visto il trattato sull'Unione europea, in particolare l'articolo 28, paragrafo 1,

Having regard to the Treaty on European Union and in particular Article 28(1),

(1) Il Consiglio europeo di Helsinki aveva convenuto, in linea di principio, di istituire un comitato politico e di sicurezza e, sulla base di tali conclusioni, la decisione 2000/143/PESC del Consiglio(1) ha istituito un comitato politico e di sicurezza ad interim.

(1) The European Council in Helsinki agreed in principle to set up a Political and Security Committee and, on the basis of these conclusions, an interim Political and Security Committee was set up by Council Decision 2000/143/CFSP(1).

(2) Il Consiglio europeo riunitosi a Nizza il 7-11 dicembre 2000 ha raggiunto un accordo sull'istituzione del comitato politico e di sicurezza permanente e ne ha stabilito il ruolo, le modalità e le funzioni.

(2) The European Council in Nice of 7 to 11 December 2000 reached agreement on the establishment of the permanent Political and Security Committee, setting out its role, modalities and functions.

(3) In osservanza degli orientamenti del Consiglio europeo di Nizza, il comitato dovrebbe essere messo in grado di avviare i suoi lavori.

(3) Following the guidelines of the Nice European Council, this Committee should be made ready to start its work.

Articolo 1

Article 1

È istituito un comitato politico e di sicurezza (CPS) in seguito denominato "il comitato", in quanto formazione permanente del comitato di cui all'articolo 25 del trattato.

A Political and Security Committee (PSC) (hereinafter the Committee) shall be established as the standing formation of the Committee referred to in Article 25 of the Treaty.

Il ruolo, le modalità e le funzioni del comitato sono definiti nell'allegato, che riproduce l'allegato III della relazione della presidenza approvata al Consiglio europeo di Nizza.

The role, modalities and functions of the Committee are defined in the Annex, which reproduces Annex III to the Presidency's report approved by the Nice European Council.

COMITATO POLITICO E DI SICUREZZA

POLITICAL AND SECURITY COMMITTEE

In base all'approccio adottato a Helsinki, il CPS è il fulcro della politica europea in materia di sicurezza e di difesa (PESD) e della politica estera e di sicurezza comune (PESC): "Il CPS tratterà tutte le questioni relative alla PESC, compresa la PESD ...". Il CPS svolge un ruolo centrale nel definire e controllare la risposta dell'UE a una crisi, fatto salvo l'articolo 207 del trattato che istituisce la Comunità europea.

The approach adopted at Helsinki makes the PSC the linchpin of the European security and defence policy (ESDP) and of the common foreign and security policy (CFSP): "The PSC will deal with all aspects of the CFSP, including the CESDP...". Without prejudice to Article 207 of the Treaty establishing the European Community, the PSC has a central role to play in the definition of and follow-up to the EU's response to a crisis.

Il CPS svolge tutti i compiti di cui all'articolo 25 del trattato sull'Unione europea (TUE). Può riunirsi a livello dei direttori politici.

The PSC will deal with all the tasks defined in Article 25 of the Treaty on European Union (TEU). It may convene in Political Director formation.

Il segretario generale/alto rappresentante per la PESC, dopo aver consultato la presidenza, può, fatto salvo l'articolo 18 del TUE, presiedere il CPS, segnatamente in caso di crisi.

After consulting the Presidency and without prejudice to Article 18 of the TEU, the Secretary-General/High Representative for the CFSP may chair the PSC, especially in the event of a crisis.

1. Il CPS dovrà in particolare:

1. In particular the PSC will:

a) seguire la situazione internazionale nei settori che rientrano nella politica estera e di sicurezza comune, contribuire a definire le politiche formulando "pareri" per il Consiglio, a richiesta di questo o di propria iniziativa, e sorvegliare l'attuazione delle politiche concordate, sempre fatti salvi l'articolo 207 del trattato che istituisce la Comunità europea e le competenze della presidenza e della Commissione;

(a) keep track of the international situation in the areas falling within the common foreign and security policy, help define policies by drawing up "opinions" for the Council, either at the request of the Council or on its own initiative, and monitor implementation of agreed policies, all of this without prejudice to Article 207 of the Treaty establishing the European Community and to the powers of the Presidency and of the Commission;

b) esaminare, nell'ambito delle sue competenze, i progetti di conclusioni del CAG;

(b) examine the areas of GAC draft conclusions in which it is involved;

c) fornire agli altri comitati orientamenti sulle materie che rientrano nella PESC;

(c) provide guidelines for other Committees on matters falling within the CFSP;

d) essere un interlocutore privilegiato del segretario generale/alto rappresentante e dei rappresentanti speciali;

(d) maintain a privileged link with the Secretary-General/High Representative (SG/HR) and the special representatives;

e) fornire orientamenti al comitato militare, che gli offre consulenze e raccomandazioni. Il presidente del comitato militare (EUMC), che funge da interfaccia con lo Stato maggiore dell'Unione europea (EUMS), partecipa, se del caso, alle riunioni del CPS;

(e) send guidelines to the Military Committee; receive the opinions and recommendations of the Military Committee. The Chairman of the Military Committee (EUMC), who liaises with the European Union Military Staff (EUMS), takes part, where necessary, in PSC meetings;

f) ricevere informazioni, raccomandazioni e consulenze dal comitato sugli aspetti civili della gestione delle crisi e fornire a quest'ultimo orientamenti sulle materie di competenza della PESC;

(f) receive information, recommendations and opinions from the Committee for Civilian Aspects of Crisis Management and send it guidelines on matters falling within the CFSP;

g) coordinare, controllare e sorvegliare i lavori svolti nel settore della PESC dai vari gruppi di lavoro, cui potrà fornire orientamenti e di cui dovrà esaminare le relazioni;

(g) coordinate, supervise and monitor discussions on CFSP issues in various Working Parties, to which it may send guidelines and whose reports it must examine;

h) svolgere il dialogo politico al suo livello e nelle forme previste dal trattato;

(h) lead the political dialogue in its own capacity and in the forms laid down in the Treaty;

i) essere l'organo privilegiato di dialogo sulla PESD con i 15 e i 6 nonché con la NATO, secondo le modalità stabilite nei documenti pertinenti;

(i) provide a privileged forum for dialogue on the ESDP with the fifteen and the six as well as with NATO in accordance with arrangements set out in the relevant documents;

j) assumersi, sotto l'autorità del Consiglio, la responsabilità della direzione politica dello sviluppo delle capacità militari, tenendo conto della natura delle crisi cui l'Unione intende reagire. Nell'ambito dello sviluppo delle capacità militari, il CPS disporrà della consulenza del comitato militare assistito dallo Stato maggiore dell'Unione europea.

(j) under the auspices of the Council, take responsibility for the political direction of the development of military capabilities, taking into account the type of crisis to which the Union wishes to respond. As part of the development of military capabilities, the PSC will receive the opinion of the Military Committee assisted by the European Military Staff.

2. In periodo di crisi, inoltre, il CPS è l'organo del Consiglio che tratta le situazioni di crisi ed esamina tutte le opzioni praticabili per la risposta dell'Unione, nel quadro istituzionale unico e fatte salve le procedure decisionali e di applicazione proprie di ciascun pilastro. Pertanto il Consiglio, i cui lavori sono predisposti dal Coreper, e la Commissione sono gli unici competenti, ciascuno nella sfera delle sue competenze e secondo le procedure stabilite dai trattati, a adottare decisioni giuridicamente vincolanti. La Commissione esercita le sue competenze, compreso il potere di iniziativa, ai sensi dei trattati. Il Coreper svolge il ruolo affidatogli dall'articolo 207 del trattato che istituisce la Comunità europea e dall'articolo 19 del regolamento interno del Consiglio. A tale effetto il CPS lo interpella in tempo utile.

2. Furthermore, in the event of a crisis the PSC is the Council body which deals with crisis situations and examines all the options that might be considered as the Union's response within the single institutional framework and without prejudice to the decision-making and implementation procedures of each pillar. Thus the Council, whose preparatory work is carried out by Coreper, and the Commission alone have powers, each within their own areas of competence and in accordance with procedures laid down by the Treaties, to take legally-binding decisions. The Commission exercises its responsibility, including its power of initiative under the Treaties. Coreper exercises the role conferred on it by Article 207 of the Treaty establishing the European Community and by Article 19 of the Council's Rules of Procedure. To that end, it will be informed in good time by the PSC.

In situazione di crisi è particolarmente necessario uno stretto coordinamento tra detti organi, che sarà effettuato mediante:

In a crisis situation, close coordination between these bodies is especially necessary and will be ensured in particular by:

a) la partecipazione del presidente del CPS alle riunioni del Coreper se del caso;

(a) the participation, where necessary, of the Chairman of the PSC in Coreper meetings;

b) il ruolo svolto dai consiglieri per le relazioni esterne, incaricati di mantenere un coordinamento efficiente e permanente tra i lavori della PESC e quelli effettuati in altri pilastri (allegato delle conclusioni del Consiglio dell'11 maggio 1992).

(b) the role of the Foreign Relations Counsellors whose task it is to maintain effective permanent coordination between CFSP discussions and those conducted in other pillars (Annex to the Council conclusions of 11 May 1992).

Per predisporre la risposta dell'UE alle crisi, spetta al CPS proporre al Consiglio gli obiettivi politici che l'Unione deve perseguire, nonché raccomandare un insieme coerente di opzioni intese a contribuire alla soluzione della crisi. Esso può elaborare, in particolare, una consulenza per raccomandare al Consiglio di adottare un'azione comune. Fatto salvo il ruolo della Commissione, esso sorveglia l'attuazione delle misure decise e ne valuta gli effetti. La Commissione informa il CPS delle misure che ha adottato o intende adottare. Gli Stati membri informano il CPS delle misure che hanno adottato o che intendono adottare a livello nazionale.

To prepare the EU's response to a crisis, it is for the PSC to propose to the Council the political objectives to be pursued by the Union and to recommend a cohesive set of options aimed at contributing to the settlement of the crisis. In particular it may draw up an opinion recommending to the Council that it adopt a joint action. Without prejudice to the role of the Commission, it supervises the implementation of the measures adopted and assesses their effects. The Commission informs the PSC of the measures it has adopted or is envisaging. The Member States inform the PSC of the measures they have adopted or are envisaging at the national level.

Il CPS assicura il controllo politico e la direzione strategica della risposta militare dell'UE alla crisi. A tal fine valuta in particolare, in base alle consulenze e alle raccomandazioni del comitato militare, le componenti fondamentali (opzioni militari strategiche, tra cui gerarchia, concetto operativo, piano operativo) da presentare al Consiglio.

The PSC exercises "political control and strategic direction" of the EU's military response to the crisis. To that end, on the basis of the opinions and recommendations of the Military Committee, it evaluates in particular the essential elements (strategic military options including the chain of command, operation concept, operation plan) to be submitted to the Council.

Il CPS svolge un ruolo importante nell'intensificarsi delle consultazioni, segnatamente con la NATO e i paesi terzi interessati.

The PSC plays a major role in enhancing consultations, in particular with NATO and the third States involved.

Il segretario generale/alto rappresentante indirizza le attività della cellula di crisi in base ai lavori del CPS. Questa sostiene il CPS e gli fornisce le informazioni in condizioni adeguate alla gestione delle crisi.

On the basis of the proceedings of the PSC, the Secretary-General/High Representative directs the activities of the Situation Centre. The latter supports the PSC and provides it with intelligence in conditions appropriate to crisis management.

Per consentire al CPS di assicurare pienamente "il controllo politico e la direzione strategica" di un'operazione militare di gestione delle crisi, saranno adottate le seguenti disposizioni:

The following arrangements will be put in place to enable the PSC to ensure full "political control and strategic direction" of a military crisis-management operation:

a) in previsione dell'avvio di un'operazione, il CPS rivolge al Consiglio una raccomandazione, in base alle consulenze del Comitato militare, secondo le procedure consuete di preparazione del Consiglio. Il Consiglio decide su questa base di avviare l'operazione nell'ambito di un'azione comune;

(a) with a view to launching an operation the PSC sends the Council a recommendation based on the opinions of the Military Committee in accordance with the usual Council preparation procedures. On that basis the Council decides to launch the operation within the framework of a joint action;

b) l'azione comune stabilisce, in particolare, ai sensi degli articoli 18 e 26 del TUE, il ruolo del segretario generale/alto rappresentante nell'attuazione delle misure che rientrano nel "controllo politico e nella direzione strategica" assicurati dal CPS. Per dette misure il segretario generale/alto rappresentante agisce su parere conforme del CPS. Qualora fosse ritenuta necessaria una nuova decisione del Consiglio, si potrebbe ricorrere alla procedura scritta semplificata (articolo 12, paragrafo 4, del regolamento interno del Consiglio);

(b) in accordance with Articles 18 and 26 of the TEU, the joint action will determine, in particular, the role of the Secretary-General/High Representative in the implementation of the measures falling within the "political control and strategic direction" exercised by the PSC. For such measures the Secretary-General/High Representative acts with the PSC's assent. Should a new Council decision be deemed appropriate, the simplified written procedure could be used (Article 12(4) of the Council's Rules of Procedure);

c) durante l'operazione si dovrà rendere conto al Consiglio mediante relazioni del CPS presentate dal segretario generale/alto rappresentante quale presidente del comitato stesso.

(c) during the operation, the Council will be kept informed through PSC reports presented by the Secretary-General/High Representative in his capacity as Chairman of the PSC.
