Annotated presentation of regulated markets and national provisions implementing relevant requirements of the investment services directive (ISD) (Council Directive 93/22/EEC)(1)

L'articolo 16 della direttiva 93/22/CEE relativa ai servizi di investimento autorizza ciascuno Stato membro a conferire lo status di "mercato regolamentato" ai mercati costituiti sul suo territorio e conformi alla sua regolamentazione.

Article 16 of Directive 93/22/EEC on investment services in the securities field (ISD) authorises each Member State to confer the status of "regulated market" on those markets constituted on its territory and which comply with its regulations.

A norma dell'articolo 1, punto 13, della direttiva 93/22/CEE, per "mercato regolamentato" si intende il mercato degli strumenti finanziari di cui all'allegato, sezione B:

Article 1.13 of Directive 93/22/EEC defines a "regulated market" as a market for the financial instruments listed in section B of the annex to the ISD, which;

- che sia riconosciuto tale dallo Stato membro d'origine [definito ai sensi dell'articolo 1, punto 6, lettera c), della direttiva],

- is recognised as such by its home Member States (where home Member State is determined in accordance with Article 1(6)c of the ISD;

- che funzioni regolarmente,

- functions regularly,

- che sia caratterizzato dal fatto che le disposizioni, elaborate o approvate dalle autorità competenti, definiscono le condizioni di funzionamento del mercato, le condizioni di accesso al mercato, nonché, qualora sia applicabile la direttiva 79/279/CEE (ammissione alla quotazione ufficiale), le condizioni di ammissione alla quotazione fissate dalla stessa e, qualora la direttiva 79/289/CEE non sia applicabile, le condizioni che questi strumenti finanziari devono soddisfare per poter essere effettivamente negoziati sul mercato,

- is characterised by the fact that regulations issued or approved by the competent authorities define the conditions for the operation of the market, the conditions for access to the market and where Directive 79/279/EEC on admission to official listing is applicable, the conditions governing admission to listing imposed in that Directive and, where that Directive is not applicable, the conditions that must be satisfied by a financial instrument before it can effectively be dealt with on the market;

- che prescriva il rispetto di tutti gli obblighi di dichiarazione e di trasparenza prescritti in applicazione degli articoli 20 e 21 della medesima direttiva.

- complies with all the reporting and transparency requirements laid down pursuant to Articles 20 and 21 of the ISD.

Sempre a norma dell'articolo 16 della direttiva 93/22/CEE, spetta a ciascuno Stato membro aggiornare l'elenco dei mercati regolamentati da esso autorizzati e comunicarlo per informazione agli altri Stati membri e alla Commissione. Lo stesso articolo stabilisce che la Commissione pubblica, almeno una volta l'anno, gli elenchi aggiornati dei mercati regolamentati. Il presente elenco è stato compilato a norma di tale disposizione.

Article 16 of Directive 93/22/EEC requires that each Member State maintain an updated list of regulated markets authorised by it. This information should be communicated to other Member States and the Commission. Under the same article, the Commission is required to publish a list of regulated markets notified to it on a yearly basis. The present list has been compiled pursuant to this requirement.

L'elenco allegato riporta la denominazione dei singoli mercati riconosciuti dalle autorità nazionali competenti conformi alla definizione di "mercato regolamentato", e indica l'ente responsabile della loro gestione e l'autorità competente a emanare e approvare le regole del mercato.

The following list indicates the title of the individual markets which are recognised by national competent authorities as complying with the definition of "regulated market". In addition, it indicates the entity responsible for managing these markets and the competent authority responsible for issuing or approving the rules of the market.

La riduzione delle barriere all'ingresso e la specializzazione dei segmenti di mercato fan sì che l'elenco dei "mercati regolamentati" debba subire continui ritocchi. La Commissione europea provvederà pertanto, oltre a pubblicare annualmente l'elenco nella Gazzetta ufficiale delle Comunità europee, a tenerne una versione aggiornata nel suo sito ufficiale

As a result of reduced entry barriers and specialisation in trading segments, the list of "regulated markets" is subject to greater turnover. Consequently, the European Commission will, in addition to yearly publication of a list in the Official Journal of the European Communities, maintain an updated version of this list on its official website

Questa sarà modificata regolarmente sulla base delle informazioni comunicate dalle autorità nazionali che, dal canto loro, sono invitate a comunicare alla Commissione tutti i dati agguinti o eliminati dall'elenco dei mercati regolamentati di cui sono lo Stato membro d'origine.

This list will be updated regularly on the basis of information communicated by national authorities. The latter are called upon to continue to advise the Commission of any additions to or deletions from the list of regulated markets for which it is the home Member State.
