IL CONSIGLIO DELL'UNIONE EUROPEA, visto il trattato che istituisce la Comunità europea, in particolare l'articolo 75, paragrafo 1, lettera d), vista la proposta della Commissione (1), visto il parere del Comitato economico e sociale (2), deliberando secondo la procedura di cui all'articolo 189 C del trattato (3), (1) considerando che la Comunità ha adottato un certo numero di misure destinate ad assicurare il buon funzionamento del mercato interno che comporta uno spazio senza frontiere nel quale è assicurata la libera circolazione delle merci, delle persone, dei servizi e dei capitali secondo le disposizioni del trattato; (2) considerando che diversi Stati membri sono parti contraenti della convenzione di Vienna del 1968 sulla circolazione stradale (4), in prosieguo denominata «la convenzione», il cui articolo 37 prevede che ogni autoveicolo in circolazione internazionale rechi nella parte posteriore, oltre al proprio numero di immatricolazione, un segno distintivo dello Stato in cui è immatricolato; (3) considerando che la Comunità non è parte contraente della convenzione e che alcuni Stati membri, che invece lo sono, applicano le disposizioni dell'articolo 37 della convenzione; che, di conseguenza, tali Stati membri richiedono che i veicoli provenienti da altri Stati membri espongano il segno distintivo previsto dall'allegato 3 della convenzione; che alcuni di detti Stati membri non ammettono altri segni distintivi, come quelli applicati sulle targhe, che, pur indicando lo Stato membro di immatricolazione del veicolo, non sono conformi all'allegato 3 della convenzione; (4) considerando che diversi Stati membri hanno adottato un modello di targa che all'estremità sinistra della targa presenta un riquadro blu contenente le 12 stelle gialle che richiamano la bandiera europea e il segno distintivo dello Stato membro di immatricolazione; che, per quanto riguarda il trasporto intracomunitario, tale segno distintivo risponde agli obiettivi di identificazione dello Stato di immatricolazione, di cui all'articolo 37 della convenzione; (5) considerando che è pertanto necessario che gli Stati membri che impongono ai veicoli provenienti da altri Stati membri di esporre il segno distintivo dello Stato di immatricolazione riconoscano anche il segno di cui all'allegato del presente regolamento,	THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty establishing the European Community, and in particular Article 75(1)(d) thereof, Having regard to the proposal from the Commission (1), Having regard to the opinion of the Economic and Social Committee (2), Acting in accordance with the procedure laid down in Article 189c of the Treaty (3), (1) Whereas the Community has adopted a certain number of measures that are intended to ensure the smooth functioning of an internal market comprising an area without frontiers in which the free movement of goods, persons, services and capital is ensured in accordance with the provisions of the Treaty; (2) Whereas several Member States are contracting parties to the Vienna Convention of 1968 on road traffic (4), hereinafter referred to as the 'Convention`, Article 37 of which provides that every motor vehicle in international traffic shall display at the rear, in addition to its registration number, a distinguishing sign of the State in which it is registered; (3) Whereas the Community is not a contracting party to the convention and whereas some of its Member States which are parties to it have recourse to the provisions of Article 37 of the Convention; whereas those Member States thus require vehicles from other Member States to display the distinguishing sign provided for by Annex 3 to the Convention; whereas some of those Member States do not recognise other distinguishing signs such as those displayed on registration plates which, while indicating the Member State in which the vehicle is registered, do not conform to Annex 3 to the Convention; (4) Whereas several Member States have introduced a model registration plate which, on the extreme left, displays a blue zone containing the 12 yellow stars representing the European flag plus the distinguishing sign of the Member State of registration; whereas for the purpose of intra-Community transport this distinguishing sign meets the objective of identifying the State of registration as provided for in Article 37 of the Convention; (5) Whereas Member States requiring vehicles from other Member States to display the distinguishing sign of the State of registration should also recognise the sign as provided for in the Annex to this Regulation,
HA ADOTTATO IL PRESENTE REGOLAMENTO: Articolo 1 Il presente regolamento si applica ai veicoli immatricolati negli Stati membri e circolanti nella Comunità. Articolo 2 Ai fini del presente regolamento, si intende per: 1) «segno distintivo dello Stato membro di immatricolazione»: un insieme composto da una, due o tre lettere in caratteri latini maiuscoli che designano lo Stato membro nel quale è immatricolato il veicolo; 2) «veicolo»: qualsiasi veicolo a motore e relativo rimorchio quali definiti nelle seguenti direttive: - direttiva 70/156/CEE del Consiglio, del 6 febbraio 1970, concernente il ravvicinamento delle legislazioni degli Stati membri relative all'omologazione dei veicoli a motore e dei loro rimorchi (5), - direttiva 92/61/CEE del Consiglio, del 30 giugno 1992, relativa all'omologazione dei veicoli a motore a due o a tre ruote (6). Articolo 3 Gli Stati membri che impongono ai veicoli immatricolati in un altro Stato membro e circolanti nel loro territorio di esporre un segno distintivo di immatricolazione, riconoscono il segno distintivo dello Stato membro di immatricolazione esposto all'estremità sinistra della targa di immatricolazione in base all'allegato del presente regolamento come equivalente a qualsiasi altro segno distintivo da essi riconosciuto al fine dell'identificazione dello Stato di immatricolazione del veicolo. Articolo 4 Il presente regolamento entra in vigore il giorno successivo alla pubblicazione nella Gazzetta ufficiale delle Comunità europee. Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri. Fatto a Bruxelles, addì 3 novembre 1998. Per il Consiglio Il presidente B. PRAMMER	HAS ADOPTED THIS REGULATION: Article 1 This Regulation shall apply to vehicles registered in the Member States that are driven within the Community. Article 2 For the purposes of this Regulation: 1. 'distinguishing sign of the Member State of registration` shall mean a set composed of one to three letters in Latin capitals indicating the Member State in which the vehicle is registered; 2. 'vehicle` shall mean any motor vehicle and its trailer as defined in: - Council Directive 70/156/EEC of 6 February 1970 on the approximation of the laws of the Member States relating to the type-approval of motor vehicles and their trailers (5), - Council Directive 92/61/EEC of 30 June 1992 relating to the type-approval of two or three-wheel motor vehicles (6). Article 3 Member States requiring vehicles registered in another Member State to display a distinguishing registration sign when they are being driven on their territory shall recognise the distinguishing sign of the Member State of registration displayed on the extreme left of the registration plate in accordance with the Annex to this Regulation as being equivalent to any other distinguishing sign that they recognise for the purpose of identifying the State in which the vehicle is registered. Article 4 This Regulation shall enter into force on the day following its publication in the Official Journal of the European Communities.
