Whereas:

(1) Il regolamento (CEE, Euratom) n. 1552/89 del Consiglio, del 29 maggio 1989, recante applicazione della decisione 88/376, /CEE, Euratom, relativa al sistema delle risorse proprie delle Comunità(4) è stato modificato a più riprese ed in maniera sostanziale(5). A fini di razionalità e chiarezza occorre pertanto procedere alla codificazione del suddetto regolamento.

(1) Council Regulation (EEC, Euratom) No 1552/89 of 29 May 1989, implementing Decision 88/376/EEC, Euratom on the system of the Communities' own resources(4) has been frequently and substantially amended(5). For reasons of clarity and rationality the said Regulation should therefore be codified.

(2) La Comunità deve disporre delle risorse proprie di cui all'articolo 2 della decisione 94/728/CE, Euratom, nelle migliori condizioni possibili. A tal fine è necessario fissare le modalità secondo le quali gli Stati mettono a disposizione della Commissione le risorse proprie attribuite alle Comunità.

(2) The Community must have the own resources referred to in Article 2 of 94/728/EC, Euratom available in the best possible conditions and accordingly arrangements must be laid down for the States to provide the Commission with the own resources allocated to the Communities.

(3) Le risorse proprie tradizionali sono riscosse dagli Stati membri secondo le disposizioni legislative, regolamentari e amministrative nazionali adattate, se del caso, alle esigenze della normativa comunitaria. La Commissione deve controllare tale adeguamento e, se del caso, fare delle proposte.

(3) Traditional own resources are levied by the Member States in accordance with laws, regulations and administrative provisions that are, where necessary, adapted to the requirements of Community regulations. The Commission must monitor such adaptation and, where necessary, make proposals.

(4) Il Consiglio ed i rappresentanti dei governi degli Stati membri riuniti in sede di Consiglio hanno adottato la risoluzione del 13 novembre 1991 concernente la protezione degli interessi finanziari delle Comunità(6).

(4) The Council and the representatives of the Governments of the Member States, meeting within the Council, adopted a resolution on 13 November 1991 on the protection of the financial interests of the Community(6).

(5) È necessario definire il concetto di accertamento e precisare le condizioni nelle quali è realizzato l'obbligo di accertamento per quanto riguarda le risorse proprie di cui all'articolo 2, paragrafo 1, lettere a) e b), della decisione 94/728/CE, Euratom.

(5) The concept of establishment must be defined in respect of the own resources and detailed rules must be laid down for satisfying the obligation to establish the own resources referred to in Article 2(1)(a) and (b) of 94/728/EC, Euratom.

(6) Per quanto riguarda le risorse proprie provenienti da contributi nel settore dello zucchero per i quali bisogna garantire una coincidenza tra la riscossione delle entrate e dell'esercizio di bilancio, da un lato, e le spese relative alla medesima campagna, dall'altro, è opportuno prevedere che gli Stati membri mettano a disposizione della Commissione le risorse provenienti dai contributi nel settore dello zucchero durante l'esercizio di bilancio nel corso del quale sono stati accertati.

(6) For own resources deriving from sugar levies, which need to be recovered in the budget year corresponding to the marketing year to which the expenditure relates, provision should be made for the Member States to make such levies available to the Commission during the budget year in which they are established.

(7) È necessario migliorare la trasparenza del sistema delle risorse proprie e l'informazione dell'autorità di bilancio.

(7) The transparency of the own resources system should be improved and more information supplied to the budgetary authority.

(8) Gli Stati membri devono tenere a disposizione della Commissione e, se del caso, comunicarle i documenti e le informazioni necessarie all'esercizio delle competenze ad essa attribuite in materia di risorse proprie.

(8) The Member States must keep at the disposal of the Commission and, where necessary, forward to it the documents and information needed to allow it to exercise the power conferred upon it as regards the Communities' own resources.

(9) Le amministrazioni nazionali incaricate della riscossione delle risorse proprie devono tenere a disposizione della Commissione, in ogni momento, i documenti giustificativi di tale riscossione.

(9) The national authorities responsible for the collection of own resources must be able to produce to the Commission at all times the documents substantiating the own resources collected.

(10) Il dispositivo d'informazione della Commissione da parte degli Stati membri è inteso a consentire la sorveglianza dell'azione di questi ultimi in materia di recupero delle risorse proprie e in particolare di quelle messe in questione a causa di frodi e irregolarità.

(10) The arrangements whereby the Member States report to the Commission, should make it possible for the latter to monitor Member States action to recover own resources, in particular in cases of fraud and irregularities.

(11) È opportuno prevedere una contabilità separata per quanto concerne in particolare i diritti non riscossi. Tale contabilità, con trasmissione di un estratto trimestrale, deve consentire alla Commissione di seguire più da vicino l'attività degli Stati membri nel campo della riscossione delle risorse proprie e in particolare di quelle compromesse da frodi e irregolarità.

(11) Separate accounts should be kept for entitlements which have not been recovered. These accounts and the submission of a quarterly statement of such accounts should enable the Commission to monitor more closely the action taken by Member States to collect own resources, and particularly those compromised by fraud or irregularities.

(12) È necessario introdurre un termine di prescrizione nei rapporti tra gli Stati membri e la Commissione, restando inteso che i nuovi accertamenti effettuati dallo Stato membro sui soggetti passivi per gli esercizi precedenti si devono considerare come accertamenti dell'esercizio in corso.

(12) A time limit should be laid down for relations between Member States and the Commission, since new entitlements established by Member States in respect of earlier years are deemed to be establishments for the current year.

(13) Per quanto riguarda le risorse proprie provenienti dall'imposta sul valore aggiunto, in appresso denominate "risorse IVA", di cui all'articolo 2, paragrafo 1, lettera c), della decisione 94/728/CE, Euratom, è opportuno stabilire che gli Stati membri mettano a disposizione della Comunità, sotto forma di dodicesimi mensili di importo costante, le risorse proprie previste dal bilancio, per poi procedere in un secondo tempo alla regolarizzazione delle somme così messe a disposizione in funzione della base reale delle risorse IVA non appena quest'ultima sarà definitivamente nota.

(13) Provision should be made, as regards the own resources accruing from value added tax, hereinafter called "VAT resources", referred to in Article 2(1)(c) of 94/728/EC, Euratom, for Member States to make available to the Community, in the form of constant monthly twelfths, the own resources entered in the budget and subsequently to adjust the amounts made available in accordance with the actual base of VAT resources as soon as it is fully known.

(14) Tale procedura deve ugualmente applicarsi alla risorsa complementare di cui all'articolo 2, paragrafo 1, lettera d), di detta decisione, in appresso denominata "risorsa complementare", fissata conformemente alla direttiva 89/130/CEE, Euratom, del Consiglio, del 13 febbraio 1989, relativa all'armonizzazione della fissazione del prodotto nazionale lordo ai prezzi di mercato(7).

(14) This procedure is also to apply to the additional resource referred to in Article 2(1)(d) of the said Decision, hereinafter referred to as "the additional resource", created in accordance with Council Directive 89/130/EEC, Euratom of 13 February 1989 on the harmonization of the compilation of the gross national product at market prices(7).

(15) La messa a disposizione delle risorse proprie può effettuarsi sotto forma di accreditamento degli impegni dovuti in un conto aperto a tale scopo, a nome della Commissione, presso il Tesoro di ogni Stato membro o l'organismo designato da ogni Stato membro. Al fine di limitare i movimenti di fondi a quanto risulta necessario all'esecuzione del bilancio, la Comunità deve limitarsi ad effettuare sui conti di cui sopra prelievi destinati a coprire unicamente i bisogni di tesoreria della Commissione.

(15) The own resources must be made available in the form of an entry of the amounts due in an account opened for this purpose in the name of the Commission with the Treasury or with the body appointed by each Member State. In order to restrict the movements of funds to that which is necessary for the implementation of the budget, the Community must confine itself to drawing on the abovementioned accounts solely to cover the Commission's cash requirements.

(16) Il pagamento degli aiuti derivante dall'applicazione del regolamento (CEE) n. 1765/92 del Consiglio, del 30 giugno 1992, che istituisce un regime di sostegno a favore dei coltivatori di alcuni seminativi(8), è soprattutto concentrato nei primi mesi dell'esercizio. La Commissione deve disporre di mezzi di tesoreria sufficienti per effettuare questo pagamento.

(16) The payment of aid resulting from application of Council Regulation (EEC) No 1765/92 of 30 June 1992 establishing a support system for producers of certain arable crops(8) is mainly concentrated in the opening months of the year; whereas the Commission must have sufficient cash resources to make this payment.

(17) La decisione 94/729, /CE del Consiglio, del 31 ottobre 1994, concernente la disciplina di bilancio(9), ha previsto l'iscrizione nel bilancio generale dell'Unione europea di una riserva relativa alle operazioni di prestito e di garanzia sui prestiti concessi dalla Comunità a favore e nei paesi terzi e di una riserva per gli aiuti d'urgenza. È opportuno, pertanto, prevedere delle misure relative all'iscrizione delle risorse proprie corrispondenti a tali riserve.

(17) Council 94/729/EC of 31 October 1994 concerning budgetary discipline(9) provides for the entry in the general budget of the European Union of a reserve relating to Community loans and loan guarantees to non-member countries and in those countries a reserve for emergency aid. Amendments need to be made to cover the entry of the own resources corresponding to these reserves.

(18) Per garantire in ogni caso il finanziamento del bilancio comunitario, occorre fissare le modalità secondo cui saranno messi a disposizione i contributi basati sul prodotto nazionale lordo, di cui all'articolo 2, paragrafo 7, della decisione 88/376, /CEE, Euratom, in appresso denominati "contributi finanziari PNL".

(18) In order to ensure that the Community budget will be financed in all circumstances, the procedure for making available the contributions based on the gross national product, hereinafter referred to as the "GNP financial contributions", referred to in Article 2(7) of Decision 88/376/EEC, Euratom should be laid down.

(19) Occorre definire il saldo di un esercizio da riportare all'esercizio successivo.

(19) The balance to be carried forward to the following financial year should be defined.

(20) Occorre che gli Stati membri procedano ai controlli e alle indagini relativi all'accertamento e alla messa a disposizione delle risorse proprie. È opportuno che la Commissione eserciti le sue competenze alle condizioni definite nel presente regolamento. Conviene precisare le competenze della Commissione per quanto concerne il controllo della risorsa complementare.

(20) The Member States should conduct the checks and enquiries relating to the establishment and making available of own resources. The Commission should exercise its powers in accordance with this Regulation. The powers of the Commission should be stipulated with regard to the inspection measures on the additional resource.

(21) Una stretta collaborazione tra Stati membri e Commissione può agevolare la corretta applicazione della regolamentazione finanziaria relativa alle risorse proprie,

HA ADOTTATO IL PRESENTE REGOLAMENTO:

HAS ADOPTED THIS REGULATION:

TITOLO I

TITLE I

Disposizioni generali

General provisions

Articolo 1

Article 1

Le risorse proprie delle Comunità previste dalla 94/728/CE, Euratom, qui di seguito denominate "risorse proprie", sono messe a disposizione della Commissione e controllate alle condizioni previste dal presente regolamento, fatti salvi il regolamento (CEE, Euratom) n. 1553/89(10) e la direttiva 89/130/CEE, Euratom.

The Community's own resources provided for in 94/728/EC, Euratom, hereinafter referred to as "own resources" shall be made available to the Commission and inspected as specified in this Regulation, without prejudice to Regulation (EEC, Euratom) No 1553/89(10) and Directive 89/130/EEC, Euratom.

Articolo 2

Article 2

1. Ai fini dell'applicazione del presente regolamento, un diritto delle Comunità sulle risorse proprie di cui all'articolo 2, paragrafo 1, lettere a) e b), della decisione 94/728/CE, Euratom, è accertato non appena ricorrono le condizioni previste dalla normativa doganale per quanto riguarda la registrazione dell'importo del diritto e la comunicazione del medesimo al soggetto passivo.

1. For the purpose of applying this Regulation, the Community's entitlement to the own resources referred to in Article 2(1)(a) and (b) of 94/728/EC, Euratom shall be established as soon as the conditions provided for by the customs regulations have been met concerning the entry of the entitlement in the accounts and the notification of the debtor.

2. La data da considerare per l'accertamento di cui al paragrafo 1 è la data della registrazione prevista dalla normativa doganale.

2. The date of the establishment referred to in paragraph 1 shall be the date of entry in the accounting ledgers provided for by the customs regulations.

In quanto ai contributi ed altri diritti previsti nel quadro dell'organizzazione comune di mercato nel settore dello zucchero, la data da considerare per l'accertamento di cui al paragrafo 1 è quella della comunicazione prevista dalla normativa del settore zucchero.

As regards the levies and other charges connected with the common organisation of the sugar market, the date of the establishment referred to in paragraph 1 shall be the date of notification under the sugar regulations.

Qualora tale comunicazione non sia esplicitamente prevista, la data da considerare è quella della liquidazione da parte degli Stati membri degli importi dovuti dai soggetti passivi, eventualmente a titolo di acconto o di pagamento del saldo.

Should that notification not be explicitly provided for, the date shall be the date of establishment by the Member States of the amounts due by the debtors, where necessary by way of advance payment or payment of balance.

3. Nei casi di contenzioso, le autorità amministrative competenti devono poter calcolare, ai fini dell'accertamento di cui al paragrafo 1, l'importo del dazio dovuto al più tardi in occasione della prima decisione amministrativa che comunica l'obbligazione al soggetto passivo o in occasione della denuncia all'autorità giudiziaria, se tale denuncia interviene precedentemente.

3. In disputed cases, the competent administrative authorities shall be deemed, for the purposes of the establishment referred to in paragraph 1, to be in a position to calculate the amount of the entitlement not later than when the first administrative decision is taken notifying the debtor of the debt or when judicial proceedings are brought if this occurs first.

La data da considerare per l'accertamento di cui al paragrafo 1 è la data della decisione o quella del calcolo da effettuare consecutivamente alla denuncia di cui al primo comma.

The date of the establishment referred to in paragraph 1 shall be the date of the decision or of the calculation to be made following the abovementioned commencing of judicial proceedings.

4. Il paragrafo 1 si applica allorché la comunicazione deve essere rettificata.

4. Paragraph 1 shall apply when a notification must be corrected.

Articolo 3

Article 3

Gli Stati membri prendono tutte le misure utili affinché i documenti giustificativi relativi all'accertamento e alla messa a disposizione delle risorse proprie siano conservati per almeno tre anni civili a decorrere dalla fine dell'anno cui si riferiscono tali documenti giustificativi.

Member States shall take all appropriate measures to ensure that the supporting documents concerning the establishment and making available of own resources are kept for at least three calendar years, counting from the end of the year to which these supporting documents refer.

I documenti giustificativi relativi alle procedure e alle basi statistiche di cui agli articoli 4 e 5 della direttiva 89/130/CEE, Euratom, sono conservati dagli Stati membri fino al 30 settembre del quarto anno successivo all'esercizio in questione. I documenti giustificativi relativi alla base delle risorse IVA sono conservati per lo stesso periodo.

The supporting documents relating to the statistical procedures and bases referred to in Articles 4 and 5 of Directive 89/130/EEC, Euratom shall be kept by the Member States until 30 September of the fourth year following the financial year in question. The supporting documents relating to the VAT resources base shall be kept for the same period.

Qualora la verifica dei documenti giustificativi di cui al primo e al secondo comma, effettuata ai sensi degli articoli 18 e 19 del presente regolamento o dell'articolo 11 del regolamento (CEE, Euratom) n. 1553/89, palesi la necessità di procedere ad una rettifica, detti documenti giustificativi sono conservati oltre il termine di cui al primo comma per una durata che consenta di procedere alla rettifica e al suo controllo.

If verification pursuant to Articles 18 and 19 of this Regulation or Article 11 of Regulation (EEC, Euratom) No 1553/89 of the supporting documents referred to in the first and second paragraphs shows that a correction is required, they shall be kept beyond the time limit provided for in the first paragraph for a sufficient period to permit the correction to be made and monitored.

1. Ogni Stato membro comunica alla Commissione:

1. Each Member State shall inform the Commission:

a) La denominazione dei servizi o organismi responsabili dell'accertamento, della riscossione, della messa a disposizione e del controllo delle risorse proprie, nonché le disposizioni essenziali relative al ruolo e al funzionamento di questi servizi e organismi;

(a) of the names of the departments or agencies responsible for establishing, collecting, making available and controlling own resources and the basic provisions relating to the role and operation of those departments and agencies;

b) le disposizioni legislative, regolamentari, amministrative e contabili di carattere generale relative all'accertamento, alla riscossione, alla messa a disposizione e al controllo delle risorse proprie;

(b) of the general provisions laid down by law, regulation or administrative action and those relating to accounting procedure concerning the establishment, collection, making available and control by the Commission of own resources;

c) la denominazione esatta di tutti gli estratti amministrativi e contabili nei quali sono iscritti i diritti accertati, specificati all'articolo 2 del presente regolamento, in particolare quelli utilizzati per la tenuta delle contabilità previste all'articolo 6.

(c) of the precise title of all administrative and accounting records in which are entered the established entitlements as specified in Article 2, in particular those used for drawing up the accounts provided for in Article 6.

Ogni modifica di denominazioni o disposizioni è immediatamente comunicata alla Commissione.

The Commission shall be informed immediately of any change in these names or provisions.

2. La Commissione comunica agli altri Stati membri, su loro richiesta, i dati di cui al paragrafo 1.

2. The Commission shall, at the request of the other Member States, pass on to them the information referred to in paragraph 1.

Articolo 5

Article 5

Il tasso di cui all'articolo 2, paragrafo 1, lettera d), della decisione 94/728/CE, , Euratom, fissato nel quadro della procedura di bilancio, è calcolato in percentuale della somma dei prodotti nazionali lordi (in appresso PNL) di previsione degli Stati membri in modo da coprire integralmente la parte del bilancio che non è finanziata dai dazi doganali, dai prelievi agricoli, dai contributi e altri diritti previsti nel quadro dell'organizzazione comune di mercato nel settore dello zucchero, dalle risorse IVA, dai contributi finanziari ai programmi complementari di ricerca e sviluppo tecnologico, dalle altre entrate e, se del caso dai contributi finanziari PNL.

The rate referred to in Article 2(1)(d) of 94/728/EC, Euratom which shall be set within the budgetary procedure, shall be calculated as a percentage of the sum of the forecast of the gross national product, (hereinafter referred to as "GNP") of the Member States in such a manner that if fully covers that part of the budget not financed from customs duties, agricultural levies, levies, and other charges connected with the common organisation of the market in the sugar sector, VAT resources, financial contributions to supplementary research and technological development programmes, other revenue and, where appropriate, GNP financial contributions.

Questo tasso è espresso nel bilancio da una cifra contenente tanti decimali quanti necessari per ripartire integralmente tra gli Stati membri la risorsa basata sul PNL.

That rate shall be expressed in the budget by a figure containing as many decimal places as is necessary to fully divide the GNP-based resource among the Member States.

TITOLO II

TITLE II

Contabilizzazione delle risorse proprie

Accounts for own resources

Articolo 6

Article 6

1. Presso il Tesoro di ogni Stato membro o l'organismo designato da quest'ultimo viene tenuta una contabilità delle risorse proprie, ripartita secondo la natura delle risorse.

1. Accounts for own resources shall be kept by the Treasury of each Member State or by the body appointed by each Member State and broken down by type of resources.

2. Per le esigenze della contabilità delle risorse proprie, la chiusura contabile è effettuata non prima delle ore tredici dell'ultimo giorno feriale del mese in cui è stato effettuato l'accertamento.

2. For own-resources accounting purposes, the month shall end no earlier than 1 p.m. on the last working day of the month during which establishment took place.

3. a) Con riserva della lettera b) del presente paragrafo, i diritti accertati conformemente all'articolo 2 sono riportati nella contabilità al più tardi il primo giorno feriale dopo il 19 del secondo mese successivo a quello nel corso del quale ha avuto luogo l'accertamento.

3. (a) Entitlements established in accordance with Article 2 shall, subject to point (b) of this paragraph, be entered in the accounts at the latest on the first working day aftger the 19th day of the second month following the month during which the entitlement was established.

b) I diritti accertati e non riportati nella contabilità di cui alla lettera a), poiché non sono stati ancora riscossi e non è stata fornita alcuna garanzia, sono iscritti in una contabilità separata entro il termine previsto alla lettera a). Gli Stati membri possono procedere nello stesso modo allorché i diritti accertati e coperti da garanzie formano oggetto di contestazione e possono subire variazioni in seguito alle controversie sorte.

(b) Established entitlements not entered in the accounts referred to in point (a), because they have not yet been recovered and no security has been provided shall be shown in separate accounts within the period laid down in point (a). Member States may adopt this procedure where established entitlements for which security has been provided have been challenged and might, upon settlement of the disputes which have arisen, be subject to change.

c) Tuttavia, le risorse IVA e la risorsa complementare sono iscritte nella contabilità di cui alla lettera a):

(c) VAT resources and the additional resources shall, however, be recorded in the accounts as specified in point (a) as follows:

- il primo giorno feriale di ogni mese, in ragione del dodicesimo di cui all'articolo 10, paragrafo 3,

- the twelfth referred to in Article 10(3) shall be recorded on the first working day of each month,

- annualmente per quanto riguarda i saldi di cui all'articolo 10, paragrafi 4 e 7, e le rettifiche di cui all'articolo 10, paragrafi 6 e 8, ad eccezione delle rettifiche particolari previste dall'articolo 10, paragrafo 6, primo trattino, le quali sono iscritte nella contabilità il primo giorno feriale del mese successivo a quello in cui è intervenuto l'accordo tra lo Stato membro interessato e la Commissione.

- the balances referred to in Article 10(4) and (7) and the adjustments referred to in Article 10(6) and (8) shall be recorded annually, except for the particular adjustments referred to in the first indend of Article 10(6), which shall be recorded in the accounts on the first working day of the month following agreement between the Member State concerned and the Commission.

d) I diritti accertati relativi ai contributi e altri diritti previsti nel quadro dell'organizzazione comune dei mercati nel settore dello zucchero sono riportati nella contabilità di cui alla lettera a). Qualora, successivamente, tali diritti non siano riscossi entro i termini previsti, gli Stati membri possono rettificare l'iscrizione effettuata e procedere a titolo eccezionale alla loro iscrizione nella contabilità separata.

(d) Established entitlements relating to levies and other charges connected with the common organization of the sugar market shall be entered in the accounts referred to in point (a). If these entitlements are not then recovered within the time limits set, the Member States may correct the entry and, by way of exception, enter the entitlements in the separate accounts.

4. Ogni Stato membro trasmette alla Commissione, entro il termine di cui al paragrafo 3:

4. Each Member State shall send the Commission, within the time limits specified in paragraph 3:

a) un estratto mensile della sua contabilità relativa ai diritti di cui al paragrafo 3, lettera a).

(a) a monthly statement of its accounts for the entitlements referred to in point (a) of paragraph 3.

A sostegno degli estratti mensili in questione, gli Stati membri interessati comunicano le indicazioni o gli estratti relativi alle detrazioni apportate alle risorse proprie sulla base delle disposizioni riguardanti i territori a statuto speciale;

Together with these monthly statements the Member States concerned shall provide details or statements of deductions from own resources based on provisions relating to special-status territories.

Le modalità degli estratti mensili e trimestrali di cui al primo comma, nonché le loro modifiche debitamente giustificate, sono definite dalla Commissione previa consultazione del comitato di cui all'articolo 20. Esse prevedono, se del caso, opportuni termini di applicazione.

Detailed rules for the monthly and quarterly statements referred to in the first subparagraph and duly substantiated amendments thereto shall be laid down by the Commission after consulting the Committee referred to in Article 20. They shall provide for any appropriate time limits for implementation.

5. Nel corso dei due mesi che seguono la fine di ogni trimestre, ogni Stato membro comunica alla Commissione una descrizione delle frodi e irregolarità già individuate relative a dazi per un importo superiore a 10000 EUR.

5. In the two months following the end of each quarter, each Member State shall send the Commission a description of cases of fraud and irregularities detected involving entitlements of over EUR 10000.

A questo riguardo, ogni Stato membro fornisce, nella misura del possibile, le precisazioni concernenti:

- il tipo di frode e/o irregolarità (denominazione, regime doganale in questione),

- i servizi o organismi nazionali che hanno proceduto all'accertamento della frode o dell'irregolarità,

- national departments or agencies which detected the fraud or irregularity,

- la fase della procedura, compresa la fase del recupero, con indicazione dell'accertamento, se è già stato effettuato,

- stage reached in procedure, including the stage of recovery, with reference to the establishment if already made,

- l'indicazione della comunicazione eventuale del caso a norma del regolamento (CE) n. 515/97(11),

- reference of notification of case under Council Regulation (EC) No 515/97(11),

- se del caso, gli Stati membri interessati,

- if appropriate, the Member States involved,

- le misure adottate o previste al fine di evitare che si ripetano casi di frode o di irregolarità già individuati.

A sostegno di ogni comunicazione trimestrale a titolo del primo comma, gli Stati membri trasmettono la situazione dei casi di frode e irregolarità già comunicati alla Commissione, che non siano stati precedentemente oggetto di una menzione di recupero, di annullamento o di mancato recupero.

Together with each quarterly statement pursuant to the first subparagraph, each Member State shall give details of the position concerning cases of fraud and irregularites already reported to the Commission whose recovery, cancellation or non-recovery was not indicated earlier.

Details of the above descriptions and duly substantiated amendments thereto shall be worked out by Commission after consulting the Committee referred to in Article 20. They shall provide for any appropriate time limits for implementation.

Ogni Stato membro redige annualmente un conto riepilogativo dei dazi accertati riportati nella sua contabilità di cui all'articolo 6, paragrafo 3, lettera a), e lo trasmette alla Commissione prima del 1o aprile dell'anno successivo all'esercizio in questione. Ogni differenza tra l'importo globale del conto riepilogativo e la somma degli estratti mensili trasmessi dallo Stato membro da gennaio a dicembre dell'anno deve costituire oggetto di un commento. La Commissione verifica la concordanza del conto riepilogativo con l'importo dei dazi messi a sua disposizione nel corso dell'anno; essa dispone del termine di due mesi, dopo aver ricevuto il conto riepilogativo, per comunicare, eventualmente, le sue osservazioni allo Stato membro interessato.

1. Each Member State shall draw up annually a summary account of established entitlements shown in the accounts referred to in of Article 6(3)(a) and shall send it to the Commission before 1 April of the year following the financial year in question. A remark shall be added to explain any difference between the total of the summary account and the sum of the monthly statements sent in by the Member States from January to December of the year in question. The Commission shall check that the summary account tallies with the amounts made available during the year; it shall have two months after receiving the summary accounts in which to make any observations to the Member State concerned.

2. Dopo il 31 dicembre del terzo anno successivo a un determinato esercizio, il conto riepilogativo annuale di cui al paragrafo 1 non è più rettificato, salvo per i punti notificati prima di tale scadenza, sia dalla Commissione, sia dallo Stato membro interessato.

2. After 31 December of the third year following a given year, no further corrections shall be made to the annual summary account referred to in paragraph 1, except on points notified before this date either by the Commission or by the Member State concerned.

Le rettifiche effettuate a norma dell'articolo 2, paragrafo 4 vengono aggiunte o detratte dall'importo totale dei diritti accertati. Esse vengono riportate nelle contabilità previste dall'articolo 6, paragrafo 3, lettere a) e b), nonché negli estratti previsti dall'articolo 6, paragrafo 4, corrispondenti alle date delle rettifiche stesse.

Corrections carried out under Article 2(4) shall be added to or subtracted from the total amount of established entitlements. They shall be recorded in the accounts as specified in Article 6(3)(a) and (b) and in the statements as specified in Article 6(4) in accordance with the date of these corrections.

Ove le rettifiche riguardino casi di frode e irregolarità già comunicati alla Commissione, il fatto deve essere specificatamente menzionato.

Corrections in respect of cases of fraud and irregularities already notified to the Commission shall be singled out.

1. Secondo le modalità definite dall'articolo 10, le risorse proprie vengono accreditate da ogni Stato membro sul conto aperto a tale scopo a nome della Commissione presso il Tesoro o l'organismo da esso designato.

1. In accordance with the procedure laid down in Article 10, each Member State shall credit own resources to the account opened in the name of the Commission with its Treasury or the body it has appointed.

Tale conto è esente da spese.

This account shall be kept free of charge.

2. Le somme iscritte sono convertite dalla Commissione e riportate nella sua contabilità in euro, ai sensi del regolamento (Euratom, CECA, CE) n. 3418/93(12).

2. The amounts credited shall be converted by the Commission and entered in its accounts in euro in accordance with Regulation (Euratom, ECSC, EC) No 3418/93(12).

1. Dopo la deduzione del 10 % a titolo di spese di riscossione in applicazione dell'articolo 3, paragrafo 3, della decisione 94/728/CE, , Euratom, l'iscrizione delle risorse proprie, di cui all'articolo 2, paragrafo 1, lettere a) e b), della summenzionata decisione, ha luogo entro il primo giorno feriale dopo il 19 del secondo mese successivo a quello in cui il diritto è stato constatato in conformità dell'articolo 2 del presente regolamento.

1. After deduction of 10 % by way of collection costs in accordance with Article 2(3) of 94/728/EC, Euratom, entry of the own resources referred to in Article 2(1)(a) and (b) of that Decision shall be made at the latest on the first working day following the 19th day of the second month following the month during which the entitlement was established in accordance with Article 2 of this Regulation.

Tuttavia, per i diritti contemplati nella contabilità separata conformemente all'articolo 6, paragrafo 3, lettera b), l'iscrizione deve aver luogo entro il primo giorno feriale dopo il 19 del secondo mese successivo a quello della riscossione dei diritti.

However, for entitlements shown in separate accounts under Article 6(3)(b) of the entry must be made at the latest on the first working day following the 19th day of the second month following the month in which the entitlements were recovered.

2. If necessary, Member States may be invited by the Commission to bring forward by one month the entering of resources other than VAT resources and the additional resource on the basis of the information available to them on the 15th of the same month.

Each entry brought forward shall be adjusted the following month when the entry mentioned in paragraph 1 is made. This adjustment shall entail the negative entry of an amount equal to that given in the entry brought forward.

3. L'iscrizione delle risorse IVA, della risorsa complementare, escluso un importo corrispondente alla riserva monetaria del Fondo europeo agricolo di orientamento e garanzia (FEAOG), alla riserva relativa alle operazioni di prestito e di garanzia sui prestiti ed alla riserva per gli aiuti d'urgenza, ed, eventualmente, dei contributi finanziari PNL, è effettuata il primo giorno feriale di ogni mese, e ciò in ragione di un dodicesimo degli importi risultanti a tale titolo dal bilancio, convertito nelle rispettive monete nazionali ai tassi di cambio dell'ultimo giorno di quotazione dell'anno civile precedente l'esercizio finanziario, quale pubblicato nella Gazzetta ufficiale delle Comunità europee, serie C.

3. VAT resources, the additional resource - excluding an amount corresponding to the EAGGF (European Agricultural Guidance and Guarantee Fund) monetary reserve, to the reserve relating to loans and loan guarantees and to the reserve for emergency aid - and, where appropriate, GNP financial contributions shall be credited on the first working day of each month, the amounts being one-twelfth of the relevant totals in the budget, converted into national currencies at the rates of exchange of the last day of quotation of the calendar year preceding the budget year, as published in the Official Journal of the European Communities, "C" Series.

Per le esigenze specifiche del pagamento delle spese del FEAOG, sezione "garanzia", a titolo del regolamento (CEE) n. 1765/92 e in funzione della tesoreria comunitaria, gli Stati membri possono essere invitati dalla Commissione ad anticipare di uno o due mesi, nel primo trimestre dell'esercizio di bilancio, l'iscrizione di un dodicesimo o di una frazione di dodicesimo degli importi previsti in bilancio a titolo delle risorse IVA e/o delle risorse complementare, escluse le risorse proprie previste per la riserva monetaria FEAOG, per la riserva per le garanzie ai prestiti e per la riserva per gli aiuti d'urgenza.

For the specific needs of paying EAGGF Gurantee Section expenditure, pursuant to Regulation (EEC) No 1765/92 and depending on the Community's cash position, Member States may be invited by the Commission to bring forward by one or two months in the first quarter of the financial year the entry of one-twelfth or a fraction of one-twelfth of the amounts in the budget for VAT resources and/or the additional resource, but excluding own resources to cover the EAGGF monetary reserve, the reserve for loan guarantees and the reserve for emergency aid.

Trascorso il primo trimestre, l'iscrizione mensile richiesta non può superare un dodicesimo delle risorse IVA e PNL, sempre nei limiti degli importi iscritti in bilancio a questo titolo.

After the first quarter, the monthly entry requested may not exceed one-twelfth of VAT and GNP-based resources, while remaining within the limit of the amounts entered in the budget for that purpose.

La Commissione ne informa preventivamente gli Stati membri al più tardi due settimane prima dell'iscrizione richiesta.

The Commission shall notify the Member States thereof in advance, no later than two weeks before the entry requested.

Alle iscrizioni anticipate si applicano le disposizioni relative all'iscrizione del mese di gennaio di ogni anno, di cui all'undicesimo comma, e le disposizioni applicabili quando il bilancio non è stato definitivamente adottato prima dell'inizio dell'esercizio, di cui al dodicesimo comma.

The eleventh subparagraph concerning the amount to be entered in January each year and the twelfth subparagraph applicable if the budget has not been finally adopted before the beginning of the financial year shall apply to these advance entries.

L'iscrizione relativa alla riserva monetaria FEAOG di cui all'articolo 6 della decisione 94/728/CE, , Euratom, alla riserva relativa alle operazioni di prestito e di garanzia sui prestiti e alla riserva per gli aiuti d'urgenza, istituite con la decisione 94/729, /CE, viene effettuata il primo giorno feriale del mese successivo a quello dell'iscrizione in bilancio delle spese interessate, in misura corrispondente all'importo di dette spese, qualora l'iscrizione abbia luogo prima del 16 del mese. In caso contrario l'iscrizione ha luogo il primo giorno feriale del secondo mese successivo all'iscrizione in bilancio.

The entry in respect of the EAGGF monetary reserve referred to in Article 6 of 94/728/EC, the reserve relating to loans and loan guarantees and the emergency aid reserve created by 94/729/EC, shall be made on the first working day of the month following the charging to the budget of the expenditure concerned and shall be limited to the said expenditure if charging is effected before the 16th day of the month. If such is not the case, the entry shall be made on the first working day of the second month after charging.

In deroga all'articolo 6 del regolamento finanziario del 21 dicembre 1977, applicabile al bilancio generale delle Comunità europee(13), in appresso denominato "regolamento finanziario", tali iscrizioni vengono prese in considerazione a titolo dell'esercizio in questione.

By way of derogation from Article 6 of the Financial Regulation of 21 December 1977 applicable to the general budget of the European Communities(13), hereinafter referred to as "the Financial Regulation", these entries shall be taken into account in the financial year to which they relate.

Tuttavia, se la situazione dell'esecuzione del bilancio dell'esercizio è tale che le iscrizioni relative alla riserva monetaria FEAOG ed alla riserva per gli aiuti d'urgenza non sono necessarie per garantire l'equilibrio fra le spese e le entrate dell'esercizio, la Commissione rinuncia totalmente o parzialmente a tali iscrizioni.

However, if the situation as regards the implementation of the budget of the financial year is such that the entries relating to the EAGGF monatary reserve and the reserve for emergency aid are not necessary to achieve a balance between revenue and expenditure for the year, the Commission shall decide to dispense with these entries or part of these entries.

Ogni modifica del tasso uniforme delle risorse IVA, della correzione a favore del Regno Unito e del suo finanziamento di cui all'articolo 5 della decisione 94/728/CE, , Euratom, nonché del tasso della risorsa complementare o, se del caso, dei contributi finanziari PNL, deve essere motivata dall'adozione definitiva di un bilancio rettificativo o suppletivo e dà luogo al ritocco dei dodicesimi iscritti dopo l'inizio dell'esercizio.

Any change in the uniform rate of VAT resources, in the correction granted to the United Kingdom and in its financing referred to in Article 5 of 94/728/EC, Euratom in the rate of the additional resource and, where appropriate, in the GNP financial contributions shall require the final adoption of a supplementary or amending budget and shall give rise to readjustements of the twelfths which have been entered since the beginning of the financial year.

Questi ritocchi sono effettuati in occasione della prima iscrizione successiva all'adozione definitiva del bilancio rettificativo o suppletivo, se tale adozione è intervenuta prima del 16 del mese. In caso contrario, i ritocchi vengono effettuati in occasione della seconda iscrizione successiva all'adozione definitiva di cui sopra. In deroga all'articolo 6 del regolamento finanziario, questi ritocchi sono contabilizzati a titolo dell'esercizio del bilancio rettificativo o suppletivo in questione.

These readjustments shall be carried out when the first entry is made following the final adoption of the amending or supplementary budget if it is adopted before the 16th of the month. Otherwise they shall be carried out when the second entry following final adoption is made. By way of derogation from Article 6 of the Financial Regulation, these readjustments shall be entered in the accounts in respect of the financial year of the supplementary of amending budget in question.

I dodicesimi relativi all'iscrizione del mese di gennaio di ciascun esercizio sono calcolati alla base delle somme, ad esclusione di quelle destinate al finanziamento della riserva monetaria FEAOG, previste dal progetto di bilancio di cui all'articolo 78, paragrafo 3, del trattato CECA, all'articolo 272, paragrafo 3, del trattato CE e all'articolo 177, paragrafo 3, del trattato CEEA e convertiti in moneta nazionale ai tassi di cambio del primo giorno di quotazione dopo il 15 dicembre dell'anno civile precedente l'esercizio finanziario. La regolarizzazione di tali importi viene effettuata in occasione dell'iscrizione relativa al mese successivo.

Calculation of the twelfths for January of each financial year shall be based on the amounts provided for in the draft budget, with the exception of the amounts for financing the EAGGF monetary reserve, referred to in Article 78(3) of the ECSC Treaty, Article 272(3) of the EC Treaty and Article 177(3) of the EAEC Treaty and converted into national currencies at the rates of exchange of the first day of quotation following 15 December of the calendar year preceding the budget year; the adjustment shall be made with the entry for the following month.

Qualora il bilancio non sia stato adottato definitivamente prima dell'inizio dell'esercizio, il primo giorno feriale di ogni mese, compreso il mese di gennaio, gli Stati membri iscrivono un dodicesimo degli importi previsti nell'ultimo bilancio definitivamente adottato a titolo delle risorse IVA e della risorsa complementare - ad esclusione degli importi destinati al finanziamento della riserva monetaria FEAOG - e eventualmente dei contributi finanziari PNL; la regolarizzazione viene effettuata al momento della prima scadenza successiva all'adozione definitiva del bilancio se questa è intervenuta prima del 16 del mese. In caso contrario, essa viene effettuata alla seconda scadenza successiva all'adozione definitiva del bilancio.

If the budget has not been finally adopted before the beginning of the financial year, the Member States shall enter on the first working day of each month, including January, one-twelfth of the amount of VAT own resources, of the additional resource, with the exception of the amounts for financing the EAGGF monetary reserve, and, where appropriate, of the GNP financial contributions entered in the last budget finally adopted; the adjustment shall be made on the first due date following final adoption of the budget if it is adopted before the 16th of the month. Otherwise, the adjustment shall be made on the second due date following final adoption of the budget.

4. Sulla base dellestratto annuo della base delle risorse IVA di cui all'articolo 7, paragrafo 1 del regolamento (CEE, Euratom) n. 1553/89, a ciascuno Stato membro è addebitato l'importo risultante dall'applicazione ai dati che figurano in detto estratto del tasso uniforme adottato per l'esercizio precedente e sono accreditate le dodici iscrizioni effettuate nel corso di detto esercizio. Tuttavia la base delle risorse IVA di uno Stato membro a cui viene applicato il tasso di cui sopra non può superare le percentuali fissate all'articolo 2, paragrafo 1, lettera c), della decisione 94/728/CE, , Euratom, conformemente al paragrafo 7, prima frase, del presente articolo. La Commissione calcola il saldo e lo comunica agli Stati membri con un anticipo sufficiente perché essi possano iscriverlo sul conto di cui all'artitolo 9, paragrafo 1, del presente regolamento il primo giorno feriale del mese di dicembre dello stesso anno.

4. Each Member State shall, on the basis of the annual statement on the VAT resources base provided for in Article 7(1) of Regulation (EEC, Euratom) No 1553/89, be debited with an amount calculated from the information contained in the said statement by applying the uniform rate adopted for the previous financial year and credited with the 12 payments made during that financial year. However each Member State's VAT own resources base to which the above rate is applied may not exceed the percentages determined by Article 2(1)(c) of 94/728/EC, Euratom as referred to in the first sentence of paragraph 7 of this Article. The Commission shall work out the balance and shall inform the Member States in time for them to enter it in the account referred to in Article 9(1) of this Regulatoin on the first working day of December of the same year.

5. La Commissione procede successivamente al calcolo delle rettifiche dei contributi finanziari in modo da ristabilire, alla luce dell'ammontare effettivo del gettito delle risorse IVA, la ripartizione iniziale esistente nel bilancio tra queste ultime e i contributi finanziari PNL. Ai fini del calcolo di dette rettifiche, i saldi di cui al paragrafo 4 sono convertiti in euro ai tassi di cambio in vigore il primo giorno feriale successivo al 15 novembre che precede le iscrizioni di cui allo stesso paragrafo 4. Alla somma dei saldi delle risorse IVA è applicato, per ciascuno Stato membro interessato, il rapporto tra i contributi finanziari da versare iscritti nel bilancio e le risorse IVA. I risultati di tale calcolo sono comunicati dalla Commissione agli Stati membri che nel corso dell'esercizio precedente hanno versato contributi finanziari PNL, affinché essi possano iscrivere, secondo i casi, a credito o a debito del conto di cui all'articolo 9, paragrafo 1, il primo giorno feriale del mese di dicembre dello stesso anno.

5. The Commission shall then calculate adjustments to the financial contributions so as to restore, in the light of the actual yield from VAT resources, the original distribution in the budget between the latter and the GNP financial contributions. For the calculation of these adjustments, the balances referred to in paragraph 4 shall be converted into euro at the rates of exchange applying on the first working day after 15 November preceding the entries provided for in paragraph 4. For each Member State concerned, the total of VAT balances shall be adjusted by the ratio between the financial contributions entered in the budget and the VAT resources. The Commission shall communicate the results of this calculation to the Member States which, during the previous financial year, paid GNP financial contributions so that they can make a credit or debit entry as appropriate in the account referred to in Article 9(1) on the first working day of December of the same year.

6. Le eventuali rettifiche della base delle risorse IVA di cui all'articolo 9, paragrafo 1, del regolamento (CEE, Euratom) n. 1553/89 danno luogo, per ciascuno Stato membro interessato la cui base non superi le percentuali fissate all'articolo 2, paragrafo 1, lettera c), della decisione 94/728/CE, , Euratom, tenuto conto di queste rettifiche, ad una rettifica del saldo calcolato in applicazione del paragrafo 4 del presente articolo, alle seguenti condizioni:

Any corrections to the VAT resources base under Article 9(1) of Regulation (EEC, Euratom) No 1553/89 shall give rise for each Member State concerned whose base, allowing for these corrections, does not exceed the percentages determined by Article 2(1)(c) of 94/728/EC, Euratom to the following adjustments to the balance referred to in paragraph 4 of this Article:

- le rettifiche di cui all'articolo 9, paragrafo 1, primo comma, del regolamento (CEE, Euratom) n. 1553/89 effettuate entro il 31 luglio danno luogo ad una rettifica globale la quale deve essere iscritta nel conto di cui all'articolo 9, paragrafo 1, del presente regolamento il primo giorno feriale del mese di dicembre dello stesso anno. Tuttavia una rettifica specifica può essere iscritta prima della data di cui sopra a condizione che lo Stato membro interessato e la Commissione siano d'accordo,

- the corrections under the first subparagraph of Article 9(1) of Regulation (EEC, Euratom) No 1553/89 made by 31 July shall give rise to a general adjustment to be entered in the account referred to in Article 9(1) of this Regulation on the first working day of December of the same year. However a particular adjustment may be entered before that date if the Member State concerned and the Commission are in agreement,

- where the measures which the Commission takes under the second subparagraph of Article 9 (1) of Regulation (EEC, Euratom) No 1553/89 to correct the base lead to an adjustment of the entries in the account referred to in Article 9 (1) of this Regulation, that adjustment shall be made on the date specified by the Commission pursuant to the said measures.

Le modifiche del PNL di cui al paragrafo 8 danno parimenti luogo a una rettifica del saldo di qualunque Stato membro la cui base, tenuto conto delle rettifiche, si riduca alle percentuali fissate all'articolo 2, paragrafo 1, lettera c), della decisione 94/728/CE, , Euratom. Le rettifiche da effettuare sui saldi IVA fino al primo giorno feriale del mese di dicembre di ogni anno in virtù del primo comma del presente paragrafo danno parimenti luogo a rettifiche supplementari dei contributi finanziari PNL ad opera della Commissione. I tassi di cambio da utilizzare per il calcolo di dette rettifiche supplementari sono quelli adottati per il calcolo iniziale di cui al paragrafo 5.

The changes to GNP referred to in paragraph 8 of this Article shall also give rise to an adjustment of the balance of any Member State whose base, allowing for those corrections, is capped at the percentages determined by Article 2(1)(c) of 94/728/EC, Euratom. The adjustments to be made to the VAT balances by the first working day of December of each year under the first suparagraph of this paragraph shall also give rise to the calculation by the Commission of further adjustments to the GNP financial contributions. The exchange rates to be employed in calculating these further adjustments shall be those used for the initial calculation referred to in paragraph 5.

La Commissione comunica le rettifiche agli Stati membri in tempo utile affinché essi possano iscriverle nel conto di cui all'articolo 9, paragrafo 1, il primo giorno feriale del mese di dicembre dello stesso anno.

The Commission shall inform the Member States of these adjustments in time for them to enter them in the account referred to in Article 9(1) on the first working day of December of the same year.

Tuttavia, una rettifica specifica può essere iscritta in qualsiasi momento, a condizione che lo Stato membro e la Commissione siano d'accordo.

However, a particular adjustment may be entered at any time if the Member State concerned and the Commission are in agreement.

7. Sulla base delle cifre per l'aggregato PNL ai prezzi di mercato e le sue componenti per l'esercizio precedente fornite dagli Stati membri in applicazione dell'articolo 3, paragrafo 2, della direttiva 89/130/CEE, Euratom, ad ogni Stato membro è addebitato l'importo risultante dall'applicazione al PNL del tasso utilizzato per l'esercizio precedente e modificato, se del caso, in funzione dell'utilizzazione della riserva monetaria FEAOG, della riserva relativa alle operazioni di prestito e di garanzia su prestiti e della riserva per gli aiuti d'urgenza, nonché sono accreditate le iscrizioni intervenute nel corso di questo esercizio. La Commissione determina l'ammontare del saldo e lo comunica agli Stati membri con un anticipo suficiente affinché essi possano iscriverlo nel conto di cui all'articolo 9, paragrafo 1, del presente regolamento il primo giorno feriale del mese di dicembre dello stesso anno.

7. On the basis of figures for aggregate GNP at market prices and its components from the preceding year, supplied by the Member States in accordance with Article 3(2) of Directive 89/130/EEC, Euratom, each Member State shall be debited with an amount calculated by applying to GNP the rate adopted for the previous financial year, amended, where appropriate, in the light of any use of the EAGGF monetary reserve, of the reserve relating to loans and loan guarantees or of the reserve relating to loans and loan guarantees or of the reserve for emergency aid, and credited with the payments made during that previous financial year. The Commission shall work out the balance and shall inform the Member States in time for them to enter it in the account referred to in Article 9(1) of this Regulation on the first working day of December of the same year.

8. Le eventuali modifiche apportate al PNL degli esercizi precedenti in applicazione dell'articolo 3, paragrafo 2, fatto salvo l'articolo 6 della direttiva 89/130/CEE, Euratom, danno luogo per ogni Stato membro interessato a una rettifica del saldo calcolato in applicazione del paragrafo 7. Questa rettifica è stabilita alle condizioni fissate al paragrafo 6, primo comma. La Commissione comunica le rettifiche dei saldi agli Stati membri affinché essi possano iscriverle nel conto di cui all'articolo 9, paragrafo 1, del presente regolamento il primo giorno feriale del mese di dicembre dello stesso anno. Dopo il 30 settembre del quarto anno successivo a un esercizio determinato, le eventuali modifiche del PNL non sono più prese in considerazione, tranne che per i punti notificati prima di tale scadenza o dalla Commissione o dallo Stato membro.

8. Any changes to the GNP of previous financial years pursuant to Article 3(2) of Directive 89/130/EEC, Euratom, subject to Article 6 thereof, shall give rise for each Member State concerned to an adjustment to the balance established pursuant to paragraph 7. This adjustment shall be established in the manner laid down in the first subparagraph of paragraph 6. The Commission shall inform the Member States of these adjustments so that they can enter them in the account referred to in Article 9(1) of this Regulation on the first working day of December of the same year. After 30 September of the fourth year following a given financial year, any changes to GNP shall no longer be taken into account, except on points notified within this time limit either by the Commission or by the Member State.

Articolo 11

Ogni ritardo nelle iscrizioni sul conto di cui all'articolo 9, paragrafo 1, dà luogo al pagamento, da parte dello Stato membro in questione, di un interesse il cui tasso è pari al tasso di interesse applicato il giorno della scadenza sul mercato monetario dello Stato membro interessato per i finanziamenti a breve termine, maggiorato di 2 punti. Tale tasso è aumentato di 0,25 punti per ogni mese di ritardo. Il tasso così aumentato è applicabile a tutto il periodo del ritardo.

Any delay in making the entry in the account referred to in Article 9(1) shall give rise to the payment of interest by the Member State concerned at the interest rate applicable on the Member State's money market on the due date for short-term public financing operations, increased by two percentage points. This rate shall be increased by 0,25 of a percentage point for each month of delay. The increased rate shall be applied to the entire period of delay.

1. La Commissione dispone delle somme accreditate sui conti previsti all'articolo 9, paragrafo 1, nella misura necessaria per coprire i bisogni di tesoreria derivanti dall'esecuzione del bilancio.

1. The Commission shall draw on the sums credited to the accounts referred to in Article 9(1) to the extent necessary to cover its cash resource requirements arising out of the implementation of the budget.

2. Qualora i bisogni di tesoreria superino gli averi dei conti, la Commissione può effettuare prelievi al di là di tali averi complessivi, sempreché delle somme a credito siano disponibili in bilancio ed entro i limiti delle risorse proprie previste nel bilancio. In questo caso essa informa preliminarmente gli Stati membri dei superamenti prevedibili.

2. If the cash resource requirements are in excess of the assets of the accounts, the Commission may draw in excess of the total of these assets subject to the availability of appropriations in the budget and within the limit of the own resources entered in the budget. In this event, it shall inform the Member States in advance of any foreseeable excess requirements.

3. In the sole case of default under a loan contracted or guaranteed pursuant to Council regulations and decisions, in circumstances in which the Commission cannot activate other measures provided for by the financial arrangements applying to these loans in time to ensure compliance with the Community's legal obligations to the lenders, paragraphs 2 and 4 may provisionally be applied, irrespective of the conditions in paragraph 2, in order to service the Community's debts.

4. The difference between the overall assets and the cash resource requirements shall be divided among the Member States, as far as possible, in proportion to the estimated budget revenue from each of them.

5. Gli Stati membri o l'organismo da essi designato conformemente all'articolo 9, paragrafo 1, sono tenuti a eseguire gli ordini di pagamento della Commissione quanto prima, comunque non oltre i sette giorni feriali successivi alla ricezione degli ordini, e a inviare un estratto conto alla Commissione entro un termine di sette giorni feriali da ciascuna operazione.

5. The Member States, or the body designated by them in accordance with Article 9(1), shall execute the Commission's payment orders as quickly as possible, and within not more than seven working days of receipt, and shall send the Commission a statement of account within not more than seven working days of completing each transaction.

Tuttavia, per le operazioni relative a movimenti di tesoreria, gli Stati membri devono eseguire gli ordini entro i termini chiesti dalla Commissione.

However, in the case of cash movement transactions, the Member States shall execute the orders within the period requested by the Commission.

Articolo 13

Article 13

1. Il presente articolo si applica qualora sia necessario ricorrere alle deroghe provvisorie previste dall'articolo 2, paragrafo 7, della decisione 88/376, /CEE, Euratom.

1. This Article shall apply where it may be neccessary to implement the provisional derogation provided for in Article 2(7) of Decision 88/376/EEC, Euratom.

2. Il PNL ai prezzi di mercato viene calcolato dall'Istituto statistico delle Comunità europee in base alle statistiche elaborate secondo il sistema europeo dei conti economici integrati (SEC) e corrispondenti, per ciascuno Stato membro, alla media aritmetica dei primi tre anni del quinquennio precedente (esercizio per il quale si applica l'articolo 2, paragrafo 7, della decisione 88/376, /CEE, Euratom. Non si tiene invece conto delle eventuali revisioni dei dati statistici intervenute dopo l'adozione del bilancio definitivo.

2. The GNP at market prices shall be calculated by the Statistical Office of the European Communities, on the basis of statistics prepared according to the European System of Integrated Economic Accounts (ESA), and corresponding, for each Member State, to the arithmetic mean of the first three years of the five-year period preceding the financial year in respect of which the provisions of Article 2(7) of Decision 88/376/EEC, Euratom have been applied. No account shall be taken of any revisions of statistical data made after the final adoption of the budget.

3. Il PNL par ciascun anno di riferimento è calcolato in euro sulla base del tasso medio dell'euro dell'anno preso in considerazione.

3. The GNP for each reference year shall be calculated in terms of the euro on the basis of the average rate of the euro for the year in question.

For such time as the derogation provided for in Article 2(7) of Decision 88/376/EEC, Euratom applies to one or more Member States, the Commission shall, in its preliminary draft budget, fix the percentage corresponding to the financial contributions of those Member States on the basis of the proportion of their GNP to the sum total of the GNPs of the Member States, and shall determine the amount of that part of the budget to be financed by VAT resources at the uniform rate and by the GNP financial contributions.

In mancanza di dette cifre, l'Istituto statistico delle Comunità europee utilizza i dati di cui dispone.

The figures to be used in calculating the precentage of the GNP financial contributions shall be those supplied pursuant to Article 3(2) of Directive 89/130/EEC, Euratom, and subject to Article 6 thereof. In the absence of such figures the Statistical Office of the European Communities shall use the data available.

Qualora appaiano, rispetto alle previsioni iniziali, delle differenze consistenti, queste costituiscono oggetto di una lettera rettificativa al progetto preliminare di bilancio dell'esercizio successivo oppure di un bilancio rettificativo e suppletivo all'esercizio in corso.

Any appreciable differences in relation to original estimates may give rise to a letter of amendment to the preliminary draft budget for the following financial year or a supplementary and amending budget for the current financial year.

Per le operazioni di cui all'articolo 10, paragrafi da 4 a 8, l'importo delle entrate che figura nel bilancio dell'esercizio in corso può essere aumentato o ridotto, mediante bilancio rettificativo, degli importi risultanti da tali operazioni.

For the operations referred to in Article 10(4) to (8), the amount of revenue set out in the budget for the current financial year may be increased or reduced, by means of an amending budget, by the amount resulting from those operations.

Provisions concerning inspection measures

Articolo 17

Article 17

1. Gli Stati membri sono tenuti a prendere tutte le misure necessarie affinché gli importi corrispondenti ai diritti accertati in conformità dell'articolo 2 siano messi a disposizione della Commissione alle condizioni previste dal presente regolamento.

1. Member States shall take all requisite measures to ensure that the amount corresponding to the entitlements established under Article 2 are made available to the Commission as specified in this Regulation.

2. Gli Stati membri sono dispensati dall'obbligo di mettere a disposizione della Commissione gli importi corrispondenti ai diritti accertati soltanto se la riscossione non abbia potuto essere effettuata per ragioni di forza maggiore. Inoltre, in casi particolari, gli Stati membri sono dispensati dal mettere tali importi a disposizione della Commissione, quando, dopo attento esame di tutti i dati pertinenti del caso, risulta definitivamente impossibile procedere alla riscossione per motivi che non potrebbero essere loro imputabili. Questi casi debbono essere menzionati nella relazione di cui al paragrafo 3, qualora gli importi superino i 10000 EUR, convertiti in moneta nazionale al tasso nel primo giorno feriale del mese d'ottobre dell'anno civile appena trascorso; questa relazione deve contenere un'indicazione delle ragioni che hanno indotto lo Stato membro a non mettere a disposizione gli importi di cui trattasi. La Commissione dispone di un termine di sei mesi per comunicare, se del caso, le proprie osservazioni allo Stato membro interessato.

2. Member States shall be free from the obligation to place at the disposal of the Commission the amounts corresponding to established entitlements soley if, for reasons of force majeure, these amounts have not been collected. In addition, Member States may disregard this obligation to make such amounts available to the Commission in specific cases if, after thorough assesment of all the relevant circumstances of the individual case, it appears that recovery is impossible in the long term for reasons which cannot be attributed to them. These cases must be mentioned in the report provided for in paragraph 3 if the amounts exceed EUR 10000, converted into national currency at the rate applying on the first working day of October of the previous calendar year; this report must contain an indication of the reasons why the Member State was unable to make available the amounts in question. The Commission has six months in which to forward, if appropriate, its comments to the Member State concerned.

3. Gli Stati membri comunicano alla Commissione, mediante una relazione annuale, l'attività e i risultati dei loro controlli nonché i dati complessivi e le questioni di principio attinenti ai problemi più importanti sollevati, in particolare sul piano del contenzioso, dall'applicazione del presente regolamento. Questa relazione è trasmessa alla Commissione entro il 30 aprile dell'anno successivo all'esercizio in questione.

3. Member States shall inform the Commission, by means of annual reports, of the details and results of their inspections and of the overall data and questions of principle concerning the most important problems arising out of the application of this Regulation and, in particular, matters in dispute. The reports shall be sent to the Commission by 30 April of the year following the financial year in question.

Il modello di tale relazione, nonché le sue modifiche debitamente giustificate, è definito dalla Commissione previa consultazione del Comitato di cui all'articolo 20. Se del caso sono previsti opportuni termini di applicazione.

A specimen of the report and duly substantiated amendments thereto shall be drawn up by the Commission after consulting the Committee referred to in Article 20. Any appropriate time limits for implementation shall be provided for.

Entro il 30 giugno dell'anno che segua l'esercizio di cui al primo comma, seconda frase, la Commissione trasmette al Parlamento europeo e al Consiglio una relazione nella quale fa una sintesi delle comunicazioni degli Stati membri a titolo del presente articolo e dell'articolo 6, paragrafo 5.

By 30 June of the year following the financial year referred to in the second sentence of paragraph 1 the Commission shall send to the European Parliament and to the Council a summary report on the notifications by the Member States under this Article and Article 6(5).

Gli Stati membri procedono a tutte le verifiche e indagini necessarie nel campo dell'accertamento e della messa a disposizione delle risorse proprie di cui all'articolo 2, paragrafo 1, lettere a) e b), della decisione 94/728/CE, , Euratom. La Commissione esercita le sue competenze alle condizioni previste dal presente articolo.

1. Member States shall conduct the checks and enquiries concerning the establishment and the making available of the own resources referred to in Article 2(1)(a) and (b) of 94/728/EC, Euratom. The Commission shall exercise its powers as specified in this Article.

2. In pursuance of paragraph 1, Member States shall:

Gli Stati niembri prendono tutte le misure atte a facilitare i controlli suddetti. Quando la Commissione vi è associata, gli Stati membri tengono a sua disposizione i documenti giustificativi di cui all'articolo 3.

Member States take all steps required to facilitate these inspection measures. Where the Commission is associated with these measures, Member States shall place at its disposal the supporting documents referred to in Article 3.

Al fine di limitare per quanto possibile i controlli supplementari:

In order to restrict additional inspection measures to the minimum:

a) la Commissione può chiedere, per dei casi specifici, che le vengano trasmessi determinati documenti;

(a) the Commission may, in specific cases, request that certain documents be forwarded to it;

b) nell'estratto conto mensile di cui all'articolo 6, paragrafo 4, si dovranno indicare con annotazioni specifiche gli importi contabilizzati relativi alle irregolarità o ai ritardi in materia di accertamento, contabilizzazione e messa a disposizione emersi nel corso dei controlli di cui sopra.

(b) in the monthly statement of accounts referred to in Article 6(4), the amounts entered in the accounts which relate to irregularities or delays in the establishment, entry in the accounts and making available of own resources, discovered during the inspections referred to above, must be identified by means of appropriate notes.

3. Fatte salve le disposizioni di cui ai paragrafi 1 e 2, la Commissione stessa può procedere a verifiche in loco. Gli agenti incaricati dalla Commissione di effettuare tali verifiche hanno accesso, qualora ciò sia necessario per la corretta applicazione del presente regolamento, ai documenti giustificativi di cui all'articolo 3 e a qualsiasi altro documento appropriato ad essi relativo. Mediante comunicazione debitamente motivata, ta Commissione avverte in tempo utile lo Stato membro presso il quale sarà effettuata la verifica. Agenti dello Stato membro interessato possono partecipare alle verifiche.

3. Without prejudice to paragraphs 1 and 2, the Commission may itself carry out inspection measures on the spot. The agents authorised by the Commission for such inspection measures shall have access, in so far as the correct application of this Regulation so requires, to the supporting documents referred to in Article 3 and to any other appropriate document connected with those supporting documents. In a duly substantiated communication, the Commission shall give notice of this inspection in good time to the Member State in which the inspection measure is to take place. Agents of the Member State concerned shall participate in such inspection measures.

4. I controlli di cui a paragrafi 1, 2 e 3 non pregiudicano:

4. The inspection measures referred to in paragraphs 1, 2 and 3 shall not prejudice:

a) i controlli effettuati dagli Stati membri in conformità delle loro disposizioni legislative, regolamentari ed amministrative;

(a) the inspection measures undertaken by Member States in accordance with their own provisions laid down by law, regulation or administrative action;

b) le misure previste agli articoli 246, 247, 248 e 276 del trattato CE e agli articoli 160 A, 160 B, 160 C e 180 ter del trattato CEEA;

(b) the measures provided for in Articles 246, 247, 248 and 276 of the EC Treaty and Articles 160a, 160b, 160c and 180b of the EAEC Treaty;

c) i controlli organizzati in virtù dell'articolo 279, lettera c), del trattato CE e dell'articolo 183, lettera c), del trattato CEEA.

(c) the inspection arrangements made pursuant to Article 279(c) of the EC Treaty and Article 183(c) of the EAEC Treaty.

5. Ogni tre anni, la Commissione riferisce al Parlamento europeo e al Consiglio in merito al funzionamento del sistema di controllo.

5. The Commission shall report every three years to the European Parliament and to the Council on the functioning of the inspection arrangements.

Articolo 19

Article 19

Insieme allo Stato membro interessato, la Commissione esamina annualmente gli aggregati trasmessi per controllare eventuali errori di rilevamento, in particolare nei casi indicati in seno al comitato di gestione del PNL. A tal fine, in casi specifici essa può esaminare calcoli e statistiche di base - ad eccezione delle informazioni relative a determinate persone fisiche o giuridiche -, qualora altrimenti non fosse possibile un giudizio equo e realistico. La Commissione è tenuta a rispettare le disposizioni nazionali in materia di segreto statistico.

Together with the Member State concerned, the Commission shall each year inspect the aggregates provided for errors in compilation, especially in cases nofified by the GNP management committee. In doing so it may, in individual cases, also examine calculations and basic statistics, apart from information about individual companies or persons, where no proper assessment would otherwise be possible. The Commission shall respect national legal provisions on the preservation of the confidentiality of statistics.

1. È istituito un comitato consultivo delle risorse proprie, in appresso denominato "comitato".

1. An Advisory Committee on the Communities' own resources, hereinafter called the committee, is hereby set up.

2. Il comitato è composto di rappresentanti degli Stati membri e della Commissione. Ciascuno Stato membro è rappresentato nel comitato da cinque funzionari al massimo.

2. The committee shall consist of representatives of the Member States and of the Commission. Each Member State shall be represented on the committee by not more than five officials.

Il comitato è composto da un rappresentante della Commissione. Il segretariato del comitato è assicurato dai sevizi della Commissione.

The chairman of the committee shall be a representative of the Commission. The secretariat services for the committee shall be provided by the Commission.

3. Il comitato stabilisce il proprio regolamento interno.

1. Il comitato esamina i problemi concernenti l'applicazione del presente regolamento che sono sollevati dal suo presidente, di propria iniziativa o su richiesta del rappresentante di uno Stato membro, in particolare per quanto concerne:

1. The committee shall examine the questions raised by its chairman on his initiative or at the request of the representative of a Member State which concern the application of this Regulation, especially as regards:

a) le informazioni e le comunicazioni di cui all'articolo 4, paragrafo 1, lettera b), agli articoli 6 e 7 e all'articolo 17, paragrafo 3;

(a) the information and reports referred to in Articles 4(1)(b), 6, 7 and 17(3);

b) i casi di forza maggiore di cui all'articolo 17, paragrafo 2;

(b) the cases of force majeure referred to in Article 17(2);

c) i controlli e gli esami di cui all'articolo 18, paragrafo 2.

(c) the inspection measures laid down in Article 18(2).

Inoltre, il comitato esamina le previsioni delle risorse proprie.

The committee shall also examine estimates of own resources.

2. Su domanda del presidente, il comitato, entro un termine che il presidente può fissare in funzione dell'urgenza della questione, formula il suo parere, eventualmente procedendo a votazione. Il parere è iscritto a verbale; ogni Stato membro ha inoltre il diritto di chiedere che la sua posizione figuri a verbale. La Commissione tiene in massima considerazione il parere formulato dal comitato. Essa lo informa del modo in cui ha tenuto conto del suo parere.

2. At the request of the chairman, the committee shall deliver its opinion within a time limit which the chairman may lay down accordning to the urgency of the matter in hand, if necessary by taking a vote. The opinion shall be recorded in the minutes; in addition, each Member State shall have the right to ask to have its position recorded in these minutes. The Commission shall take the utmost account of the opinion delivered by the committee. It shall inform the committee of the manner in which its opinion has been taken into account.

Il regolamento (CEE, Euratom) n. 1552/89 è abrogato.

Regulation (EEC, Euratom) No 1552/89 shall be repealed.

I riferimenti al suddetto regolamento devono intendersi come fatti al presente regolamento e devono essere letti secondo la tabella di corrispondenza che figura all'allegato, parte A.

References to the said Regulation shall be construed as references to this Regulation and should be read in accordance with the correlation table set out in Part A of the Annex.

Il presente regolamento entra in vigore il giorno della sua pubblicazione nella Gazzetta ufficiale delle Comunità europee.

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Communities.

Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
