Decision No 792/2004/EC of the European Parliament and of the Council of 21 April 2004 establishing a Community action programme to promote bodies active at European level in the field of culture

IL PARLAMENTO EUROPEO E IL CONSIGLIO DELL'UNIONE EUROPEA,

Whereas:

(1) Il trattato assegna alla Comunità il compito di creare un'unione sempre più stretta fra i popoli europei e di contribuire al pieno sviluppo delle culture degli Stati membri nel rispetto delle loro diversità nazionali e regionali, evidenziando nel contempo il patrimonio culturale comune.

(1) The Treaty confers responsibility on the Community for creating an ever-closer union among the peoples of Europe and for contributing to the flowering of the cultures of the Member States, while respecting their national and regional diversity and at the same time bringing the common cultural heritage to the fore.

(2) La dichiarazione di Laeken, allegata alle conclusioni del Consiglio europeo del 14 e 15 dicembre 2001, afferma che una delle sfide fondamentali che l'Unione europea deve affrontare consiste nell'avvicinare i cittadini al progetto europeo e alle istituzioni europee.

(2) The Laeken Declaration annexed to the conclusions of the European Council of 14 and 15 December 2001 asserts that one of the basic challenges to be resolved by the European Union is to bring citizens closer to the European design and the European institutions.

(3) Il Consiglio e i ministri della Cultura, riuniti in sede di Consiglio, nella risoluzione del 14 novembre 1991 sulle reti culturali europee(2), hanno sottolineato l'importante ruolo delle reti di organizzazioni culturali nella cooperazione culturale in ambito europeo, e hanno convenuto di incoraggiare le organizzazioni culturali dei rispettivi paesi a partecipare attivamente alla cooperazione non governativa a livello europeo.

(3) The Council and the Ministers of Culture meeting within the Council, in the Resolution of 14 November 1991 on European cultural networks(2), stressed the important role of networks of cultural organisations in cultural cooperation in Europe, and agreed to encourage the cultural organisations in their countries to participate actively in non-governmental cooperation on a European scale.

(6) Further to the resolutions of the European Parliament on regional languages and cultures, the European Union has engaged in action to promote and safeguard the linguistic diversity in the Union, in order to preserve languages as an element in Europe's living cultural heritage.

(7) Su richiesta del Parlamento europeo, la Commissione ha sostenuto, a partire dal 1982, un organismo senza scopo di lucro, l'Ufficio europeo per le lingue meno diffuse (EBLUL), organizzato in rete di comitati nazionali attivi negli Stati membri e, dal 1987, la rete d'informazione e documentazione Mercator. Tali organismi perseguono un obiettivo d'interesse generale europeo: l'Ufficio europeo per le lingue meno diffuse rappresenta tutte le comunità che vivono nell'Unione europea e che parlano una lingua regionale o minoritaria, e garantisce una diffusione d'informazioni europee presso tali comunità. La rete d'informazione e documentazione Mercator raccoglie e diffonde a livello europeo informazioni su tre aspetti essenziali per la promozione delle lingue regionali e minoritarie: l'istruzione, la legislazione e i mezzi di comunicazione.

(7) At the request of the European Parliament, the Commission has provided support since 1982 for a non-profit-making body, the European Bureau for Lesser-Used Languages (EBLUL), which is organised as a network of national committees working in the Member States, and since 1987 for the Mercator information and documentation network. These pursue an aim of general European interest: EBLUL represents all regional or minority language communities in the European Union and disseminates European information in these communities; the Mercator information and documentation network collects and disseminates at European level information on three aspects which are essential to the promotion of regional and minority languages: education, legislation and the media.

(11) Il regolamento (CE, Euratom) n. 1605/2002 del Consiglio, del 25 giugno 2002, che stabilisce il regolamento finanziario applicabile al bilancio generale delle Comunità europee(5), in prosieguo denominato "regolamento finanziario", impone di dotare di un atto di base le azioni di sostegno esistenti. La Commissione si è impegnata a tener conto dei commenti di bilancio nel contesto dell'attuazione.

(11) Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities(5), hereinafter "the Financial Regulation", requires a basic act to be provided to cover these existing support actions. The Commission undertook to take into account the remarks entered in the budget in the context of implementation.

(12) Il Parlamento europeo, il Consiglio e la Commissione europea si sono impegnati, in occasione dell'adozione del regolamento finanziario, a conseguire l'obiettivo di un'entrata in vigore di tale atto di base a decorrere dall'esercizio 2004.

(12) The European Parliament, the Council and the Commission, when adopting the Financial Regulation, undertook to achieve the objective of ensuring that this basic act comes into force as from the financial year 2004.

(13) È necessario assicurare un'adeguata stabilità e continuità dei finanziamenti nell'ambito del regolamento finanziario, alle istituzioni cui la Comunità ha assegnato un sostegno finanziario negli anni precedenti.

(13) It is necessary to ensure appropriate funding stability and continuity, within the framework of the Financial Regulation, for institutions to which the European Community has granted financial support over previous years.

(14) Risultano necessarie disposizioni transitorie per il 2004 e il 2005 per consentire l'erogazione di sovvenzioni in base alla parte 2 del presente programma comunitario. È opportuno ricorrere all'eccezione citata nell'articolo 168, paragrafo 1, lettera d), del regolamento (CE, Euratom) n. 2342/2002 della Commissione(6) in base alla quale possono essere assegnate sovvenzioni senza invito a presentare proposte a favore di organismi identificati in un atto di base come beneficiari di una sovvenzione.

(14) Transitional arrangements are deemed necessary for the years 2004 and 2005 to allow grants to be awarded under part 2 of this Community programme. It is deemed appropriate to make use of the exception mentioned in Article 168(1)(d) of Commission Regulation (EC, Euratom) No 2342/2002(6) which allow grants to be awarded without a call for proposals to bodies identified by a basic act as recipients of a grant.

(15) Gli eventuali finanziamenti non comunitari provenienti da risorse degli Stati dovrebbero essere conformi agli articoli 87 e 88 del trattato.

(15) Any non-Community financing from State resources should comply with Articles 87 and 88 of the Treaty.

(16) La presente decisione stabilisce, per tutta la durata del programma, una dotazione finanziaria che costituisce per l'autorità di bilancio, nel quadro della procedura di bilancio annuale, il riferimento principale ai sensi del punto 33 dell'accordo interistituzionale del 6 maggio 1999 tra il Parlamento europeo, il Consiglio e la Commissione europea sulla disciplina di bilancio e il miglioramento della procedura di bilancio(7).

(16) This Decision lays down, for the entire duration of the programme, a financial framework constituting the prime reference, within the meaning of point 33 of the Interinstitutional Agreement of 6 May 1999 between the European Parliament, the Council and the Commission on budgetary discipline and improvement of the budgetary procedure(7), for the budgetary authority during the annual budgetary procedure.

(17) Le misure necessarie per l'attuazione della presente decisione sono adottate secondo la decisione 1999/468/CE del Consiglio, del 28 giugno 1999, recante modalità per l'esercizio delle competenze di esecuzione conferite alla Commissione(8).

(17) The measures necessary for the implementation of this Decision should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(8).

(18) È necessario valutare il contenuto delle azioni e, in particolare, il valore aggiunto europeo delle attività progettate dai beneficiari ammissibili ad una sovvenzione; tale valutazione può essere effettuata nel modo migliore avvalendosi di un comitato di gestione.

(18) It is necessary to evaluate the content of actions and, in particular, the European added value of the activities planned by the beneficiaries eligible for a grant; such an evaluation may be best carried out by using a management committee.

DECIDONO:

HAVE DECIDED AS FOLLOWS:

Articolo 1

1. La presente decisione istituisce un programma d'azione comunitaria per la promozione degli organismi attivi a livello europeo nel settore della cultura (in prosieguo: "il programma").

1. This Decision establishes a Community action programme to promote bodies active at European level in the field of culture (hereinafter referred to as "the programme").

2. L'obiettivo generale del programma consiste nel sostenere le attività di tali organismi.

2. The general objective of the programme is to support the activities of these bodies.

Il programma comprende le seguenti attività:

The programme covers the following activities:

a) il programma di lavoro permanente di un organismo che persegue un obiettivo d'interesse generale europeo nel settore della cultura o un obiettivo che si iscrive nel quadro della politica dell'Unione europea in questo settore;

(a) the ongoing work programme of a body which pursues an aim of general European interest in the field of culture or an objective forming part of the European Union's policy in this area;

b) un'azione specifica in questo settore.

(b) a specific action in this area.

Queste attività devono contribuire, o essere in grado di contribuire, allo sviluppo e all'attuazione della politica e delle azioni di cooperazione comunitaria nel settore della cultura.

These activities must contribute, or be capable of contributing, to the development and implementation of Community cooperation policy and actions in the field of culture.

3. Il programma è attuato per il periodo compreso tra il 1o gennaio 2004 e il 31 dicembre 2006.

3. The programme shall start on 1 January 2004 and shall end on 31 December 2006.

Accesso al programma

Access to the programme

Per poter beneficiare di una sovvenzione, un organismo deve soddisfare i requisiti riportati nell'allegato I e presentare le seguenti caratteristiche:

To be eligible for a grant, a body must satisfy the requirements of Annex I and have the following characteristics:

a) essere una persona giuridica indipendente, senza scopo di lucro, attiva principalmente nel settore della cultura, e avere un obiettivo orientato verso il pubblico interesse;

(a) it must be an independent and non-profit-making legal person primarily active in the field of culture, with an objective aimed at the public good;

b) essere un organismo legalmente costituito da più di due anni la cui contabilità relativa agli ultimi due anni sia stata certificata da un revisore contabile iscritto al rispettivo registro;

(b) it must have been legally established for more than two years and have had its annual statement of accounts for the two preceding years certified by a registered auditor;

c) svolgere attività conformi ai principi su cui si basa l'azione comunitaria nel settore della cultura e tenere conto delle priorità di cui all'allegato I.

(c) its activities must be in accordance with the principles underlying Community action in the field of culture and take account of the priorities set out in Annex I.

1. La concessione di una sovvenzione di funzionamento a titolo del programma di lavoro permanente di un organismo che persegue un obiettivo d'interesse generale europeo nel settore della cultura o un obiettivo che si iscrive nel quadro della politica dell'Unione europea in questo settore deve rispettare i criteri globali indicati nell'allegato I.

1. Operating grants for the ongoing work programme of a body pursuing an aim of general European interest in the field of culture or an objective forming part of the European Union's policy in this area shall be awarded in accordance with the overall criteria laid down in Annex I.

2. La concessione di una sovvenzione per un'azione prevista dal programma rispetta i criteri globali indicati nell'allegato I. Le azioni sono selezionate sulla base di un invito a presentare proposte.

2. Grants for actions specified in the programme shall be awarded in accordance with the overall criteria laid down in Annex I. Actions shall be selected by means of a call for proposals.

Grants under the different actions of the programme shall be awarded in compliance with the provisions set out in the relevant part of Annex I.

1. La dotazione finanziaria per l'esecuzione del programma per il periodo di cui all'articolo 1, paragrafo 3, è pari a 19 milioni di EUR.

1. The financial framework for the implementation of the programme for the period specified in Article 1(3) is hereby set at EUR 19 million.

2. Gli stanziamenti annuali sono autorizzati dall'autorità di bilancio entro i limiti delle prospettive finanziarie.

2. The annual appropriations shall be authorised by the budgetary authority within the limits of the financial perspective.

1. Sono adottate secondo la procedura di gestione di cui all'articolo 7, paragrafo 2, le misure necessarie all'attuazione della presente decisione per quanto riguarda le materie di seguito elencate:

1. The measures necessary for the implementation of this Decision relating to the matters referred to below shall be adopted in accordance with the management procedure referred to in Article 7(2):

a) il piano di lavoro annuale, compresi gli obiettivi, le priorità, i criteri e le procedure di selezione;

(a) the annual plan of work, including objectives, priorities, the selection criteria and procedures;

b) il sostegno finanziario (importi, durata e beneficiari) che deve fornire la Comunità nei settori che rientrano nelle azioni di cui alle sezioni 2 e 3 dell'allegato I e gli orientamenti generali per l'attuazione del programma;

(b) the financial support to be supplied by the Community (amounts, duration and recipients) in the areas covered by actions under part 2 and 3 of Annex I, and the general guidelines for implementing the programme;

c) il bilancio annuale e la ripartizione dei fondi tra le varie azioni del programma;

(c) the annual budget and the breakdown of funds among the different actions of the programme;

d) le disposizioni per il monitoraggio e la valutazione del programma e per la divulgazione e il trasferimento dei risultati.

(d) the arrangements for monitoring and evaluating the programme and for the dissemination and transfer of results;

2. Per tutte le altre materie, le misure necessarie all'attuazione della presente decisione sono adottate secondo la procedura consultiva di cui all'articolo 7, paragrafo 3.

2. The measures necessary for the implementation of this Decision relating to all other matters shall be adopted in accordance with the advisory procedure referred to in Article 7(3).

1. La Commissione è assistita dal comitato istituito dalla decisione n. 508/2000/CE(9).

2. Nei casi in cui è fatto riferimento al presente paragrafo, si applicano gli articoli 4 e 7 della decisione 1999/468/CE del Consiglio, tenendo conto dell'articolo 8 della stessa.

2. Where reference is made to this paragraph, Articles 4 and 7 of Decision 1999/468/EC shall apply, having regard to the provisions of Article 8 thereof.

Il periodo di cui all'articolo 4, paragrafo 3, della decisione 1999/468/CE è fissato a due mesi.

The period laid down in Article 4(3) of Decision 1999/468/EC shall be set at two months.

Monitoraggio e valutazione

La Commissione presenta al Parlamento europeo e al Consiglio:

The Commission shall present to the European Parliament and the Council:

a) entro il 31 dicembre 2005, una relazione sull'attuazione del programma, sulla realizzazione degli obiettivi e su un eventuale programma futuro che sostituisce quello presente;

(a) not later than 31 December 2005, a report on the implementation of the programme, on the achievement of its objectives and on a possible future programme to replace the present programme.

la Commissione presenta ogni anno al Parlamento europeo e al Consiglio una relazione annuale sull'attuazione del programma;

The Commission shall moreover report to the European Parliament and Council on an annual basis on the implementation of the programme.

b) entro il 31 dicembre 2007, una relazione sulla realizzazione degli obiettivi del programma. Detta relazione si basa, tra l'altro, sui risultati della valutazione esterna ed esamina i risultati ottenuti dai beneficiari del programma, in particolare l'efficacia, l'efficienza e il contenuto delle diverse azioni (considerate globalmente e individualmente) in termini di conseguimento degli obiettivi di cui all'articolo 1 e all'allegato I.

(b) not later than 31 December 2007 a report on the achievement of the programme's objectives. This report shall be based, inter alia, on the outcome of the external evaluation and shall assess the results obtained by the beneficiaries of the programme, in particular as regards the effectiveness, efficiency and content of their actions, considered overall and individually, in achieving the objectives set out in Article 1 and in Annex I.

L'obiettivo generale di cui all'articolo 1 è di rafforzare l'azione comunitaria nel settore della cultura e l'efficacia di quest'azione, sostenendo gli organismi attivi in questo settore.

The general objective laid down in Article 1 is to strengthen Community action in the field of culture and increase its effectiveness by supporting the bodies working in this field.

Il sostegno si concretizza in uno dei seguenti due tipi di sovvenzione:

This support takes the form of one of two types of grant:

- sovvenzione di funzionamento destinata a cofinanziare le spese connesse al programma di lavoro permanente di un organismo che persegue un obiettivo d'interesse generale europeo nel settore della cultura o un obiettivo che si iscrive nel quadro della politica dell'Unione europea in questo settore (sezioni 1 e 2), oppure

- either an operating grant to co-finance expenditure associated with the permanent work programme of a body which pursues an aim of general European interest in the field of culture or an objective forming part of the European Union's policy in this area (parts 1 and 2),

- sovvenzione destinata a cofinanziare un'azione specifica in questo settore (sezione 3).

- or a grant to co-finance a specific action in this area (part 3).

Le principali attività di questi organismi suscettibili di contribuire al rafforzamento e all'efficacia dell'azione comunitaria nel settore della cultura sono le seguenti:

The main activities of these bodies that are likely to contribute to the strengthening and effectiveness of Community action in the field of culture are as follows:

- rappresentanza dei soggetti interessati a livello comunitario,

- representation of stakeholders at Community level,

- diffusione di informazioni sull'azione comunitaria,

- dissemination of information on Community action,

- messa in rete degli organismi attivi nel settore della cultura,

- networking of bodies active in the cultural field,

- rappresentanza e informazione delle comunità linguistiche regionali e minoritarie dell'Unione europea,

- representation and informing of the regional and minority language communities of the European Union,

- ricerca e diffusione di informazioni nei settori della legislazione, dell'istruzione e dei mezzi di comunicazione,

- finding and disseminating of information in the legislation, education and media fields,

- adempimento del ruolo di "ambasciatore" culturale, promozione della consapevolezza del patrimonio culturale comune dell'Europa,

- fulfilling the role of cultural "ambassador", promoting awareness of Europe's common cultural heritage,

- preservazione e commemorazione dei principali siti e archivi connessi con le deportazioni, di cui sono simbolo i memoriali eretti nei siti dei campi di concentramento, e in altri luoghi di martirio e sterminio di massa di civili, nonché preservazione del ricordo delle vittime nei siti stessi.

- preservation and commemoration of the main sites and archives associated with the deportations, symbolised by the memorials which have been raised on the sites of the former camps and other places of mass-civilian martyrdom and extermination, and the keeping alive of the memory of the victims at these sites.

La concessione di una sovvenzione avviene in base a un programma di lavoro approvato dalla Commissione.

Grants shall be awarded on the basis of a work programme approved by the Commission.

Chiunque benefici di una sovvenzione concessa nell'ambito delle azioni del programma segnala in una sede ben visibile, quale la homepage di un sito web o una relazione annuale, di aver ricevuto finanziamenti a titolo del bilancio dell'Unione europea.

Any beneficiary of a grant awarded under any action of this programme, shall indicate in a prominent place, such as a website homepage or an annual report, that it has received funding from the budget of the European Union.

5. FINANZIAMENTO E SPESE AMMISSIBILI

5. FUNDING AND ELIGIBLE EXPENDITURE

5.1. A titolo della sezione 1, le spese ammissibili dell'Ufficio europeo per le lingue meno diffuse e dei centri della rete Mercator comprendono le spese di funzionamento e quelle necessarie alla realizzazione delle loro azioni.

5.1. Under part 1, the eligible expenditure of the European Bureau for Lesser-Used Languages and the Mercator network centres comprises operating costs and expenses for carrying out their actions.

5.2. La sovvenzione concessa all'Ufficio europeo per le lingue meno diffuse e ai centri della rete Mercator non può finanziare l'integralità delle spese ammissibili di questi organismi per l'anno civile per il quale la sovvenzione è concessa: gli organismi in questione devono ottenere cofinanziamenti pari ad almeno il 20 % dei loro bilanci da fonti diverse da quelle comunitarie.

5.2. The grant to the European Bureau for Lesser-Used Languages and the Mercator network centres shall not fund all their eligible expenditure in the calendar year for which it is awarded: at least 20 per cent of the bodies' budgets must be co-financed from non-Community sources.

5.3. In applicazione dell'articolo 113, paragrafo 2, del regolamento finanziario, il principio di degressività non si applica alle sovvenzioni di funzionamento dell'Ufficio europeo per le lingue meno diffuse e dei centri della rete Mercator tenuto conto della loro natura di organismo che persegue un obiettivo d'interesse generale europeo.

5.3. Pursuant to Article 113(2) of the Financial Regulation the principle of gradual reduction shall not apply to operating grants to the European Bureau for Lesser-Used Languages and the Mercator network centres, since they are bodies pursuing an objective of general European interest.

5.4. A titolo della sezione 2, sono prese in considerazione per determinare la sovvenzione di funzionamento le spese necessarie al corretto svolgimento delle normali attività dell'organismo selezionato in particolare le spese per il personale, le spese generali (affitti, oneri immobiliari, attrezzature, forniture per uffici, telecomunicazioni, spese postali, ecc.), le spese per le riunioni interne e le spese di pubblicazione, d'informazione e di diffusione, nonché le spese direttamente collegate alle attività dell'organismo.

5.4. Under part 2, the costs to be taken into account in determining the operating grant shall be those necessary for the proper conduct of the normal activities of the body selected. In particular, these costs are personnel costs, overheads (rental and property charges, equipment, office supplies, telecommunications, postal charges, etc.), costs of internal meetings, publication, information and dissemination costs and costs directly linked to the body's activities.

5.5. Una sovvenzione di funzionamento assegnata a titolo della sezione 2 del presente allegato non può finanziare l'integralità delle spese ammissibili dell'organismo per l'anno civile per il quale la sovvenzione viene concessa. Gli organismi interessati da questa sezione devono ottenere cofinanziamenti pari ad almeno il 20 % dei loro bilanci da fonti diverse da quelle comunitarie. Questo cofinanziamento può essere parzialmente fornito in natura, a condizione che il valore attribuito a tale contributo non ecceda il costo realmente sostenuto e giustificato da documenti contabili, né il costo generalmente accettato sul mercato considerato.

5.5. An operating grant under part 2 of this Annex shall not fund all the body's eligible expenditure in the calendar year for which it is awarded. At least 20 per cent of the budgets of the bodies covered by this part must be co-financed from non-Community sources. Such co-financing may be partly contributed in kind, provided the contribution is valued at no more than the cost actually incurred and evidenced by accounting documents or the cost generally obtaining on the market in question.

5.6. Conformemente all'articolo 113, paragrafo 2, del regolamento finanziario la sovvenzione di funzionamento in tal modo concessa ha, in caso di rinnovo, un carattere degressivo. Tale degressività è applicata a decorrere dal terzo anno in misura del 2,5 % l'anno. Per rispettare tale regola, che si applica fatta salva la regola di cofinanziamento di cui sopra, la percentuale del cofinanziamento comunitario corrispondente alla sovvenzione concessa per un dato esercizio è inferiore di almeno 2,5 punti alla percentuale di cofinanziamento comunitario corrispondente alla sovvenzione concessa per l'esercizio precedente.

5.6. Pursuant to Article 113(2) of the Financial Regulation operating grants so awarded, if renewed, shall be gradually decreased. This reduction shall apply from the third year onwards, at a rate of 2,5 per cent per year. In order to observe this rule, which applies without prejudice to the co-financing rule mentioned above, the percentage of Community co-financing corresponding to the grant awarded for a given financial year shall be at least 2,5 points below the percentage of Community co-financing corresponding to the grant awarded for the previous financial year.

5.7. Una sovvenzione concessa a titolo della sezione 3 del presente allegato non può coprire più del 75 % delle spese ammissibili dell'azione interessata.

5.7. A grant awarded under part 3 of this Annex may not cover more than 75 per cent of the eligible costs of the action concerned.

5.8. Per le sovvenzioni assegnate nel 2004, il periodo di ammissibilità delle spese potrà iniziare il 1o gennaio 2004, sempre che tali spese non siano precedenti alla data di presentazione della domanda di sovvenzione né alla data in cui inizia l'esercizio finanziario del beneficiario.

5.8. For grants awarded in 2004, it will be possible for the period of eligibility of expenditure to start on 1 January 2004, provided that the expenditure does not precede the date on which the grant application was lodged or the date on which the beneficiary's budget year starts.

5.9. Nel 2004 potranno essere concesse deroghe all'obbligo di firmare la convenzione di finanziamento entro i primi quattro mesi dall'inizio dell'esercizio finanziario del beneficiario, come previsto all'articolo 112, paragrafo 2, del regolamento finanziario, nel caso di beneficiari il cui esercizio finanziario inizia prima del primo marzo. In questo caso, la convenzione di finanziamento dovrebbe essere firmata entro il 30 giugno 2004.

5.9. During 2004, in the case of beneficiaries whose budgetary year starts before 1 March, an exception may be granted to the obligation to sign the grant agreement within the first four months of the start of the beneficiary's budget year, as referred to in Article 112, paragraph 2 of the Financial Regulation. In this case, the grant agreement should be signed by 30 June 2004 at the latest.

6. GESTIONE DEL PROGRAMMA

6. MANAGEMENT OF THE PROGRAMME

Sulla base di un'analisi costi/efficacia, la Commissione può decidere di affidare in tutto o in parte compiti di gestione del programma a un'agenzia esecutiva, nel rispetto dell'articolo 55 del regolamento finanziario; può inoltre far ricorso ad esperti, nonché a qualunque altra spesa per assistenza tecnica e amministrativa che non comporti l'esercizio di funzioni pubbliche, subappaltata nel quadro di contratti di prestazioni specifiche di servizi. Inoltre la Commissione può finanziare studi e organizzare riunioni di esperti in grado di facilitare l'attuazione del programma, e intraprendere azioni di informazione, pubblicazione e diffusione direttamente collegate al conseguimento dell'obiettivo del programma.

In the light of a cost/benefit analysis, the Commission may decide to entrust all or part of the tasks of managing the programme to an executive agency, in conformity with Article 55 of the Financial Regulation. It may also have recourse to experts and incur any other expenditure on technical and administrative assistance, not involving the exercise of public authority, outsourced under ad hoc service contracts. It may also finance studies and organise meetings of experts likely to facilitate the implementation of the programme, and undertake information, publication and dissemination actions directly linked to the achievement of the programme's objective.

7. CONTROLLI E AUDIT

7.1. Il beneficiario di una sovvenzione di funzionamento conserva a disposizione della Commissione tutti i documenti giustificativi delle spese sostenute nel corso dell'anno per il quale la sovvenzione è stata concessa, in particolare il rendiconto certificato per un periodo di cinque anni dall'ultimo pagamento. Il beneficiario di una sovvenzione è tenuto ad assicurare che, laddove necessario, i documenti giustificativi detenuti dai partner o dai membri siano messi a disposizione della Commissione.

7.1. The beneficiary of an operating grant shall keep available for the Commission all the supporting documents, including the audited financial statement, regarding expenditure incurred during the grant year, for a period of five years following the last payment. The beneficiary of a grant shall ensure that, where applicable, supporting documents in the possession of partners or members be made available to the Commission.

7.2. La Commissione ha il diritto di effettuare, direttamente tramite i suoi agenti oppure tramite qualsiasi altro organismo esterno qualificato di sua scelta, un audit dell'utilizzo della sovvenzione. Tali audit possono essere effettuati durante tutta la durata della convenzione nonché per un periodo di cinque anni dalla data di pagamento del saldo della sovvenzione. I risultati di tali audit potranno eventualmente condurre a decisioni di recupero da parte della Commissione.

7.2. The Commission may have an audit of the use made of the grant carried out either directly by its own staff or by any other qualified outside body of its choice. Such audits may be carried out throughout the lifetime of the agreement and for a period of five years from the date of payment of the balance. Where appropriate, the audit findings may lead to recovery decisions by the Commission.

7.3. Il personale della Commissione e le persone esterne delegate dalla Commissione hanno un adeguato diritto di accesso, in particolare agli uffici del beneficiario, nonché a tutte le informazioni, comprese quelle in formato elettronico, necessarie per svolgere tali audit.

7.3. Commission staff and outside personnel authorised by the Commission shall have appropriate right of access, in particular to the beneficiary's offices and to all the information, including information in electronic format, needed in order to conduct such audits.

7.4. La Corte dei conti e l'Ufficio europeo per la lotta antifrode (OLAF) godono dei medesimi diritti della Commissione, in particolare in materia di diritto di accesso.

7.4. The Court of Auditors and the European Anti-Fraud Office (OLAF) shall enjoy the same rights, especially of access, as the Commission.

7.5. Inoltre, ai fini della tutela degli interessi finanziari delle Comunità europee contro le frodi e altre irregolarità, la Commissione è autorizzata a effettuare controlli e verifiche in loco nel quadro del presente programma, conformemente al regolamento (Euratom, CE) n. 2185/96 del Consiglio(1). Se necessario, indagini sono svolte dall'Ufficio europeo per la lotta antifrode (OLAF) a norma del regolamento (CE) n. 1073/1999 del Parlamento europeo e del Consiglio(2).

7.5. In order to protect the European Communities' financial interests against fraud and other irregularities, the Commission may carry out on-the-spot checks and inspections under this programme in accordance with Council Regulation (Euratom, EC) No 2185/96(1). Where necessary, investigations shall be conducted by the European Anti-Fraud Office (OLAF) and these shall be governed by Regulation (EC) No 1073/1999 of the European Parliament and of the Council(2).
