| IL CONSIGLIO DELL'UNIONE EUROPEA, | THE COUNCIL OF THE EUROPEAN UNION, |
| visto il trattato sull'Unione europea, in particolare l'articolo 14, | Having regard to the Treaty on European Union, and in particular Article 14 thereof, |
| con riferimento all'articolo 18, paragrafo 2 dello stesso; | Recalling Article 18(2) thereof, |
| considerando quanto segue: | Whereas: |
| (1) Nell'ambito del ruolo costante e attivo svolto dall'Unione europea nel promuovere il processo di pace in Medio Oriente, il Consiglio ha adottato il 29 aprile 1997 l'azione comune 97/289/PESC sull'istituzione di un programma di assistenza dell'Unione europea per sostenere l'Autorità palestinese nei suoi sforzi per contrastare le attività terroristiche organizzate nei territori sotto il suo controllo(1). | (1) In pursuit of the European Union's active and continued role in promoting the Middle East Peace Process, the Council adopted on 29 April 1997 Joint Action 97/289/CFSP on the establishment of a European Union assistance programme to support the Palestinian Authority in its efforts to counter terrorist activities emanating from the territories under its control(1). |
| (2) La decisione 1999/440/PESC(2) ha prorogato l'azione comune 97/289/PESC e ha stabilito che essa sarà riesaminata entro il 30 giugno 2000 in vista dell'eventuale adozione di un programma pluriennale. | (2) Decision 1999/440/CFSP(2) extended Joint Action 97/289/CFSP and provided for it to be reviewed no later than 30 June 2000 with a view to the possible adoption of a multiannual programme. |
| (3) I risultati del riesame intermedio dell'azione comune 97/289/PESC e della valutazione effettuata a seguito di una visita della Troika nella regione hanno confermato che il programma di assistenza dell'Unione rappresenta un importante contributo al conseguimento dell'obiettivo perseguito dall'Unione di sostenere l'Autorità palestinese nei suoi sforzi per contrastare le attività terroristiche. | (3) The results of the mid-term review of Joint Action 97/289/CFSP and of the evaluation carried out following a Troika visit to the region confirmed that the European Union's assistance programme makes an important contribution to the objectives pursued by the European Union in supporting the Palestinian Authority in its efforts to counter terrorist activities. |
| (4) La prosecuzione dell'attuazione delle suddette varie iniziative è ritenuta importante per il conseguimento degli obiettivi perseguiti dall'Unione. | (4) Continuity in the implementation of these several activities is deemed important in order to achieve the objectives pursued by the European Union. |
| (5) Il 26 ottobre 1998 il Consiglio ha esteso il mandato del rappresentante speciale dell'Unione per il processo di pace in Medio Oriente, al fine di includervi le questioni inerenti alla sicurezza. È pertanto importante assicurare il coordinamento e la coerenza dell'azione dell'Unione. | (5) On 26 October 1998 the Council extended the mandate of the EU Special Representative for the Middle East Peace Process (MEPP), to include security questions; in such circumstances it is important to ensure coordination and coherence of the European Union approach. |
| (6) Il Consiglio ha ribadito il 24 gennaio 2000 il permanente impegno dell'Unione nel capitolo palestinese del processo di pace in Medio Oriente e il suo appoggio all'Autorità palestinese. | (6) On 24 January 2000 the Council reiterated the European Union's continued commitment to the Palestinian track of the Middle East Peace Process and its support of the Palestinian Authority. |
| (7) È pertanto opportuno adottare un programma pluriennale e determinare un importo di riferimento finanziario per il periodo coperto da tale programma. | (7) It is, therefore, appropriate to adopt a multiannual programme and to establish a financial reference amount for the period covered by this programme. |
| (8) L'azione comune 97/289/PESC e la decisione 1999/440/PESC dovrebbero essere abrogate e sostituite con una nuova azione comune. | (8) Joint Action 97/289/CFSP and Decision 1999/440/CFSP should be repealed and replaced by a new Joint Action. |
| (9) Un importo di riferimento finanziario, ai sensi del punto 34 dell'accordo interistituzionale del 6 maggio 1999 tra il Parlamento europeo, il Consiglio e la Commissione sulla disciplina di bilancio e il miglioramento della procedura di bilancio(3), dovrebbe essere inserito nella presente azione comune, per tutta la durata del programma, senza che ciò incida sulle competenze dell'autorità di bilancio, definite dal trattato che istituisce la Comunità europea, | (9) A financial reference amount, within the meaning of point 34 of the Interinstitutional Agreement of 6 May 1999 between the European Parliament, the Council and the Commission on budgetary discipline and improvement of the budgetary procedure(3) should be inserted in this Joint Action for the whole duration of the programme, without prejudice to the competences of the budgetary authority defined in the Treaty establishing the European Community, |
| HA ADOTTATO LA PRESENTE AZIONE COMUNE: | HAS ADOPTED THIS JOINT ACTION: |
| Articolo 1 | Article 1 |
| 1. Il programma di assistenza dell'Unione europea per sostenere l'Autorità palestinese (AP) nei suoi sforzi per contrastare le attività terroristiche organizzate nei territori sotto il suo controllo, istituito dall'azione comune 97/289/PESC (in prosieguo: "il programma"), è prorogato per un periodo di tre anni. | 1. The European Union assistance programme to support the Palestinian Authority (PA) in its efforts to counter terrorist activities emanating from the territories under its control, established by Joint Action 97/289/CFSP (hereinafter referred to as "the programme") shall be extended for a period of three years. |
| 2. Scopo del programma è sostenere la capacità della AP di contrastare il terrorismo, assisterla nell'istituzione di strutture amministrative palestinesi in questo settore, contribuire a rafforzare il processo di pace in Medio Oriente nonché fornire ai competenti servizi di sicurezza e polizia assistenza e formazione pienamente compatibili con i principi dei diritti dell'uomo e il rispetto dello Stato di diritto. | 2. The objective of the programme is to support the PA's capacity to counter terrorism, assist in the establishment of related Palestinian administrative structures, help sustain the Middle East Peace Process and provide the relevant security and police services with assistance and training that are fully compatible with the principles of human rights and respect for the rule of law. |
| Articolo 2 | Article 2 |
| 1. Il programma consiste in singoli progetti realizzati nei seguenti settori principali: | 1. The programme shall consist of individual projects carried out in the following main areas: |
| a) migliore capacità organizzativa, | (a) improved organisational capacity; |
| b) migliore capacità operativa, | (b) improved operational capacity; and |
| c) gestione della fase successiva agli incidenti. | (c) post-incident management. |
| 2. Il Consiglio prende atto che la Commissione intende dirigere la propria azione verso il raggiungimento degli obiettivi e delle priorità della presente azione comune, in particolare nel campo dei diritti dell'uomo, mediante le pertinenti misure comunitarie. | 2. The Council notes that the Commission intends to direct its actions towards achieving the objectives and priorities of this Joint Action, notably in the field of human rights, by pertinent Community measures. |

| Le decisioni specifiche relative all'attuazione dei singoli progetti sono prese dalla presidenza, visto il parere di un comitato presieduto dalla presidenza e composto di esperti antiterrorismo degli Stati membri. Tale parere può essere trasmesso mediante procedura scritta semplificata. La Commissione è associata pienamente ai lavori del comitato. | Specific implementing decisions regarding individual projects shall be taken by the Presidency, in the light of the opinion of a Committee chaired by the Presidency and composed of anti-terrorism experts from the Member States. Such opinion may be collected by simplified written procedure. The Commission shall be associated fully to the work of this Committee. |

| 1. Il consulente dell'Unione europea nominato a norma dell'azione comune 97/289/PESC (in prosieguo: "consulente dell'UE") è confermato nelle sue mansioni a norma della presente azione comune. Egli continua a soprintendere all'attuazione del programma e a monitorare l'uso appropriato delle capacità fornite dall'Unione europea ai fini dell'attuazione dell'articolo 2, paragrafo 1, fatta salva la revisione di cui all'articolo 7, paragrafo 3. | 1. The European Union adviser appointed under Joint Action 97/289/CFSP (hereinafter referred to as the "EU adviser") is confirmed in his tasks under this Joint Action. He shall continue to oversee the implementation of the programme and monitor the proper use of European Union-provided capabilities for the purposes of implementing Article 2(1), without prejudice to the review mentioned in Article 7(3). |
| 2. Il consulente dell'UE opera sotto la guida della presidenza e riferisce al Consiglio o ai suoi servizi competenti, sotto l'autorità della presidenza, periodicamente e in caso di necessità. | 2. The EU adviser shall be guided by the Presidency and shall report, under the Presidency's authority, to the Council or its designated instances on a regular basis and as the need arises. |
| 3. Al fine di assicurare la coerenza dell'azione dell'Unione a sostegno del processo di pace in Medio Oriente, in particolare nel campo della cooperazione in materia di sicurezza, la presidenza, assistita dal Segretario generale/Alto rappresentante, provvede al coordinamento tra le attività del consulente dell'Unione europea e quelle del rappresentante speciale dell'Unione europea per il processo di pace in Medio Oriente. | 3. In order to ensure coherence of European Union action in support of the MEPP, in particular in the field of security cooperation, the Presidency, assisted by the Secretary-General/High Representative, shall ensure coordination between the activities of the European Union adviser and the European Union Special Representative for the MEPP. |
| 4. La presidenza, assistita dal Segretario generale/Alto rappresentante, e la Commissione, ciascuna nell'ambito delle proprie competenze, assicurano l'adeguato coordinamento tra il programma, l'assistenza comunitaria e l'assistenza bilaterale fornita dagli Stati membri. Gli Stati membri collaborano con la presidenza e la Commissione a tal fine. | 4. The Presidency, assisted by the Secretary-General/High Representative, and the Commission, within the scope of their respective competences, shall ensure appropriate coordination between the programme, Community assistance and the bilateral assistance provided by the Member States. Member States shall cooperate with the Presidency and the Commission to that end. |
| Articolo 5 | Article 5 |
| 1. L'importo di riferimento finanziario per l'attuazione della presente azione comune è di 10 milioni di EUR. L'autorità di bilancio stabilisce l'ammontare degli stanziamenti autorizzati per ciascun esercizio finanziario, nei limiti delle prospettive finanziarie. | 1. The financial reference amount for the implementation of this Joint Action shall be EUR 10 million. The budgetary authority shall establish the amount of the credits authorised for each financial year, within the limits of the financial perspectives. |
| 2. Le spese finanziate con l'importo di cui al paragrafo 1 sono gestite nel rispetto delle procedure e norme della Comunità europea applicabili in materia di bilancio. | 2. The expenditure financed by the amount stipulated in paragraph 1 shall be managed in accordance with the European Community procedures and rules applicable to the budget. |
| 3. L'Unione europea finanzia l'infrastruttura e le spese correnti del consulente dell'UE, compresa la sua retribuzione e le spese per il personale. | 3. The European Union shall finance the infrastructure and current expenditure of the EU adviser, including his salary and the cost of his staff. |

| 1. I privilegi, le immunità e ulteriori garanzie necessarie per il compimento e il regolare svolgimento del programma d'assistenza e del consulente dell'UE e del suo personale sono definiti con le parti. Gli Stati membri e la Commissione concedono tutto il sostegno necessario a tale scopo. | 1. The privileges, immunities and further guarantees necessary for the completion and smooth functioning of the programme and of the EU adviser and his international staff shall be defined with the parties. The Member States and the Commission shall grant all necessary support to that effect. |
| 2. Il Consiglio prende atto che la presidenza, la Commissione e gli Stati membri, a seconda dei casi, forniscono il supporto logistico nell'area. | 2. The Council notes that the Presidency, Commission and Member States, as appropriate, shall provide support in the region. |
| Articolo 7 | Article 7 |
| 1. In fasi concordate verranno condotte valutazioni periodiche. | 1. Periodic evaluations shall be conducted at agreed stages. |
| 2. Il programma sarà sospeso se l'AP: | 2. The programme shall be suspended if the PA fails: |
| a) non coopera pienamente all'attuazione del programma; | (a) to cooperate fully in the implementation of the programme; |
| b) non prende le misure necessarie ad assicurare il rispetto dei diritti umani nell'attuazione del programma; | (b) to take appropriate measures to ensure respect for human rights in the implementation of the programme; |
| c) non consente all'Unione europea di effettuare il controllo e/o le valutazioni esterne periodiche a tal fine. | (c) to allow European Union monitoring and/or periodic external evaluations to that effect. |
| 3. Gli aspetti operativi, amministrativi e finanziari del programma sono riveduti una volta l'anno e in caso di necessità. | 3. The operational, administrative and financial aspects of the programme shall be reviewed on a yearly basis and whenever the need arises. |
| Articolo 8 | Article 8 |
| 1. L'azione comune 97/289/PESC e la decisione 1999/440/PESC sono abrogate e sostituite dalla presente azione comune. | 1. Joint Action 97/289/CFSP and Decision 1999/440/CFSP are hereby repealed and replaced by this Joint Action. |
| 2. Fatto salvo il paragrafo 1, i progetti intrapresi a norma dell'azione comune 97/289/PESC prorogata dalla decisione 1999/440/PESC continuano ad essere attuati nel quadro della presente azione comune. | 2. Notwithstanding paragraph 1, projects undertaken under Joint Action 97/289/CFSP, as extended by Decision 1999/440/CFSP, shall continue to be implemented within the framework of this Joint Action. |
| Articolo 9 | Article 9 |
| La presente azione comune entra in vigore alla data dell'adozione. | This Joint Action shall enter into force on the day of its adoption. |

| La presente azione comune è pubblicata nella Gazzetta ufficiale. | This Joint Action shall be published in the Official Journal. |
