considerando quanto segue:

Whereas:

(1) Il regolamento (CEE) n. 1973/92 del Consiglio, del 21 maggio 1992, che istituisce uno strumento finanziario per l'ambiente (LIFE)(5), è stato adottato per contribuire all'attuazione e allo sviluppo della politica comunitaria nel settore dell'ambiente e della legislazione ambientale.

(1) Council Regulation (EEC) No 1973/92 of 21 May 1992 establishing a Financial Instrument for the Environment (LIFE)(5) was adopted to contribute to the implementation and development of Community environment policy and of environmental legislation.

(2) Il regolamento (CEE) n. 1973/92 è stato modificato in maniera sostanziale dal regolamento (CE) n. 1404/96(6). Al fine di contribuire ulteriormente all'attuazione, all'aggiornamento e allo sviluppo della politica comunitaria nel settore dell'ambiente e della legislazione ambientale, in particolare per quanto riguarda l'integrazione dell'ambiente in altre politiche, e allo sviluppo sostenibile nella Comunità, devono essere apportate modifiche al regolamento (CEE) n. 1973/92, che è opportuno, a fini di maggiore chiarezza, riformulare e sostituire con il presente regolamento.

(2) Council Regulation (EEC) No 1973/92 was substantially amended by Regulation (EC) No 1404/96(6); with a view to further contributing to the implementation, updating and development of Community environment policy and of environmental legislation, in particular as regards the integration of the environment into other policies, and to sustainable development in the Community, amendments are to be made to Council Regulation (EEC) No 1973/72, which should, for reasons of clarity, be recast and replaced by this Regulation.

(3) L'applicazione dello strumento finanziario per l'ambiente LIFE avviene per fasi. La seconda fase si conclude il 31 dicembre 1999.

(3) The Financial Instrument for the Environment, LIFE, is being implemented in phases; the second phase ended on 31 December 1999.

(4) Visto il contributo positivo dato da LIFE alla realizzazione degli obiettivi della politica comunitaria in materia ambientale e in base all'articolo 14 del regolamento (CEE) n. 1973/92, è opportuno avviare una terza fase della durata di cinque anni, che si concluderà il 31 dicembre 2004.

(4) Given the positive contribution of LIFE to the attainment of the objectives of Community policy on the environment and in accordance with Article 14 of Regulation (EEC) No 1973/92, a third phase for a period of five years ending on 31 December 2004 should be set in motion.

(5) È opportuno rafforzare LIFE quale strumento finanziario specifico, complementare ad altri strumenti comunitari, senza tuttavia limitare gli interventi di LIFE a settori non coperti da altri strumenti finanziari comunitari.

(5) LIFE should be reinforced as a specific financial instrument, complementary with other Community instruments, without however limiting LIFE interventions to areas not covered by other Community financial instruments.

(6) È opportuno aumentare l'efficacia e la trasparenza delle varie procedure di LIFE individuando chiaramente i tre settori che costituiscono lo strumento.

(6) The efficiency and transparency of the various procedures for LIFE should be improved by identifying clearly the three component parts which constitute the instrument.

(7) È necessario garantire un controllo e una valutazione efficaci delle azioni realizzate nel quadro di LIFE.

(7) It is necessary to ensure effective monitoring and evaluation of the actions undertaken under LIFE.

(8) L'esperienza maturata durante la seconda fase di LIFE ha evidenziato la necessità di concentrare gli sforzi precisando con maggior chiarezza i settori d'azione che possono fruire del sostegno finanziario comunitario, snellendo le procedure di gestione e migliorando le misure di divulgazione delle informazioni relative all'esperienza acquisita, ai risultati conseguiti e al loro impatto a lungo termine, per promuovere il trasferimento di tali risultati.

(8) The experience gained with LIFE during the second phase has highlighted the need to concentrate efforts by specifying more clearly the areas of activity able to benefit from Community financial aid, simplifying the management burden and improving the measures to disseminate information concerning the experience gained, the results achieved and their long-term impact, with a view to promoting the transfer of these results.

(9) Lo sviluppo della politica comunitaria nel settore dell'ambiente deve tener conto dei risultati conseguiti e dell'esperienza maturata grazie alle singole azioni realizzate nel quadro di LIFE.

(9) The development of Community environmental policy must take account of the results achieved and the experience gained from the individual actions implemented under LIFE.

(10) Nel quadro dei progetti che contribuiscono all'attuazione di "Natura 2000" è opportuno tener conto delle rotte migratorie e del ruolo delle zone cuscinetto.

(10) Consideration should be given to migration routes and the role of buffer zones in the context of projects contributing to the implementation of "Natura 2000".

(11) I progetti preparatori dovrebbero riguardare lo sviluppo di azioni e strumenti comunitari nuovi in materia ambientale o l'aggiornamento della legislazione e delle politiche ambientali.

(11) Preparatory projects should concern the development of new Community environmental actions and instruments, and/or the updating of environmental legislation and policies.

(12) La decisione n. 2179/98/CE del Parlamento europeo e del Consiglio, del 24 settembre 1998, relativa al riesame del programma comunitario di politica ed azione a favore dell'ambiente e di uno sviluppo sostenibile "Per uno sviluppo durevole e sostenibile"(7) stabilisce, tra gli obiettivi prioritari della Comunità, lo sviluppo di programmi volti a promuovere una maggiore consapevolezza dei problemi ambientali nell'industria ed in particolare nelle piccole e medie imprese (PMI) e l'esame in via prioritaria dei problemi tecnici e finanziari delle PMI che ostacolano lo sviluppo e l'applicazione delle tecnologie pulite sotto il profilo ambientale.

(12) Decision No 2179/98/EC of the European Parliament and of the Council of 24 September 1998 on the review of the European Community programme of policy and action in relation to the environment and sustainable development, "Towards sustainability"(7) sets, among the priority objectives of the Community, the development of programmes for the further promotion of environmental awareness on the part of industry, including, in particular, small and medium-sized enterprises (SMEs), and giving priority to the problems of SMEs as regards technical and financial obstacles to the development and use of clean technology in relation to the environment.

(13) Occorre, ove opportuno, tener conto delle implicazioni occupazionali delle proposte prese in considerazione per il sostegno finanziario nel quadro di LIFE-Ambiente.

(13) The employment implications of proposals considered for financial support under LIFE-environment should be taken into account, where appropriate.

(14) Per i paesi terzi rivieraschi del Mar Mediterraneo e del Mar Baltico diversi dai paesi dell'Europa centrale e orientale che hanno concluso accordi di associazione con la Comunità europea è necessario realizzare progetti di assistenza tecnica alla creazione di capacità e di strutture amministrative nel settore dell'ambiente.

(14) For third countries bordering on the Mediterranean and the Baltic Sea other than the countries of central and eastern Europe which have concluded Association Agreements with the European Community, technical assistance activities are needed to create capacities and administrative structures in the field of the environment.

(15) Gli accordi europei tra le Comunità europee ed i loro Stati membri, da una parte, ed i paesi dell'Europa centrale e orientale candidati all'adesione, dall'altra, prevedono la partecipazione di questi paesi a programmi comunitari, in particolare nel settore dell'ambiente.

(15) The Europe Agreements between the European Communities and their Member States, of the one part, and the accession candidate central and east European countries, of the other part, provide for the participation of those countries in Community programmes, in particular in the field of the environment.

(16) Sebbene i suddetti paesi dell'Europa centrale e orientale debbano di norma farsi carico dei costi connessi alla loro partecipazione, in casi specifici e secondo le norme applicabili al bilancio generale dell'Unione europea e ai pertinenti accordi di associazione, la Comunità può, se necessario, decidere di integrare il contributo nazionale del paese interessato.

(16) While the abovementioned central and east European countries should normally themselves meet the costs arising from their participation, the Community may decide, if necessary, for specific cases and in conformity with the rules applicable to the general budget of the European Union and the relevant Association Agreements, to supplement the national contribution of the country concerned.

(17) Gli altri paesi candidati all'adesione, qualora apportino un contributo finanziario a LIFE, possono parteciparvi a condizioni analoghe a quelle stabilite per i paesi dell'Europa centrale e orientale candidati all'adesione.

(17) The other accession candidate countries may, where they make a financial contribution to LIFE, participate under conditions equivalent to those laid down for the accession candidate central and east European countries.

(18) Le entrate provenienti da paesi terzi costituiscono risorse vincolate allo strumento in questione e in quanto tali sono iscritte al corrispondente capitolo di spesa.

(18) Receipts from third countries constitute resources earmarked for the instrument in question and are entered as such in the corresponding expenditure item.

(19) È opportuno istituire meccanismi di selezione che consentano di adeguare gli interventi della Comunità in relazione alle caratteristiche dei progetti da finanziare. È opportuno che le linee direttrici promuovano la sinergia tra azioni di dimostrazione e principi guida della politica ambientale della Comunità con l'obiettivo di uno sviluppo sostenibile.

(19) Selection mechanisms should be established so that Community assistance may be adapted to the particular features of the projects to be supported; guidelines should promote synergy between demonstration actions and the guiding principles of Community environmental policy with a view to sustainable development.

(20) Le misure necessarie per l'attuazione del presente regolamento sono adottate in base alla decisione 1999/468/CE del Consiglio, del 28 giugno 1999, recante modalità per l'esercizio delle competenze di esecuzione conferite alla Commissione(8).

(20) The measures necessary for the implementation of this Regulation should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(8).

(21) Il presente regolamento definisce, per l'intera durata della terza fase, una dotazione finanziaria di massima che, in base al punto 33 dell'accordo interistituzionale del 6 maggio 1999 tra il Parlamento europeo, il Consiglio e la Commissione(9), costituisce il riferimento principale per l'autorità di bilancio nell'ambito della procedura di bilancio annuale.

(21) This Regulation lays down, for the entire duration of the third phase, a financial framework constituting the prime reference, within the meaning of point 33 of the Interinstitutional Agreement of 6 May 1999 between the European Parliament, the Council and the Commission(9), for the budgetary authority during the annual budgetary procedure.

Obiettivo generale

General objective

È istituito uno strumento finanziario per l'ambiente, in prosieguo denominato "LIFE".

A Financial Instrument for the Environment, hereinafter referred to as "LIFE", is hereby established.

Obiettivo generale di LIFE è contribuire all'applicazione, all'aggiornamento e allo sviluppo della politica comunitaria nel settore dell'ambiente e della legislazione ambientale, in particolare nel settore dell'integrazione dell'ambiente nelle altre politiche, nonché allo sviluppo sostenibile nella Comunità.

The general objective of LIFE shall be to contribute to the implementation, updating and development of Community environment policy and of environmental legislation, in particular as regards the integration of the environment into other policies, and to sustainable development in the Community.

Settori tematici e criteri generali

Thematic components and general criteria

LIFE è diviso in tre settori tematici denominati LIFE-Natura, LIFE-Ambiente e LIFE-Paesi terzi.

LIFE shall consist of the three thematic components: LIFE-nature, LIFE-environment and LIFE-third countries.

I progetti finanziati da LIFE soddisfano i seguenti criteri generali:

The projects financed by LIFE shall meet the following general criteria:

a) sono di interesse comunitario in quanto contribuiscono in maniera significativa all'obiettivo generale di cui all'articolo 1;

(a) be of Community interest by making a significant contribution to the general objective laid down in Article 1;

b) sono realizzati da partecipanti affidabili sul piano tecnico e finanziario;

(b) be carried out by technically and financially sound participants;

c) sono realizzabili in termini di proposte tecniche, di calendario e di bilancio e di convenienza.

(c) be feasible in terms of technical proposals, timetable, budget and value for money.

Può essere data la priorità ai progetti basati su un approccio multinazionale allorché si presuma che questo possa avere risultati più efficaci in fatto di conseguimento degli obiettivi, tenendo conto della fattibilità e dei costi.

Priority may be given to projects based on a multinational approach when this is likely to have more effective results in terms of achievement of objectives taking into account feasibility and costs.

Article 3

LIFE-Natura

LIFE-nature

1. L'obiettivo specifico di LIFE-Natura è contribuire all'attuazione della direttiva 79/409/CEE del Consiglio, del 2 aprile 1979, concernente la conservazione degli uccelli selvatici(10); della direttiva 92/43/CEE del Consiglio, del 21 maggio 1992, relativa alla conservazione degli habitat naturali e della flora e della fauna selvatiche(11), e, in particolare, della rete europea Natura 2000 istituita da tale direttiva.

1. The specific objective of LIFE-nature shall be to contribute to the implementation of Council Directive 79/409/EEC of 2 April 1979 on the conservation of wild birds(10), Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora(11) and, in particular, the Natura 2000 European network established by the latter Directive.

2. The following shall be eligible for LIFE-nature:

a) i progetti di conservazione della natura che rispondono all'obiettivo specifico di cui al paragrafo 1 e contribuiscono a mantenere o ripristinare, in uno stato di conservazione favorevole, gli habitat naturali e/o le popolazioni di specie, ai sensi della direttiva 92/43/CEE;

(a) nature conservation projects which further the specific objective set out in paragraph 1 and contribute to maintaining or restoring natural habitats and/or species populations to a favourable conservation status within the meaning of Directive 92/43/EEC;

b) le misure di accompagnamento che agevolano il conseguimento dell'obiettivo specifico di cui al paragrafo 1 e sono necessarie per:

(b) accompanying measures which further the specific objective set out in paragraph 1 and are required:

i) la preparazione di progetti che coinvolgono partner di più Stati membri (misura "starter");

(i) to prepare projects involving partners in several Member States ("starter" measure);

ii) lo scambio di esperienze tra progetti (misura "coop");

(ii) to exchange experiences between projects ("co-op" measure);

iii) il controllo e la valutazione dei progetti, nonché la diffusione dei loro risultati, compresi quelli adottati nel quadro delle fasi precedenti dello strumento LIFE (misura "assist").

(iii) to monitor and evaluate projects and disseminate their results, including the results of projects decided upon during the preceding phases of LIFE ("assist" measure).

3. Il sostegno finanziario è accordato sotto forma di cofinanziamento dei progetti e non può superare:

3. Financial assistance shall be provided by co-financing of projects. The maximum rate shall be:

a) il 50 % per i progetti relativi alla conservazione della natura e il 100 % per le misure di accompagnamento;

(a) 50 % for nature conservation projects and 100 % for accompanying measures;

b) in circostanze eccezionali, la percentuale di cui alla lettera a) può ammontare fino al 75 % per i progetti relativi a habitat naturali prioritari o specie prioritarie indicati dalla direttiva 92/43/CEE o a specie di uccelli considerate prioritarie per il finanziamento nel quadro di LIFE-Natura da parte del comitato istituito a norma dell'articolo 16 della direttiva 79/409/CEE.

(b) by way of exception, the rate of 50 % provided for in (a) shall be a maximum of 75 % for projects concerning priority natural habitats or priority species within the meaning of Directive 92/43/EEC or the species of birds considered as priority for funding under LIFE-nature by the committee set up pursuant to Article 16 of Directive 79/409/EEC.

4. Gli Stati membri trasmettono alla Commissione le proposte di progetti da finanziare a norma del paragrafo 2, lettera a). Qualora i progetti prevedano la partecipazione di più Stati membri, le proposte sono trasmesse dallo Stato membro in cui ha sede l'organismo responsabile del coordinamento del progetto.

4. Proposals for projects to be financed pursuant to paragraph 2(a) shall be forwarded to the Commission by the Member States. Where projects involve more than one Member State, proposals shall be forwarded by the Member State in which the project coordinating body is located.

La Commissione fissa ogni anno la data di trasmissione delle proposte e delibera sulle medesime conformemente al paragrafo 7.

The Commission shall fix annually the date of forwarding of proposals and shall decide on the proposals in accordance with paragraph 7.

5. A norma del paragrafo 7, sono prese in considerazione per il sostegno finanziario soltanto le proposte che soddisfano i requisiti di cui all'articolo 2 e del paragrafo 2, lettera a), del presente articolo e che rispondano ai criteri seguenti:

5. Proposals shall be considered for financial support, in accordance with paragraph 7, only where they comply with the requirements of Article 2 and paragraph (2)(a) of this Article, and meet the following criteria:

a) progetti sul territorio europeo degli Stati membri che riguardano:

(a) projects in the European territory of the Member States relating to:

i) un sito proposto da uno Stato membro a norma dell'articolo 4 della direttiva 92/43/CEE; o

(i) a site proposed by a Member State under Article 4 of Directive 92/43/EEC, or

ii) un sito classificato a norma dell'articolo 4 della direttiva 79/409/CEE; o

(ii) a site classified pursuant to Article 4 of Directive 79/409/EEC, or

iii) una specie menzionata negli allegati II o IV della direttiva 92/43/CEE o nell'allegato I della direttiva 79/409/CEE.

(iii) a species in Annexes II or IV to Directive 92/43/EEC or in Annex I to Directive 79/409/EEC;

b) nei paesi candidati all'adesione ai quali si applica l'articolo 6, progetti che riguardino:

(b) projects in accession candidate countries to which Article 6 applies relating to:

i) un sito d'importanza internazionale che ospiti un tipo di habitat di cui all'allegato I o una specie di cui all'allegato II della direttiva 92/43/CEE, o un tipo di habitat o una specie, non presente nella Comunità, classificati nelle pertinenti risoluzioni della convenzione di Berna in quanto richiedono misure di conservazione specifiche;

(i) a site of international importance hosting a type of habitat cited in Annex I or a species cited in Annex II to Directive 92/43/EEC or a type of habitat or species not present in the Community but classified in the relevant Berne Convention resolutions as being in need of specific conservation measures, or

ii) un sito di importanza internazionale che ospiti una specie di uccello di cui all'allegato I della direttiva 79/409/CEE o una specie di uccello migratore presente nella Comunità, o una specie di uccello non presente nella Comunità ma classificato nelle pertinenti risoluzioni della convenzione di Berna come bisognoso di misure di conservazione specifiche; ovvero

(ii) a site of international importance hosting a bird species cited in Annex I to Directive 79/409/EEC or a migratory bird species present in the Community or a bird species not present in the Community but classified in the relevant Berne Convention resolutions as being in need of specific conservation measures, or

iii) una specie di cui agli allegati II o IV della direttiva 92/43/CEE o all'allegato I della direttiva 79/409/CEE, o una specie non presente nella Comunità ma classificata nelle appendici I o II della convenzione di Berna.

(iii) a species cited in Annexes II or IV to Directive 92/43/EEC or in Annex I to Directive 79/409/EEC or a species not present in the Community but classified in Appendix I or II to the Berne Convention.

6. La Commissione invia agli Stati membri un riassunto delle proposte pervenute. Su richiesta, essa mette i documenti originali a disposizione degli Stati membri per consultazione.

6. A summary of the proposals received shall be sent to the Member States by the Commission. On request, it shall place the original documents at the disposal of the Member States for consultation.

7. I progetti presi in considerazione per il sostegno finanziario nel quadro di LIFE-Natura sono soggetti alla procedura di cui all'articolo 11. Ai fini del presente paragrafo, il comitato è quello di cui all'articolo 20 della direttiva 92/43/CEE.

7. Projects considered for financial support under LIFE-nature shall be subject to the procedure set out in Article 11. For the purposes of this paragraph, the committee shall be that referred to in Article 20 of Directive 92/43/EEC.

An outline decision shall be adopted by the Commission and addressed to the Member States on the projects which have been accepted, and individual decisions shall be addressed to the beneficiaries laying down the amount of financial assistance, the financial procedures and controls, and the specific technical conditions of the project approved.

(a) accompanying measures to be financed pursuant to paragraph 2(b)(i) and (ii) shall, after consultation of the committee mentioned in Article 21 of Directive 92/43/EEC, be the subject of calls for expressions of interest. Member States may submit proposals on accompanying measures to the Commission;

b) le misure di accompagnamento da finanziare a norma del paragrafo 2, lettera b), punto iii), sono oggetto di inviti a manifestare interesse.

(b) accompanying measures to be financed pursuant to paragraph 2(b)(iii) shall be the subject of calls for expression of interest.

All calls for expression of interest shall be published in the Official Journal of the European Communities where the specific criteria to be met will be set out.

LIFE-Ambiente

LIFE-environment

1. L'obiettivo specifico di LIFE-Ambiente è contribuire allo sviluppo di tecniche e metodi innovativi e integrati e all'ulteriore sviluppo della politica comunitaria dell'ambiente.

1. The specific objective of LIFE-environment shall be to contribute to the development of innovative and integrated techniques and methods and to the further development of Community environment policy.

2. Nel quadro di LIFE-Ambiente possono essere finanziati i seguenti progetti e/o misure:

2. The following projects and/or measures shall be eligible for LIFE-environment:

a) i progetti di dimostrazione che rispondono all'obiettivo previsto al paragrafo 1, e mirano a:

(a) demonstration projects which further the objective set out in paragraph 1 and:

- integrare considerazioni sull'ambiente e sullo sviluppo sostenibile nella pianificazione e nella valorizzazione del territorio, incluse le zone urbane e costiere, oppure

- integrate considerations on the environment and on sustainable development in land-use development and planning, including in urban and coastal areas, or

- promuovere la gestione sostenibile delle acque freatiche e di superficie, oppure

- promote the sustainable management of groundwater and surface water, or

- ridurre al minimo l'impatto ambientale delle attività economiche, in particolare mediante lo sviluppo di tecnologie pulite e ponendo l'accento sulla prevenzione, compresa la riduzione delle emissioni di gas ad effetto serra, oppure

- minimise the environmental impact of economic activities, notably through the development of clean technologies and by placing the emphasis on prevention, including the reduction of emission of gases having a greenhouse effect, or

- prevenire, riutilizzare, recuperare e riciclare i rifiuti di tutti i tipi e a gestire razionalmente il flusso di rifiuti, oppure

- prevent, reuse, recover and recycle waste of all kinds and ensure the sound management of waste streams, or

The rate of Community financial support shall be a maximum of 30 % of the eligible cost of the project for projects generating substantial net revenue. In this case, the beneficiaries' contribution to the financing shall be at least as much as the Community support.

The rate of Community financial support to all other applicants shall be a maximum of 50 % of the eligible cost of the project.

4. Per quanto attiene ai progetti di dimostrazione, le linee direttrici saranno stabilite dalla Commissione, dopo essere state oggetto della procedura di cui all'articolo 11, e pubblicate nella Gazzetta ufficiale delle Comunità europee. As far as demonstration projects are concerned, guidelines will be established by the Commission, after being subject to the procedure set out in Article 11, and published in the Official Journal of the European Communities. The guidelines shall promote synergy between demonstration actions and the guiding principles of Community environmental policy with a view to sustainable development.

5. Gli Stati membri trasmettono alla Commissione le proposte di progetti da finanziare a norma del paragrafo 2, lettera a). Qualora i progetti prevedano la partecipazione di più Stati membri, le proposte sono trasmesse dallo Stato membro in cui ha sede l'organismo responsabile del coordinamento del progetto.

5. Proposals for projects to be financed pursuant to paragraph 2(a) shall be forwarded to the Commission by the Member States. Where projects involve more than one Member State, proposals shall be forwarded by the Member State in which the project coordinating body is located.

La Commissione fissa ogni anno la data di trasmissione delle proposte e delibera sulle medesime conformemente al paragrafo 10.

The Commission shall fix annually the date of forwarding of proposals and shall decide on the proposals in accordance with paragraph 10.

1. L'obiettivo specifico di LIFE-Paesi terzi è contribuire alla creazione di capacità e strutture amministrative necessarie nel settore dell'ambiente nonché per lo sviluppo di politiche e programmi d'azione nel settore dell'ambiente nei paesi terzi rivieraschi del Mediterraneo o del Baltico, diversi dai paesi dell'Europa centrale e orientale che hanno concluso accordi di associazione con la Comunità europea, di cui all'articolo 6, paragrafo 1.

The specific objective of LIFE-third countries shall be to contribute to the establishment of capacities and administrative structures needed in the environmental sector and in the development of environmental policy and action programmes in third countries bordering on the Mediterranean and the Baltic Sea other than the countries of central and eastern Europe which have concluded Association Agreements with the European Community and are referred to in Article 6(1).

LIFE shall be open to the accession candidate central and east European countries in accordance with the conditions referred to in the Association Agreements concluded with those countries and on the basis of provisions of the decision of the Association Council competent for each country concerned.

Quando per gli altri paesi candidati all'adesione saranno adottate condizioni e disposizioni equivalenti a quelle previste al paragrafo 1, LIFE sarà aperto alla partecipazione di questi paesi in base ai paragrafi da 2 a 6. I paesi partecipanti a norma del presente articolo non possono partecipare in base all'articolo 5.

7. Where conditions and provisions equivalent to those referred to in paragraph 1 have been established for the other accession candidate countries, LIFE will be open for participation by those countries in accordance with paragraphs 2 to 6. Countries participating under this Article may not participate under Article 5.

1. Fatte salve le condizioni previste all'articolo 6 per i paesi candidati all'adesione, i progetti che beneficiano degli aiuti previsti a titolo dei fondi strutturali o di altri strumenti di bilancio comunitari non sono ammissibili al sostegno finanziario previsto dal presente regolamento.

1. Without prejudice to the conditions for accession candidate countries set out in Article 6, projects receiving aid provided for under the Structural Funds or other Community budget instruments shall not be eligible for financial assistance under this Regulation.

1. L'applicazione di LIFE avviene per fasi. La terza fase inizia il 1o gennaio 2000 e si conclude il 31 dicembre 2004. Il quadro finanziario per l'attuazione della terza fase per il periodo 2000-2004 è stabilito a 640 milioni di EUR.

1. LIFE shall be implemented in phases. The third phase shall start on 1 January 2000 and shall end on 31 December 2004. The financial framework for the implementation of the third phase for the period 2000 to 2004 is hereby set at EUR 640 million.

Controllo dei progetti

Monitoring of projects

1. Per ciascun progetto finanziato da LIFE, il beneficiario presenta alla Commissione e, su richiesta, allo Stato membro interessato, relazioni tecniche e finanziarie sullo stato di avanzamento dei lavori. Le relazioni destinate agli Stati membri possono essere inviate in forma sintetica. Inoltre, entro tre mesi dal completamento del progetto è inviata una relazione finale alla Commissione e allo Stato membro interessato.

1. For any project financed by LIFE, the beneficiary shall send the Commission and, on request, the Member State concerned technical and financial reports on the progress of work. Reports sent to Member States could be sent in summarised form. A final report shall also be sent to the Commission and the Member State concerned within three months of completion of the project.

La Commissione stabilisce la forma e il contenuto di tali relazioni. Le relazioni si basano su indicatori fisici e finanziari stabiliti nella decisione della Commissione che approva i progetti o nel contratto o nella convenzione conclusi con i beneficiari. Questi indicatori sono strutturati in maniera tale da indicare lo stato di avanzamento dell'azione e gli obiettivi da conseguire entro un termine stabilito.

The Commission shall determine the form and content of the reports. The report shall be based on the physical and financial indicators set out in the Commission Decision approving the projects or in the contract or agreement concluded with the beneficiaries. These indicators shall be such as to indicate the progress of the work and the objectives to be attained within a specified time limit.

2. A prescindere dai controlli eseguiti dalla Corte dei conti in cooperazione con gli organi o i servizi di controllo nazionali competenti, a norma dell'articolo 248 del trattato e dalle ispezioni svolte a norma dell'articolo 279, lettera c), del trattato, funzionari o agenti della Commissione possono controllare sul posto i progetti finanziati da LIFE, anche mediante controlli a campione.

2. Without prejudice to the audits carried out by the Court of Auditors in liaison with the competent national audit bodies or departments pursuant to Article 248 of the Treaty, or any inspection carried out pursuant to Article 279(c) of the Treaty, officials and other staff of the Commission may carry out on-the-spot checks, including sample checks, on projects financed under LIFE.

Prima di effettuare un controllo in loco, la Commissione ne informa il beneficiario interessato e il suo Stato membro, salvo quando vi sia un fondato sospetto di frode e/o di uso improprio.

Before carrying out an on-the-spot check, the Commission shall inform the beneficiary and its Member State unless there are good reasons to suspect fraud and/or improper use.

3. Il beneficiario del sostegno finanziario tiene a disposizione della Commissione tutti i documenti giustificativi attinenti alle spese connesse con l'azione per un periodo di cinque anni dopo l'ultimo pagamento ad essa relativo.

3. For a period of five years following the last payment in respect of any action, the beneficiary of financial assistance shall keep available for the Commission all the supporting documents regarding expenditure on the action.

4. On the basis of the results of the reports and sample checks referred to in paragraphs 1 and 2, the Commission shall, if necessary, adjust the scale or the conditions of allocation of the financial assistance originally approved and also the timetable for payments.

5. The Commission shall take every other step necessary to verify that the projects financed are carried out properly and in compliance with the provisions of this Regulation.

Protection of Community financial interests

1. La Commissione può ridurre, sospendere o recuperare l'importo del sostegno finanziario concesso per un progetto, qualora accerti l'esistenza di irregolarità, inclusa l'inosservanza del presente regolamento o della singola decisione o del contratto o della convenzione relativo alla concessione del sostegno finanziario in questione, o qualora risulti che, senza chiedere il consenso della Commissione, siano state apportate ad un progetto modifiche rilevanti incompatibili con la natura o le condizioni di esecuzione del medesimo.

1. The Commission may reduce, suspend or recover the amount of financial assistance granted for a project if it finds irregularities, including non-compliance with the provisions of this Regulation or the individual decision or the contract or agreement granting the financial support in question, or if it transpires that, without Commission approval having been sought, the project has undergone a major change which conflicts with the nature or implementing conditions of the project.

2. Qualora non siano state rispettate le scadenze o qualora la realizzazione di un progetto giustifichi solo una parte del sostegno concesso, la Commissione invita il beneficiario a comunicarle le sue osservazioni entro un termine stabilito. Qualora il beneficiario non fornisca spiegazioni adeguate, la Commissione può annullare il sostegno finanziario residuo e procedere al recupero dei fondi già erogati.

2. If the time limits have not been observed or if only part of the allocated financial assistance is justified by the progress made with implementing a project, the Commission shall request the beneficiary to submit its observations within a specified period. If the beneficiary does not give a satisfactory answer, the Commission may cancel the remaining financial assistance and demand repayment of sums already paid.

3. Tutti gli importi indebitamente versati devono essere restituiti alla Commissione. Per gli importi non restituiti a tempo debito possono essere addebitati i relativi interessi di mora. La Commissione stabilisce le modalità di applicazione del presente paragrafo.

3. Any undue payment shall be repaid to the Commission. Interest may be added to any sums not repaid in good time. The Commission shall lay down detailed rules for the implementation of this paragraph.

a) una relazione sullo stato di applicazione del presente regolamento, sul contributo del medesimo allo sviluppo della politica della Comunità in materia ambientale, e sull'impiego degli stanziamenti nonché, se del caso, proposte di eventuali modifiche da apportare in vista del proseguimento dell'azione oltre la terza fase;

(a) a report on the implementation of this Regulation, its contribution to the development of Community environmental policy, and the use made of the appropriations as well as, where appropriate, proposals for any adjustments to be made with a view to continuing the action beyond the third phase;

b) se del caso, una proposta concernente una quarta fase di LIFE.

(b) if appropriate, a proposal concerning a fourth phase of LIFE.

2. Il Parlamento europeo e il Consiglio, a norma del trattato, decidono entro il 1o luglio 2004 in merito all'attuazione della quarta fase a decorrere dal 1o gennaio 2005.

La Commissione nota che il Parlamento europeo ed il Consiglio convengono in merito all'opportunità di adottare una procedura di regolamentazione per la scelta dei progetti, rispetto alla procedura di gestione suggerita dalla Commissione nella proposta modificata presentata dopo la pronuncia del Parlamento europeo in seconda lettura.

The Commission notes the agreement of the European Parliament and the Council to provide for a regulatory procedure when considering the choice of projects, as opposed to the management procedure proposed by the Commission in the modified proposal following Parliament's second reading.

La Commissione, ribadendo quanto dichiarato allorché la posizione comune è stata adottata, sottolinea nuovamente quanto sia importante dare applicazione ai criteri fissati dall'articolo 2 della decisione del Consiglio 1999/468/CE, del 28 giugno 1999, recante modalità per l'esercizio delle competenze di esecuzione conferite alla Commissione.

The Commission insists, as it stated at the time of the adoption of the Common Position, on the importance of applying the criteria of Article 2 of Council Decision 1999/468/EC of 28 June 1999, laying down the procedures for the exercise of implementing powers conferred on the Commission.

La Commissione ritiene che la scelta dei progetti, date le sue notevoli implicazioni in termini di bilancio, debba essere effettuata seguendo la procedura di gestione.

The Commission believes that, the choice of projects being a measure with substantial budgetary implications, this should follow the management procedure.

La Commissione ritiene inoltre che ignorare le disposizioni dell'articolo 2 dalla decisione del Consiglio 1999/468/CE, in un caso tanto evidente quanto appunto il caso in oggetto, contravvenga sia ai principi ispiratori che al disposto della decisione del Consiglio.

The Commission considers that to ignore the terms of Article 2 of Decision 1999/468/EC in a case as clear as this is contrary to both the spirit and the letter of the Council Decision.

La Commissione si vede pertanto costretta ad adottare le dovute riserve in materia, compreso il diritto di adire la Corte di giustizia quando e se lo riterrà opportuno.

The Commission must therefore reserve its position in this matter, including its right to take appropriate future action before the Court.

Il Consiglio prende atto della dichiarazione della Commissione sulla scelta della procedura di comitato affinché quest'ultima adotti misure di attuazione nel quadro del regolamento LIFE.

The Council notes the statement by the Commission regarding the choice of the committee procedure for the adoption, by the Commission, of implementing measures under the LIFE Regulation.

Scegliendo la procedura di regolamentazione di cui all'articolo 5 della decisione 1999/468/CE del Consiglio, del 28 giugno 1999, recante modalità per l'esercizio delle competenze di esecuzione conferite alla Commissione, il Consiglio ha tenuto conto dell'esperienza acquisita con la procedura di regolamentazione nel quadro dello strumento LIFE nella prima fase (dal 1992) e nella seconda fase (dal 1996), nonché della natura di tale strumento, che svolge un ruolo essenziale per la tutela dell'ambiente nella Comunità e contribuisce all'attuazione e allo sviluppo della politica comunitaria in questo settore.

In choosing the regulatory procedure contained in Article 5 of Council Decision 1999/468/EC of 28 June 1999, laying down the procedures for the exercise of implementing powers conferred on the Commission, the Council took into account the experience gained with the regulatory procedure under the LIFE instrument during the first (since 1992) and second phase (since 1996) and the nature of the LIFE instrument, which plays a vital role in the protection of the environment within the Community and contributes to the implementation and development of Community environmental policy.

Il Consiglio rammenta che i criteri fissati all'articolo 2 della decisione 1999/468/CE del Consiglio non sono vincolanti sotto il profilo giuridico e hanno un carattere indicativo. Il Consiglio ritiene che il campo di applicazione delle competenze di esecuzione nel regolamento in questione giustifichi pienamente il ricorso alla procedura di regolamentazione.

The Council recalls that the criteria laid down in Article 2 of Decision 1999/468/EC are legally non-binding and of an illustrative nature. The Council considers that the scope of the implementing powers in this Regulation fully justify having recourse to a regulatory procedure.
