IL PARLAMENTO EUROPEO E IL CONSIGLIO DELL'UNIONE EUROPEA,

Whereas:

(1) Il 23 e 24 marzo 2000 il Consiglio europeo di Lisbona ha fissato l'obiettivo di trasformare l'Unione europea nell'economia basata sulla conoscenza più competitiva e più dinamica del mondo e stabilito la necessità di ricorrere ad un metodo aperto per misurarne i progressi in modo coordinato.

(1) On 23 and 24 March 2000 the Lisbon European Council set the objective of making the European Union the most competitive and dynamic knowledge-based economy in the world and stated the need to use an open method for the coordination of measurement of progress.

(2) Il 19 e 20 giugno 2000 il Consiglio europeo di Feira ha approvato il piano d'azione eEurope 2002 e sottolineato in particolare la necessità di preparare prospettive a più lungo termine per l'economia basata sulla conoscenza che incoraggino l'accesso alle nuove tecnologie da parte di tutti i cittadini. Il 30 novembre 2000 il Consiglio "Mercato interno" ha definito un elenco di 23 indicatori per misurare i progressi del piano d'azione eEurope 2002.

(2) On 19 and 20 June 2000, the Feira European Council endorsed the eEurope 2002 Action plan and especially underlined the necessity to prepare longer term perspectives for the knowledge-based economy encouraging the access of all citizens to the new technologies and on 30 November 2000 the Internal Market Council defined a list of 23 indicators to measure progress of the eEurope 2002 Action plan.

(3) Il 28 maggio 2002 la Commissione ha pubblicato una comunicazione destinata al Parlamento europeo, al Consiglio, al Comitato economico e sociale europeo e al Comitato delle regioni intitolata "eEurope 2005: una società dell'informazione per tutti" e il 21 e 22 giugno 2002 il Consiglio europeo di Siviglia ha approvato gli obiettivi generali del piano d'azione.

(3) On 28 May 2002 the Commission published a Communication addressed to the European Parliament, the Council, the European Economic and Social Committee and the Committee of the Regions entitled "eEurope 2005: An information society for all", and the Seville European Council endorsed the general objectives of the Action plan on 21 and 22 June 2002.

(4) On 22 January 2001, the Commission published a Communication addressed to the European Parliament, the Council, the European Economic and Social Committee and the Committee of the Regions entitled "Creating a Safer Information Society by Improving the Security of Information Infrastructures and Combating Computer-related Crime".

(5) Nelle conclusioni del Consiglio europeo di Stoccolma del 23 e 24 marzo 2001 il Consiglio e la Commissione sono stati invitati a sviluppare una strategia globale in materia di sicurezza delle reti elettroniche e a definire azioni pratiche di attuazione. La comunicazione intitolata "Sicurezza delle reti e sicurezza dell'informazione: proposta di un approccio strategico europeo", del 6 giugno 2001, ha costituito la prima risposta della Commissione alla richiesta del Consiglio europeo.

(5) The Conclusions of the Stockholm European Council of 23 and 24 March 2001 contained a request that the Council, together with the Commission, develop a comprehensive strategy on the security of electronic networks including practical implementing action. The communication on "Network and Information Security: Proposal for a European Policy Approach" of 6 June 2001 was the initial Commission response to this request.

(6) La risoluzione del Consiglio del 30 maggio 2001 relativa al piano d'azione eEurope: Sicurezza dell'informazione e delle reti, la risoluzione del Consiglio del 28 gennaio 2002 relativa a un approccio comune e ad azioni specifiche nel settore della sicurezza delle reti e dell'informazione(4), la risoluzione del Consiglio del 18 febbraio 2003 su un approccio europeo per una cultura della sicurezza delle reti e dell'informazione(5) e la risoluzione del Parlamento europeo del 22 ottobre 2002 sulla sicurezza delle reti e sicurezza dell'informazione: Proposta di un approccio strategico europeo esortano gli Stati membri ad avviare iniziative specifiche volte a migliorare la sicurezza delle reti di comunicazione elettronica e dei sistemi di informazione. Il Parlamento europeo e il Consiglio hanno inoltre accolto favorevolmente l'intenzione della Commissione di sviluppare, tra le altre iniziative, una strategia tesa a garantire un funzionamento più stabile e sicuro dell'infrastruttura Internet e a proporre l'istituzione di una futura struttura a livello europeo relativa ai problemi della sicurezza dell'informazione e delle reti.

(6) The Council Resolution of 30 May 2001 on the eEurope Action plan: Information and Network Security, the Council Resolution of 28 January 2002 on a common approach and specific actions in the area of network and information security(4), the Council resolution of 18 February 2003 on a European approach towards a culture of network and information security(5) and the European Parliament Resolution of 22 October 2002 on Network and Information Security: Proposal for a European Policy called upon Member States to launch specific actions to enhance the security of electronic communication networks and information systems. The European Parliament and the Council further welcomed the Commission's intentions to develop amongst others a strategy for a more stable and secure operation of the Internet infrastructure and to make a proposal for the establishment of the future structure at European level for network and information security issues.

(7) Il piano d'azione eEurope 2005, confermato al riguardo dalla risoluzione del Consiglio del 18 febbraio 2003, propone tra l'altro di istituire la futura struttura a livello europeo relativa ai problemi della sicurezza dell'informazione e delle reti.

(7) The eEurope 2005 Action plan, confirmed in this respect by the Council Resolution of 18 February 2003, proposes inter alia the establishment of the future structure at European level for network and information security issues.

(8) Introducendo nuove forme di relazioni economiche, politiche e sociali, la transizione verso la società dell'informazione può aiutare l'Unione europea a far fronte alle sfide di questo secolo e contribuire alla crescita, alla competitività e all'aumento dell'occupazione. La società dell'informazione ridisegna progressivamente la natura delle attività economiche e sociali ed ha importanti effetti trasversali su settori di attività sino ad ora indipendenti tra loro. Le misure necessarie per dare attuazione alla società dell'informazione dovrebbero tener conto sia della coesione economica e sociale della Comunità e dei rischi derivanti da una esclusione digitale sia della necessità di garantire un efficiente funzionamento del mercato interno. Le azioni dell'Unione europea e degli Stati membri nel campo della società dell'informazione mirano a promuovere ulteriormente la partecipazione di gruppi svantaggiati alla società dell'informazione.

(8) The move towards the Information Society can, by introducing new forms of economic, political and social relations, help the European Union to cope with the challenges of this century, and can contribute to growth, competitiveness and job creation. The Information Society gradually reorganises the nature of economic and social activity and has important cross-sectorial effects in hitherto independent areas of activity. The measures necessary for its implementation should take into account the economic and social cohesion of the Community and the risks associated with a digital exclusion as well as the efficient functioning of the Internal market. The actions of the European Union and of the Member States in relation to the Information Society aim to promote further the participation of disadvantaged groups in the Information Society.

(9) È necessario istituire meccanismi di sorveglianza e di scambio delle esperienze che consentano agli Stati membri di raffrontare ed analizzare le prestazioni e di valutare i progressi compiuti in relazione al piano d'azione eEurope 2005.

(9) There is a need for the establishment of mechanisms for monitoring and for the exchange of experiences which will enable Member States to compare and analyse performances and review progress in relation to the eEurope 2005 Action plan.

(10) L'analisi comparativa consente agli Stati membri di valutare se le iniziative nazionali varate nel quadro del piano d'azione eEurope 2005 producono risultati comparabili a quelli degli altri Stati membri, nonché a livello internazionale, e sfruttano in modo ottimale il potenziale tecnologico.

(10) Benchmarking allows Member States to assess whether the national initiatives that they have taken in the framework of the eEurope 2005 Action plan are producing results that can be compared with those in other Member States, as well as internationally, and are fully exploiting the potential of the technologies.

(11) La diffusione delle buone prassi può integrare le attività condotte dagli Stati membri nel quadro del piano d'azione eEurope 2005. Il valore aggiunto europeo in materia di analisi comparativa e buona prassi risiede in una valutazione comparativa dei risultati di decisioni diverse, misurati in base a metodi comuni di controllo e di analisi.

(11) Action by Member States in the framework of the eEurope 2005 Action plan can be further supported by disseminating good practices. The European added value in the area of benchmarking and good practices consists of the comparative evaluation of results of alternative decisions, measured by a common methodology of monitoring and analysis.

(12) È necessario analizzare le conseguenze economiche e sociali della società dell'informazione al fine di agevolare le discussioni politiche. Ciò permetterà agli Stati membri di sfruttare al meglio le potenzialità economiche ed industriali del progresso tecnologico, in particolar modo nel settore della società dell'informazione.

(12) There is a need to analyse the economic and societal consequences of the Information Society with a view to facilitating policy discussions. This will allow Member States better to exploit the economic and industrial potential of technological development, in particular in the area of the Information Society.

(13) La sicurezza delle reti e dell'informazione è ormai una condizione essenziale per l'ulteriore sviluppo di un ambiente commerciale sicuro. La natura complessa della sicurezza delle reti e dell'informazione presuppone che, nel definire le misure politiche in questo campo, le autorità locali, nazionali e, ove opportuno, europee tengano conto di un'ampia gamma di considerazioni politiche, economiche, organizzative e tecniche e siano consapevoli del carattere decentrato e globale delle reti di comunicazione. L'istituzione programmata della futura struttura a livello europeo relativa ai problemi della sicurezza dell'informazione e delle reti accrescerebbe la capacità degli Stati membri e della Comunità di far fronte ai principali problemi connessi alla sicurezza delle reti e dell'informazione. I lavori preliminari dovranno iniziare già nel 2003.

(13) Network and information security has become a prerequisite for further progress towards a secure business environment. The complex nature of network and information security implies that, in developing policy measures in this field, local, national and, where appropriate, European authorities should take into account a range of political, economic, organisational and technical aspects, and be aware of the decentralised and global character of communication networks. The planned establishment of the future structure at European level for network and information security issues would enhance the Member States' and the Community's ability to respond to major network and information security problems. Preparatory work needs to commence as early as 2003.

(14) Dato che le attività sopra indicate perseguono gli obiettivi di promuovere sinergie e cooperazione tra Stati membri, paesi dello Spazio economico europeo, paesi richiedenti e candidati nonché paesi associati dell'Europa centrale e orientale, la Commissione potrebbe in futuro incoraggiare un ulteriore coinvolgimento di questi paesi nelle attività del programma.

(14) Since the activities mentioned above pursue the objectives of promoting synergies and cooperation between Member States, countries of the European Economic Area, applicant and candidate countries as well as the associated countries of Central and Eastern Europe, the Commission could in future encourage further involvement of these countries in the activities of the programme.

(15) La presente decisione stabilisce, per tutta la durata del programma, una dotazione finanziaria che costituisce per l'autorità di bilancio, nel quadro della procedura di bilancio annuale, il riferimento principale ai sensi del punto 33 dell'accordo interistituzionale del 6 maggio 1999 tra il Parlamento europeo, il Consiglio e la Commissione sulla disciplina di bilancio e il miglioramento della procedura di bilancio.

(15) This Decision lays down, for the entire duration of the programme, a financial framework constituting the prime reference, within the meaning of point 33 of the Interinstitutional Agreement of 6 May 1999 between the European Parliament, the Council and the Commission on budgetary discipline and improvement of the budgetary procedure, for the budgetary authority during the annual budgetary procedure.

(16) Le misure necessarie per l'attuazione della presente decisione sono adottate secondo la decisione 1999/468/CE del Consiglio, del 28 giugno 1999, recante modalità per l'esercizio delle competenze di esecuzione conferite alla Commissione(6).

(16) The measures necessary for the implementation of this Decision should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(6).

HANNO ADOTTATO LA PRESENTE DECISIONE:

HAVE ADOPTED THIS DECISION:

Articolo 1

Article 1

È adottato un programma pluriennale (2003-2005) per il monitoraggio del piano d'azione eEurope 2005, la diffusione delle buone prassi e il miglioramento della sicurezza delle reti e dell'informazione (in seguito denominato "il programma").

A multiannual programme (2003-2005) for the monitoring of the eEurope 2005 Action plan, dissemination of good practices and improvement of network and information security (hereafter referred to as "the programme") is hereby adopted.

Il programma ha i seguenti obiettivi:

The programme shall have the following objectives:

a) sorvegliare le prestazioni degli Stati membri e all'interno degli Stati membri e raffrontarle alle migliori prestazioni realizzate nel mondo utilizzando, nei limiti del possibile, statistiche ufficiali;

(a) to monitor performance of and within Member States and to compare it with the best in the world by using, where possible, official statistics;

b) sostenere gli sforzi compiuti dagli Stati membri nell'ambito di eEurope a livello nazionale, regionale o locale mediante l'analisi delle buone prassi emerse nel quadro di eEurope e l'interazione complementare di sviluppo di meccanismi per lo scambio di esperienze;

(b) to support efforts made by Members States in the framework of eEurope, at national, regional or local level, by analysis of eEurope good practices and by the complementary interaction of developing mechanisms of exchange of experiences;

c) analizzare le conseguenze economiche e sociali della società dell'informazione al fine di agevolare le discussioni politiche in particolare in termini di competitività industriale e di coesione, nonché in termini di inclusione sociale, fornire al gruppo direttivo eEurope le informazioni necessarie per metterlo in grado di valutare l'indirizzo strategico adeguato del piano d'azione eEurope 2005;

(c) to analyse the economic and societal consequences of the Information Society with a view to facilitating policy discussions particularly in terms of industrial competitiveness and cohesion as well as in terms of social inclusion; to provide the eEurope Steering Group with the necessary information for it to be able to assess the appropriate strategic direction of the eEurope 2005 Action plan;

d) preparare l'istituzione della futura struttura a livello europeo sui problemi della sicurezza delle reti e dell'informazione, come previsto nella risoluzione del Consiglio del 28 gennaio 2002 e nel piano d'azione eEurope 2005, con l'obiettivo di migliorare la sicurezza delle reti e dell'informazione.

(d) to prepare for the establishment of the future structure at European level for network and information security issues, as envisaged by the Council Resolution of 28 January 2002 and in the eEurope 2005 Action plan, with a view to improving network and information security.

Il programma prevede attività di tipo intersettoriale complementari alle azioni avviate dalla Comunità in altri campi. Esse non devono sovrapporsi ad attività svolte negli stessi campi nell'ambito di altri programmi comunitari. Le azioni svolte nel quadro del programma sulla valutazione comparativa, le buone prassi e il coordinamento delle politiche devono essere dirette a realizzare gli obiettivi del piano d'azione eEurope 2005, a promuovere la sicurezza delle reti e dell'informazione e la banda larga, nonché a promuovere eGovernment, eBusiness, eHealth e eLearning.

The activities of the programme shall be actions of a cross-sectorial nature, complementing Community actions in other fields. None of these actions shall duplicate the work being carried out in these fields under other Community programmes. The actions taken under the programme on benchmarking, good practices and policy coordination shall work to achieve the objectives of the eEurope 2005 Action plan, to promote network and information security and broadband, and to promote eGovernment, eBusiness, eHealth and eLearning.

Il programma istituisce inoltre un quadro di riferimento comune per un'interazione complementare su scala europea delle iniziative adottate a livello nazionale, regionale e locale.

The programme shall also provide a common framework for complementary interaction at European level of the various national, regional and local levels.

Articolo 2

Article 2

Per realizzare gli obiettivi stabiliti all'articolo 1 il programma prevede l'esecuzione delle seguenti categorie di azioni:

In order to attain the objectives referred to in Article 1, the following categories of actions shall be undertaken:

a) Azione 1: Sorveglianza e raffronto delle prestazioni

(a) Action 1: Monitoring and Comparison of Performance

- raccolta ed analisi dei dati sulla base degli indicatori di valutazione comparativa, definiti nella risoluzione del Consiglio del 18 febbraio 2003 relativa all'attuazione del piano d'azione eEurope 2005(7), contenenti, ove opportuno, indicatori di tipo regionale. Particolare attenzione andrebbe riservata ai dati relativi agli obiettivi principali del piano d'azione eEurope 2005.

- data collection and analysis on the basis of the benchmarking indicators as defined in the Council Resolution of 18 February 2003 on the implementation of the eEurope 2005 Action plan(7), including regional indicators where appropriate. A special focus should be given to data relating to the key targets of the eEurope 2005 Action plan;

b) Azione 2: Diffusione delle "buone prassi"

(b) Action 2: Dissemination of Good Practices

- studi finalizzati ad individuare le buone prassi a livello nazionale, regionale e locale che contribuisce alla corretta attuazione del piano d'azione eEurope 2005;

- studies to identify good practices, at national, regional and local level, contributing to successful implementation of the eEurope 2005 Action plan;

- sostegno all'organizzazione di conferenze, seminari e workshop specifici a sostegno del piano d'azione eEurope 2005 destinati a promuovere la cooperazione e lo scambio di esperienze e di buone prassi nell'ambito del quadro comune di interazione complementare definito all'articolo 1, lettera b).

- support for targeted conferences, seminars or workshops in support of the objectives of the eEurope 2005 Action plan in order to promote cooperation and exchange of experiences and good practices within the common framework of complementary interaction as defined in point (b) of Article 1;

c) Azione 3: Analisi e discussione strategica

(c) Action 3: Analysis and Strategic Discussion

- sostegno al lavoro degli esperti in questioni sociali ed economiche al fine di fornire alla Commissione e, su richiesta, al gruppo direttivo eEurope informazioni per quanto riguarda l'analisi delle future politiche;

- support the work of social and economic experts with a view to providing the Commission and, on request, the eEurope Steering Group with input as regards prospective policy analysis;

- sostegno al gruppo direttivo eEurope per fornire una visione strategica dell'attuazione del piano d'azione eEurope 2005, per offrire una sede per lo scambio di esperienze e consentire ai paesi candidati di partecipare fin dall'inizio ed eventualmente per invitare altri interessati ad esprimere il proprio parere.

- support for the eEurope Steering Group to provide a strategic overview of implementation of the eEurope 2005 Action plan, to offer a forum to exchange experiences and to permit early participation of candidate countries and, where appropriate, to invite other stakeholders to express their views.

d) Azione 4: Miglioramento della sicurezza delle reti e dell'informazione

(d) Action 4: Improvement of Network and Information Security

- preparare l'istituzione della futura struttura a livello europeo sui problemi della sicurezza delle reti e dell'informazione, come previsto nelle risoluzioni del Consiglio del 28 gennaio 2002 e del 18 febbraio 2003 su "un approccio europeo per una cultura della sicurezza delle reti e dell'informazione" e nel piano d'azione eEurope 2005, anche attraverso il finanziamento di indagini, studi e workshop in settori quali: dispositivi di sicurezza e loro interoperabilità, affidabilità e protezione della rete, crittografia avanzata, riservatezza e sicurezza delle comunicazioni senza filo.

- preparation for the establishment of the future structure at European level for network and information security issues, as envisaged in the Council Resolutions of 28 January 2002 and of 18 February 2003 on a European approach towards a culture of network and information security, and in the eEurope 2005 Action plan, through, inter alia, financing surveys, studies, workshops on subjects such as security mechanisms and their interoperability, network reliability and protection, advanced cryptography, privacy and security in wireless communications.

Articolo 3

Per realizzare gli obiettivi fissati all'articolo 1 e condurre le azioni elencate all'articolo 2, la Commissione si avvale di mezzi adeguati e pertinenti; in particolare:

In carrying out the objectives set out in Article 1 and the actions set out in Article 2, the Commission shall use the appropriate and relevant means, and in particular:

- la conclusione di contratti per l'esecuzione di attività connesse con indagini, studi preliminari, studi particolareggiati in settori specifici, azioni di dimostrazione di portata limitata, tra cui workshop e conferenze;

- the award of contracts for the execution of tasks relating to surveys, exploratory studies, detailed studies on specific fields, demonstration actions of limited size including workshops and conferences;

- la raccolta, la pubblicazione e la diffusione delle informazioni e lo sviluppo di servizi basati sul web;

- the collection, publication and dissemination of information and the development of web-based services;

- la concessione di aiuti per le riunioni di esperti, conferenze e seminari.

- the granting of support for meetings of experts, conferences, seminars.

Articolo 4

Article 4

Il programma copre il periodo compreso tra il 1o gennaio 2003 e il 31 dicembre 2005.

The programme shall cover a period from 1 January 2003 to 31 December 2005.

La dotazione finanziaria per l'esecuzione del presente programma è pari a 20 milioni di EUR.

The financial framework for the implementation of this programme is hereby set at EUR 20 million.

Una ripartizione indicativa è fornita nell'allegato.

An indicative breakdown is given in the Annex.

Gli stanziamenti annuali sono autorizzati dall'autorità di bilancio entro i limiti delle prospettive finanziarie.

The annual appropriations shall be authorised by the budgetary authority within the limits of the financial perspective.

Articolo 5

Article 5

La Commissione è responsabile dell'attuazione del programma e del suo coordinamento con altri programmi comunitari. Ogni anno la Commissione elabora un programma di lavoro sulla base della presente decisione.

The Commission shall be responsible for the implementation of the programme and its coordination with other Community programmes. The Commission shall draw up a work programme every year on the basis of this Decision.

La Commissione opera secondo la procedura di cui all'articolo 6, paragrafo 2:

The Commission shall act in accordance with the procedure referred to in Article 6(2):

a) per l'adozione del programma di lavoro, compresa la ripartizione complessiva del bilancio,

(a) for the adoption of the work programme, including the overall budgetary breakdown,

b) per l'adozione delle misure di valutazione del programma,

(b) for the adoption of the measures for programme evaluation,

c) per la definizione dei criteri per gli inviti a presentare proposte, coerenti con gli obiettivi delineati nell'articolo 1, e per la valutazione dei progetti proposti in risposta a tali inviti se il finanziamento comunitario di un contributo della Comunità è di un importo stimato pari o superiore a 250000 EUR.

(c) for determination of the criteria for calls for proposals, in line with the objectives outlined in Article 1, and for the assessment of the projects submitted in response to such calls where Community funding of an estimated amount of Community contribution is equal to, or more than, EUR 250000.

Articolo 6

1. La Commissione è assistita da un comitato (in seguito denominato "il comitato").

1. The Commission shall be assisted by a Committee (hereinafter referred to as "the Committee").

2. Nei casi in cui è fatto riferimento al presente paragrafo, si applicano gli articoli 4 e 7 della decisione 1999/468/CE, tenendo conto delle disposizioni dell'articolo 8 della stessa.

2. Where reference is made to this paragraph, Articles 4 and 7 of Decision 1999/468/EC shall apply, having regard to the provisions of Article 8 thereof.

Il periodo di cui all'articolo 4, paragrafo 3 della decisione 1999/468/CE è fissato a tre mesi.

The period laid down in Article 4(3) of Decision 1999/468/EC shall be set at three months.

3. Il comitato adotta il proprio regolamento interno.

1. In order to ensure that Community aid is used efficiently, the Commission shall ensure that actions under this Decision are subject to effective prior appraisal, monitoring and subsequent evaluation.

2. La Commissione valuta, durante e dopo l'esecuzione delle azioni, il modo in cui queste sono state condotte e l'impatto della loro esecuzione onde accertare se gli obiettivi iniziali sono stati realizzati.

2. During implementation of actions and after their completion the Commission shall evaluate the manner in which they have been carried out and the impact of their implementation in order to assess whether the original objectives have been achieved.

3. La Commissione informa regolarmente il comitato e il gruppo direttivo eEurope in merito ai progressi registrati nell'attuazione del programma nel suo insieme.

3. The Commission shall regularly inform the Committee and the eEurope Steering Group of progress with the implementation of the programme as a whole.

4. Al termine del programma, la Commissione sottopone al Parlamento europeo, al Consiglio e al Comitato economico e sociale europeo una relazione di valutazione sui risultati ottenuti nell'attuazione delle azioni elencate all'articolo 2.

4. At the end of the programme, the Commission shall submit to the European Parliament, to the Council and to the European Economic and Social Committee an evaluation report on the results obtained in implementing the actions referred in Article 2.

1. Il 26 luglio 2002 la Commissione ha adottato la suddetta proposta di decisione del Parlamento europeo e del Consiglio(1). La proposta è fondata sull'articolo 157, paragrafo 3 del trattato CE.

1. On 26 July 2002 the Commission adopted the above-mentioned proposal for a Decision of the European Parliament and the Council(1). The proposal is based on Article 157(3) of the EC Treaty.

2. Il Parlamento europeo ha formulato il suo parere il 12 febbraio 2003, il Comitato economico e sociale il 24 ottobre 2002 e il Comitato delle regioni il 12 febbraio 2003.

2. The European Parliament delivered its Opinion on 12 February 2003, the Economic and Social Committee on 24 October 2002 and the Committee of Regions on 12 February 2003.

II. OBIETTIVO

II. OBJECTIVE

Lo scopo di questa proposta è realizzare un programma di sostegno finanziario che integri gli sforzi compiuti a livello nazionale per trasformare l'Europa in una economia basata sulla conoscenza. Il programma contribuisce all'attuazione della strategia di Lisbona mediante la sorveglianza delle prestazioni degli Stati membri, facilitando la diffusione delle buone prassi, analizzando le conseguenze economiche e sociali della società dell'informazione e rafforzando la sicurezza delle reti e dell'informazione. MODINIS è un successore del programma PROMISE, che è giunto al termine alla fine dello scorso anno. Esso inoltre fornisce il finanziamento complementare necessario per garantire la corretta attuazione del piano d'azione eEurope 2005, i cui obiettivi sono stati confermati dal Consiglio europeo di Siviglia.

The purpose of this proposal is to provide a financial support programme to accompany national efforts for the transformation of Europe into a knowledge-based economy. The programme contributes to the Lisbon strategy by monitoring performances of and within Member States, by facilitating the dissemination of good practices, by analysing the economic and societal consequences of the Information Society and by improving network and information security. MODINIS is a successor to the PROMISE programme, which expired at the end of last year. It also provides necessary complementary funding to ensure the proper implementation of the eEurope 2005 Action Plan, the objectives of which were endorsed by the Seville European Council.

III. ANALISI DELLA POSIZIONE COMUNE

Nella posizione comune sono condivisi l'obiettivo generale della proposta presentata dalla Commissione e, in linea di massima, i mezzi proposti per conseguirlo.

The common position shares the overall objective of the Commission's proposal and in general terms, the proposed means of attaining that objective.

Il testo della proposta è stato tuttavia rimaneggiato durante la discussione in sede di Consiglio. Inoltre alcuni articoli sono stati ristrutturati per accrescere la chiarezza e la usabilità. I punti principali su cui la posizione comune diverge dalla proposta della Commissione sono i seguenti:

However, the text of the proposal has been reworded in the course of discussion within the Council. Moreover, some articles were restructured to enhance clarity and user-friendliness. The main points of the common position differing from the Commission proposal are the following:

1) La posizione comune ha ristrutturato l'articolo 2 per allinearlo all'articolo 1 e alle quattro azioni incluse nel programma proposto. Inoltre, in questi articoli, il livello locale ha ricevuto uno status parallelo ai livelli nazionale e regionale nel quadro delle buone prassi e dello scambio di esperienze.

1. The common position re-structured Article 2 to align it with Article 1 and the four actions included in the proposed programme. Moreover, in these articles, the local level has been given a parallel status to national and regional levels in the framework of good practices and exchange of experiences.

2) Negli articoli 1 e 2 il Consiglio ha rafforzato l'impulso volto a raggiungere gli obiettivi del piano d'azione eEurope 2005. In questo contesto ha aggiunto un riferimento a un gruppo direttivo eEurope.

2. In Articles 1 and 2, the Council enforced the impetus given to achieving the objectives of the eEurope 2005 Action Plan. In this context, it added a reference to an eEurope Steering Group.

3) Per quanto riguarda la sicurezza delle reti e dell'informazione, la "task force sulla sicurezza informatica" a cui si fa riferimento nella proposta della Commissione è stata denominata "futura struttura a livello europeo relativa ai problemi della sicurezza dell'informazione e delle reti". Ciò è dovuto al fatto che, dopo la presente proposta della Commissione, è stata emessa una nuova proposta della Commissione per la creazione di una Agenzia europea per la sicurezza delle reti e dell'informazione, e la forma definitiva di questa struttura non è stata al momento decisa. Tuttavia la necessità di preparare questa struttura, che deve essere operativa dall'inizio del 2004, è evidenziata nei riferimenti della posizione comune negli articoli 1 e 2.

3. As far as network and information security is concerned, the "cyber-security task force" referred to in the Commission's proposal has been termed "future structure at European level for network and information security issues". This is due to the fact that, since the present Commission's proposal, a new Commission proposal for the establishment of a European Network and Information Security Agency was issued, and the final form of this structure is currently not decided. However, the need to prepare this structure, which is to be operative from the beginning of 2004, is underlined in the references of the common position in Articles 1 and 2.

4) Sulla base dell'esperienza acquisita con il precedente programma PROMISE e visto lo spiacevole ritardo nell'adozione del programma, l'importo finanziario di riferimento ora proposto nell'articolo 4 della posizione comune è pari a 20 milioni di euro.

4. On the basis of the experience from the preceding programme PROMISE and given unfortunate delay in the adoption of the programme, the financial reference amount now proposed in Article 4 of the common position is EUR 20 million.

5) All'articolo 5 il Consiglio ha ampliato il campo di applicazione del coinvolgimento del comitato di gestione per assicurare un sufficiente controllo sull'attuazione del programma pur evitando la burocrazia inutile.

5. In Article 5, the Council has broadened the scope of the involvement of the management committee in order to ensure sufficient control over the implementation of the programme while avoiding unnecessary bureaucracy.

6) Il nuovo articolo 8 della posizione comune prevede la possibilità di aprire il programma ai paesi dello Spazio Economico Europeo, ai paesi richiedenti e candidati nonché ai paesi associati dell'Europa centrale ed orientale. Inoltre è incoraggiata la cooperazione con paesi non membri e con organizzazioni e organismi internazionali.

6. The new Article 8 of the common position provides for the possibility of opening the programme to EEA countries, applicant and candidate countries as well as the association countries of central and eastern Europe. Moreover, cooperation with non-member countries and international organisations or bodies is encouraged.

- L'emendamento 7 non è stato ripreso perché il programma eEurope+ a cui si riferisce termina alla fine del 2003 e nel 2004 i paesi candidati interessati partecipano a pieno titolo come Stati membri.

- Amendment 7 has not been accepted because the eEurope+ programme it refers to will end at the end of 2003 and in 2004 the candidate countries concerned shall participate in full as Member States.

- Gli emendamenti 8 e 13, che trasformerebbero il comitato di gestione in un comitato consultivo non sono stati ripresi. Come la Commissione, il Consiglio ritiene che per ragioni di trasparenza un comitato di gestione sia più appropriato. Anche i riferimenti a vari rappresentanti inclusi nell'emendamento 13 non sono stati ripresi. Nell'articolo 6 della posizione comune il Consiglio ha soppresso del tutto il riferimento ai rappresentanti, poiché tale questione è esplicitata nella pertinente decisione a cui l'articolo fa riferimento.

- Amendments 8 and 13, which would change the management committee to an advisory committee have not been accepted. Like the Commission, the Council considers that for transparency reasons a management committee is more appropriate. The references to different representatives included in amendment 13 has not been accepted either. The Council deleted in the Article 6 of the common position the reference to representatives altogether, given that this matter is made explicit in the relevant Decision to which the article refers.

- Il Consiglio ha respinto l'emendamento 14, visto che ripete semplicemente gli obblighi del regolamento finanziario.

- The Council did not adopt amendment 14 since it merely repeats the obligations of the Financial regulation.
