COMMISSION DIRECTIVE 1999/19/EC of 18 March 1999 amending Council Directive 97/70/EC setting up a harmonised safety regime for fishing vessels of 24 metres in length and over (Text with EEA relevance)

LA COMMISSIONE DELLE COMUNITÀ EUROPEE,

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

visto il trattato che istituisce la Comunità europea,

Having regard to the Treaty establishing the European Community,

vista la direttiva 97/70/CE del Consiglio, dell'11 dicembre 1997, che istituisce un regime di sicurezza armonizzato per le navi da pesca di lunghezza uguale o superiore a 24 metri (1), in particolare l'articolo 8,

Having regard to Council Directive 97/70/EC of 11 December 1997 setting up a harmonised safety regime for fishing vessels of 24 metres in length and over (1), and in particular Article 8 thereof,

(1) considerando che la Commissione ha esaminato le disposizioni relative al capitolo IX di cui all'allegato II della direttiva 97/70/CE per quanto riguarda la loro applicazione alle navi da pesca nuove di lunghezza compresa fra 24 e 45 metri, tenendo conto delle dimensioni limitate delle navi e del numero di persone a bordo;

(1) Whereas the Commission has examined the provisions on Chapter IX in Annex II to the Directive with regard to their application to new fishing vessels with a length between 24 and 45 metres, thereby taking due account to the limited size of the vessels and the number of persons on board;

(2) considerando che questo esame ha dimostrato che, per quanto riguarda le radiocomunicazioni, può essere garantito un livello equivalente di sicurezza per questa categoria di navi, esclusivamente quando operano nella zona marittima A1, prescrivendo l'installazione di un impianto radio VHF supplementare a chiamata selettiva numerica (DSC) al posto di un radiofaro di localizzazione dei sinistri (EPIRB);

(2) Whereas that examination has demonstrated that with regard to radio communications an equivalent level of safety can be guaranteed for such vessels, when operating exclusively in sea area A1, by requiring the carriage of an additional VHF radio using Digital Selective Calling (DSC) in lieu of an Emergency Position Indicating Radio Beacon (EPIRB);

(3) considerando che, alla luce di questo esame, è opportuno modificare l'allegato II della direttiva;

(3) Whereas, in the light of that examination, Annex II to the Directive should be amended;

(4) considerando che la modifica è conforme alle linee direttrici relative alla partecipazione al sistema globale di soccorso e sicurezza marittimo (GMDSS) delle navi che non rientrano nella convenzione SOLAS, come stabilito dal comitato per la sicurezza marittima dell'Organizzazione marittima internazionale nella circolare 803 del 9 giugno 1997;

(4) Whereas the amendment is in compliance with the guidelines for the participation of non-SOLAS ships in the Global Maritime Distress and Safety System (GMDSS) as established by the Maritime Safety Committee of the International Maritime Organisation by its Circular 803 of 9 June 1997;

(5) considerando che le misure di cui alla presente direttiva sono conformi al parere del comitato istituito dall'articolo 12 della direttiva 93/75 /CEE del Consiglio (2), modificata da ultimo dalla direttiva 98/74/CE della Commissione (3),

(5) Whereas the measures provided for in this Directive are in accordance with the opinion of the Committee established by Article 12 of Council Directive 93/75 /EEC (2), as last amended by Commission Directive 98/74/EC (3),

HA ADOTTATO LA PRESENTE DIRETTIVA:

HAS ADOPTED THIS DIRECTIVE:

Nell'allegato II della direttiva 97/70/CE, alla rubrica «Capitolo IX: Radiocomunicazioni», è aggiunto quanto segue:

The following is added to Annex II to Directive 97/70/EC, under the heading 'CHAPTER IX: RADIOCOMMUNICATIONS`:

«Regola 7: Apparecchiature radio - zona marittima A1

'Regulation 7: Radio equipment - sea area A1

È inserito il nuovo paragrafo 4:

Insert a new paragraph (4) to read as follows:

"Fatto salvo il disposto della regola 4, lettera a), l'amministrazione può esentare le navi da pesca nuove di lunghezza uguale o superiore a 24 metri, ma inferiore a 45 metri che operano esclusivamente nella zona marittima A1, dalle prescrizioni di cui alla regola 6, paragrafo 1, lettera f), e alla regola 7, paragrafo 3, a condizione che siano provviste di un impianto radio VHF, come prescritto alla regola 6, paragrafo 1, lettera a), nonché di un impianto radio VHF che utilizza il sistema di chiamata selettiva numerica (DSC) per la trasmissione di richieste di soccorso da nave a terra, come disposto dalla regola 7, paragrafo 1, lettera a)."»

"Notwithstanding the provisions of Regulation 4(a), the Administration may exempt new fishing vessels of 24 metres in length and over but less than 45 metres and engaged exclusively on voyages within sea area A1 from the requirements of Regulations 6(1)(f) and 7(3) provided that they are equipped with a VHF radio installation as prescribed by Regulation 6(1)(a) and, in addition, with a VHF radio installation using DSC for the transmission of ship-to-shore distress alerts as prescribed by Regulation 7(1)(a)."`

1. Gli Stati membri mettono in vigore le disposizioni legislative, regolamentari ed amministrative necessarie per conformarsi alla presente direttiva entro il 31 maggio 2000. Essi ne informano immediatamente la Commissione.

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 31 May 2000 at the latest. They shall forthwith inform the Commission thereof.

Quando gli Stati membri adottano tali disposizioni, queste contengono un riferimento alla presente direttiva o sono corredate di un siffatto riferimento all'atto della pubblicazione ufficiale. Le modalità del riferimento sono decise dagli Stati membri.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

2. Gli Stati membri comunicano alla Commissione il testo delle disposizioni di diritto interno che essi adottano nella materia disciplinata dalla presente direttiva.

2. Member States shall communicate to the Commission the provisions of national law which they adopt in the field covered by this Directive.

La presente direttiva entra in vigore il ventesimo giorno successivo alla pubblicazione nella Gazzetta ufficiale delle Comunità europee.

This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Communities.

Gli Stati membri sono destinatari della presente direttiva.

This Directive is addressed to the Member States.
