| considerando che determinati compiti relativi all'attuazione e, in particolare, il potere di emendare alcuni aspetti degli allegati settoriali sono stati attribuiti al comitato misto istituito dall'accordo; | Whereas certain tasks for implementation have been attributed to the Joint Committee established by the Agreement, and in particular the power to amend certain aspects of the Sectoral Annexes thereto; |
| considerando che occorrerebbe istituire le procedure interne adeguate per garantire il corretto funzionamento dell'accordo e che è necessario delegare alla Commissione il potere di procedere a taluni emendamenti tecnici dell'accordo e di emanare talune decisioni per la sua attuazione, | Whereas the appropriate internal procedures should be established to ensure the proper functioning of the Agreement, and whereas it is necessary to empower the Commission to make certain technical amendments to the Agreement and to take certain decisions for its implementation, |

| È approvato, a nome della Comunità, l'accordo sul reciproco riconoscimento tra la Comunità europea e gli Stati Uniti d'America, ivi compresi i suoi allegati. | The Agreement on Mutual Recognition between the European Community and the United States of America, including its Annexes, is hereby approved on behalf of the Community. |
| Il testo dell'accordo e degli allegati è accluso alla presente decisione. | The text of the Agreement and the Annexes thereto is attached to this Decision. |

| Il presidente del Consiglio trasmette, a nome della Comunità, la lettera di cui all'articolo 21, paragrafo 1 dell'accordo (1). | The President of the Council shall, on behalf of the Community, transmit the letter provided for in Article 21(1) of the Agreement (1). |

| 1. La Commissione, assistita dal comitato speciale designato dal Consiglio, rappresenta la Comunità in seno al comitato misto previsto dall'articolo 14 dell'accordo e in seno ai comitati misti settoriali istituiti dagli allegati settoriali. La Commissione procede, previa consultazione con il suddetto comitato speciale, alle designazioni, alle notifiche, allo scambio di informazioni e alle richieste di verifica di cui agli articoli 10, lettera b), 12, 13 e 14, paragrafo 2 dell'accordo e alle disposizioni corrispondenti dei suoi allegati settoriali. | 1. The Commission shall represent the Community in the Joint Committee provided for in Article 14 of the Agreement, and in the Joint Sectoral Committees established by the Sectoral Annexes, assisted by the special committee designated by the Council. The Commission shall proceed, after consultation with this special committee, to the appointments, notifications, exchange of information and the requests for verifications referred to in Articles 10(b), 12, 13, and 14(2) of the Agreement and the equivalent provisions of its Sectoral Annexes. |
| 2. La posizione della Comunità per quanto riguarda le decisioni che il comitato misto o, se del caso, i comitati misti settoriali devono adottare è determinata in relazione agli emendamenti degli allegati settoriali (articolo 14, paragrafo 4, lettera b) e articoli 7, 8 e 9 dell'accordo e le disposizioni corrispondenti dei suoi allegati settoriali) e la verifica dell'idoneità a norma dell'articolo 7, lettera d) dell'accordo da parte della Commissione, previa consultazione del comitato speciale di cui al paragrafo 1 del presente articolo. | 2. The position of the Community with regard to decisions to be taken by the Joint Committee or if appropriate in the Joint Sectoral Committees shall be determined, with regard to amendments of the Sectoral Annexes (Article 14(4)(b), and Articles 7, 8 and 9 of the Agreement and the equivalent provisions of its Sectoral Annexes), and verification of compliance in accordance with Article 7(d) of the Agreement, by the Commission, following consultation of the special committee, referred to in paragraph 1 of this Article. |
| 3. In tutti gli altri casi, la posizione della Comunità nel comitato misto o nei comitati misti settoriali è stabilita dal Consiglio, che delibera a maggioranza qualificata su proposta della Commissione. La stessa procedura si applica alle decisioni adottate dalla Comunità nell'ambito degli articoli 16 e 21 dell'accordo. | 3. In all other cases the position of the Community in the Joint Committee or Joint Sectoral Committees shall be determined by the Council, acting by qualified majority on a proposal from the Commission. The same procedure shall apply to decisions taken by the Community in the framework of Articles 16 and 21 of the Agreement. |
