COUNCIL DECISION of 18 June 1998 concerning the Agreement between the European Community, the European Space Agency and the European Organisation for the Safety of Air Navigation on a European contribution to the development of a global navigation satellite system (GNSS)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the EuropeanCommunity, and in particular Article 75(1), Article 84(2)and Article 130m, in conjunction with the first sentenceof Article 228(2), the first subparagraph of Article 228(3)and with Article 228(4) thereof,

Having regard to the proposal from the Commission ( 1 ),

Having regard to the opinion of the European Parliament ( 2 ),

Whereas the Community can, within the scope of itspowers, make a contribution to the implementation of aglobal navigation satellite system;

Whereas the Agreement between the European Community, the European Space Agency and the EuropeanOrganisation for the Safety of Air Navigation on a European contribution to the development of a global navigation satellite system (GNSS) should be approved,

HAS DECIDED AS FOLLOWS:

Article 1

The Agreement between the European Community, theEuropean Space Agency and the European Organisationfor the Safety of Air Navigation on a European contribution to the development of a global navigation satellitesystem (GNSS) is hereby approved on behalf of theCommunity.

The text of the Agreement as well as the technicalannexes thereto are attached to this Decision.

Article 2

1. The Community shall be represented in the JointCommittee referred to in Article 5 of the Agreement bythe Commission.

2. With regard to matters covered in Article 5(4) of theAgreement, the Community position shall be adopted bythe Council on a proposal from the Commission; withregard to matters covered in Article 5(1), (2) and (3), theCommunity position shall be determined by theCommission after consultation with a Committee ofrepresentatives of the Member States.

3. The Commission shall be authorized to approve, onbehalf of the Community, the amendments referred to inArticle 5(4) of the Agreement.

Article 3

The President of the Council shall be authorized to nominate the signatory of the Agreement on behalf of theCommunity.
