Whereas:

(1) Nel mercato interno l'applicazione effettiva, uniforme ed efficiente del diritto comunitario è essenziale per il funzionamento dei sistemi di imposizione, in particolare per proteggere gli interessi finanziari nazionali e comunitari mediante la lotta contro l'elusione e l'evasione fiscale, la prevenzione di distorsioni della concorrenza e la riduzione degli oneri imposti alle amministrazioni e ai contribuenti. Assicurare tale applicazione effettiva, uniforme ed efficiente del diritto comunitario spetta alla Comunità, in collaborazione con gli Stati membri.

(1) In the internal market, the effective, uniform and efficient application of Community law is essential for the functioning of taxation systems, in particular for the protection of national and Community financial interests through combating tax evasion and tax avoidance, avoiding distortions of competition and reducing burdens on administrations and taxpayers. Achieving this effective, uniform and efficient application is a matter for the Community acting in partnership with the Member States.

(2) La decisione n. 888/98/CE del Parlamento europeo e del Consiglio, del 30 marzo 1998, recante adozione di un programma d'azione comunitario inteso a migliorare i sistemi di imposizione indiretta nel mercato interno (programma Fiscalis)(4) ha contribuito in modo significativo al conseguimento dei suddetti obiettivi globali per il periodo dal 1998 al 2002. Si ritiene pertanto opportuno proseguire la realizzazione del programma Fiscalis per un altro quinquennio.

(2) Decision No 888/98/EC of the European Parliament and the Council of 30 March 1998 establishing a programme of Community action to ameliorate the indirect taxation systems of the internal market (Fiscalis programme)(4) has significantly contributed to the achievement of those overall objectives for the period 1998 to 2002. It is therefore considered desirable to continue the Fiscalis programme for another five-year period.

(3) Una cooperazione ampia, efficiente ed effettiva tra gli Stati membri attuali e futuri e tra gli stessi e la Commissione è importante ai fini del funzionamento dei sistemi di imposizione nel mercato interno.

(3) Efficient, effective and extensive cooperation among the present and future Member States and between them and the Commission is important for the functioning of the taxation systems in the internal market.

(4) L'esperienza acquisita dalla Comunità nell'ambito del programma Fiscalis ha dimostrato che gli scambi, i seminari e le operazioni di controllo multilaterali hanno consentito di raggiungere gli obiettivi del programma, riunendo funzionari di diverse amministrazioni nazionali nel quadro di attività professionali. Dette attività dovrebbero quindi essere proseguite, ma anche estese alle imposte sul reddito, sul patrimonio e sui premi assicurativi.

(4) The experience gained by the Community from the Fiscalis programme has shown that exchanges, seminars and multilateral control exercises could achieve the objectives of the programme by bringing officials from different national administrations together in professional activities. Those activities should therefore be continued, but extended to cover taxes on income, on capital and on insurance premiums.

(5) La creazione e il funzionamento di un'infrastruttura di comunicazione e di scambio di informazioni sono essenziali per il rafforzamento dei sistemi di imposizione nella Comunità. In particolare il sistema di scambio di informazioni sull'IVA (VIES), di cui al regolamento (CEE) n. 218/92 del Consiglio, del 27 gennaio 1992, concernente la cooperazione amministrativa nel settore delle imposte indirette (IVA)(5), ha dimostrato l'utilità dell'informatica per preservare le entrate e nel contempo limitare al massimo gli oneri amministrativi.

(5) The establishment and functioning of a communication and information exchange infrastructure has a vital part to play in reinforcing the taxation systems within the Community. In particular, the VAT information exchange system (VIES), referred to in Council Regulation (EEC) No 218/92 of 27 January 1992 on administrative cooperation in the field of indirect taxation (VAT)(5), has shown the value of information technology in protecting revenue whilst minimising administrative burdens.

(6) Ai fini dell'applicazione uniforme del diritto comunitario, è essenziale un elevato livello comune di comprensione del diritto comunitario stesso, e della sua applicazione negli Stati membri attuali e futuri, da parte dei funzionari delle amministrazioni fiscali. Tale livello può essere raggiunto soltanto tramite un'efficace formazione iniziale e permanente fornita dagli Stati membri attuali e futuri. Per coordinare e incoraggiare questa formazione è utile un'azione comunitaria supplementare.

(6) In order to ensure uniform application of Community law, it is essential that officials responsible for taxation have a high common standard of understanding of Community law and its implementation in the present and future Member States. Such a standard can be achieved only through effective initial and continuing training provided by the present and future Member States. Supplementary Community action is useful to coordinate and foster such training.

(7) L'esperienza acquisita nell'ambito del programma Fiscalis indica che l'elaborazione e l'attuazione coordinate di un programma comune di formazione hanno consentito di raggiungere gli obiettivi del programma, in particolare un livello comune più elevato di comprensione del diritto comunitario.

(7) The experience gained from the Fiscalis programme has indicated that the coordinated development and implementation of a common training programme could attain the objectives of this programme, in particular by achieving a higher common standard of understanding of Community law.

(8) L'acquisizione di un livello sufficiente di conoscenze linguistiche da parte dei funzionari delle amministrazioni fiscali è risultata essenziale ai fini di una migliore cooperazione. È quindi opportuno che gli Stati partecipanti offrano la necessaria formazione linguistica ai propri funzionari.

(8) A sufficient standard of linguistic competence on the part of taxation officials has proved to be essential to facilitate cooperation. Participating countries should therefore provide the necessary language training for their officials.

(9) Sebbene la responsabilità principale nel raggiungimento di questi obiettivi spetti agli Stati partecipanti, è necessaria un'azione comunitaria supplementare per coordinare tali attività nonché per fornire un'infrastruttura e l'impulso necessario. Poiché gli scopi delle misure previste dalla presente decisione non possono essere sufficientemente realizzati dagli Stati membri e possono dunque, a motivo delle dimensioni e degli effetti dell'azione in questione, essere realizzati meglio a livello comunitario, la Comunità può intervenire, in base al principio di sussidiarietà sancito dall'articolo 5 del trattato. La presente decisione si limita a quanto è necessario per conseguire tali scopi in ottemperanza al principio di proporzionalità enunciato nello stesso articolo.

(9) Although the primary responsibility for achieving these objectives rests with the participating countries, supplementary Community action is needed for the coordination of such activities as well as for the provision of an infrastructure and the necessary stimulus. Since the objectives of the measures laid down in this Decision cannot all be sufficiently achieved by the participating countries and can therefore, by reason of the scale and the effect of the action, be better achieved at Community level, the Community may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. In accordance with the principle of proportionality, as set out in that Article, this Decision does not go beyond what is necessary in order to achieve those objectives.

(10) La presente decisione fissa, per l'intera durata del programma, una dotazione finanziaria che costituisce il riferimento privilegiato, ai sensi del punto 33 dell'accordo interistituzionale del 6 maggio 1999 tra il Parlamento europeo, il Consiglio e la Commissione sulla disciplina di bilancio e il miglioramento della procedura di bilancio(6).

(10) This Decision lays down, for the entire duration of the programme, a financial framework constituting the prime reference, within the meaning of point 33 of the Interinstitutional Agreement of 6 May 1999 between the European Parliament, the Council and the Commission on budgetary discipline and improvement of the budgetary procedure(6), for the budgetary authority during the annual budgetary procedure.

1. Un programma d'azione comunitario pluriennale (Fiscalis 2003-2007), denominato in appresso "programma", è istituito per il periodo 1o gennaio 2003-31 dicembre 2007, allo scopo di migliorare il funzionamento dei sistemi di imposizione nel mercato interno.

1. A multiannual Community action programme (Fiscalis 2003 to 2007), hereinafter referred to as "the programme", is hereby established for the period 1 January 2003 to 31 December 2007 to improve the operation of the taxation systems in the internal market.

(f) any other working meetings, visits or similar activities in the context of the programme's objectives as stated in Article 3 which shall be decided on a case-by-case basis in accordance with the procedure referred to in Article 14(2).

Ai fini della presente decisione si intende per:

For the purpose of this Decision:

a) "imposizione", le seguenti imposte applicate nei paesi partecipanti:

(a) "taxation" shall mean the following taxes applied in the participating countries:

i) imposta sul valore aggiunto;

(i) value added tax;

ii) accise su alcole, tabacchi lavorati e oli minerali;

(ii) excise duties on alcohol and tobacco products and mineral oils;

iii) imposte sul reddito e sul patrimonio come definite all'articolo 1, paragrafo 2, della direttiva 77/799/CEE del Consiglio, del 19 dicembre 1977, relativa alla reciproca assistenza fra le autorità competenti degli Stati membri nel settore delle imposte dirette(8);

(iii) taxes on income and on capital as defined in Article 1(2) of Council Directive 77/799/EEC of 19 December 1977 concerning mutual assistance by the competent authorities of the Member States in the field of direct taxation(8);

iv) imposte sui premi assicurativi come definite all'articolo 3 della direttiva 76/308/CEE del Consiglio, del 15 marzo 1976, sull'assistenza reciproca in materia di recupero dei crediti risultanti da taluni contributi, dazi, imposte ed altre misure(9);

(iv) taxes on insurance premiums as defined in Article 3 of Council Directive 76/308/EEC of 15 March 1976 on mutual assistance for the recovery of claims relating to certain levies, duties, taxes and other measures(9);

b) "amministrazione", le autorità pubbliche dei paesi partecipanti competenti per l'imposizione;

(b) "administration" shall mean the public authorities in the participating countries responsible for administering taxation;

c) "paesi partecipanti", gli Stati membri e i paesi di cui all'articolo 4 che partecipano effettivamente al programma;

(c) "participating countries" shall mean the Member States and the countries referred to in Article 4, which effectively participate in the programme;

d) "funzionario", un funzionario dell'amministrazione;

(d) "official" shall mean an official of the administration;

e) "scambio", un soggiorno di lavoro, organizzato nell'ambito del programma, effettuato da un funzionario di un'amministrazione in un altro paese partecipante;

(e) "exchange" shall mean a working visit organised under the programme of an official from an administration in another participating country;

f) "controllo multilaterale", un controllo coordinato dell'obbligazione tributaria di uno o più soggetti passivi collegati, organizzato da più paesi partecipanti, sulla base di un interesse comune o complementare.

(f) "multilateral control" shall mean a coordinated control of the tax liability of one or more related taxable persons, which is organised by several participating countries and has a common or complementary interest.

Articolo 3

Obiettivi

Objectives

1. L'obiettivo globale del programma è quello di migliorare il funzionamento dei sistemi di imposizione nel mercato interno accrescendo la cooperazione tra i paesi partecipanti, le loro amministrazioni e i loro funzionari.

1. The overall objective of the programme shall be to improve the proper functioning of the taxation systems in the internal market by increasing cooperation between participating countries, their administrations and officials.

iii) garantire il costante miglioramento delle procedure amministrative per tener conto delle esigenze delle amministrazioni e dei contribuenti attraverso lo sviluppo e la diffusione di buone pratiche amministrative;

(iii) to ensure the continuing improvement of administration procedures to take account of the needs of administrations and taxpayers through the development and dissemination of good administrative practice;

3. Il piano d'azione del programma è stabilito annualmente secondo la procedura di cui all'articolo 14, paragrafo 2.

a) dei paesi associati dell'Europa centrale e orientale, secondo quanto stabilito negli accordi europei, nei loro protocolli aggiuntivi e nelle decisioni dei rispettivi Consigli di associazione;

(a) the associated countries of central and eastern Europe, in accordance with the conditions laid down in the Europe Agreements, in the additional Protocols thereto and in the decisions of the respective Association Councils;

b) di Cipro, di Malta e della Turchia, sulla base degli accordi bilaterali in materia conclusi con detti paesi.

(b) Cyprus, Malta and Turkey, on the basis of bilateral agreements on this matter concluded with these countries.

Sistemi di comunicazione e di scambio di informazioni

Communications and information-exchange systems

1. La Commissione e i paesi partecipanti assicurano il funzionamento dei seguenti sistemi di comunicazione e di scambio di informazioni nella misura in cui il loro funzionamento sia necessario secondo la legislazione comunitaria:

1. The Commission and the participating countries shall ensure that the following communications and information-exchange systems are operational in so far as their operation is necessary under Community legislation:

a) Common Communications Network/Common Systems Interface (CCN/CSI) nella misura necessaria per sostenere il funzionamento degli altri sistemi elencati nel presente paragrafo;

(a) the common communications network/common systems interface (CCN/CSI) to the extent necessary to support the functioning of the other systems referred to in this paragraph;

b) il sistema di scambio di informazioni sull'IVA (VIES) e i relativi sistemi di comunicazione;

(b) the VAT information exchange system (VIES) and its messaging systems;

c) il sistema di verifica del movimento delle accise;

(c) the excise movement verification system;

d) il sistema di informazione preventiva per le accise;

(d) the early-warning system for excise;

e) il sistema di tabelle sulle accise;

(e) the excise duty tables system;

f) qualsiasi altro nuovo sistema di comunicazione e di scambio di informazioni designato secondo la procedura di cui all'articolo 14, paragrafo 2, quando la legislazione comunitaria ne richieda l'introduzione.

(f) any other new communication and information-exchange systems designated in accordance with the procedure referred to in Article 14(2), when Community legislation requires them to be introduced.

2. Gli elementi comunitari dei sistemi di comunicazione e di scambio d'informazioni comprendono l'attrezzatura, i programmi per elaboratori e i collegamenti di rete, i quali sono comuni a tutti i paesi partecipanti ai fini dell'interconnessione e dell'interoperabilità dei sistemi, siano essi installati in locali della Commissione (o di un subappaltatore designato), o in locali degli Stati partecipanti (o di un subappaltatore designato). La Commissione conclude i contratti necessari per assicurare il carattere operativo di tali elementi per conto della Comunità.

2. The Community components of the communication and information-exchange systems shall be the hardware, software and network connections, which shall be common to all participating countries so as to ensure the interconnection and interoperability of the systems, whether they be installed at the premises of the Commission (or a designated subcontractor) or at the premises of participating countries (or a designated subcontractor). The Commission shall conclude the necessary contracts to assure the operational nature of these components on behalf of the Community.

3. Gli elementi non comunitari dei sistemi di comunicazione e di scambio di informazioni comprendono le basi di dati nazionali che fanno parte di questi sistemi, i collegamenti di rete tra gli elementi comunitari e non comunitari e i programmi per elaboratori e l'attrezzatura che ciascun paese partecipante ritenga necessari per un impiego ottimale di detti sistemi da parte della propria amministrazione. I paesi partecipanti provvedono a mantenere in funzione gli elementi non comunitari e ne assicurano l'interoperabilità con gli elementi comunitari.

3. The non-Community components of the communication and information-exchange systems shall comprise the national databases forming part of these systems, the network connections between the Community and non-Community components and such software and hardware as each participating country shall deem appropriate for the full operation of those systems throughout its administration. The participating countries shall ensure that the non-Community components are kept operational and shall ensure the interoperability of these components with the Community components.

4. La Commissione coordina, in collaborazione con i paesi partecipanti, gli aspetti dell'elaborazione e del funzionamento degli elementi comunitari e non comunitari dei sistemi e dell'infrastruttura di cui al paragrafo 1.

4. The Commission shall coordinate, in cooperation with the participating countries, those aspects of the establishment and functioning of the Community and non-Community elements of the systems and infrastructure referred to in paragraph 1.

I paesi partecipanti scelgono, tra i controlli multilaterali da essi organizzati, quelli per cui la Comunità si assume le spese ai sensi dell'articolo 11. Detti controlli comprendono in ogni caso il controllo dell'obbligazione tributaria per quanto riguarda l'imposta sul valore aggiunto e/o le accise.

Participating countries shall choose, from among the multilateral controls organised by them, those whose costs are to be borne by the Community in accordance with Article 11. Such controls shall include at all events control of the tax liability in respect of value added tax and/or excise duties.

I paesi partecipanti trasmettono alla Commissione relazioni e valutazioni annuali in merito a detti controlli.

The participating countries shall send annual reports and evaluations concerning such controls to the Commission.

Seminars

La Commissione e i paesi partecipanti organizzano in collaborazione tra loro seminari ai quali partecipano funzionari delle amministrazioni, rappresentanti della Commissione e, ove opportuno, altri esperti.

The Commission and the participating countries shall together organise seminars to be attended by officials from the administrations, Commission representatives and, if appropriate, other experts.

Scambi di funzionari

Exchanges of officials

1. La Commissione e i paesi partecipanti organizzano scambi di funzionari. La durata di detti scambi non può essere superiore a un mese. Ogni scambio è dedicato ad una specifica attività professionale e viene sufficientemente preparato e successivamente valutato dai funzionari e dalle amministrazioni interessati. L'amministrazione ospitante può limitare il numero dei partecipanti allo scambio se il volume delle domande di iscrizione ne impedisce la preparazione e l'adeguato funzionamento, a condizione che fornisca le motivazioni di tale limitazione.

1. The Commission and participating countries shall organise exchanges of officials. The length of exchanges may not exceed one month. Each exchange shall be targeted on a particular professional activity and shall be sufficiently prepared and subsequently evaluated by the officials and administrations concerned. Provided that it states its reasons for doing so, the host administration may limit the number of participants in the exchange if the volume of applications received impedes its preparation and proper operation.

2. I paesi partecipanti adottano i provvedimenti necessari affinché i funzionari partecipanti agli scambi siano attivamente coinvolti nelle attività dell'amministrazione ospitante. A tal fine i funzionari in questione sono autorizzati a svolgere le mansioni inerenti alle funzioni loro assegnate dall'amministrazione ospitante, secondo il suo ordinamento giuridico.

2. The participating countries shall take the necessary steps to enable exchange officials to play an effective part in the host administration's activities. To this end, such officials shall be authorised to carry out the tasks relating to the duties entrusted to them by the host administration in accordance with its legal system.

3. Durante lo scambio, la responsabilità civile dei funzionari nell'esercizio delle loro funzioni è assimilata a quella dei funzionari dell'amministrazione ospitante. I funzionari che partecipano allo scambio sono tenuti al segreto d'ufficio secondo le regole vigenti per i funzionari del paese ospitante.

3. During the exchange, the civil liability of the exchange official in the performance of his duties shall be treated in the same way as that of officials of the host administration. Exchange officials shall be bound by the same rules of professional secrecy as national officials.

4. I paesi partecipanti possono limitare l'ambito di questi scambi a funzionari competenti per l'imposta sul valore aggiunto e/o le accise.

4. Participating countries may restrict the scope of these exchanges to officials responsible for value added tax and/or excise duties.

Attività di formazione

Training activities

1. Per favorire una cooperazione strutturata tra gli organismi nazionali di formazione e i funzionari responsabili della formazione in materia di imposizione all'interno delle amministrazioni, i paesi partecipanti, in cooperazione con la Commissione:

1. In order to encourage structured cooperation between national training bodies and officials responsible for training in taxation in administrations, participating countries shall, in cooperation with the Commission:

a) sviluppano i programmi di formazione esistenti e, se necessario, approntano nuovi programmi atti a fornire una formazione di base comune ai funzionari, che consenta loro di acquisire le competenze e le conoscenze professionali comuni necessarie;

(a) develop existing training programmes and, where necessary, devise new programmes to provide a common core of training for officials so as to enable them to acquire the necessary common professional skills and knowledge;

b) consentono, ove sia opportuno, ai funzionari di tutti i paesi partecipanti di partecipare ai corsi di formazione in materia di imposizione previsti da ciascun paese partecipante per i propri funzionari;

(b) where appropriate, open the training courses in taxation provided by each participating country for its own officials to officials from all participating countries;

c) sviluppano gli strumenti comuni necessari per la formazione in materia di imposizione.

(c) develop the necessary common tools for taxation training.

2. Each year the Commission shall submit to the Committee referred to in Article 14(1) a follow-up report setting out the progress of all the programme's activities in terms of implementation and results in relation to the annual action plan. This report shall also be forwarded to the European Parliament.

1. Il 17 gennaio 2002 la Commissione ha trasmesso al Consiglio una comunicazione(1) al Parlamento europeo e al Consiglio circa l'opportunità di proseguire la realizzazione di un programma d'azione comunitario inteso a migliorare i sistemi di imposizione nel mercato interno, accompagnata da una proposta di decisione del Parlamento europeo e del Consiglio recante adozione di un programma comunitario inteso a migliorare il funzionamento dei sistemi di imposizione nel mercato interno (Fiscalis 2007). La proposta è basata sull'articolo 95 del trattato.

On 17 January 2002, the Commission transmitted to the Council a communication(1) to the European Parliament and to the Council on the desirability of continuing a programme of action to ameliorate the taxation systems of the internal market, with a proposal for a decision of the European Parliament and of the Council adopting a Community programme to improve the operation of taxation systems in the internal market (Fiscalis 2007 programme). This proposal is based on Article 95 of the Treaty.

II. OBIETTIVO DELLA PROPOSTA

La proposta di prefigge di proseguire la realizzazione dell'attuale programma Fiscalis(3) per un altro quinquennio (dal 1o gennaio 2003 al 31 dicembre 2007), nonché di estenderlo in particolare all'imposizione diretta. Inoltre, il programma sarà ora aperto agli Stati membri e ai paesi candidati.

The purpose of the proposal is to provide for the continuation of the current Fiscalis programme(4) for a new five-year period (1 January 2003 to 31 December 2007) as well as for its extension, in particular to direct taxation. Furthermore, the programme will now be open to Member States and candidate countries.

L'obiettivo globale del programma è quella di migliorare il funzionamento dei sistemi di imposizione nel mercato interno attraverso una maggiore cooperazione tra le amministrazioni e i funzionari dei paesi partecipanti.

The overall objective of the programme is to improve the operation of the taxation systems in the internal market and to do so through an increased cooperation between the administrations and officials of the participating countries.

- per l'imposizione indiretta (valore aggiunto e accise): sostanzialmente gli stessi obiettivi dell'attuale programma,

- with regard to indirect taxation (value added tax and excise duties): in substance, the same objectives as in the existing programme,

- per l'imposizione diretta: fornire sostegno allo scambio di informazioni nel settore dell'assistenza reciproca e far conoscere il diritto comunitario applicabile nel settore dell'imposizione diretta,

- with regard to direct taxation: to support the information exchange in the field of mutual assistance and to raise awareness of Community law applicable in the field of direct taxation,

- per le imposte sui premi assicurativi: garantire un'applicazione migliore delle norme vigenti mediante una migliore cooperazione tra Stati membri, e

- with regard to taxes on insurance premiums: to ensuring a better application of the existing rules through an improved cooperation between Member States, and

- per i paesi candidati: tener conto delle loro specifiche esigenze cosicché essi rafforzino la loro capacità amministrativa, ed aiutarli ad attuare le necessarie misure legislative, amministrative, organizzative e tecniche in materia di legislazione fiscale.

Sebbene il Consiglio sia favorevole all'obiettivo generale della proposta della Commissione, la posizione comune differisce da quest'ultima in alcuni punti:

- le attività previste dovrebbero essere chiaramente definite e, in particolare, le "altre attività" che ora sono state formulate in modo preciso ricorrendo ai termini della relazione introduttiva (articolo 1),

- the planned activities should be clearly defined and, in particular, "any other activities" which now have been precisely worded using the terms of the explanatory memorandum (Article 1),

- il riferimento nella versione inglese a "taxes on insurance" va fatto in realtà a "taxes on insurance premiums" (articolo 2) (imposte sui premi assicurativi),

- the reference to taxes on insurance must be in fact to taxes on insurance premiums (Article 2),

- va chiarito che l'obiettivo globale del programma è quello di migliorare il funzionamento dei sistemi di imposizione nel mercato interno accrescendo la cooperazione tra l'amministrazione e i funzionari, e di evitare di dare l'impressione che al programma siano attribuiti poteri legislativi (articolo 3.1),

- it should be clear that the overall objective of the programme is to improve the proper functioning of the taxation systems in the internal market by increasing cooperation between administration and officials, and to avoid giving the impression that legislative powers were being conferred on the programme (Article 3(1)),

This is already provided for in recital 10 and Article 10, second sentence. Furthermore, Article 12 makes it clear that any provision in Community law on financial and budgetary control is applicable,

Si è ritenuto probabile il rischio di interferenze nella corretta attuazione del programma e, per quanto riguarda l'ultima parte dell'emendamento proposto, che non venga rispettato il diritto di iniziativa della Commissione.

- Amendment 6: the obligation for the Commission to study how best to develop synergy between similar Community programmes. It was considered that there was a risk that this might interfere with the proper implementation of the programme and, as regards the last part of the proposed amendment, that it did not respect the Commission's right of initiative.
