparable information about noise around airports throughout Europe, nor about the noise sensitivity of the different populations for the Community to be able to set limit values on solid scientific bases. It should suffice at this stage to establish noise maps and action plans around airports and to envisage submitting proposals for more stringent noise emission limits for aircraft.
Emendamento 39 relativo ad un'aggiunta all'articolo 1, paragrafo 2, sul rispetto di quattro principi generali (accettato dalla Commissione): questo emendamento è stato respinto perché tali principi sono stati considerati vaghi [a parte quello: "chi inquina (acusticamente) paga"], contraddittori, difficili da applicare, e di carattere politico, e pertanto inadatti ad essere inseriti in un testo giuridico. Amendment 14 concerning Article 3(a) (not accepted by the Commission): this amendment limits the notion of "noise from industrial sites and buildings" to the sole noise emitted by "all types of machinery", which is too restrictive.
Emendamento 16 relativo all'articolo 3, lettera p), inteso ad includere gli aeroporti militari (non accettato dalla Commissione): si è ritenuto necessario non contemplare gli aeroporti militari per ragioni di difesa nazionale.	Amendment 16 concerning Article 3(p) with a view to including military airports (not accepted by the Commission): it was felt to be necessary not to cover military airports for reasons of national defence.
Emendamento 18 relativo all'articolo 3, lettera u): modifiche redazionali della definizione dei "piani d'azione": piuttosto che fare riferimento ad "attività", il Consiglio ha utilizzato il termine "piani" nella definizione dei "piani d'azione"; invece che fare riferimento al fatto che i valori limite "rischiano di essere superati", il Consiglio ha fatto riferimento ad "altri criteri" all'articolo 8, paragrafo 1, ultimo comma.	Amendment 18 concerning Article 3(u): drafting changes to the definition of "Action plans": rather than referring to "activity" or "activities", the Council used the word "plans" in the definition of "action plans"; rather than referring to "is in danger of being exceeded", the Council referred to "other criteria" in Article 8(1), last subparagraph.
Emendamento 19 relativo all'articolo 4, paragrafo 1: indipendenza delle autorità responsabili dell'attuazione della direttiva: tale emendamento non è stato accettato poiché le autorità competenti devono essere sempre indipendenti ed imparziali.	Amendment 19 concerning Article4 (1): independence of the authorities responsible for implementing the Directive: was not accepted as the competent authorities must always be independent and impartial.
Emendamento 20 relativo ad un'aggiunta all'articolo 5, paragrafo 2, al fine di rendere obbligatoria l'utilizzazione di descrittori supplementari quali il LAmax: il Consiglio ha ritenuto che l'uso dei descrittori supplementari debba rimanere facoltativo: l'armonizzazione dei descrittori acustici Lden e Lnight non è stata accettata con facilità dagli Stati membri, e si è ritenuto che la scelta di altri descrittori, anche se talvolta utili, debba essere lasciata agli Stati membri, mentre i descrittori comuni forniscono un quadro soddisfacente della situazione del rumore.	Amendments 20 regarding an addition to Article 5(2) with a view to making the use of additional indicators such as LAmax mandatory: the Council felt that additional indicators should remain optional: the harmonisation of noise indicators Lden and Lnight has not been accepted easily by the Member States, and it was felt that the choice of other indicators, although useful in some cases, should be left to Member States, while the common indicators provide a good overview of the noise situation.
Emendamenti 23 e 25 relativi ad un'aggiunta agli articoli 7 e 8 al fine di produrre mappe acustiche e piani d'azione in caso di serie lamentele (non accettato dalla Commissione): tale emendamento non è stato accettato poiché sarebbe difficile definire la nozione di "serie lamentele" e si corre un serio rischio di lamentele ingiustificate. Il Consiglio ritiene inoltre che il pubblico sia sufficientemente tutelato dal sistema attuale, in virtù del quale:	Amendments 23 and 25 regarding an addition to Articles 7 and 8 with a view to producing noise maps and action plans in case of serious complaints (not accepted by the Commission): this was not retained as it would be difficult to define the notion of "serious complaint" and as there is a very serious danger of abusive complaints. The Council also considers that the public is sufficiently protected by the present system whereby:

Emendamento 24 relativo ad un nuovo articolo 7, paragrafo 3 bis, sul mantenimento delle mappe acustiche esistenti: il Consiglio non vede la necessità di tale disposizione. Non appena l'articolo 7 sarà applicabile, le mappe acustiche strategiche dovranno rispondere ai requisiti della direttiva e non ci sarà motivo di mantenere i vecchi modelli di mappe a scopi comunitari.	Amendment 24 regarding a new paragraph 7(3a) on maintaining existing noise maps: the Council sees no necessity for this provision: as soon as Article 7 becomes applicable, strategic noise maps will have to respond to the requirements of the Directive. There will be no need for maintaining the old types of maps for Community purposes.
Emendamento 26 relativo ad un nuovo paragrafo secondo cui i responsabili di sorgenti significative di rumore sono invitati ad elaborare piani d'azione individuali (non accettato dalla Commissione): il rumore da singole sorgenti sarà disciplinato in generale dai piani d'azione per gli agglomerati e per gli assi stradali, gli assi ferroviari e gli aeroporti principali. Sarà compito di tali piani d'azione stabilire le norme per la gestione del rumore, nonché decidere se imporre piani d'azione ai singoli responsabili di sorgenti di rumore.	Amendment 26 regarding a new paragraph requiring emitters of significant sources of noise to produce individual action plans (not accepted by the Commission): noise from individual sources will generally be covered by the action plans for agglomerations and for the major roads, railways and airports. It will up to those action plans to determine their rules for noise management, and to decide whether they will impose action plans to individual emitters of noise.
VIII. ALTRE MODIFICHE DELLA PROPOSTA DELLA COMMISSIONE INTRODOTTE DAL CONSIGLIO	VIII. OTHER CHANGES TO THE COMMISSION PROPOSAL INTRODUCED BY THE COUNCIL
Preambolo	The preamble
Il Consiglio ha riunito i concetti riunendo i considerando 4 e 10 sui lavori futuri. Esso ha aggiunto un nuovo considerando 5 al fine di precisare il campo di applicazione ed ha scisso il considerando 8 nei considerando 9, 10 e 11. It added a new recital 5 to clarify the scope and split recital 8 to become recitals 9, 10 and 11. The Council also improved the drafting of recitals 3, 6, 7, 8 and 15 (former 3, 5, 6, 7 and 12).

Nella prima frase del primo paragrafo, il termine più sintetico "lottare" sostituisce i termini "evitare, prevenire o ridurre", che sono trasferiti alla lettera c) relativa alle azioni da intraprendere. In the first sentence of the first subparagraph, the more synthetic "combating" replaces "avoid, prevent and reduce", which were sent back to paragraph (c) concerning action to be undertaken. The sentence asks Member States to fix priorities - the notion of "priorities" being explained in Article 8 (2). Community action will address "effects" generally and not solely "harmful effects on human health", which are now referred to in paragraph (c).

Articolo 2	Article 2
Il Consiglio ha sostituito i termini "rumore ambientale percepito dall'essere umano" con quelli meno soggettivi di "rumore cui è esposto l'essere umano". The deletion of "pupils" and "patients" was proposed by Parliament. For reasons of national defence, the Council exempted military activities in military areas.

- ha soppresso l'inclusione di dati di natura economica nella definizione della mappatura acustica,	- deleted the inclusion of economic data in noise mapping,
- ha mantenuto il requisito di esprimere i valori limite in termini di Lden e Lnight precisando al tempo stesso ("e, se del caso...") che i descrittori Lday e Levening possono essere anch'essi utilizzati; ha chiarito che i valori limite possono variare a seconda della sensibilità al rumore delle popolazioni,	- maintained the requirement of expressing the limit values in terms of Lden and Lnight while indicating ("and, where appropriate ...") that the indicators Lday and Levening may be used in addition; clarified that the limit values may adapt to the noise sensitiveness of the groups of populations,
- ha concentrato le due definizioni di "piano d'azione per un agglomerato urbano" e di "piano d'azione per una strada, una ferrovia o un aeroporto principale" in un'unica definizione semplificata, che contiene anche la nozione di "gestione del rumore"; i riferimenti al superamento dei valori limite ed alla tutela delle zone silenziose sono stati trasferiti rispettivamente alla fine dell'articolo 8, paragrafo 1 ed all'articolo 8, paragrafo 1, lettera b),	- reduced the two definitions of "action plan for an agglomeration" and of "action plan for a major road, railway or airport" to a single simplified definition. This new definition also contains the notion of "management of noise". The elements of "exceedance of limit values" and "protection of quiet areas" were transferred to Article 8(1) in fine and Article 8(1)(b),

Articolo 4	Article 4
Il Consiglio ha modificato il paragrafo 1, lettera a), al fine di tener conto del fatto che le mappe acustiche sono elaborate, ma non sempre adottate, dalle autorità competenti. La stessa modifica figura nell'articolo 7, paragrafi 1 e 2 e nell'articolo 8, paragrafo 1. Il paragrafo 2 è stato soppresso perché non esistono ancora "Programmi comunitari di garanzia di qualità" ufficiali.	The Council modified paragraph 1(a) in order to take into account the fact that noise maps are made, but not always approved, by the competent authorities. The same modification appears in Article 7(1) and (2) and Article 8(1). Point 2 was deleted because official "Community-wide quality assurance programmes" are not available yet.
Articolo 5	Article 5
La possibilità di utilizzare i descrittori esistenti in attesa dell'adozione mediante la procedura di comitato dei metodi di determinazione (paragrafo 1, secondo comma) dovrebbe consentire agli Stati membri di introdurre il sistema definitivo in un unica volta, senza dover attraversare una serie di fasi intermedie provvisorie.	The possibility for using of existing indicators pending adoption through the Committee procedure of the assessment methods (paragraph 1(2) should enable Member States to introduce the final system in one single go rather than passing through provisional intermediate stages.
Ai sensi del nuovo paragrafo 3 della posizione comune, l'utilizzazione di Lden e Lnight deve essere facoltativo ai fini della pianificazione acustica e della delimitazione delle zone acustiche, analogamente alla definizione dei piani acustici e delle zone acustiche stesse.	According to the new paragraph 3 of the Common Position, the use of Lden and Lnight should be optional for acoustical planning and noise zoning, like the establishment of acoustical plans and noise zones itself.
Al paragrafo 4, il Consiglio ha stabilito la possibilità di utilizzare altri descrittori oltre a Lden e Lnight al momento di definire i valori limite.	In paragraph 4, the Council expressed the possibility of using more indicators than only Lden and Lnight when drawing up limit values.
Articolo 6 e allegato III	Article 6 and Annex III
Il Consiglio ha aggiunto nel paragrafo 2 una nuova disposizione transitoria, avente lo stesso scopo di quella contenuta all'articolo 5, paragrafo 1, secondo comma, relativa ai descrittori.	The Council added a new transitional provision in paragraph 2 which has the same purpose as Article 5(1)(2) relating to indicators.
Riguardo al paragrafo 3 (paragrafo 2 nella proposta della Commissione) ed all'allegato III ad esso correlato (allegato II, paragrafo 4, della proposta), il Consiglio ha mantenuto l'idea della Commissione secondo cui le relazioni dose-effetto saranno definite mediante la procedura di comitato, ma ha precisato con maggiori dettagli il campo di applicazione previsto. Tuttavia, considerata l'importanza di tali relazioni dose-effetto, tuttavia, il Consiglio non ha voluto renderle obbligatorie mediante la procedura di comitato. Al limite, tale procedura potrebbe condurre ad un'applicazione facoltativa. However, having regard to the importance of these dose/effects relations, the Council did not wish these relations to be made obligatory through the comitology procedure. At most the outcome of that procedure could lead to an optional practice. That is why the Council replaced "shall" by "may" in Article 6(3).

Nella sua proposta la Commissione aveva incluso un'impostazione in due fasi, secondo la quale in un primo tempo si sarebbero elaborate le mappe per gli agglomerati con più di 250000 abitanti e successivamente quelle per gli agglomerati con più di 100000 abitanti. Il Consiglio si è detto d'accordo su tale impostazione, ma l'ha estesa agli assi stradali (6 milioni di transiti nella prima fase, 3 milioni nella successiva) ed agli assi ferroviari (60000-30000 ).	In its proposal the Commission included a two-step approach under which maps should be made first for agglomerations of more than 250000 inhabitants and later for agglomerations of 100000 inhabitants. The Council agreed to this approach but expanded it to roads (6 million passages first; later 3 million) and railways (60000 to 30000 ).
Riguardo a paragrafo 5, la Commissione aveva proposto che le mappe fossero rielaborate in ogni caso ogni 5 anni. Il Consiglio ha modificato tale requisito, precisando che le mappe devono essere riesaminate in ogni caso, ma rielaborate soltanto se necessario.	Concerning point 5, the Commission had proposed that maps should be remade in any case every five years. The Council modified that requirement to read that maps must be reviewed in any case, but that they should be remade only if such is necessary.
Articolo 8	Article 8
Come già per l'articolo 7, il Consiglio ha esteso agli assi stradali e ferroviari l'impostazione in due fasi proposta dalla Commissione.	As it already did for Article 7, the Council expanded to roads and railways the two-step approach proposed by the Commission.
Il Consiglio ha inserito il secondo comma del paragrafo 1 ed il paragrafo 3, che contengono l'idea di individuare priorità e di tener conto di altri criteri.	Subparagraph 2 of point 1 and point 3 were inserted by the Council. They contain the idea of fixing priorities and of taking into account other criteria.
È stato aggiunto il paragrafo 6, che ribadisce l'idea della cooperazione tra gli Stati membri limitrofi già menzionata all'articolo 7, paragrafo 4.	Point 6 was added; it reiterates the idea of cooperation between neighbouring Member States already contained in Article 7(4).
Il paragrafo 7 sostituisce e rafforza l'articolo 9, paragrafo 2, della proposta della Commissione in merito alla partecipazione del pubblico alla definizione dei piani d'azione.	Point 7 replaces and strengthens Article 9(2) of the Commission proposal on public participation to the establishment of action plans.
Articolo 9	Article 9
Il paragrafo 1 fa riferimento alla legislazione generale vigente e futura relativa all'accesso del pubblico all'informazione ambientale. Tale modifica comporta il vantaggio di fare riferimento ad una serie di precisi atti legislativi. Il paragrafo 2 è un emendamento del Parlamento.	Point 1 refers to general existing and future legislation concerning access of the public to environmental information. This modification has the advantage of referring to a very detailed body of law. Point 2 is an amendment of Parliament.
Articolo 10	Article 10
Il paragrafo 1 della proposta della Commissione è stato soppresso perché superfluo tenuto conto dell'articolo 4. Le amministrazioni dispongono adesso di termini più lunghi per elaborare le sintesi delle mappe e dei piani d'azione e trasmetterli alla Commissione. Al paragrafo 2, il Consiglio ha precisato il possibile uso della banca dati da parte della Commissione.	Point 1 of the Commission proposal was deleted because it was redundant to Article 4. More time was given to the administrations to make the summaries of their maps and action plans and to transmit these to the Commission. In point 2, the Council specified the use the Commission could make of the database.
Articolo 11	Article 11
Il paragrafo 2 è stato ampiamente modificato. In particolare, il Consiglio ha sostituito il riferimento agli obiettivi qualitativi della Comunità con un riferimento alle azioni a livello comunitario in materia di rumore ambientale. Come eventuali strategie di attuazione, il Consiglio ha mantenuto la riduzione del numero di persone esposte al rumore, la riduzione del rumore provocato da sorgenti specifiche e la protezione delle zone silenziose. Tutti gli elementi relativi al rumore provocato da sorgenti specifiche sono stati tuttavia trasferiti in una lettera a parte ed ampliati, tenendo conto anche delle richieste del Parlamento. Riguardo al nuovo paragrafo 4, cfr. in appresso gli allegati I e VI.	Point 2 was widely amended. In particular, the Council replaced the consideration of Community quality objectives by the consideration of Community actions on environmental noise. As possible implementing strategies, the Council maintained the reduction of people affected by noise, the reduction of noise from specific sources and the protection of quiet areas. However, all elements relating to noise from specific sources were transferred to a single paragraph and expanded, also in line with Parliament's wishes. On the new point 4, see below under Annex I and VI.
Articolo 12	Article 12
Il Consiglio ha ridotto il campo di applicazione della procedura di comitato, anche se in misura minore rispetto agli emendamenti del Parlamento.	The Council reduced the scope of the comitology procedure, albeit less than in Parliament's amendments.
Articolo 13	Article 13
Nella posizione comune è stato soppresso il paragrafo 4 della proposta, considerato superfluo tenuto conto dell'elaborazione delle linee guida di cui all'allegato III, secondo comma, all'allegato IV, punto 9, all'allegato V, punto 4 e all'allegato VI, punto 3.	The Common Position deleted point 4 of the proposal as it was redundant to the drafting of guidelines laid down in Annex III(2), Annex IV(9), Annex V(4) and in Annex VI(3).

Il Consiglio ha trasferito tale articolo all'articolo 11, paragrafo 5, seconda frase.	The Council transferred this Article to Article 11(5), second sentence.
Articolo 15 - Entrata in vigore	Article 15 - dates of implementation
Nell'ipotesi di una pubblicazione della direttiva nella Gazzetta ufficiale l'1.1.2000, si può considerare che il Consiglio ha posticipato la data di entrata in vigore di 6 mesi (articolo 14), l'informazione della Commissione di 18 mesi (articoli 4, paragrafo 2 e 5, paragrafo 3) e le varie fasi della mappatura (articolo 7) e l'elaborazione dei piani d'azione (articolo 8) di 2 anni. Nel complesso l'attuazione comincerebbe nel 2003 e sarebbe completata alla fine del 2012. I maggiori tempi di attuazione sono stati determinati dal fatto che la direttiva coinvolgerà molte amministrazioni a livello nazionale, regionale o locale.	Assuming that the Directive would be published in the Official Journal on 1 February 2000, it could be considered that the Council postponed the starting date for implementation by six months (Article 14), the information of the Commission by 18 months (Articles 4(2) and 5(3) and the different stages of mapping (Article 7) and drafting of action plans (Article 8) by two years. In all, the implementation would start in 2003 and be complete end 2012. Longer implementation periods were necessitated by the fact that the Directive will involve many national, regional or local administrations.
Allegato I	Annex I
L'allegato I definisce il descrittore Lden. Lden misura, in decibel (dB), il fastidio nel corso di un giorno, composto da un periodo diurno di 12 ore, un periodo serale di 4 ore ed un periodo notturno di 8 ore. La posizione comune dà tuttavia agli Stati membri la possibilità di trasferire 1 o 2 ore dal periodo serale a quello diurno o a quello notturno, in modo da tener conto delle eventuali differenze negli stili di vita tra le popolazioni degli Stati membri.	Annex I defines the indicator Lden. Lden measures, in decibels (dB), the annoyance during a day composed of a daytime of 12 hours, an evening of four hours and a night of eight hours. However, the Common Position gives the Member States the possibility of transferring ore or two hours from the evening period to the day period or to the night, in order to take into account the possible differences in lifestyle that might occur between Member States.
La Commissione ha proposto che la determinazione delle emissioni acustiche sia effettuata ad una distanza di 2 metri dalla facciata degli edifici, in modo da evitare fenomeni di riflessione. Poiché questo si è rivelato problematico nel caso di strade strette o di strade con autovetture in sosta, è stato convenuto che la misurazione deve essere effettuata sulla facciata, ma che sarà apportata una correzione (in generale 3 dB).	The Commission had proposed that the assessment of noise emissions should be undertaken at 2 m in front of the façade of buildings in order to avoid reflections. Since that created problems in narrow streets or in streets with parked cars, it was agreed that the measurement must be undertaken at the façade, but that a correction would be introduced (in general 3 dB).
Il Consiglio ha convenuto che la determinazione del rumore in prossimità degli edifici deve in generale essere effettuata ad un'altezza dal suolo di 4 metri, ma che 1,5 metri o altezze superiori possono essere decise nel caso di metodi di determinazione finalizzati alla pianificazione acustica ed alla mappatura acustica. Ai sensi dell'articolo 11, paragrafo 4, la Commissione riesaminerà l'altezza del punto di misura per le zone con abitazioni a un piano.	The Council agreed that the assessment of the noise near buildings should in principle be undertaken at a height of 4 m, but that 1,5 m or more may be chosen in case of measurement method, for acoustical planning and for noise zoning. Under Article 11(4), the Commission would reconsider the measurement height for areas with houses of one storey.
Il Consiglio ha inoltre soppresso i punti 1.2 e 2.2 della proposta e ha aggiunto un riferimento al descrittore LAmax.	The Council also deleted points 1.2 and 2.2 of the proposal. It added a reference to the Lamax indicator.
Allegato II	Annex II
Il Consiglio ha posto il metodo di calcolo prima del metodo di misurazione perché il metodo di calcolo è utilizzato con maggiore frequenza. L'ultima frase del punto 3 dalla proposta della Commissione relativa all'utilizzazione di metodi di determinazione equivalenti è stata sostituita con l'ultima parte dell'articolo 6, paragrafo 2.	The Council placed the computation method in front of the measurement method because the computation method is used more often. The last sentence of the Commission's section 3 on the use of equivalent assessment methods was replaced by Article 6(2) in fine.
Allegato III della proposta della Commissione	Annex III of the Commission proposal
Il Consiglio ha soppresso questo allegato, relativo ai requisiti per il software di mappatura, ed ha reintrodotto tale idea nell'allegato IV, punto 9, che autorizza la Commissione ad elaborare linee guida in tale settore.	The Council deleted this Annex, which concerned requirements for mapping software, and reintroduced this idea in Annex IV(9), which allows the Commission to develop guidelines in that field.
Allegato IV	Annex IV
Il Consiglio ha apportato alcune lievi modifiche (numeri "stimati", nuovo paragrafo 3).	The Council made a few minor changes ("estimated" numbers, new paragraph 3).
Allegato V	Annex V
Riguardo al punto 1, il Consiglio ha riunito tutti i trattini relativi alla situazione sanitaria nel sesto trattino. I riferimenti relativi agli aspetti economici sono ora riuniti nell'undicesimo trattino. Al punto 2 sono stati soppressi alcuni dettagli.	Regarding section 1, the Council merged all indents relating to the health situation into indent 6. The economic aspects are now referred to in indent 11. A few details were deleted in section 2.
Allegato VI	Annex VI
La posizione comune ha in generale ridotto gli intervalli superiori ed inferiori dei livelli di decibel da cui deve essere definita l'esposizione al rumore. Tale riduzione consente alle amministrazioni di concentrarsi maggiormente sulle zone rumorose. Ciò nondimeno, il limite inferiore degli intervalli resta sufficientemente ampio da consentire il rilevamento del trasferimento del rumore dalle zone rumorose a quelle silenziose. Inoltre, la Commissione, conformemente all'articolo 11, paragrafo 4, riesaminerà i limiti inferiori degli intervalli. Un'ultima modifica è che i dati relativi alle persone che vivono in abitazioni dotate di insonorizzazione speciale sono necessari unicamente se già disponibili.	The Common Position mainly reduced the upper and lower bands of values of dB where exposure to noise has to be assessed. The reduction enables administrations better to concentrate on noisy areas. Nevertheless, the lower limit of the bands is still wide enough to enable tracking the transfer of noise from noisy areas to quiet areas. Moreover, the Commission will, according to Article 11(4), reexamine the lower limit of the bands. A last modification is that the data related to persons living in specially insulated houses are only required if already available.
