Proposal for a COUNCIL DECISION on the signature, on behalf of the European Community, of the Cartagena Protocol on Biosafety

RELAZIONE

EXPLANATORY MEMORANDUM

Il 19 ottobre 1995 il Consiglio aveva autorizzato la Commissione a partecipare, in nome della Comunità, ai negoziati relativi ad un protocollo sulla sicurezza biologica ai sensi della Convenzione sulla diversità biologica [1]. Nel corso di questi negoziati la Comunità ha conseguito tutti gli obiettivi principali che figuravano nelle direttive di negoziato, in particolare le Conclusioni del Consiglio del 13 dicembre 1999 [2].

On 19 October 1995 [1] the Council authorised the Commission to participate, on behalf of the Community, in the negotiations on a Protocol on Biosafety under the Convention on Biological Diversity. The Community reached in these negotiations all its main objectives as set out in its negotiation directives, in particular the Council Conclusions of 13 December 1999 [2].

Promoting measures at international level to deal with regional or worldwide environmental problems is one of the objectives of the Community's policy on the environment, in accordance with Article 174 of the Treaty, which includes the conservation and sustainable use of biological diversity.

Il protocollo di Cartagena sulla sicurezza biologica ha come tema principale i movimenti intenzionali transfrontalieri di organismi viventi modificati, per cui esso produce effetti sul commercio internazionale. La decisione relativa alla sua firma deve quindi essere fondata sugli articoli 133 e 174, paragrafo 4, in combinato disposto con l'articolo 300, paragrafo 2, primo comma, prima frase.

The main focus of the Cartagena Protocol on Biosafety is the intentional transboundary movements of living modified organisms and it affects therefore international trade. The Decision to sign should therefore be based on article 133 and 174(4), in conjunction with the first sentence of the first subparagraph of art. 300 (2).

By decision 93/626/EEC [3], the Community concluded the Convention on Biological Diversity under the auspices of the United Nations Environment Programme. Pursuant to Article 19 (3) of the Convention, the second Conference of the Parties to the Convention established in 1995 [4] a negotiation process to consider the need for and modalities of a protocol on biosafety.

The Cartagena Protocol on Biosafety provides a framework, based on the precautionary principle, for the safe transfer, handling and use of living modified organisms resulting from modern biotechnology that may have adverse effects on the conservation and sustainable use of biological diversity, taking also into account risks to human health and specifically focussing on transboundary movements.

The Cartagena Protocol on Biosafety was adopted by consensus in Montreal on 29 January 2000 during the Extraordinary Conference of the Parties to the Convention on Biological Diversity.

The Protocol will be open for signature in Nairobi during the fifth meeting of the Conference of the Parties to the Convention in Nairobi from 15 to 26 May 2000, and at the UN Headquarters in New York from 5 June 2000 to 4 June 2001.

The Commission considers that by signing the Cartagena Protocol on Biosafety in Nairobi in May, the European Community would give an important political signal to all parties that signature and ratification of the Protocol should be an absolute priority.

La competenza della Comunità riguardo al protocollo è preponderante. Questa competenza e il principio dell'unità della rappresentanza esterna della Comunità militano a favore della firma simultanea e del successivo deposito dei rispettivi strumenti di ratifica o di approvazione da parte della Comunità e dei suoi Stati membri. Community competence is preponderant. Linked with the principle of unity in the international representation of the Community this militates in favour of simultaneous signature and eventual deposit of the respective instruments of ratification or approval by the Community and its Member States. In any case, Member States should not sign the Protocol, nor eventually deposit their instruments of ratification or approval before the Community does.

The Commission therefore requests the Council to authorise the President to designate the persons empowered to sign the Cartagena Protocol on Biosafety on behalf of the Community and to confer on them the necessary powers.

Notwithstanding Article 4 and without prejudice to any right of a Party of transit to regulate the transport of living modified organisms through its territory and make available to the Biosafety Clearing-House, any decision of that Party, subject to Article 2, paragraph 3, regarding the transit through its territory of a specific living modified organism, the provisions of this Protocol with respect to the advance informed agreement procedure shall not apply to living modified organisms in transit.

Notwithstanding Article 4 and without prejudice to any right of a Party to subject all living modified organisms to risk assessment prior to decisions on import and to set standards for contained use within its jurisdiction, the provisions of this Protocol with respect to the advance informed agreement procedure shall not apply to the transboundary movement of living modified organisms destined for contained use undertaken in accordance with the standards of the Party of import.

The Party shall provide a copy of the information, in writing, to the national focal point of each Party that informs the Secretariat in advance that it does not have access to the Biosafety Clearing-House. The notification shall be provided as soon as the Party knows of the above situation.

In order to avoid adverse effects on the conservation and sustainable use of biological diversity, taking also into account risks to human health, each Party shall take necessary measures to require that living modified organisms that are subject to intentional transboundary movement within the scope of this Protocol are handled, packaged and transported under conditions of safety, taking into consideration relevant international rules and standards.

The Parties shall cooperate in the development and/or strengthening of human resources and institutional capacities in biosafety, including biotechnology to the extent that it is required for biosafety, for the purpose of the effective implementation of this Protocol, in developing country Parties, in particular the least developed and small island developing States among them, and in Parties with economies in transition, including through existing global, regional, subregional and national institutions and organizations and, as appropriate, through facilitating private sector involvement.
