Proposal for a COUNCIL REGULATION on specific restrictive measures directed against certain persons and entities with a view to combating international terrorism

RELAZIONE

EXPLANATORY MEMORANDUM

(1) Durante la riunione straordinaria del 21 settembre 2001, il Consiglio europeo ha dichiarato che il terrorismo rappresenta una vera sfida per il mondo e per l'Europa e che la lotta al terrorismo costituirà un obiettivo prioritario per l'Unione europea. Il Consiglio europeo ha aggiunto che la lotta al finanziamento del terrorismo costituisce un aspetto decisivo e ha chiesto al Consiglio di adottare le misure necessarie a combattere qualsiasi forma di finanziamento delle attività terroristiche.

(1) At its extraordinary meeting on 21 September 2001 the European Council declared that terrorism is a real challenge to the world and to Europe, and that the fight against terrorism will be a priority objective of the European Union. It also declared that combating the funding of terrorism is a decisive aspect of the fight against terrorism and called upon the Council to take the necessary measures to combat any form of financing for terrorist activities.

(2) Il regolamento proposto intende garantire un'applicazione tempestiva e più coerente, oltre ad un'efficacia ottimale, delle misure in questione in tutta la Comunità europea. Si ritiene necessario applicare restrizioni ai pagamenti e ai movimenti di capitali intracomunitari per impedire l'elusione delle misure proposte.

(2) The proposed Regulation is intended to ensure a rapid and more coherent application, and optimal effectiveness, of these measures throughout the European Community. In order to prevent circumvention of the proposed measures, it is considered necessary to apply restrictions on intra-Community payments and movements of capital.

(3) A tempo debito, le misure proposte dovranno forse essere integrate da misure supplementari, tenendo conto delle decisioni del Consiglio di sicurezza delle Nazioni Unite e dell'esperienza acquisita in sede di attuazione. La Commissione presenterà, se del caso, ulteriori proposte in tal senso.

(3) The proposed measures may have to be complemented in due course by additional measures, taking into account decisions made by the UN Security Council and experience with the application of the proposed measures. The Commission will make additional proposals where appropriate.

(4) The measures provided for in this Regulation, when taken at the level of the European Union, will ensure a rapid and more coherent application, and optimal effectiveness of these measures throughout the Community, while at the same time preventing a distortion of competition or negative effects on the functioning of the common market.

(5) For the purpose of preventing circumvention of the provisions of this Regulation, restrictions should also be imposed on intra-Community payments and movements of capital.

(11) The Member States should lay down rules on sanctions applicable to infringements of the provisions of this Regulation and ensure that they are implemented. Those penalties must be effective, proportionate and dissuasive. It is desirable that those sanctions can be imposed as from the date of entry into force of this Regulation.

HA ADOTTATO IL PRESENTE REGOLAMENTO:

HAS ADOPTED THIS REGULATION:

Articolo 1

Article 1

Ai fini del presente regolamento valgono le seguenti definizioni:

For the purpose of this Regulation, the following definitions shall apply:

1. Capitali: tutte le attività e i benefici finanziari di qualsiasi natura, compresi - ma si tratta di un elenco non limitativo - contanti, assegni, titoli di credito, tratte, ordini di pagamento e altri strumenti di pagamento; depositi presso istituti finanziari o altre entità, saldi sui conti, debiti e titoli di debito; titoli negoziati a livello pubblico e privato e strumenti di debito, segnatamente azioni, certificati azionari, titoli a reddito fisso, pagherò, warrant, obbligazioni e contratti derivati; interessi, dividendi o altri redditi generati dalle attività; il credito, il diritto di compensazione, le garanzie, le fideiussioni e gli altri impegni finanziari; lettere di credito, polizze di carico e atti di cessione; i documenti da cui risulti un interesse riguardante capitali o risorse finanziarie e tutti gli altri strumenti di finanziamento delle esportazioni.

(1) 'Funds' means financial assets and economic benefits of any kind, including, but not necessarily limited to, cash, cheques, claims on money, drafts, money orders and other payment instruments; deposits with financial institutions or other entities, balances on accounts, debts and debt obligations; publicly and privately traded securities and debt instruments, including stocks and shares, certificates representing securities, bonds, notes, warrants, debentures, derivatives contracts; interest, dividends or other income on or value accruing from or generated by assets; credit, right of set-off, guarantees, performance bonds or other financial commitments; letters of credit, bills of lading, bills of sale; documents evidencing an interest in funds or financial resources, and any other instrument of export-financing.

2. Congelamento dei capitali: divieto di spostare, trasferire, alterare, utilizzare o trattare i capitali in modo da modificarne il volume, l'importo, la collocazione, la proprietà, il possesso, la natura e la destinazione o da introdurre altri cambiamenti tali da consentire l'uso dei capitali in questione, compresa la gestione di portafoglio.

(2) 'Freezing of funds' means preventing any move, transfer, alteration, use of or dealing with funds in any way that would result in any change in their volume, amount, location, ownership, possession, character, destination or other change that would enable the use of the funds, including portfolio management.

Articolo 2

1. Fatte salve le disposizioni degli articoli 7 e 8:

1. Except as permitted under Articles 7 and 8:

(a) vengono congelati tutti i capitali in possesso di persone fisiche o giuridiche, entità o organismi elencati all'allegato 1.

(a) all funds held by a natural or legal person, entity or body listed in Annex I shall be frozen;

(b) È vietato mettere a disposizione, direttamente o indirettamente, fondi destinati a persone fisiche o giuridiche, entità o organismi elencati all'allegato 1.

(b) no funds shall be made available, directly or indirectly, to or for the benefit of a natural or legal person, entity or body listed in Annex I.

2. Il Consiglio adotta le eventuali modifiche dell'allegato 1 deliberando a maggioranza qualificata su proposta della Commissione.

2. The Council, acting by qualified majority on a proposal from the Commission, shall adopt amendments to Annex I.

Articolo 3

Article 3

È vietato avviare o proseguire la prestazione di servizi finanziari destinati alle persone fisiche o giuridiche, alle entità o agli organismi elencati all'allegato 1.

It shall be prohibited to engage in or to continue the provision of financial services to or for the benefit of a natural or legal person, entity or body listed in Annex I.

Articolo 4

Article 4

3. È vietata la partecipazione, consapevole e intenzionale, ad attività collegate che abbiano per oggetto o per effetto, direttamente o indirettamente, di eludere gli articoli 2 e 3.

1. The participation, knowingly and intentionally, in related activities, the object or effect of which is, directly or indirectly, to circumvent Articles 2 and 3 shall be prohibited.

4. Qualsiasi informazione relativa all'elusione, già avvenuta o ancora in corso, delle disposizioni del presente regolamento viene comunicata alle autorità competenti degli Stati membri elencate nell'allegato II e/o alla Commissione.

2. Any information that the provisions of this Regulation are being, or have been, circumvented shall be notified to the competent authorities of the Member States listed in Annex II and/or to the Commission.

Articolo 5

Article 5

Fatte salve le norme comunitarie in materia di riservatezza e le disposizioni dell'articolo 284 del trattato, le autorità competenti degli Stati membri possono chiedere alle banche, alle altre istituzioni finanziarie, alle società di assicurazioni e ad altri organismi e persone tutte le informazioni pertinenti necessarie per garantire l'osservanza del presente regolamento.

Without prejudice to the Community rules concerning confidentiality and to Article 284 of the Treaty, the competent authorities of the Member States shall have the power to require banks, other financial institutions, insurance companies, and other bodies, entities and persons to provide all relevant information necessary for ensuring compliance with this Regulation.

Quando si possa legittimamente supporre che una persona, società, impresa, istituzione o entità agisca per conto o a vantaggio di persone fisiche o giuridiche, entità o organismi elencati all'allegato 1, ma non figura nell'elenco dell'allegato 1, qualsiasi persona fisica o giuridica riceve dalle autorità competenti degli Stati membri di cui all'allegato 2 la conferma scritta che detta persona, società, impresa, istituzione o entità non agisce per conto o a vantaggio di persone fisiche o giuridiche, entità o organismi elencati all'allegato 1 prima di avviare attività altrimenti vietate dal presente regolamento.

In cases where there exists a reasonable expectation that a person, company, undertaking, institution or entity is acting on behalf or for the benefit of a natural or legal person, entity or body listed in Annex I, but does not appear on that list, any natural or legal person shall, before entering into activities otherwise prohibited by this Regulation, obtain written confirmation from the relevant competent authorities of the Member States listed in Annex II that such a person, company, undertaking, institution or entity is not acting on behalf or for the benefit of a natural or legal person, entity or body listed in Annex I.

Se le autorità competenti non forniscono detta conferma scritta entro 10 giorni lavorativi, si considera che detta persona, società, impresa, istituzione o entità non agisce per conto o a vantaggio di persone fisiche o giuridiche, entità o organismi elencati all'allegato 1.

If the competent authorities do not provide such written conformation within 10 working days, the person, company, undertaking, institution or entity shall be deemed not to be acting on behalf or for the benefit of a natural or legal person, entity or body listed in Annex I.

Articolo 7

Article 7

L'articolo 2 non si applica:

Article 2 shall not apply to:

(1) ai pagamenti da eseguire nella Comunità per soddisfare un fabbisogno umano fondamentale;

(2) addition to frozen accounts of interest due on those accounts;

(3) ai pagamenti dei capitali connessi a contratti, accordi o obblighi conclusi o insorti prima dell'entrata in vigore del presente regolamento, purché detti pagamenti vengano effettuati su un conto congelato all'interno della Comunità.

(3) payments of funds due under contracts, agreements or obligations which were concluded or arose prior to the entry into force of this Regulation provided that those payments are made into a frozen account within the Community.

Articolo 8

Article 8

1. Per tutelare gli interessi della Comunità possono essere concesse, secondo la procedura di cui all'articolo 9, paragrafo 2, autorizzazioni specifiche o generali al fine di scongelare fondi o renderli disponibili.

1. Specific or general authorisations to unfreeze funds or to make funds available with a view to the protection of the interests of the Community may be granted in accordance with the procedure referred to in Article 9(2).

L'allegato II può essere modificato secondo la stessa procedura.

Annex II may be amended in accordance with the same procedure.

2. Le autorizzazioni di cui al paragrafo 1 del presente articolo e le modifiche dell'allegato 1 del presente regolamento devono essere chieste alla Commissione, direttamente o attraverso le autorità competenti degli Stati membri elencate nell'allegato 2.

2. Any request by a legal or natural person for an authorisation referred to in paragraph 1 shall be made to the Commission directly or through the appropriate competent authorities of the Member States listed in Annex II.

Articolo 9

1. La Commissione è assistita dal comitato istituito a norma del regolamento (CE) n. 2271/96.

1. The Commission shall be assisted by the committee instituted by Regulation (EC) No 2271/96.

2. Nei casi in cui si fa riferimento al presente paragrafo, si applica la procedura di gestione di cui agli articoli 4 e 7 della decisione 1999/468/CE.

2. Where reference is made to this paragraph, the management procedure laid down in Articles 4 and 7 of Decision 1999/468/EC shall apply.

Il periodo di cui all'articolo 4, paragrafo 3 della decisione 1999/468/CE è fissato a dieci giorni lavorativi.

The period laid down in Article 4(3) of Decision 1999/468/EC shall be 10 working days.

Il comitato di cui all'articolo 9 può esaminare tutte le questioni inerenti all'applicazione del presente regolamento sollevate dal presidente di sua iniziativa o su richiesta di uno Stato membro.

The committee referred to in Article 9 may examine any question concerning the application of this Regulation referred to it by the Chairman either on his own initiative or at the request of a Member State.

Articolo 11

La Commissione e gli Stati membri si informano reciprocamente delle misure adottate ai sensi del presente regolamento e si comunicano tutte le altre informazioni in loro possesso riguardanti il presente regolamento, in particolare quelle ricevute ai sensi degli articoli 4, 5 e 6, nonché le violazioni e i problemi di applicazione o le sentenze pronunciate dai tribunali nazionali.

The Commission and the Member States shall immediately and fully inform each other of the measures taken under this Regulation and supply each other with the relevant information at their disposal in connection with this Regulation, notably information received in accordance with Articles 4, 5 and 6, and in respect of violation and enforcement problems or judgements handed down by national courts.

Ciascuno Stato membro determina le sanzioni da imporre in caso di violazione delle disposizioni del presente regolamento. Le sanzioni devono essere efficaci, proporzionate e dissuasive.

Each Member State shall determine the sanctions to be imposed where the provisions of the Regulation are infringed. Such sanctions shall be effective, proportionate and dissuasive.

In attesa che sia adottata la legislazione eventualmente necessaria a tal fine, in caso di violazione delle disposizioni del presente regolamento si applicano le sanzioni più rigorose stabilite dagli Stati membri a norma dell'articolo 13 del regolamento (CE) n. 467/2001 [4], dell'articolo 8 del regolamento (CE) n. 2488/2000 [5] o dell'articolo 7 del regolamento (CE) n. 1081/2000 [6].

Pending the adoption, where necessary, of any legislation to this end, the sanctions to be imposed where the provisions of this Regulation are infringed shall be those determined by the Member States in accordance with Article 13 of Regulation (EC) No 467/2001 [4], Article 8 of Regulation (EC) No 2488/2000 [5] or Article 7 of Regulation (EC) No 1081/2000 [6], whichever may be more severe.

Il presente regolamento si applica:

This Regulation shall apply:

- nel territorio della Comunità, compreso il suo spazio aereo;

(1) within the territory of the Community including its airspace,

- a bordo di tutti gli aeromobili e di tutti i natanti sotto la giurisdizione di uno Stato membro;

(2) on board any aircraft or any vessel under the jurisdiction of a Member State,

- a tutti i cittadini di uno Stato membro che si trovano altrove;

(3) to any person elsewhere who is a national of a Member State,

- a tutte le persone giuridiche, entità o organismi registrati o costituiti secondo la legislazione di uno Stato membro;

(4) to any legal person, entity or body which is incorporated or constituted under the law of a Member State,

- a tutte le persone giuridiche, entità o organismi che svolgono attività commerciali nella Comunità.

(5) to any legal person, entity or body doing business within the Community.

Il presente regolamento entra in vigore il giorno della sua pubblicazione sulla Gazzetta ufficiale delle Comunità europee.

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Communities.

Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
