Regolamento finanziario del 27 marzo 2003 per il 9o Fondo europeo di sviluppo	Financial regulation of 27 March 2003 applicable to the 9th European Development Fund
Il CONSIGLIO DELL'UNIONE EUROPEA,	THE COUNCIL OF THE EUROPEAN UNION
visto il trattato che istituisce la Comunità europea,	Having regard to the Treaty establishing the European Community,
visto l'accordo di partenariato concluso tra i membri del gruppo degli stati dell'Africa, dei Caraibi e del Pacifico, da un lato, e la Comunità europea e i suoi Stati membri, dall'altro, firmato a Cotonou il 23 giugno 2000(1),	Having regard to the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States of the one part, and the European Community and its Member States, of the other part, signed in Cotonou on 23 June 2000(1) (hereinafter referred to as the "ACP-EC Agreement"),

visto l'accordo interno tra i rappresentanti dei governi degli Stati membri, riuniti in sede di Consiglio, relativo al finanziamento e alla gestione degli aiuti della Comunità nel quadro del protocollo finanziario dell'accordo di partenariato tra gli stati dell'Africa, dei Caraibi e del Pacifico, da un lato, e la Comunità europea e i suoi Stati membri, dall'altro, firmato a Cotonou (Benin) il 23 giugno 2000, nonché alla concessione di un'assistenza finanziaria ai paesi e territori d'oltremare cui si applicano le disposizioni della parte quarta del trattato CE(3), in particolare l'articolo 31,	Having regard to the Internal Agreement between Representatives of the Governments of the Member States, meeting within the Council, on the Financing and Administration of Community Aid under the Financial Protocol to the Partnership Agreement between the African, Caribbean and Pacific States and the European Community and its Member States signed in Cotonou (Benin) on 23 June 2000 and the allocation of financial assistance for the Overseas Countries and Territories to which Part Four of the EC Treaty applies(3) (hereinafter referred to as the "Internal Agreement") and in particular Article 31 thereof,
vista la proposta della Commissione(4),	Having regard to the proposal from the Commission(4),

considerando quanto segue:	Whereas:
(1) Occorre determinare le modalità di versamento dei contributi degli Stati membri al nono Fondo europeo di sviluppo (in prosieguo: "FES"), istituito dall'accordo interno, nonché alla concessione di un'assistenza finanziaria ai paesi e territori d'oltremare cui si applicano le disposizioni della parte quarta del trattato CE.	(1) It is necessary to determine the detailed rules for the payment of contributions by the Member States to the 9th European Development Fund (hereinafter "the EDF"), set up by the Internal Agreement, and to the allocation of financial assistance for the Overseas Countries and Territories to which Part Four of the EC Treaty applies.
(2) Occorre definire le modalità secondo le quali la Corte dei conti esercita i propri poteri nei confronti del FES.	(2) It is necessary to lay down the conditions in accordance with which the Court of Auditors is to exercise its powers in respect of the EDF.
(3) Le disposizioni in materia di controllo della Corte dei conti sulle risorse gestite dalla BEI rispettano il carattere convenzionale dell'accordo tripartito, quale risulta dall'articolo 248 del trattato.	(3) The provisions concerning scrutiny by the Court of Auditors of the resources managed by the EIB comply with the contractual nature of the Tripartite Agreement provided for in Article 248 of the Treaty.
(4) Dovrebbe essere regolata la questione del trattamento delle eventuali rimanenze di precedenti FES, in particolare per quanto riguarda le modalità di trasferimento al 9o FES, la loro assegnazione ai vari strumenti di cooperazione previsti dall'accordo ACP-CE o dalla decisione sull'associazione d'oltremare, e le relative disposizioni di attuazione.	(4) Rules should be laid down for the treatment of any balances remaining from previous EDFs, in particular as regards the detailed arrangements for their transfer to the 9th EDF, their allocation to the various cooperation instruments provided for by the ACP-EC Agreement or by the Overseas Association Decision, and the rules applicable for their implementation.
(5) È necessario assicurare la coerenza fra il presente regolamento e le misure adottate dalla Commissione per l'attuazione della decisione sull'associazione d'oltremare.	(5) It is necessary to ensure consistency as between this Regulation and the measures adopted by the Commission for the implementation of the Overseas Association Decision.
(6) Occorre garantire l'esecuzione adeguata, rapida ed efficace dei programmi e dei progetti finanziati nell'ambito dell'accordo ACP-CE nonché definire procedure di gestione trasparenti, di agevole applicazione e idonee a permettere il decentramento dei compiti e delle responsabilità verso gli operatori in loco.	(6) It is appropriate to ensure the proper, prompt and efficient execution of programmes and projects financed under the ACP-EC Agreement and to establish management procedures which are transparent and easy to apply, and which facilitate the decentralisation of tasks and responsibilities.
(7) La decisione n. 2/2002 del Consiglio dei Ministri ACP-CE, del 7 ottobre 2002, relativa all'attuazione degli articoli 28, 29 e 30 dell'allegato IV dell'accordo di Cotonou(6), definisce la regolamentazione generale e i capitolati generali d'oneri applicabili agli appalti di lavori, forniture e servizi finanziati dal FES nonché le norme in materia di procedura di conciliazione e di arbitrato applicabili a tali appalti.	(7) Decision 2/2002 of the ACP-EC Council of Ministers of 7 October 2002 on the implementation of Articles 28, 29 and 30 of Annex IV to the Cotonou Agreement(6) has specified the general regulations and general conditions applicable to works, supply and service contracts financed by the EDF, as well as the rules governing procedure, conciliation and arbitration in relation to such contracts.
(8) È necessario determinare le modalità secondo le quali l'ordinatore principale del FES designato dalla Commissione che è responsabile in particolare del controllo delle spese finanziate sul FES, adotta, in stretta collaborazione con l'ordinatore nazionale, le misure necessarie per garantire la buona esecuzione delle operazioni.	(8) It is necessary to establish the detailed rules in accordance with which the Chief Authorising Officer of the EDF, to be appointed by the Commission with responsibility inter alia for the clearance of expenditure under the EDF, has, in close cooperation with the National Authorising Officer, to make such arrangements as prove necessary to ensure the proper execution of operations.
(9) Nella misura del possibile, si dovrebbe tener conto del regolamento (CE, Euratom) n. 1605/2002 del Consiglio, del 25 giugno 2002, che stabilisce il regolamento finanziario applicabile al bilancio generale delle Comunità europee(7) (in prosieguo denominato il "regolamento finanziario generale"), in quanto elemento centrale della riforma della gestione interna della Commissione, ai fini del regolamento finanziario del FES, in particolare nella prospettiva dell'eventuale integrazione delle risorse del FES nel bilancio generale delle Comunità. Modificazioni del presente regolamento potranno essere proposte dalla Commissione alla luce dell'esperienza acquisita a seguito della sua applicazione,	(9) As far as possible, Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities(7), (hereinafter referred to as the "General Financial Regulation") should, as the cornerstone of the reform of the Commission's internal management, be taken into account in drawing up the Financial Regulation for the EDF, particularly with a view to the possible integration of EDF resources into the general budget of the Communities. In the light of the experience acquired from the implementation of this Regulation, the Commission may propose amendments thereto,

PARTE PRIMA	PART ONE
DISPOSIZIONI PRINCIPALI	MAIN PROVISIONS
TITOLO I	TITLE I
DISPOSIZIONI GENERALI	GENERAL PROVISIONS
CAPO 1	CHAPTER 1
OGGETTO	SUBJECT MATTER AND SCOPE
Articolo 1	Article 1
1. Il presente regolamento precisa le norme relative alla costituzione ed all'esecuzione finanziaria delle risorse del 9o FES.	1. This Regulation lays down the rules for the establishment and financial implementation of the resources of the 9th EDF.
2. La Commissione assume le responsabilità della Comunità definite all'articolo 57 dell'accordo ACP-CE e quelle definite dalla decisione sull'associazione d'oltremare. A tal fine, garantisce l'esecuzione finanziaria di tutte le operazioni effettuate sulle risorse del FES assegnate sotto forma di aiuti non rimborsabili, all'infuori degli abbuoni di interessi ed effettua i pagamenti conformemente al presente regolamento.	2. The Commission shall assume the Community's responsibilities defined in Article 57 of the ACP-EC Agreement and in the Overseas Association Decision. To that end, it shall undertake the financial implementation of operations carried out with EDF resources allocated in the form of non-repayable aid, excluding interest rate subsidies, and make payments in accordance with this Regulation.
Nell'applicazione del presente regolamento, la Commissione agisce sotto la propria responsabilità, entro i limiti delle risorse disponibili.	In applying this Regulation, the Commission shall act on its own responsibility and within the limits of the resources allocated.
3. La BEI provvede, per conto della Comunità, alla gestione del Fondo investimenti e degli abbuoni di interessi, ed effettua le relative operazioni, secondo le modalità di cui alla parte seconda. In questo ambito la BEI agisce a nome e a rischio della Comunità.	3. The EIB, acting on behalf of the Community, shall manage the Investment Facility, as well as interest rate subsidies, and shall conduct operations thereunder, in accordance with the rules set out in Part Two. In that context, the EIB shall act on behalf of and at the risk of the Community.
La BEI provvede all'esecuzione finanziaria delle operazioni effettuate mediante prestiti sulle sue risorse proprie, cui si applicano eventualmente abbuoni di interessi sulle risorse del FES.	The EIB shall undertake the financial implementation of operations carried out by means of loans from its own resources, where applicable combined with interest rate subsidies drawn from the EDF's grant resources.
4. Le disposizioni della prima e della terza parte si applicano esclusivamente all'esecuzione finanziaria delle risorse del FES gestite dalla Commissione. Tali disposizioni non possono essere interpretate come fonte di obblighi della Commissione nell'esecuzione finanziaria delle risorse del FES gestite dalla BEI.	4. The provisions of this Part, together with those of Part Three, shall apply exclusively to the financial implementation of the EDF resources managed by the Commission. Those provisions may not be interpreted as giving rise to any obligations on the Commission's part in respect of the financial implementation of EDF resources managed by the EIB.
5. Salvo indicazione contraria, i riferimenti fatti nel presente regolamento agli Stati ACP includono gli organismi o i loro rappresentanti di cui agli articoli 13 e 14 dell'allegato IV dell'accordo ACP-CE debitamente autorizzati all'esercizio delle loro competenze nell'ambito di detto accordo.	5. Unless otherwise specified, references in this Regulation to the ACP States shall be deemed to refer also to the bodies or representatives defined in Articles 13 and 14 of Annex IV to the ACP-EC Agreement, which they may duly mandate to exercise their responsibilities under that Agreement.
6. L'esercizio ha inizio il 1o gennaio e si conclude il 31 dicembre.	6. The financial year shall begin on 1 January and end on 31 December.
CAPO 2	CHAPTER 2
PRINCIPIO DELL'UNITÀ DI CONTO	PRINCIPLE OF THE UNIT OF ACCOUNT
Articolo 2	Article 2
Le risorse del FES sono costituite, eseguite e sono oggetto di rendiconto in euro.	EDF resources shall be established and implemented in euro and the accounts shall be presented in euro.
Tuttavia, per le esigenze della tesoreria di cui all'articolo 26, il contabile è autorizzato ad effettuare operazioni in euro, in altre divise e in monete nazionali.	However, for the treasury management purposes referred to in Article 26, the accounting officer may carry out operations in euro, in other currencies and in national currencies.
CAPO 3	CHAPTER 3
PRINCIPIO DELLA SPECIALIZZAZIONE	PRINCIPLE OF SPECIFICATION
Articolo 3	Article 3
Le risorse del FES sono specializzate secondo gli strumenti principali di cooperazione, quali definiti nel protocollo finanziario dell'accordo ACP-CE e nella decisione sull'associazione d'oltremare.	The resources of the EDF shall be earmarked for specific purposes according to the main instruments of cooperation, as described in the Financial Protocol of the ACP-EC Agreement and the Overseas Association Decision.
Per quanto riguarda gli Stati dell'Africa, dei Caraibi e del Pacifico (in prosieguo: "Stati ACP"), questi strumenti sono stabiliti dal protocollo finanziario di cui all'allegato I dell'accordo ACP-CE. La specializzazione si basa anche sulle disposizioni dell'accordo interno e tiene conto della riserva di cui all'articolo 2, paragrafo 2, di tale accordo e delle risorse riservate alle spese di esecuzione di cui all'articolo 4 dello stesso.	In respect of the African, Caribbean and Pacific States, (hereinafter referred to as "the ACP States"), those instruments are laid down by the Financial Protocol set out in Annex I to the ACP-EC Agreement. Earmarking of resources shall also be based on the provisions of the Internal Agreement and shall take account of the non-allocated reserve provided for in Article 2(2) of that Agreement and of the resources reserved for costs linked to implementation under Article 4 thereof.
Per quanto riguarda i paesi e territori d'oltremare (in prosieguo: "PTOM"), questi strumenti sono fissati nell'allegato II A della decisione sull'associazione d'oltremare. La specializzazione tiene conto anche della riserva di cui all'articolo 3, paragrafo 3, di detto allegato e delle risorse destinate agli studi o interventi d'assistenza tecnica di cui all'articolo 1, paragrafo 1, lettera c), dello stesso.	In respect of the Overseas Countries and Territories, (hereinafter referred to as "the OCTs"), those instruments are laid down in Annex II A to the Overseas Association Decision. Earmarking of those resources shall also take account of the non-allocated reserve provided for in Article 3(3) of that Annex and of the resources reserved for studies or technical assistance measures under Article 1(1)(c) thereof.
CAPO 4	CHAPTER 4
PRINCIPIO DELLA SANA GESTIONE FINANZIARIA	PRINCIPLE OF SOUND FINANCIAL MANAGEMENT

1. Le risorse del FES sono utilizzate secondo i principi di una sana gestione finanziaria, vale a dire secondo i principi di economia, efficienza ed efficacia.	1. EDF resources shall be used in accordance with the principles of sound financial management, that is to say, in accordance with the principles of economy, efficiency and effectiveness.
2. Secondo il principio dell'economia, i mezzi impiegati per la realizzazione delle attività sono resi disponibili in tempo utile, nella quantità e qualità appropriate ed al prezzo migliore.	2. The principle of economy requires that the resources used for the pursuit of activities be made available in due time, in appropriate quantity and quality and at the best price.
Secondo il principio dell'efficienza, deve essere ricercato il miglior rapporto tra i mezzi impiegati ed i risultati conseguiti.	The principle of efficiency is concerned with the best relationship between resources employed and results achieved.
Secondo il principio dell'efficacia, gli obiettivi specifici fissati devono essere raggiunti e devono essere conseguiti i risultati attesi.	The principle of effectiveness is concerned with attaining the specific objectives set and achieving the intended results.
3. Sono fissati obiettivi e il controllo permanente della loro realizzazione è assicurato mediante indicatori misurabili. A tale scopo l'utilizzazione delle risorse del FES deve essere preceduta da una valutazione ex-ante dell'azione da realizzare e l'azione deve formare oggetto di una valutazione ex-post al fine di garantire che i risultati previsti giustifichino i mezzi impiegati.	3. Objectives shall be set and achievement of those objectives shall be monitored by means of measurable indicators. To that end, the use of EDF resources must be preceded by an ex ante evaluation of the operation to be undertaken and the operation must be submitted to an ex post evaluation with a view to ensuring that the intended results justify the means deployed.
4. I programmi o le azioni devono essere sottoposti ad un esame periodico, in particolare in vista della stima delle richieste di contributi di cui all'articolo 38, paragrafo 1, per verificarne la giustificazione.	4. Programmes or operations shall be periodically examined, particularly in relation to the estimates of calls for contributions referred to in Article 38(1), so that it can be established that they are justified.
CAPO 5	CHAPTER 5
PRINCIPIO DELLA TRASPARENZA	PRINCIPLE OF TRANSPARENCY
Articolo 5	Article 5
1. Le risorse del FES sono costituite, eseguite e sono oggetto di rendiconto nel rispetto del principio della trasparenza.	1. The resources of the EDF shall be established and implemented and the accounts presented in compliance with the principle of transparency.
2. Le previsioni annuali degli impegni e dei pagamenti a norma dell'articolo 10 dell'accordo interno e i conti del FES di cui all'articolo 96 del presente regolamento sono pubblicati nella Gazzetta ufficiale dell'Unione europea.	2. The annual estimates of commitments and payments under Article 10 of the Internal Agreement, together with the EDF accounts referred to in Article 96 of this Regulation, shall be published in the Official Journal of the European Union.
TITOLO II	TITLE II
RISORSE E SPESE AMMINISTRATIVE	RESOURCES AND ADMINISTRATIVE EXPENDITURE
CAPO 1	CHAPTER 1
COSTITUZIONE DELLE RISORSE DEL FES	COMPOSITION OF EDF RESOURCES
Articolo 6	Article 6
1. Il FES è costituito dei seguenti elementi:	1. The EDF shall consist of:
a) l'importo fissato all'articolo 1 dell'accordo interno;	(a) the amount laid down in Article 1 of the Internal Agreement;
b) le eventuali rimanenze dei FES precedenti constatate secondo l'articolo 1, paragrafo 2, lettera b), dell'accordo interno e definite alla parte terza, titolo I del presente regolamento.	(b) pursuant to Article 1(2)(b) of the Internal Agreement, any balances remaining from previous EDFs as defined in Title I of Part Three of this Regulation.
2. Le entrate provenienti dagli interessi prodotti da fondi di cui al paragrafo 1, depositati presso i delegati ai pagamenti in Europa di cui all'articolo 37 dell'allegato IV dell'accordo ACP-CE, sono accreditate ad uno o più conti bancari aperti a nome della Commissione ed utilizzate conformemente alle disposizioni dell'articolo 9 dell'accordo interno e del presente regolamento.	2. The revenue accruing from interest on the funds referred to in paragraph 1 deposited with the paying agents in Europe referred to in Article 37 of Annex IV to the ACP-EC Agreement shall be credited to one or more bank accounts opened in the name of the Commission, and shall be used in accordance with Article 9 of the Internal Agreement and with this Regulation.
3. La ripartizione delle dotazioni fissata dall'accordo ACP-CE e dall'accordo interno è riprodotta a titolo indicativo in allegato al presente regolamento.	3. The breakdown of allocations laid down by the ACP-EC Agreement and by the Internal Agreement is indicated in the Annex to this Regulation for information purposes.
Articolo 7	Article 7
L'importo fissato all'articolo 4 dell'accordo interno è destinato a finanziare le spese d'esecuzione sostenute dalla Commissione nell'ambito dell'accordo ACP-CE. È utilizzato secondo i principi stabiliti all'articolo 9 del suddetto accordo interno.	The amount laid down in Article 4 of the Internal Agreement shall be reserved for the financing of costs linked to implementation incurred by the Commission in the framework of the ACP-EC Agreement. It shall be utilised in accordance with the principles set out in Article 9 of the Internal Agreement.
Dette risorse sono utilizzate in particolare per rafforzare le capacità amministrative della Commissione e delle sue delegazioni, al fine di garantire la buona preparazione ed esecuzione delle operazioni finanziate dal FES.	Those resources shall be used inter alia to reinforce the administrative capacities of the Commission and its Delegations in order to ensure the smooth preparation and implementation of operations financed from the EDF.
CAPO 2	CHAPTER 2
CONTRIBUTI AL FES	CONTRIBUTIONS TO THE EDF
Articolo 8	Article 8
1. Ogni anno, la Commissione stabilisce e comunica al Consiglio, entro il 15 ottobre, lo stato di previsione dei pagamenti per l'esercizio successivo e lo scadenzario delle richieste di contributi, tenendo conto delle previsioni che la BEI, le comunica a norma dell'articolo 121 per le operazioni di cui questa garantisce la gestione, compresi gli abbuoni d'interesse.	1. Each year, the Commission shall establish and communicate to the Council, by 15 October at the latest, a statement of the payments to be made in the following financial year and a schedule of the calls for contributions. In so doing, the Commission shall take into account the estimates submitted to it by the EIB, in accordance with Article 121 concerning operations, including interest rate subsidies, managed by the EIB.
La Commissione giustifica l'importo chiesto in base alla sua capacità di assegnare realmente le risorse proposte. La BEI giustifica l'importo chiesto in base alle sue esigenze operative. Il Consiglio si pronuncia su queste giustificazioni e su ciascuna richiesta di contributi secondo le modalità di cui all'articolo 10 dell'accordo interno ed all'articolo 38 del presente regolamento.	The Commission shall justify the amount requested on the basis of its capacity to deliver the proposed level of resources effectively. The EIB shall justify the amount requested on the basis of its operational requirements. The Council shall decide on those justifications and on each call for contributions in accordance with the rules referred to in Article 10 of the Internal Agreement and laid down in Article 38 of this Regulation.
2. Per le rimanenze trasferite dai FES precedenti al 9o FES a norma dell'articolo 6, i contributi di ogni Stato membro sono calcolati proporzionalmente al suo contributo al FES interessato.	2. As regards balances remaining from previous EDFs which are transferred to the 9th EDF in accordance with Article 6, the contributions of each Member State shall be calculated in proportion to the contribution of that State to the EDF in question.
3. Unitamente alle previsioni annuali per i contributi, la Commissione trasmette quanto segue:	3. The Commission's annual estimates of contributions shall cover:
a) le proprie previsioni degli impegni per l'esercizio successivo e quelle della BEI;	(a) its estimates of commitments for the following financial year, and those of the EIB;
b) le proprie stime degli impegni e degli esborsi relativi a ciascuno dei quattro anni successivi all'anno della richiesta di contributi e quelle della BEI; ogni anno il Consiglio riesamina e approva lo scadenzario.	(b) its estimates of commitments and disbursements for each of the four years following the year relating to the call for contributions, and those of the EIB. The schedule shall be approved and reviewed annually by the Council.
Le informazioni finanziarie sul FES che la Commissione fornisce all'autorità di bilancio nel quadro della procedura annuale di bilancio, incluse le stime dei contributi per l'esercizio in corso e quello successivo, sono messe a disposizione del Consiglio entro il 15 giugno. Tali informazioni servono da base per una stima intermedia degli impegni e degli esborsi.	The financial information on the EDF provided by the Commission to the budgetary authority in the context of the annual budget procedure, including the estimates of contributions for the current and the following financial year, shall be made available to the Council by 15 June. This information serves as a basis for an intermediate estimate of commitments and disbursements.
4. Qualora i contributi non siano sufficienti a coprire il fabbisogno effettivo del FES durante l'esercizio in esame, si applica l'articolo 10, paragrafo 4, dell'accordo interno relativo ai versamenti supplementari.	4. Should the contributions prove insufficient to meet the EDF's actual needs in the financial year in question, any supplementary payments may be decided upon in accordance with Article 10(4) of the Internal Agreement.
5. Il versamento dei contributi da parte degli Stati membri è eseguito conformemente all'articolo 38.	5. Payments of contributions by the Member States shall be made in accordance with Article 38.

ESECUZIONE DELLE RISORSE DEL FES	IMPLEMENTATION OF EDF RESOURCES

Articolo 9	Article 9
La Commissione può delegare ai propri uffici i poteri d'esecuzione delle risorse del FES di cui è titolare alle condizioni determinate dal presente regolamento e nei limiti che essa stessa determina nell'atto di delega. I delegati possono agire soltanto entro i limiti dei poteri che sono loro espressamente conferiti.	The Commission may, within its own departments, delegate its powers to implement EDF resources, in accordance with the conditions laid down by this Regulation and within the limits set by the Commission in the instrument of delegation. Delegates may act only within the limits of the powers expressly conferred upon them.
Articolo 10	Article 10
Gli agenti finanziari di cui al capo 3 non possono adottare atti d'esecuzione delle risorse del FES in relazione ai quali i loro interessi e quelli della Comunità potrebbero essere in conflitto. Qualora ciò si verificasse, l'agente è tenuto ad astenersi e ad informarne l'autorità competente.	All financial actors as defined in Chapter 3 shall be prohibited from taking any measures implementing EDF resources which may bring their own interests into conflict with those of the Community. Should such a case arise, the actor in question shall refrain from such measures and refer the matter to the competent authority.
Articolo 11	Article 11
1. Secondo le procedure previste per le proposte di finanziamento di cui all'articolo 24, paragrafi 1 e 3, dell'accordo interno e al fine di accelerarne l'espletamento, la Commissione presenta proposte di finanziamento relative all'autorizzazione di importi globali destinati al finanziamento delle attività di cui all'articolo 16, paragrafo 7, dell'allegato IV dell'accordo ACP-CE. Quando la proposta è adottata, la Commissione può prendere decisioni di finanziamento sulla base dell'autorizzazione globale.	1. In accordance with the procedures laid down for financing proposals in Articles 24(1) and (3) of the Internal Agreement, and in order to speed up those procedures, the Commission shall submit financing proposals concerning the authorisation of overall amounts allocated to the financing of the activities referred to in Article 16(7) of Annex IV to the ACP-EC Agreement. After the proposal has been adopted, the Commission may take financing decisions on the basis of the global authorisation.

3. Per accertarsi che i fondi siano utilizzati conformemente alla normativa pertinente ed entro i limiti delle competenze da questa attribuitele, la Commissione attua procedure di liquidazione dei conti o meccanismi di correzioni finanziarie che le permettono di assumere le responsabilità che le sono affidate dall'accordo ACP-CE, in particolare in forza dell'articolo 34, paragrafo 1, dell'allegato IV del medesimo, nonché dalla decisione sull'associazione d'oltremare, in particolare in forza degli articoli 20 e 32 della medesima per il controllo delle spese finanziate sulle risorse del FES.	3. In order to ensure that funds are used in accordance with the applicable rules and within the limits of powers thereby conferred upon it, the Commission shall implement clearance of account procedures or financial correction mechanisms enabling it to discharge its obligations under the ACP-EC Agreement, in particular under Article 34(1) of Annex IV thereto, and under the Overseas Association Decision, in particular under Articles 20 and 32 thereof, for the clearance of expenditure financed from EDF resources.

Depending on the degree of decentralisation provided for in the ACP-EC Agreement and in the Overseas Association Decision and the measures implementing that Decision, the Commission shall strive to encourage the beneficiary ACP States and the OCTs to adhere, when exercising the powers entrusted to them under the ACP-EC Agreement and under the Overseas Association Decision, to the principle of sound financial management set out in Article 4, in particular the progressive application of the following criteria:

f) per gli appalti in amministrazione diretta ai sensi dell'articolo 80, paragrafo 2, disposizioni adeguate per la gestione ed il controllo dei conti dell'amministrazione e per la definizione delle responsabilità dell'amministratore e del contabile. Nel caso previsto al primo comma, lettera b), di programmi o di progetti cofinanziati dagli Stati membri o dai loro organismi incaricati dell'esecuzione e conformi alle priorità fissate nelle strategie di cooperazione per ciascun paese di cui al capitolo III dell'accordo interno ed all'articolo 20 della decisione sull'associazione d'oltremare, la Commissione può affidare agli Stati membri, o ai loro organismi incaricati dell'esecuzione, la responsabilità della gestione dei fondi della Comunità. La Commissione può corrispondere, a valere sulle risorse del FES di cui all'articolo 1, paragrafo 2, lettera a), i) e ii) dell'accordo interno, una compensazione finanziaria per l'onere amministrativo sostenuto.	In the case, referred to in point (b) of the first subparagraph, of programmes or projects co-financed by the Member States or their implementing bodies and reflecting the priorities laid down in the Country Cooperation Strategies provided for in Chapter III of the Internal Agreement and in Article 20 of the Overseas Association Decision, the Commission may entrust responsibility for managing Community aid to Member States or to their implementing bodies. The Commission may draw on the EDF resources provided for in Article 1(2)(a)(i) and (ii) of the Internal Agreement in order to pay financial compensation for the administration costs incurred.
Gli organismi od entità di cui al primo comma, lettera b), possono essere incaricati di funzioni d'esecuzione soltanto se la delega di funzioni d'esecuzione finanziaria è effettuata in risposta alle esigenze della sana gestione finanziaria secondo un'analisi preliminare e garantisce il rispetto del principio di non discriminazione e la visibilità dell'azione della Comunità. Le funzioni d'esecuzione così affidate non danno luogo a conflitti d'interesse. Se dall'analisi risulta che la delega risponde al meglio alle esigenze della sana gestione finanziaria, la Commissione chiede, preventivamente alla sua attuazione, il parere del comitato del FES di cui all'articolo 21 dell'accordo interno, il quale può altresì pronunciarsi sulla prevista applicazione dei criteri di selezione.	Implementation tasks may be entrusted to the bodies referred to in point (b) of the first subparagraph only if the delegation of financial implementation tasks is a response to the requirements of sound financial management, as shown by prior analysis and, ensures compliance with the principle of non-discrimination and the visibility of Community action. No implementing tasks entrusted in this way may give rise to conflicts of interests. If the analysis shows that delegation best satisfies the requirements of sound financial management, the Commission shall request the opinion of the EDF Committee provided for in Article 21 of the Internal Agreement before proceeding to implement the delegation. The EDF Committee may also give its opinion on the planned application of the selection criteria.

5. Le decisioni di cui al paragrafo 3, con cui vengono affidate funzioni d'esecuzione, comprendono le disposizioni appropriate per garantire la trasparenza delle operazioni effettuate e comportano necessariamente quanto segue:	5. The decisions, referred to in paragraph 3, entrusting implementing tasks shall cover all appropriate arrangements for ensuring the transparency of operations carried out and must comprise:
a) una revisione contabile esterna indipendente;	(a) an independent external audit;
b) un sistema efficace di controllo interno delle operazioni di gestione;	(b) an effective internal control system for management operations;
c) una contabilità di tali operazioni e procedure di rendiconto che consentano di accertare la corretta utilizzazione delle risorse del FES e che riflettano nei conti delle Comunità l'effettiva misura di tale utilizzazione;	(c) accounting arrangements for those operations and procedures for the presentation of the accounts which will enable the correct use of EDF resources to be ascertained and the true extent of that use to be reflected in the accounts;
d) procedure di aggiudicazione degli appalti e di concessione delle sovvenzioni conformi alle norme di cui ai titoli IV e V.	(d) procurement and grant award procedures which comply with the provisions of Titles IV and VI.
La Commissione può riconoscere l'equipollenza fra i sistemi di controllo e di contabilità nonché fra le procedure di aggiudicazione degli appalti degli organismi nazionali di cui al paragrafo 3 e le proprie regole, tenendo conto delle norme riconosciute a livello internazionale.	The Commission may accept that the audit, accounting and procurement systems of the national bodies referred to in paragraph 3 are equivalent to its own, with due account for internationally accepted standards.
6. La Commissione provvede alla sorveglianza, alla valutazione e al controllo dell'esecuzione delle funzioni affidate agli organismi di cui al paragrafo 3. L'Ufficio europeo per la lotta antifrode (OLAF) dispone nei confronti di tali organismi degli stessi poteri esercitati nei confronti degli uffici della Commissione. Gli organismi interessati adottano le disposizioni necessarie per agevolare lo svolgimento delle indagini interne dell'OLAF. Qualsiasi atto di tali organismi relativo all'esecuzione finanziaria delle risorse del FES e in particolare qualsiasi decisione e qualsiasi contratto da essi stipulato, deve prevedere espressamente gli stessi controlli previsti dall'articolo 51, paragrafo 4.	6. The Commission shall ensure periodic supervision, evaluation and control of the implementation of the tasks entrusted to the bodies referred to in paragraph 3. The European Anti-Fraud Office (OLAF) shall enjoy the same powers with regard to such bodies as it does with regard to Commission departments. The bodies in question shall adopt the necessary measures to help OLAF carry out internal investigations. Any act undertaken by such bodies for the financial implementation of EDF resources, and in particular any decision or any contract concluded by them, must specifically provide for the same controls as Article 51(4).
7. La Commissione non può affidare atti d'esecuzione su fondi in provenienza dalle risorse del FES, compreso il pagamento e la riscossione, ad entità od organismi esterni di diritto privato, ad eccezione degli organismi o delle entità di cui al paragrafo 3, primo comma, lettera b).	7. The Commission may not entrust measures implementing funds deriving from EDF resources, such as payment and recovery, to external private sector entities or bodies other than those referred to in point (b) of the first subparagraph of paragraph 3.
Ad entità od organismi esterni di diritto privato non previsti dal paragrafo 3, primo comma, lettera b), possono essere affidate dalla Commissione, mediante contratto, funzioni di perizia tecnica e funzioni amministrative, preparatorie o accessorie che non implicano né attribuzioni proprie dell'autorità pubblica né l'esercizio di un potere di apprezzamento discrezionale.	The tasks which the Commission may entrust by contract to external private sector entities or bodies other than those referred to in point (b) of the first subparagraph of paragraph 3 shall be technical expertise tasks and administrative, preparatory or ancillary tasks involving neither the exercise of public authority nor the use of discretionary power.

The authorising officer entrusted with the management of EDF resources shall be responsible for implementing revenue and expenditure in accordance with the principle of sound financial management and for ensuring that the requirements of legality and regularity are complied with.

1. Save in cases where management is centralised, operations relating to the implementation of programmes or projects shall be carried out by the national or regional authorising officer, as defined in Article 35 of Annex IV to the ACP-EC Agreement and in the measures implementing the Overseas Association Decision, in close cooperation, in the ACP States, with the head of delegation in accordance with Articles 35 and 36 of Annex IV to the ACP-EC Agreement.

He shall receive the necessary instructions and powers to perform his duties as defined in Article 36 of Annex IV to the ACP-EC Agreement and in the measures implementing the Overseas Association Decision.

The Chief Authorising Officer shall take all measures necessary for the implementation of Annex IV to the ACP-EC Agreement and Articles 18 and 33 of the Overseas Association Decision and Annexes II A to II D thereto.

The Chief Authorising Officer shall take all measures necessary to ensure that national, regional or local authorising officers perform the tasks for which they are responsible by virtue of the ACP-EC Agreement, and in particular Annex IV thereto, and by virtue of the Overseas Association Decision or measures implementing that Decision. In close cooperation with the National Authorising Officer, he shall take such commitment decisions and financial measures as prove necessary, from an economic and technical point of view, to ensure the proper execution of operations.

L'ordinatore principale che venga a conoscenza di problemi nello svolgimento delle procedure relative alla gestione delle risorse del FES, prende con l'ordinatore nazionale o regionale tutti i contatti necessari per rimediare alla situazione ed adotta le misure necessarie compresa, qualora l'ordinatore nazionale o regionale non svolga o non sia in grado di svolgere i compiti affidatigli dall'accordo ACP-CE, la sostituzione temporanea da parte dell'ordinatore principale. Where the Chief Authorising Officer becomes aware of problems in carrying out procedures relating to management of EDF resources, he shall, in conjunction with the national or regional authorising officer, make all contacts necessary to remedy the situation and take any steps that are necessary. For instance, in cases where the national or regional authorising officer does not or is unable to perform the duties incumbent on him under the ACP-EC Agreement, the Chief Authorising Officer may temporarily take his place, in which case, the Commission may receive, from the resources allocated to the ACP State in question, financial compensation for the extra administrative workload incurred.
Qualsiasi misura adottata dall'ordinatore principale a titolo del primo comma è adottata in nome e per conto dell'ordinatore nazionale o regionale interessato.	Any measure taken by the Chief Authorising Officer pursuant to the first subparagraph shall be taken in the name of and on behalf of the national or regional authorising officer concerned.

In compliance with the minimum standards adopted by the Commission and having due regard to the risks associated with the management environment and the nature of the operations financed, the Chief Authorising Officer shall put in place the organisational structure and the internal management and control systems and procedures suited to the performance of his duties, including where appropriate ex post checks. Before an operation is authorised, the operational and financial aspects shall be verified by staff other than the member of staff who initiated the operation. Initiation of an operation and the ex ante and ex post verification of that operation shall be separate functions.
2. Ogni agente incaricato del controllo della gestione delle operazioni finanziarie dispone delle necessarie competenze professionali. Rispetta il codice deontologico specifico stabilito dalla Commissione.	2. All staff responsible for controlling the management of financial operations shall have the necessary professional skills. They shall respect a specific code of professional standards established by the Commission.
3. Quando un agente che partecipa alla gestione finanziaria e al controllo delle operazioni ritiene irregolare, o contraria al principio di una sana gestione finanziaria o alle regole deontologiche che è tenuto a rispettare, una decisione la cui applicazione o accettazione gli sia imposta dal suo superiore, ne informa per iscritto l'ordinatore principale e, in caso d'inerzia di quest'ultimo, l'istanza di cui all'articolo 35, paragrafo 3. In caso di frode, corruzione o altra attività illecita che potrebbe nuocere agli interessi della Comunità, informa l'OLAF e le istanze designate dallo statuto.	3. Any member of staff involved in the financial management and control of operations who considers that a decision which his superior requires him to apply or to agree to is irregular or contrary to the principles of sound financial management or the professional rules by which he is bound shall inform the Chief Authorising Officer in writing and, if the latter fails to take action, the panel referred to in Article 35(3). In the event of fraud, corruption or any other illegal activity which may harm the interests of the Community, he shall inform OLAF and the authorities designated by the Staff Regulations.

The Chief Authorising Officer shall report to the Commission on the performance of his duties in the form of an annual activity report, which shall include financial and management information. The report shall cover the results of his operations by reference to the objectives set, the risks associated with those operations, the use made of the resources provided and the functioning of the internal control system. The annual activity report and other specified information shall be brought to the attention of the internal auditor of the Commission. By 15 June each year at the latest, the Commission shall send the European Parliament and the Council a summary of the annual activity report for the previous year.

c) tenere la contabilità di quanto segue:	(c) keeping the accounts for:
i) delle dotazioni di cui all'articolo 6, ad esclusione del fondo investimenti e degli abbuoni di interessi;	(i) the allocations referred to in Article 6, except those for the Investment Facility, and interest rate subsidies;
ii) degli impegni di cui all'articolo 51;	(ii) the commitments referred to in Article 51;
iii) dei pagamenti, delle entrate e dei crediti;	(iii) payments, revenue and debts;
d) definire, conformemente al titolo VII, le norme e i metodi contabili nonché il piano contabile;	(d) laying down, in accordance with Title VII, the accounting rules and methods and the chart of accounts;
e) precisare e convalidare i sistemi contabili e, se necessario, convalidare i sistemi stabiliti dall'ordinatore principale e destinati a fornire o giustificare informazioni contabili;	(e) defining and validating the accounting systems and, where appropriate, validating systems defined by the Chief Authorising Officer for the purpose of supplying or explaining accounting information;

The accounting officer shall obtain from the Chief Authorising Officer and from the EIB, who shall, each for their own part, guarantee its reliability, all the information necessary for the production of accounts giving a true image of the financial implementation of EDF resources.

Articolo 27	Article 27
Il contabile è nominato dalla Commissione. Per l'esercizio dei suoi compiti il contabile può delegare alcune delle sue funzioni ad agenti soggetti allo statuto sotto la propria responsabilità gerarchica. L'atto di delega definisce i compiti affidati ai delegati.	The accounting officer shall be appointed by the Commission. The accounting officer may, for the performance of his duties, delegate certain tasks to subordinates who are subject to the Staff Regulations. The instrument of delegation shall define the tasks entrusted to the delegates.
Le decisioni prese a norma del primo comma sono notificate ai delegatari, all'ordinatore principale, al revisore interno e alla Corte dei conti.	Decisions taken pursuant to the first subparagraph shall be notified to the delegates, the Chief Authorising Officer, the internal auditor and the Court of Auditors.

I delegati ai pagamenti	Paying agent
Articolo 28	Article 28
Per effettuare i pagamenti di cui all'articolo 37, paragrafi 1 e 4, dell'allegato IV dell'accordo ACP-CE o alle misure d'attuazione della decisione sull'associazione d'oltremare, il contabile apre conti presso istituti finanziari degli Stati ACP e dei PTOM, per i pagamenti nella valuta nazionale degli Stati ACP o nella valuta locale dei PTOM, e presso istituti finanziari degli Stati membri, per i pagamenti in euro ed in altre valute. Conformemente all'articolo 37, paragrafo 2, di detto allegato, i fondi depositati su conti presso istituti finanziari degli Stati ACP e dei PTOM sono infruttiferi e i servizi resi da queste ultime non sono retribuiti. Conformemente all'articolo 1, paragrafo 3, dell'accordo interno i fondi depositati su conti presso istituti finanziari degli Stati membri producono interessi che sono accreditati ad uno dei conti di cui al medesimo articolo.	In order to make the payments provided for in Article 37(1) and (4) of Annex IV to the ACP-EC Agreement or in the measures implementing the Overseas Association Decision, the accounting officer shall open accounts with financial institutions in the ACP States and the OCTs, for payments in the national currencies of the ACP States or in the local currencies of the OCTs, and with financial institutions in the Member States, for payments in euro and other currencies. In accordance with Article 37(2) of Annex IV to the ACP-EC Agreement, deposits in accounts with financial institutions in the ACP States and the OCTs shall bear no interest and the latter shall receive no remuneration for their services. In accordance with Article 1(3) of the Internal Agreement, deposits in accounts with financial institutions in the Member States shall bear interest and such interest shall be credited to the one of the accounts provided for in that Article.

Once signed, copies of those contracts shall be sent to the Court of Auditors for information purposes.

1. La Commissione trasferisce dai conti speciali aperti a norma dell'articolo 40, paragrafo 3, gli importi necessari all'approvvigionamento dei conti aperti a suo nome a norma dell'articolo 28. The Commission shall transfer from the special accounts opened pursuant to Article 40(3) the amounts needed to replenish the accounts opened in its name in accordance with Article 28. Such transfers shall be made on the basis of the cash needs of the projects and programmes.

The Commission shall endeavour to make any withdrawals from the special accounts referred to in the first subparagraph of Article 40(3) in such a way as to maintain a distribution of its assets in those accounts corresponding to the proportions in which the various Member States contribute to the EDF.

The signatures of the Commission officials and staff who are empowered to carry out operations on the EDF's accounts shall be lodged with the banks concerned when the accounts are opened or, in the case of officials and staff who are authorised subsequently, when they are designated. That procedure also applies to the lodging of signatures of national and regional authorising officers and their deputies for operations in paying agent accounts opened in the ACP States or the OCTs and, where appropriate, in the accounts opened in the Member States.

Le disposizioni del presente capo fanno salva l'eventuale responsabilità penale degli agenti di cui all'articolo 32 secondo il diritto nazionale applicabile e le disposizioni vigenti sulla tutela degli interessi finanziari delle Comunità europee e sulla lotta contro la corruzione nella quale sono coinvolti funzionari delle Comunità europee o degli Stati membri.	1. The provisions of this Chapter shall obtain without prejudice to the criminal law liability which the persons referred to in Article 32 may incur under the applicable national law and the legislation in force on the protection of the European Communities' financial interests and on the fight against corruption involving officials of the European Communities or officials of Member States.

Authorising officers shall be liable to pay compensation in accordance with the conditions laid down in the Staff Regulations, under which an official may be required to make good, in whole or in part, any damage suffered by the Communities as a result of serious misconduct on his part in the course of or in connection with the performance of his duties, in particular in the event of failure to comply with this Financial Regulation when establishing entitlements to be recovered or issuing recovery orders, entering into a commitment of expenditure or signing a payment order. The same shall apply if they omit to draw up a document establishing a debt or if they neglect to issue recovery orders or are, without justification, late in issuing them, or if they neglect to issue payment orders or are, without justification, late in issuing them, thereby rendering the institution liable to civil action by third parties.

Quando l'ordinatore principale o l'ordinatore sottodelegato ritiene che una decisione di propria competenza sia inficiata d'irregolarità o contravvenga al principio di una sana gestione finanziaria, ne informa per iscritto l'autorità delegante. Se l'autorità delegante dà istruzione motivata per iscritto, all'ordinatore principale o all'ordinatore sottodelegato, di prendere tale decisione, quest'ultimo è esente da responsabilità.	1. Where the Chief Authorising Officer or an authorising officer by sub-delegation considers that a decision which it is his responsibility to take is irregular or contrary to the principles of sound financial management, he shall inform the delegating authority in writing. If the delegating authority then gives a reasoned instruction in writing to the Chief Authorising Officer or authorising officer by sub-delegation to take the decision in question, the latter may not be held liable.
2. In the event of internal sub-delegation, the Chief Authorising Officer shall continue to be responsible for the effectiveness of the internal management and control systems put in place and for the choice of the authorising officer by sub-delegation.

L'istanza specializzata istituita dalla Commissione a norma del regolamento finanziario generale è competente per determinare l'esistenza di un'irregolarità finanziaria, e le sue eventuali conseguenze, nell'ambito del FES. Per quanto concerne la gestione delle risorse del FES da parte della Commissione, l'istanza è adita conformemente alle modalità d'esecuzione del regolamento finanziario generale.	3. The specialised panel set up by the Commission in accordance the General Financial Regulation, shall have competence to determine, in relation to the EDF, whether a financial irregularity has occurred and, if so, the consequences entailed, if any. In respect of the management of EDF resources by the Commission, cases shall be referred to that panel as provided for in the detailed rules for implementing the General Financial Regulation.

Il contabile è responsabile, alle condizioni e secondo le procedure previste dallo statuto, sotto il profilo disciplinare o patrimoniale. Esso risponde personalmente in particolare nelle fattispecie seguenti:	An accounting officer shall be liable to disciplinary action and payment of compensation, as provided for and in accordance with the procedures laid down in the Staff Regulations, in particular where:
a) perdita o deterioramento di fondi, valori e documenti che ha in custodia;	(a) he loses or damages monies, assets and documents in his keeping;
b) indebita modificazione di conti bancari o di conti correnti postali;	(b) he unduly alters bank accounts or postal giro accounts;
c) recuperi o pagamenti non conformi ai corrispondenti ordini di riscossione o di pagamento;	(c) he recovers or pays amounts which are not in conformity with the corresponding recovery or payment orders;

EDF revenue consists of payments made by the Member States in accordance with the Internal Agreement and this Regulation, the income generated by deposits in accordance with Article 6(2) of this Regulation and any other sum whose acceptance is established by the Council.
Articolo 38	Article 38
1. I contributi annuali degli Stati membri sono stabiliti dal Consiglio alla maggioranza qualificata di cui all'articolo 21 dell'accordo interno, sulla base di una proposta della Commissione, in tre quote esigibili in conformità delle procedure in appresso.	1. In respect of the amount due to the Commission under Article 38(2)(a), financial contributions shall be credited by each Member State to a special account entitled "Commission of the European Communities - European Development Fund" opened with the bank of issue of that Member State or the financial institution designated by it. The amount of such contributions shall remain in those special accounts until the payments provided for in Article 37 of Annex IV to the ACP-EC Agreement or in the measures implementing the Overseas Association Decision need to be made.

Where an instalment of contributions payable under this Article is not paid by the deadline fixed by Article 38(1), the Member State concerned shall be required to pay interest in respect of the unpaid amount. This interest shall be charged at a rate of two percentage points above the interest rate applied by the European Central Bank to its main refinancing operations on the first working day of the month in which the amount falls due, as published in the C series of the Official Journal of the European Union. That rate shall be increased by a quarter of a percentage point for each month of delay. The interest shall be payable for the entire period of delay and shall be calculated from the first calendar day following the deadline for payment of the instalment laid down in Article 38.

Such estimates shall be sent to the accounting officer for recording in the accounts. They shall mention the type of revenue and the accounting item to which it is to be booked and also, as far as possible, the estimated amount involved and the name and description of the debtor. When drawing up estimates of amounts receivable, the accounting officer responsible shall check that:

2. Fatte salve le responsabilità degli Stati ACP o dei PTOM, la Commissione può formalizzare l'accertamento di un credito a carico di persone diverse dagli Stati con una decisione che costituisce titolo esecutivo alle stesse condizioni di cui all'articolo 256 del trattato.	2. Without prejudice to the responsibilities of the ACP States or the OCTs, the Commission may formally establish an amount as being receivable from persons other than States by means of a decision which shall be enforceable under the same conditions as laid down in Article 256 of the Treaty.

Ogni credito verificato come certo, liquido ed esigibile nell'ambito dell'esecuzione delle risorse del FES, è accertato da un ordine di riscossione dell'ordinatore competente, trasmesso al contabile unitamente ad una nota di addebito dell'ordinatore competente indirizzata al debitore. Nell'emettere l'ordine di riscossione, l'ordinatore competente verifica:	Every debt that is identified as being certain, of a fixed amount and due in the context of the implementation of EDF resources shall be established by means of a recovery order given to the accounting officer, followed by a debit note sent to the debtor, both drawn up by the authorising officer responsible. The recovery order shall be accompanied by supporting documents certifying the established entitlements. When drawing up the recovery order, the authorising officer responsible shall ensure that:

1. Il contabile prende a carico gli ordini di riscossione dei crediti debitamente stabiliti dall'ordinatore competente. È tenuto ad assicurare alle scadenze previste negli ordini di riscossione, il versamento delle entrate del FES e vigilare sulla salvaguardia dei pertinenti diritti delle Comunità.	1. The accounting officer shall act on recovery orders for amounts receivable that have been duly established by the authorising officer responsible. He shall exercise due diligence to ensure that the EDF receives its revenue by the due dates indicated in the recovery orders and ensure that the relevant rights of the Communities are safeguarded.
2. Se alla scadenza prevista nell'ordine di riscossione, il recupero effettivo non ha avuto luogo, il contabile ne informa l'ordinatore competente ed avvia senza indugio la procedura di recupero, con qualsiasi mezzo legale, se necessario anche mediante compensazione. Se ciò non è possibile, il contabile ricorre all'esecuzione forzata conformemente all'articolo 44, paragrafo 2 o tramite vie legali.	2. If recovery has not actually taken place by the due date specified in the recovery order, the accounting officer shall inform the authorising officer responsible and immediately initiate the procedure for effecting recovery by any means offered by the law, including, where appropriate, by offsetting. If this is not possible, the accounting officer shall enforce a recovery decision secured either in accordance with Article 44(2) or by a legal action.
3. 4. Nel contesto degli appalti eseguiti in economia di cui al titolo V ed in caso di mancato recupero entro i termini dei crediti del FES nei confronti dell'ordinatore nazionale attraverso le agenzie o i servizi pubblici o a partecipazione pubblica dello Stato ACP interessato, l'ordinatore competente prende tutte le misure necessarie per ottenere il rimborso effettivo delle somme dovute, compresa, se necessario, l'interruzione decisa dall'ordinatore principale del ricorso a questo tipo di appalti a favore dello Stato o del PTOM in questione.	4. In connection with the direct labour operations referred to in Title V, where claims that the EDF has on the National Authorising Officer via the public or semi-public bodies or departments of the ACP State or OCT concerned are not recovered within the prescribed time-limits, the authorising officer responsible shall take all the necessary measures to obtain actual repayment of the sums due, including, where appropriate, suspension by the Chief Authorising Officer of the use of that type of arrangement for that State or OCT.

The waiver decision must be substantiated. The authorising officer may delegate the decision only as laid down by the Commission in the rules referred to in paragraph 2.

1. L'ordinatore competente procede all'impegno finanziario prima di concludere un impegno giuridico della Commissione nei confronti di terzi.	1. 2. Danno luogo ad impegni finanziari della Commissione le decisioni di finanziamento adottate dalla Commissione secondo le disposizioni dell'accordo ACP-CE o della decisione sull'associazione d'oltremare che l'autorizzano ad accordare un aiuto finanziario a titolo del FES.	2. Financing decisions taken by the Commission, in accordance with the ACP-EC Agreement or the Overseas Association Decision, which authorise it to grant financial aid from the EDF, shall give rise to financial commitments by the Commission.

Sezione 3	Section 3

The amount of each individual legal commitment adopted by the Commission following a global commitment shall, prior to signature, be registered by the authorising officer responsible in the EDF financial accounts and booked to the global commitment.
4. Gli impegni giuridici contratti per azioni la cui realizzazione si estende su più di un esercizio e gli impegni finanziari corrispondenti comportano, fatte salve le spese amministrative di cui all'articolo 50, paragrafo 3, un termine d'esecuzione fissato secondo le esigenze della sana gestione finanziaria.	4. The legal commitments entered into for operations extending over more than one financial year and the corresponding financial commitments shall have a final date for implementation set in accordance with the requirements of sound financial management, save in the case of the administrative expenditure referred to in Article 50(3).
Le parti degli impegni non eseguite nei sei mesi successivi a tale data sono oggetto di disimpegno e gli stanziamenti corrispondenti sono annullati.	Any parts of such commitments which have not been implemented six months after that date shall be decommitted and the corresponding appropriations cancelled.

The termination of a project and the decommitment of the funds committed in accordance with paragraphs 1 to 4 shall be carried out when the legal commitments entered into by the Commission in connection with that project with respect to third parties are concluded and the related payments and collections have been recorded in the accounts.
6. Le disposizioni di cui al paragrafo 4 si applicano fatte salve le eventuali decisioni adottate dal Consiglio ai sensi dell'articolo 96 e dell'articolo 97 dell'accordo di partenariato ACP-CE.	6. a) contratti e programmi a preventivo di cui all'articolo 80, paragrafo 4, conformemente all'articolo 36, paragrafo 2, lettera i) dell'allegato IV dell'accordo ACP-CE o alle disposizioni pertinenti delle misure d'attuazione della decisione sull'associazione d'oltremare;	(a) endorses contracts and programme estimates, as provided for in Article 80(4) of this Regulation, in accordance with Article 36(2)(i) of Annex IV to the ACP-EC Agreement, or the relevant provisions of the measures implementing the Overseas Association Decision;

The termination of a project and the decommitment of the funds committed in accordance with paragraphs 1 to 4 shall be carried out after conclusion of the legal commitments entered into by the ACP State or OCT or its authorities, and/or by the Commission acting in their name and on their behalf in connection with that project with respect to third parties, and after the related payments and collections have been recorded in the accounts.

La liquidazione di una spesa è l'atto dell'ordinatore competente avente il seguente oggetto:	Validation of expenditure is the act whereby the authorising officer responsible:
a) verifica dell'esistenza dei diritti del creditore;	(a) verifies the existence of the creditor's entitlement;
b) determinazione e verifica dell'esistenza e dell'importo del credito;	(b) determines or verifies the reality and the amount of the claim;
c) verifica dell'esigibilità del credito.	(c) verifies the conditions in which payment is due.
Articolo 56	Article 56
1. La liquidazione di una spesa è basata su documenti giustificativi validi che attestano i diritti del creditore, sulla base dell'accertamento di servizi effettivamente resi, di forniture effettivamente consegnate o di lavori effettivamente eseguiti oppure sulla base di altri titoli che giustificano il pagamento. La natura dei documenti giustificativi da allegare al titolo di pagamento e le menzioni da riportare devono permettere i controlli di cui agli articoli 55, 58 e 60.	1. Validation of any expenditure shall be based on valid supporting documents attesting the creditor's entitlement, on the basis of a statement of services actually rendered, supplies actually delivered or work actually carried out or on the basis of other documents justifying payment. The nature of the supporting documents to be enclosed with the payment orders and the particulars to be included shall be such as to make it possible to carry out the checks provided for in Articles 55, 58 and 60.
2. I criteri per la firma del "visto per pagamento" sono determinati dall'ordinatore principale per analogia con le disposizioni corrispondenti delle modalità d'esecuzione del regolamento finanziario generale.	The Chief Authorising Officer shall lay down the criteria for signing the "passed for payment" voucher by analogy with the relevant provisions of the detailed rules for the implementation of the General Financial Regulation.
Articolo 58	Article 58
In un sistema non informatizzato, il "visto per pagamento" è costituito da un timbro che comporta la firma dell'ordinatore competente. Authorisation of expenditure is the act whereby the authorising officer responsible, by issuing a payment order, instructs the accounting officer to pay an item of expenditure which he has validated.
Articolo 60	Article 60
Quando emette l'ordine di pagamento, l'ordinatore competente verifica quanto segue:	When drawing up the payment order, the authorising officer responsible shall ensure that:
a) la regolarità dell'emissione dell'ordine di pagamento, che implica una corrispondente e previa decisione di liquidazione espressa col "visto per pagamento";	(a) the payment order has been properly issued, meaning that a corresponding validation decision has been taken previously in the form of "passed for payment";

e) l'importo da pagare, con l'indicazione della valuta di pagamento;	(e) the sum to be paid, indicating the currency in which it is to be paid;

Sezione 7	Section 7
Pagamento delle spese	Payment of expenditure
Articolo 63	Article 63
1. Il pagamento deve basarsi sulla prova che l'azione corrispondente, è conforme alle disposizioni dell'atto di base o del contratto, e consiste in uno dei seguenti atti:	1. Payment shall be made only on production of proof that the relevant action is in accordance with the provisions of the basic act or the contract and shall cover one or more of the following operations:
a) il pagamento della totalità degli importi dovuti;	(a) payment of the entire amount due;
b) un pagamento degli importi dovuti secondo le seguenti modalità:	(b) payment of the amounts due in any of the following ways:
i) un prefinanziamento, eventualmente frazionato in più versamenti;	(i) pre-financing, which may be divided into a number of payments,
ii) uno o più pagamenti intermedi;	(ii) one or more interim payments,
iii) un pagamento a saldo degli importi dovuti.	(iii) payment of the balance of the amounts due.

Il pagamento delle spese è eseguito dal contabile nei limiti dei fondi disponibili.	Payment of expenditure shall be made by the accounting officer within the limits of the funds available.
Articolo 65	Article 65
I pagamenti si effettuano tramite i conti bancari di cui all'articolo 28. Le modalità per l'apertura, il funzionamento e l'utilizzazione di questi conti sono determinate dalla Commissione.	Payments shall be effected through the bank accounts referred to in Article 28. The detailed rules for opening, administering and using such accounts shall be determined by the Commission.
Tali modalità prevedono in particolare la firma congiunta di due agenti debitamente autorizzati sui bonifici e su tutti i pagamenti bancari.	Those rules shall in particular require the joint signatures on transfer orders and all bank payments of two duly authorised officials.
Articolo 66	Article 66
1. Nei casi in cui il capo di delegazione esercita le funzioni di ordinatore sottodelegato a norma dell'articolo 21, paragrafo 2, i pagamenti corrispondenti possono essere effettuati da un contabile sottodelegato, se necessario sul posto.	1. In cases where the head of delegation performs the duties of authorising officer by sub-delegation in accordance with Article 21(2), the corresponding payments may be effected by an accounting officer by sub-delegation, where appropriate on the spot.

Articolo 67	Article 67
Le procedure di liquidazione, d'ordinazione e di pagamento delle spese devono essere compiute entro un termine di novanta giorni a partire dalla data di esigibilità del pagamento. L'ordinatore nazionale procede all'emissione dell'ordine di pagamento e lo notifica al capo di delegazione entro quarantacinque giorni dalla scadenza.	The validation, authorisation and payment of expenditure must be completed within a period of no more than 90 days from the date on which payment is due. The National Authorising Officer shall authorise the expenditure and notify the head of delegation accordingly no later than 45 days before that time limit expires.
I reclami concernenti i ritardi di pagamento di cui essa è responsabile secondo l'articolo 37 dell'allegato IV dell'accordo ACP-CE sono a carico della Commissione che li imputa sulle risorse del conto o dei conti di cui all'articolo 6, paragrafo 2 del presente regolamento. Espone nei dettagli il modo in cui il sistema garantisce l'esistenza di una pista di controllo completa per ogni operazione.	Each description shall define the content of all data fields and describe how the system treats each individual operation. It shall show in detail how the system guarantees the existence of a complete audit trail for each operation.

IL REVISORE INTERNO	INTERNAL AUDITOR
Articolo 69	Article 69
Il revisore interno del FES è il revisore interno della Commissione. Il revisore esercita le proprie funzioni nel rispetto delle norme internazionali pertinenti. È responsabile nei confronti della Commissione della verifica del corretto funzionamento dei sistemi e delle procedure d'esecuzione delle risorse del FES alla cui gestione provvede la Commissione a norma dell'articolo 1. Il revisore interno non può essere né ordinatore né contabile.	The internal auditor of the EDF shall be the internal auditor of the Commission. He shall perform his duties in accordance with the relevant international standards. He shall be accountable to the Commission for verifying the proper operation of systems and procedures for implementing EDF resources managed by the Commission under Article 1. The internal auditor may be neither authorising officer nor accounting officer.
Articolo 70	Article 70
1. Il revisore interno consiglia la Commissione riguardo al controllo dei rischi, esprimendo pareri indipendenti sulla qualità dei sistemi di gestione e di controllo e formulando raccomandazioni mirate a migliorare le condizioni di esecuzione delle operazioni e promuovere una sana gestione finanziaria. Può essere invitato a consigliare le autorità dei paesi ACP o dei PTOM sugli stessi argomenti.	1. The internal auditor shall advise the Commission on dealing with risks, by issuing independent opinions on the quality of management and control systems and by issuing recommendations for improving the conditions of implementation of operations and promoting sound financial management. He may be called on to advise the authorities of ACP countries or OCTs on the same topics.

3. Il revisore interno riferisce alla Commissione le sue constatazioni e raccomandazioni. Questa provvede a dar seguito alle raccomandazioni risultanti dalle revisioni contabili. Presenta inoltre alla Commissione una relazione annuale di revisione contabile interna indicando il numero ed il tipo di controlli effettuati, le raccomandazioni formulate ed il seguito dato a queste ultime.	3. APPALTI PUBBLICI	PROCUREMENT

Public contracts are contracts for pecuniary interest concluded in writing by a contracting authority within the meaning of Article 73 in order to obtain, against payment of a price paid in whole or in part from EDF resources, the supply of movable or immovable assets, the execution of works or the provision of services.

Articolo 73	Article 73

1. Le procedure per l'aggiudicazione degli appalti nell'ambito delle operazioni finanziate dal FES a favore dei PTOM sono definite nelle misure d'attuazione della decisione d'associazione oltremare.	The procedures for the award of contracts relating to operations financed by the EDF to assist OCTs shall be defined in the measures implementing the Overseas Association Decision.
2. La Commissione è tenuta al rispetto delle norme comunitarie sull'aggiudicazione degli appalti quando assume le funzioni di amministrazione aggiudicatrice ai fini dell'attuazione dell'aiuto umanitario e dell'aiuto d'urgenza nell'ambito dell'accordo ACP o della decisione sull'associazione d'oltremare.	2. Where the Commission acts as contracting authority for the implementation of humanitarian aid or emergency aid within the framework of the ACP-EC Agreement or the Overseas Association Decision, it shall be required to comply with the relevant Community rules on procurement.

PARTECIPAZIONE AGLI APPALTI	PARTICIPATION IN CONTRACTS

1. La partecipazione alle gare e agli appalti finanziati dal FES è aperta a parità di condizioni, secondo le disposizioni dell'articolo 20 dell'allegato IV dell'accordo ACP-CE.	1. Participation in tendering procedures in respect of contracts financed by the EDF shall be open on equal terms in accordance with the conditions laid down in Article 20 of Annex IV to the ACP-EC Agreement.
2. Possono essere ammessi a partecipare alle gare anche cittadini di paesi che non sono Stati ACP e Stati membri, compresi i PTOM, alle condizioni previste dall'articolo 22 dell'allegato IV dell'accordo ACP-CE.	2. Nationals of countries other than ACP States and the Member States, including the OCTs, may be authorised to take part in the tendering procedures in accordance with the conditions laid down in Article 22 of Annex IV to the ACP-EC Agreement.

Nei limiti delle competenze conferitele dall'accordo ACP-CE, la Commissione adotta le misure necessarie per costituire, analogamente a quanto disposto dal regolamento finanziario generale, una base di dati centrale in cui sono raccolti tutti i dati concernenti i candidati e gli offerenti che si trovano, secondo il disposto dell'articolo 28 dell'allegato IV dell'accordo ACP-CE, in una delle situazioni di esclusione dalla partecipazione alle gare e agli appalti finanziati dal FES.	Within the limits of the powers conferred on it by the ACP-EC Agreement the Commission shall take steps to establish, by analogy with the relevant rules of the general financial regulation, a central database containing details of candidates and tenderers who are, according to the rules defined in Article 28 of Annex IV to the ACP-EC Agreement, in a situation that excludes them from participation in procedures for the award of contracts relating to operations financed by the EDF.

Within the limits of the powers conferred on it by the ACP-EC Agreement and in accordance with the conditions laid down in Articles 21 and 34 of Annex IV thereto, the Commission shall take the necessary steps to have international tendering procedures published in the Official Journal of the European Union and on the Internet.

TITOLO V	TITLE V
APPALTI IN ECONOMIA	DIRECT LABOUR OPERATIONS
Articolo 80	Article 80
1. Il presente titolo disciplina gli appalti in economia di cui all'articolo 24 dell'allegato IV dell'accordo ACP-CE. Si applica, in quanto compatibile, alla cooperazione finanziaria con i PTOM.	1. This Title shall govern the direct labour operations provided for in Article 24 of Annex IV to the ACP-EC Agreement. It shall apply mutatis mutandis to financial cooperation with the OCT.
2. Nel caso degli appalti in amministrazione diretta, i progetti ed i programmi sono eseguiti in economia direttamente dai servizi pubblici dello Stato o degli Stati ACP interessati.	2. In the case of direct labour operations, projects and programmes shall be implemented directly through public departments of the ACP State or States concerned.
La Comunità contribuisce alle spese dei servizi interessati fornendo le attrezzature e/o i materiali mancanti e/o le risorse che permettano l'assunzione del personale supplementare necessario, come esperti aventi la cittadinanza dello Stato ACP interessato o di un altro Stato ACP. La partecipazione della Comunità riguarda soltanto la presa a carico di mezzi complementari e di spese d'esecuzione, temporanee, limitate alle necessità dell'intervento considerato.	The Community shall contribute to the costs of the department involved by providing the equipment and/or materials that it lacks and/or the resources to acquire any additional staff required, such as experts from within the ACP States concerned or other ACP States. The Community's participation shall cover only costs incurred by supplementary measures and temporary expenditure relating to execution that are strictly confined to the requirements of the project in question.
La gestione finanziaria di un progetto attuato in amministrazione diretta secondo il primo e il secondo comma è realizzata mediante conti di casse di anticipi gestiti da un amministratore e da un contabile, la cui nomina da parte dell'ordinatore nazionale deve essere preventivamente approvata dal capo di delegazione.	The financial management of a project implemented by direct labour in accordance with the first and second subparagraphs shall be carried out by imprest accounts administered by an imprest administrator and an accounting officer, appointed by the National Authorising Officer with the prior approval of the head of delegation.
3. Nel caso di appalti in amministrazione indiretta, le amministrazioni aggiudicatrici ai sensi dell'articolo 73, paragrafo 1, lettera a), affidano compiti inerenti all'esecuzione dei progetti o dei programmi ad organismi pubblici, semipubblici o privati, giuridicamente distinti dallo Stato o dagli Stati ACP interessati. In tal caso, l'organismo interessato provvede alla gestione ed all'esecuzione del progetto o del programma in luogo dell'ordinatore nazionale. I compiti così delegati possono includere il potere di stipulare contratti nonché la gestione dei contratti e la direzione dei lavori in nome e per conto dello Stato o degli Stati ACP interessati.	3. In the case of externalised direct labour operations, the contracting authorities within the meaning of Article 73(1)(a) shall entrust tasks relating to the implementation of projects or programmes to public, semi-public or private bodies that are legally distinct from the ACP State or States concerned. In such cases, the body concerned shall assume responsibility for the management and implementation of the programme or project in place of the National Authorising Officer. Tasks so delegated may include the power to conclude contracts and manage contracts and the supervision of works on behalf of or for the account of the ACP State or States concerned.
4. Gli appalti in economia sono attuati sotto forma di un programma d'interventi da realizzare e di una stima dei relativi costi, in prosieguo denominato "programma a preventivo". Il programma a preventivo è un documento contrattuale che fissa i mezzi in risorse umane e materiali necessari, il bilancio di previsione e le modalità tecniche ed amministrative d'attuazione per l'esecuzione di un progetto per un periodo di tempo determinato in economia amministrativa ed eventualmente mediante l'aggiudicazione di appalti pubblici e la concessione di sovvenzioni specifiche. Ogni programma a preventivo è preparato dall'amministratore e dal contabile di cui al paragrafo 2, in caso di appalti in amministrazione diretta, o dall'organismo terzo di cui al paragrafo 3, in caso di appalti in amministrazione indiretta, ed è quindi approvato dall'ordinatore nazionale e dal capo di delegazione prima dell'avviamento delle attività previste nel documento.	4. Direct labour operations shall be implemented on the basis of a programme of measures to be carried out and an estimate of their cost, hereinafter referred to as the "programme estimate". The programme estimate is a document laying down the human and material resources required, the budget and the detailed technical and administrative implementing arrangements for execution of a project over a specified period by direct labour and, possibly, by means of public procurement and the award of specific grants. Each programme estimate shall be prepared by the imprest administrator and the accounting officer referred to in paragraph 2, in the case of direct labour operations, or by the third party organisation referred to in paragraph 3, in the case of externalised direct labour operations, and shall then be approved by the National Authorising Officer and the head of delegation before the activities it provides for commence.
5. Nell'ambito dell'attuazione dei programmi a preventivo di cui al paragrafo 4, le procedure d'aggiudicazione degli appalti e di concessione delle sovvenzioni devono essere conformi a quelle enunciate ai titoli IV e VI rispettivamente. In particolare, le proposte d'aggiudicazione degli appalti devono essere approvate dal capo di delegazione secondo l'articolo 36 dell'allegato IV dell'accordo ACP-CE. Ciò si applica anche per le proposte di concessione delle sovvenzioni.	5. In the context of the implementation of the programme estimates referred to in paragraph 4, the procurement and grant award procedures shall comply with those laid down in Titles IV and VI respectively. In particular, proposals for the award of contracts must be approved by the head of delegation in accordance with Article 36 of Annex IV to the ACP-EC Agreement. The same shall apply to proposals to award grants.
6. Il ricorso all'attuazione dei progetti o dei programmi mediante appalti in economia dev'essere previsto nelle convenzioni di finanziamento di cui all'articolo 51, paragrafo 3.	6. The financing agreements referred to in Article 51(3) must make provision for the implementation of projects or programmes by direct-labour operations.
Articolo 81	Article 81
Nel caso degli appalti in amministrazione indiretta, l'amministrazione aggiudicatrice di cui all'articolo 73, paragrafo 1, lettera a), stipula un contratto di servizi con un organismo terzo. La Commissione provvede affinché il contratto preveda quanto segue:	In the case of externalised direct labour operations, the contracting authority referred to in Article 73(1)(a) shall conclude a service contract with a third party organisation. The Commission shall ensure that the contract sets out:
a) disposizioni adeguate per il controllo dell'utilizzazione delle risorse del FES da parte dell'ordinatore principale, del capo di delegazione e dell'OLAF, da parte dell'ordinatore nazionale e della Corte di conti e da parte degli organismi nazionali di controllo degli Stati ACP interessati;	(a) adequate provisions for scrutiny of the use of EDF resources by the Chief Authorising Officer, the head of delegation, OLAF, the National Authorising Officer, the Court of Auditors and the national audit bodies of the ACP State or States concerned;
b) la definizione chiara e l'esatta delimitazione dei poteri delegati all'organismo interessato e dei poteri attribuiti all'ordinatore nazionale;	(b) a clear definition and precise delimitation of the powers delegated to the organisation concerned and the powers retained by the National Authorising Officer;
c) le procedure da seguire per l'esercizio dei poteri così delegati quali la selezione delle azioni da finanziare, l'aggiudicazione degli appalti o la direzione dei lavori;	(c) the procedures to be followed in exercising the powers so delegated, such as the selection of operations to be financed, the award of contracts or the supervision of works;

Nell'ambito della gestione centralizzata, le sovvenzioni sono contributi finanziari diretti a carico delle risorse del FES, accordati dalla Commissione a titolo di liberalità, per finanziare quanto segue:	1. d) l'aiuto di bilancio diretto o indiretto e gli aiuti versati a titolo di sostegno alla riduzione del debito o di sostegno delle entrate da esportazione in caso di fluttuazioni a breve termine;	(d) direct or indirect budgetary assistance, or aid to help relieve debt or support export earnings in the event of short-term fluctuations;
e) i versamenti effettuati agli organismi delegati dalla Commissione di cui agli articoli 14 e 15 o nell'ambito della gestione congiunta di cui all'articolo 16. Articolo 84	Article 84
1. Quando un intervento nell'ambito della gestione centralizzata prevede un finanziamento sotto forma di sovvenzioni, la sua pianificazione operativa comprende una programmazione annuale, pubblicata all'inizio dell'esercizio, ad eccezione degli aiuti erogati per situazioni di crisi e le operazioni d'aiuto umanitario.	1. Where, in the context of centralised management, an action provides for financing in the form of grants, the operational plan for that action shall contain a programme, except in the case of crisis management aid or humanitarian aid operations.
Detta programmazione è attuata mediante la pubblicazione di inviti a presentare proposte, tranne in casi d'urgenza eccezionali e debitamente giustificati o se le caratteristiche del beneficiario lo impongono come unica scelta per un intervento determinato.	That programme shall be implemented through the publication of calls for proposals save in duly substantiated cases of urgency or where the nature of the beneficiary leaves no other choice for a given action.

Articolo 85	Article 85
1. Per uno stesso intervento può essere accordata una sola sovvenzione, a carico delle risorse del FES, a favore di uno stesso beneficiario.	1. One action may give rise to the award of only one grant from EDF resources to any one beneficiary.
2. Un beneficiario può ricevere una sola sovvenzione di funzionamento a carico delle risorse del FES per esercizio di bilancio del beneficiario.	2. A beneficiary may be awarded only one operating grant from EDF resources per financial year of the beneficiary.
Articolo 86	Article 86
1. La sovvenzione per interventi già avviati può essere ammessa solo se il richiedente può provare la necessità dell'avvio dell'intervento prima della firma della convenzione.	1. A grant may be awarded for an action which has already begun only if the applicant can demonstrate the need to start the action before the agreement was signed.
In tali casi, le spese ammissibili al finanziamento non possono essere anteriori alla data di deposito della domanda di sovvenzione, salvo in casi eccezionali debitamente giustificati o per spese necessarie all'erogazione di aiuti in situazioni di crisi e al buono svolgimento delle operazioni d'aiuto umanitario secondo le modalità previste dall'accordo ACP-CE o dalla decisione sull'associazione d'oltremare.	In such cases, expenditure eligible for financing may not have been incurred prior to the date of submission of the grant application, save in duly substantiated exceptional cases or in the case of expenditure necessary for the proper implementation of crisis management aid or humanitarian aid operations, as provided for in the ACP-EC Agreement or the Overseas Association Decision.

CAPO 3	CHAPTER 3
PROCEDIMENTO DI CONCESSIONE	AWARD PROCEDURE
Articolo 88	Article 88
1. Sono ammissibili le domande di sovvenzione presentate in forma scritta da parte di persone giuridiche, nell'ambito dell'accordo ACP-CE o della decisione sull'associazione d'oltremare, o di un programma o di un progetto approvato secondo le disposizioni di questi ultimi. A titolo di eccezione, in funzione della natura dell'intervento o dell'obiettivo perseguito dal richiedente, persone fisiche possono beneficiare delle sovvenzioni secondo le modalità previste dall'accordo e dalla decisione sull'associazione d'oltremare.	1. Grant applications shall be eligible where they fall under the ACP-EC Agreement or the Overseas Association Decision or a programme or project adopted in accordance with that Agreement or Decision and are submitted in writing by legal persons. By way of exception, depending on the nature of the action or the objective pursued by the applicant, natural persons may receive grants in accordance with the conditions laid down in the Agreement or Decision.
2. Sulla base dei criteri di selezione e di attribuzione preventivamente annunciati, le proposte sono valutate da un comitato di valutazione appositamente costituito, al fine di individuare le proposte che possono beneficiare di un finanziamento.	1. Proposals shall be evaluated, on the basis of pre-announced selection and award criteria, by an evaluation committee set up for that purpose, with a view to determining which proposals may be financed.
2. L'ordinatore competente stabilisce quindi, in base alla valutazione di cui al paragrafo 1, l'elenco dei beneficiari e gli importi considerati.	2. On the basis of the evaluation provided for in paragraph 1, the authorising officer responsible shall draw up the list of beneficiaries and the amounts approved.
3. L'ordinatore competente informa per iscritto il richiedente del seguito riservato alla sua domanda. In caso di rifiuto della sovvenzione richiesta, egli comunica i motivi del rifiuto della richiesta, in particolare sulla base dei criteri di selezione e di attribuzione preventivamente annunciati. I richiedenti sono informati entro i quindici giorni successivi alla trasmissione della decisione di concessione ai beneficiari.	3. The authorising officer responsible shall inform applicants in writing of the decision on their application. L'ordinatore competente può esigere dal beneficiario una garanzia preliminare per limitare i rischi finanziari inerenti al versamento dei prefinanziamenti.	The authorising officer responsible may require the beneficiary to lodge a guarantee in advance in order to limit the financial risks connected with the payment of pre-financing.
Tenuto conto delle difficoltà di accesso ai servizi bancari locali da parte degli attori non statali, tale garanzia è richiesta in relazione a prefinanziamenti superiori a un milione di euro o che rappresentano più del 90 % dell'importo complessivo della sovvenzione. L'ordinatore competente può tuttavia esonerare da tale obbligo i beneficiari che hanno concluso una convenzione quadro di partenariato.	Taking account of difficulties of access to local banking services, for non-state actors this guarantee shall be demanded in respect of pre-financing exceeding EUR one million or representing over 90 % of the total amount of the grant. The authorising officer responsible may however exempt from this obligation beneficiaries who have concluded a framework partnership agreement.

ESECUZIONE	IMPLEMENTATION

Where implementation of the action requires the award of procurement contracts by the beneficiary, the grant agreements referred to in Article 82(1) shall make provision for procedures that comply with the Community rules on procurement applicable to cooperation with non-member countries.

Nel quadro della gestione decentrata di cui all'articolo 13, la Commissione si adopera per promuovere presso gli Stati ACP e i PTOM beneficiari una gestione avente come obiettivo l'applicazione di disposizioni equivalenti a quelle del presente titolo.	In the context of decentralised management, referred to in Article 13, the Commission shall strive to encourage management by the beneficiary ACP States and OCTs that is aimed at applying provisions equivalent to those laid down in this Title.

CONTABILITÀ	ACCOUNTS
CAPO 1	CHAPTER 1
RENDICONTO	PRESENTATION OF THE ACCOUNTS
Articolo 96	Article 96
1. La Commissione forma, entro il 31 luglio di ogni anno, i conti del FES che ne descrivono la situazione finanziaria al 31 dicembre dell'esercizio trascorso. I conti del FES comprendono:	1. The Commission shall draw up, by 31 July each year at the latest, the accounts of the EDF describing the financial situation of the Fund as at 31 December of the preceding year. The EDF Accounts shall comprise:

Articolo 100	Article 100
1. Gli stati finanziari sono formati dal contabile e presentati in milioni di euro. Essi comprendono:	1. The financial statements shall be prepared by the accounting officer and presented in millions of euro. They shall comprise:

La Commissione trasmette alla Corte dei conti il progetto di conti entro il 31 marzo che segue l'esercizio chiuso. Trasmette al Parlamento europeo, al Consiglio e alla Corte dei conti, entro il 30 aprile, la relazione sulla gestione finanziaria dell'esercizio, di cui all'articolo 96.	The Commission shall send the provisional accounts to the Court of Auditors by 31 March of the following financial year at the latest. By 30 April it shall send the European Parliament, the Council and the Court of Auditors the report, referred to in Article 96, concerning financial management during the year.

1. La Corte dei conti formula, entro il 15 giugno, le sue osservazioni sul progetto di conti, relativamente alla parte delle risorse del FES per le quali la Commissione provvede all'esecuzione finanziaria a norma dell'articolo 1, paragrafo 2, per permettere alla Commissione di apportare le correzioni giudicate necessarie per stabilire i conti definitivi.	1. The Court of Auditors shall, by 15 June at the latest, make its observations on the provisional accounts as regards the part of the EDF resources for which the Commission is responsible for financial management under Article 1(2), so that the Commission can make the corrections deemed necessary for drawing up the final accounts.

CAPO 2	CHAPTER 2
INFORMAZIONE SULL'ESECUZIONE DELLE RISORSE DEL FES	INFORMATION ON IMPLEMENTATION OF EDF RESOURCES
Articolo 104	Article 104
1. La Commissione e la BEI controllano, ciascuna nell'ambito delle sue competenze, l'utilizzazione dell'assistenza del FES fatta dagli Stati ACP, dai PTOM e da qualsiasi altro beneficiario, nonché l'attuazione dei progetti finanziati con l'assistenza del FES, tenendo conto in modo particolare degli obiettivi di cui agli articoli 55 e 56 dell'accordo ACP-CE e alle corrispondenti disposizioni della decisione sull'associazione d'oltremare.	1. The Commission and the EIB shall monitor, each to the extent to which it is concerned, the use of EDF assistance by the ACP States, the OCTs or any other beneficiary, and the implementation of projects financed by the EDF, having particular regard to the objectives referred to in Articles 55 and 56 of the ACP-EC Agreement and in the corresponding provisions of the Overseas Association Decision.
2. La BEI informa periodicamente la Commissione sull'attuazione dei progetti finanziati con le risorse del FES da essa amministrate, secondo le modalità esposte negli orientamenti per il funzionamento del fondo investimenti.	2. The EIB shall periodically inform the Commission regarding the implementation of projects financed from the EDF resources it administers, following the procedures set out in the operational guidelines of the Investment Facility.
3. La Commissione e la BEI forniscono al comitato del FES le informazioni sull'attuazione operativa, a livello delle dotazioni nazionali e regionali di cui all'allegato delle risorse del FES. Le informazioni riguardano altresì le operazioni relative ai progetti e programmi finanziati con il fondo investimenti. Tali informazioni sono comunicate dalla Commissione alla Corte dei conti conformemente all'articolo 32, paragrafo 4 dell'accordo interno.	3. The Commission and the EIB shall provide the EDF Committee with information on the operational implementation of EDF resources through the national and regional allocations set out in the Annex. Such information shall also cover projects and programmes financed from the Investment Facility. The Commission shall send that information to the Court of Auditors in accordance with Article 32(4) of the Internal Agreement.
CAPO 3	CHAPTER 3
CONTABILITÀ	ACCOUNTING

The figures in the general accounts and the financial accounts shall be adopted at the close of the financial year so that the accounts referred to in Chapter 1 can be drawn up.

Il seguito e la contabilizzazione dei versamenti e delle altre entrate effettuati dagli Stati membri sono garantiti dal contabile.	The accounting officer shall be responsible for the monitoring and entry in the accounts of payments by the Member States and other revenue.

La contabilità generale riproduce in forma cronologica, secondo il metodo della partita doppia, gli eventi e le operazioni che intervengono nella situazione economica, finanziaria e patrimoniale del FES e il cui saldo costituisce il bilancio finanziario del FES.	The general accounts shall record, in chronological order using the double entry method, all events and operations affecting the economic and financial situation and the assets and liabilities of the EDF, and which make up the EDF balance sheet.

1. I movimenti di ciascun conto e i relativi saldi sono iscritti nei libri contabili.	1. Movements on the accounts and the balances shall be entered in the accounting ledgers.
2. Ogni scrittura contabile, comprese le correzioni contabili, è basata su documenti giustificativi ai quali fa riferimento.	2. All accounting entries, including adjustments to the accounts, shall be based on supporting documents, to which they shall refer.

Dopo la chiusura dell'esercizio finanziario e fino alla data del rendiconto, il contabile procede alle correzioni che, senza comportare esborsi o incassi a carico dell'esercizio, sono necessarie per una presentazione regolare, fedele e veritiera dei conti. d) pagamenti, crediti accertati e recuperi intervenuti durante l'esercizio per l'importo integrale e senza contrazioni fra di essi.	(d) payments, and established debts and collection operations for the financial year, in full and without any adjustment against each other.
2. Se necessario, quando stanziamenti delegati, pagamenti e crediti sono indicati in moneta nazionale, il sistema contabile deve consentirne la registrazione in tale moneta oltre a quella in euro.	2. When commitments, payments and debts are expressed in national currencies, the accounting system shall make it possible, where necessary, for them to be recorded in national currencies as well as in euro.

Gli stanziamenti delegati di cui all'articolo 54, paragrafo 3, sono contabilizzati in euro per il controvalore degli appalti, sovvenzioni e programmi a preventivo conclusi dallo Stato ACP o dal PTOM beneficiario o dalla Commissione nell'ambito dell'esecuzione del progetto. Tale controvalore tiene eventualmente conto di quanto segue:	The assigned funds defined in Article 54(3) shall be recorded in euro at the equivalent of the value of the contracts, grants and programme estimates concluded by the beneficiary ACP State or OCT or by the Commission in the performance of the project. That value shall include where appropriate:

4. I tassi di conversione da utilizzare per la contabilizzazione definitiva dei pagamenti effettuati nell'ambito dei progetti o programmi di cui alla quarta parte dell'accordo ACP-CE, nonché all'allegato IV dell'accordo o alla decisione sull'associazione d'oltremare, sono i tassi applicabili alla data in cui vengono addebitati i conti della Commissione di cui all'articolo 28 del presente regolamento.	4. The conversion rates to be used for final accounting of payments made under the projects or programmes referred to in Part 4 of the ACP-EC Agreement and Annex IV thereto or in the Overseas Association Decision shall be the rates applicable on the date on which the Commission accounts referred to in Article 28 of this Regulation were debited.
5. The accounting officer shall adopt the applicable accounting rules and methods. He shall prepare and, after consulting the Chief Authorising Officer, adopt the chart of accounts to be applied to the EDF's operations. In so doing he shall be guided by the internationally accepted accounting standards for the public sector but may depart from them where justified by the specific nature of the EDF's activities.
2. Le scritture contabili sono approvate in conformità del piano contabile. La nomenclatura di quest'ultimo comporta una separazione netta fra contabilità generale e contabilità finanziaria. DISPOSIZIONI GENERALI	GENERAL PROVISIONS
Articolo 112	Article 112
Le operazioni finanziate sulle risorse del FES, alla cui gestione provvede la BEI a norma dell'articolo 1, paragrafo 3, sono soggette alle procedure di controllo e di discarico previste dallo statuto della BEI per tutte le sue operazioni. Le modalità del controllo da parte della Corte dei conti figurano nell'accordo tripartito. Esse sono stabilite di comune accordo tra la BEI, la Commissione e la Corte dei conti nell'accordo vigente o in un eventuale nuovo accordo o in qualsiasi altro accordo sostitutivo.	The operations financed from EDF resources managed by the EIB in accordance with Article 1(3) shall be subject to the audit and discharge procedures laid down in the Statutes of the EIB for all of its operations. Detailed rules for auditing by the Court of Auditors are set out in the Tripartite Agreement. They shall be the result of a common agreement between the EIB, the Commission and the Court of Auditors in the Agreement currently in force or possibly by a new Agreement or any other agreement that may replace it.

In the performance of its task, the Court of Auditors shall notify the Commission and the authorities to which this Regulation applies of the names of the members of its staff who are empowered to audit them and the tasks entrusted to those persons.
Articolo 115	Article 115
1. Nell'ambito della cooperazione con gli Stati ACP, l'esame da parte della Corte dei conti della legittimità e della regolarità delle entrate e delle spese è conforme alle disposizioni dell'accordo ACP-CE, del presente regolamento e di ogni atto adottato in esecuzione degli stessi.	1. In respect of cooperation with the ACP States, the Court of Auditors, when examining whether all revenue has been received and all expenditure incurred in a lawful and proper manner, shall have regard to the provisions of the ACP-EC Agreement, this Regulation and all other acts adopted pursuant to those instruments.
Nell'ambito della cooperazione con i PTOM l'esame da parte della Corte dei conti della legittimità e della regolarità delle entrate e delle spese è conforme alle disposizioni del trattato CE, della decisione sull'associazione d'oltremare, del presente regolamento e di ogni altro atto applicabile.	In respect of cooperation with the OCT, the Court of Auditors, when examining whether all revenue has been received and all expenditure incurred in a lawful and proper manner, shall have regard to the provisions of the EC Treaty, the Overseas Association Decision, this Regulation and all other applicable acts.
2. Nell'assolvimento delle proprie attribuzioni, la Corte dei conti può prendere conoscenza, alle condizioni determinate al paragrafo 6, di tutti i documenti e informazioni riguardanti la gestione finanziaria dei servizi o organismi che riguardano le operazioni finanziate o cofinanziate sulle risorse del FES. In the performance of its task, the Court of Auditors shall be entitled to consult, in the manner provided for in paragraph 6, all documents and information relating to the financial management of departments or bodies with regard to operations financed or co-financed from EDF resources. It shall have the power to make enquiries of any official responsible for a revenue or expenditure operation and to use any of the auditing procedures appropriate to those departments or bodies.

3. La Corte dei conti cura che tutti i titoli ed i fondi depositati o in cassa siano verificati mediante attestazioni sottoscritte dai depositari o mediante verbali di situazioni di cassa e di portafoglio. The Court of Auditors shall ensure that all securities and cash on deposit or in hand are checked against vouchers signed by the depositories or against official memoranda of cash and securities held. The Court may carry out such checks itself.
4. At the request of the Court of Auditors, the Commission shall authorise financial institutions holding EDF deposits to enable the Court of Auditors to ensure that the external data tally with the accounts.
5. La Commissione accorda alla Corte dei conti ogni agevolazione e le fornisce tutte le informazioni di cui quest'ultima ritenga di aver bisogno per l'assolvimento dei suoi compiti. The Commission shall afford the Court of Auditors all the facilities and give it all the information which the latter deems necessary for the performance of its task. It shall place at the disposal of the Court of Auditors all documents concerning the award and performance of contracts and all accounts of cash or materials, all accounting records or supporting documents, and also administrative documents relating thereto, all documents relating to revenue and expenditure, all inventories, all organisation charts which the Court of Auditors considers necessary for auditing the financial outturn report on the basis of documents or on the spot and, for the same purposes, all documents and data created or stored on a magnetic medium.
Gli agenti soggetti alle verifiche della Corte dei conti sono tenuti a quanto segue:	The officials whose operations are checked by the Court of Auditors shall:
a) aprire le loro casse, esibire i denari, valori e materie di qualsiasi natura, i documenti giustificativi della loro gestione di cui sono depositari, nonché libri e registri e qualsiasi altro documento attinente;	(a) disclose their records of cash in hand, any other cash, securities and materials of any kind and the supporting documents in respect of their stewardship of the funds with which they are entrusted and any books, registers and other documents relating thereto;
b) esibire la corrispondenza e qualunque altro documento necessario alla completa esecuzione del controllo di cui al paragrafo 1.	(b) present the correspondence or any other document required for the full implementation of the audit referred to in paragraph 1.
La comunicazione delle informazioni di cui al secondo comma, lettera b), può essere chiesta solo dalla Corte dei conti.	The information referred to under (b) of the second subparagraph may be requested only by the Court of Auditors.
La Corte dei conti è autorizzata a verificare i documenti relativi alle entrate ed alle uscite del FES e che sono detenuti negli uffici competenti della Commissione.	The Court of Auditors shall be empowered to audit the documents relating to EDF revenue and expenditure which are held by the Commission departments responsible.
6. La verifica della legittimità e regolarità delle entrate e delle spese e il controllo della sana gestione finanziaria si estendono all'impiego, da parte degli organismi esterni alla Commissione, delle risorse del FES che questi hanno percepito e gestito, sotto forma di sovvenzioni, a norma del titolo VI. Qualsiasi finanziamento sulle risorse del FES a beneficiari esterni alla Commissione è subordinato all'accettazione scritta, da parte dei beneficiari o, in mancanza di questa, da parte degli appaltanti o dei subappaltanti, di una verifica eseguita dalla Corte dei conti sull'impiego dei finanziamenti accordati.	6. The task of establishing that the revenue has been received and the expenditure incurred in a lawful and proper manner and that the financial management has been sound shall extend to the utilisation by bodies outside the Commission of EDF resources which they have received and managed in the form of grants in accordance with Title VI. All financing from EDF resources granted to beneficiaries outside the Commission shall be subject to the agreement in writing by the beneficiaries or, failing agreement on their part, by the contractors or subcontractors, to an audit by the Court of Auditors of the use made of the financing granted.
7. L'uso di sistemi informatici integrati non può avere l'effetto di limitare l'accesso della Corte dei conti ai documenti giustificativi.	7. Use of integrated computer systems may not have the effect of impairing access by the Court of Auditors to supporting documents.
8. Le autorità nazionali di audit dei paesi beneficiari sono incoraggiate a partecipare ai lavori della Corte dei conti.	8. The national audit authorities of the beneficiary states shall be encouraged to participate in the work of the Court of Auditors.
Articolo 116	Article 116
1. Al termine di ciascun esercizio la Corte dei conti redige una relazione annuale disciplinata dai paragrafi da 2 a 6.	1. After the closure of each financial year, the Court of Auditors shall draw up an annual report in accordance with paragraphs 2 to 6.
2. La Corte dei conti trasmette alla Commissione, entro il 15 giugno, le osservazioni che ritiene di natura tale da dover figurare nella relazione annuale. Tali osservazioni devono rimanere riservate. La Commissione invia le proprie risposte alla Corte dei conti entro il 30 settembre.	2. The Court of Auditors shall transmit to the Commission, by 15 June at the latest, any observations which, in its opinion, are such that they should appear in the annual report. Those observations must remain confidential. The Commission shall address its replies to the Court of Auditors by 30 September at the latest.
3. Nella relazione annuale figura una valutazione della sana gestione finanziaria.	3. The annual report shall contain an assessment of the soundness of financial management.

The Court of Auditors shall take all necessary steps to ensure that the Commission's replies to its observations are published immediately after the observations to which they relate.
6. Entro il 31 ottobre, la Corte dei conti invia alle autorità responsabili del discarico e alla Commissione la propria relazione annuale accompagnata dalle risposte della Commissione e ne cura la pubblicazione nella Gazzetta ufficiale dell'Unione europea.	6. The Court of Auditors shall send its annual report, together with the Commission's replies, to the authorities responsible for giving discharge and to the Commission, by 31 October at the latest, and shall ensure the publication thereof in the Official Journal of the European Union.
Articolo 117	Article 117
1. La Corte dei conti comunica alla Commissione qualsiasi osservazione che, a suo avviso, deve figurare in una relazione speciale. Tali osservazioni devono rimanere riservate.	1. The Court of Auditors shall notify the Commission of any observations which, in its opinion, are such that they should appear in a special report. Those observations must remain confidential.
La Commissione dispone di un termine di due mesi e mezzo per comunicare alla Corte dei conti i propri eventuali commenti alle suddette osservazioni.	The Commission shall have two and a half months within which to inform the Court of Auditors of any comments it wishes to make on the observations in question.
La Corte dei conti adotta entro il mese successivo il testo definitivo della relazione speciale in questione.	The Court of Auditors shall adopt the definitive version of the special report in question the following month.
2. Le relazioni speciali di cui al paragrafo 1, accompagnate dalle risposte della Commissione, sono immediatamente comunicate al Parlamento europeo ed al Consiglio, ciascuno dei quali decide, eventualmente d'intesa con la Commissione, quale seguito darvi.	2. Articolo 118	Article 118
Contestualmente alla relazione annuale di cui all'articolo 116, la Corte dei conti presenta al Parlamento europeo e al Consiglio una dichiarazione attestante l'affidabilità dei conti, nonché la legittimità e la regolarità delle relative operazioni.	At the same time as the annual report referred to in Article 116, the Court of Auditors shall provide the European Parliament and the Council with a statement of assurance as to the reliability of the accounts and the legality and regularity of the underlying transactions.
CAPO 2	CHAPTER 3
DISCARICO	DISCHARGE
Articolo 119	Article 119
1. Il Parlamento europeo, su raccomandazione del Consiglio che delibera a maggioranza qualificata, dà discarico alla Commissione, entro il 30 aprile dell'anno n + 2, dell'esecuzione finanziaria delle risorse del FES dell'esercizio n., di cui cura la gestione a norma dell'articolo 1, paragrafo 2. Se tale data non può essere rispettata, il Parlamento europeo o il Consiglio informano la Commissione dei motivi per cui la decisione ha dovuto essere differita. Qualora il Parlamento europeo rinvii la decisione di discarico, la Commissione si adopera per prendere, al più presto, misure che consentano di facilitare la rimozione degli ostacoli che si frappongono a detta decisione.	1. Before 30 April of year N + 2, the European Parliament, upon a recommendation from the Council acting by a qualified majority, shall give a discharge to the Commission in respect of the financial implementation for year N of the EDF resources, which it manages in accordance with Article 1(2). If that date cannot be met, the European Parliament or the Council shall inform the Commission of the reasons for the postponement. Should the European Parliament postpone the decision giving discharge, the Commission shall make every effort to take measures, as soon as possible, to facilitate removal of the obstacles to that decision.
2. La decisione di discarico riguarda i conti del FES di cui all'articolo 96, ad eccezione della parte a cura della BEI conformemente all'articolo 125, paragrafo 2. The discharge decision shall cover the accounts referred to in Article 96, except the part thereof provided by the EIB in accordance with Article 125(2). The discharge decision shall include an assessment of the responsibility of the Commission in the execution of the financial management during the preceding period.
3. In vista del discarico, il Parlamento europeo esamina, successivamente al Consiglio, i conti del FES di cui all'articolo 96. With a view to granting the discharge, the European Parliament shall, after the Council has done so, examine the EDF accounts referred to in Article 96. It shall also examine the annual report made by the Court of Auditors together with the Commission's replies, any special reports by the Court of Auditors relevant to the financial year in question and the Court of Auditors' statement of assurance as to the reliability of the accounts and the legality and regularity of the underlying transactions.
4. La Commissione si adopera per dare seguito alle osservazioni che accompagnano la decisione di discarico del Parlamento europeo e ai commenti che accompagnano la raccomandazione di discarico adottata dal Consiglio.	4. The Commission shall take all appropriate steps to act on the observations accompanying the European Parliament's discharge decision and the comments accompanying the discharge recommendation adopted by the Council.
5. Su richiesta del Parlamento europeo o del Consiglio, la Commissione riferisce in merito alle misure adottate a seguito di tali osservazioni e commenti, in particolare sulle istruzioni da essa impartite agli uffici incaricati dell'esecuzione finanziaria del FES. At the request of the European Parliament or the Council, the Commission shall report on the measures taken in the light of those observations and comments, and, in particular, on the instructions given to those of its departments which are responsible for the financial implementation of EDF resources. That report shall also be sent to the Court of Auditors.
6. La decisione di discarico è pubblicata nella Gazzetta ufficiale dell'Unione europea.	6. The decision giving the discharge shall be published in the Official Journal of the European Union.
Articolo 120	Article 120
La Commissione presenta al Parlamento europeo, su richiesta di quest'ultimo, tutte le informazioni necessarie per il controllo dell'esecuzione delle risorse del FES nell'esercizio in oggetto alla cui gestione essa provvede a norma dell'articolo 1, paragrafo 2. L'accesso e il trattamento delle informazioni riservate avvengono nel rispetto dei diritti fondamentali della persona, della tutela del segreto professionale, delle regole sui procedimenti giudiziari e disciplinari e degli interessi della Comunità.	The Commission shall submit to the European Parliament, at the latter's request, any information required for the control of implementation of the EDF resources managed by the Commission in accordance with Article 1(2) for the year in question. Access to confidential information and the arrangements for handling it shall comply with fundamental human rights, the protection of business secrecy, the provisions governing judicial and disciplinary proceedings and the interests of the Community.
PARTE SECONDA	PART TWO
DISPOSIZIONI SPECIFICHE RELATIVE ALLE RISORSE DEL FES GESTITE DALLA BEI	SPECIFIC PROVISIONS CONCERNING EDF RESOURCES MANAGED BY THE EIB
Articolo 121	Article 121
Ogni anno la BEI comunica alla Commissione, entro il 1o settembre, le sue previsioni di impegni e di pagamenti necessarie ai fini della comunicazione di cui all'articolo 8, paragrafo 1 relativamente alle operazioni del Fondo investimenti, compresi gli abbuoni di interessi, conformemente all'accordo interno.	Each year, before 1 September, the EIB shall send the Commission its estimates of commitments and payments, which are necessary for drawing up the communication referred to in Article 8(1), in respect of the operations of the Investment Facility, including interest rate subsidies, in accordance with the Internal Agreement.

1. I contributi di cui all'articolo 39 stabiliti dal Consiglio sono versati dagli Stati membri alla BEI su un conto speciale aperto a nome di ciascuno Stato membro.	1. The contributions referred to in Article 39 and adopted by the Council shall be paid by the Member States to the EIB via a special account opened in the name of each Member State.
2. Salvo decisione contraria del Consiglio per quanto riguarda la remunerazione della BEI a norma dell'articolo 8 dell'accordo interno, gli utili percepiti dalla BEI sul saldo creditore dei conti speciali di cui al paragrafo 1 del presente articolo sono registrati in un conto a nome della Commissione ed utilizzati ai fini di cui all'articolo 9 di detto accordo.	2. Save where the Council decides otherwise regarding the remuneration of the EIB in accordance with Article 8 of the Internal Agreement, proceeds received by the Bank via the credit balance of the special accounts referred to in paragraph 1 of this Article shall be recorded in an account in the Commission's name, and used for the purposes set out in Article 9 of the Agreement.

The Investment Facility shall be managed in accordance with the conditions laid down in the ACP-EC Agreement, the Overseas Association Decision and the Internal Agreement.
Articolo 123	Article 123
La BEI è remunerata a copertura totale delle spese sostenute per la gestione delle operazioni effettuate a titolo del fondo investimenti. Il Consiglio decide le risorse ed i meccanismi di remunerazione della BEI conformemente all'articolo 8, paragrafo 2 dell'accordo interno. Le modalità d'applicazione della decisione del Consiglio sono integrate nella convenzione di gestione di cui all'articolo 128.	The EIB shall be remunerated on a full indemnity basis for the management of the Investment Facility operations. The Council shall decide on the resources and mechanisms for remuneration of the Bank in accordance with Article 8(2) of the Internal Agreement. The measures implementing that decision shall be incorporated in the management agreement provided for in Article 128.

The EIB shall keep the accounts of the Investment Facility, including interest rate subsidies, financed by the EDF to provide a trail for the full circuit of the funds, from receipt to disbursement and then to the revenue to which they give rise and any subsequent recoveries. The EIB and the Commission shall draw up the relevant accounting rules and methods by common agreement and inform the Member States accordingly.
2. La BEI trasmette ogni anno al Consiglio ed alla Commissione una relazione sull'esecuzione delle operazioni finanziate sulle risorse del FES di cui cura la gestione, compresi gli stati finanziari stabiliti secondo le norme e metodi di cui al paragrafo 1 e le informazioni di cui all'articolo 101, paragrafo 2.	2. Each year the EIB shall send the Council and the Commission a report on the implementation of operations financed from EDF resources under its management, including the financial statements drawn up in accordance with the rules and methods referred to in paragraph 1 and the information referred to in Article 101(2).

Articolo 129	Article 129
1. Le disposizioni del presente titolo disciplinano il trasferimento al 9o FES delle rimanenze delle risorse costituite nell'ambito degli accordi interni relativi rispettivamente al 6o(9), al 7o(10) e all'8o(11) FES (in prosieguo: "i FES precedenti").	1. The provisions of this Title shall govern the transfer to the 9th EDF of the balances remaining from resources constituted under the Internal Agreements relating to the 6th(9), 7th(10) and 8th(11) EDFs (hereinafter referred to as "previous EDFs").
2. Le rimanenze dei FES precedenti sono utilizzate per finanziare i programmi, i progetti e le altre azioni che contribuiscono alla realizzazione degli obiettivi dell'accordo ACP-CE e della decisione sull'associazione d'oltremare, secondo le disposizioni, rispettivamente, dell'accordo e della decisione stessa e alle condizioni previste dal presente titolo.	2. This paragraph shall apply without prejudice to Decision No 2/2000 of the ACP-EC Council of Ministers(12).

Resources that were allocated to OCTs before the entry into force of the Overseas Association Decision shall remain allocated to them. Any resources thus transferred to the 9th EDF after having been allocated previously to the indicative programme of an OCT or a region shall remain allocated to that OCT or to regional cooperation in the context of the implementation of the Overseas Association Decision.
3. Le rimanenze di entrate provenienti dagli interessi sulle risorse dei FES precedenti sono trasferite al 9o FES e sono assegnate agli stessi obiettivi previsti per le entrate di cui all'articolo 1, paragrafo 3 dell'accordo interno. The balance of revenue accruing from interest on the resources of previous EDFs shall be transferred to the 9th EDF and allocated for the same purposes as the revenue provided for in Article 1(3) of the Internal Agreement. The same shall apply to miscellaneous revenue of previous EDFs comprising, for example, default interest received in the event of late payment of contributions to those EDFs by Member States and the interest generated by the EDF resources managed by the EIB, that is payable to the Community.
Articolo 131	Article 131
1. 2. In respect of the OCTs, any balance that is not allocated to an indicative programme on the date when the Internal Agreement enters into force shall be assigned to the non-allocated amount of the EDF.
La disposizione del primo comma si applica in particolare a tutte le eventuali rimanenze degli importi globali di cui agli articoli 118 e 142 della decisione 91/482/CE del Consiglio(13), riguardanti rispettivamente gli strumenti Stabex e Sysmin. Possono tuttavia essere adottate decisioni di finanziamento relative alle rimanenze del Sysmin fino all'entrata in vigore dell'accordo interno, se viene presentata una richiesta di finanziamento prima della scadenza della decisione 91/482/CE.	The first subparagraph shall apply in particular to any balance remaining from the overall amounts referred to in Articles 118 and 142 of Council Decision 91/482/EC(13), which concern, respectively, the Stabex and Sysmin instruments. However, financing decisions concerning balances under Sysmin may be adopted up to the entry into force of the Internal Agreement if a request for financing was introduced before Decision 91/482/EC expired.

La Commissione adotta le modalità d'applicazione del presente titolo per quanto riguarda il trattamento definitivo, nell'ambito del 9o FES, delle rimanenze e degli importi da disimpegnare che devono essere trasferiti al 9o FES.	The Commission shall adopt the detailed arrangements for implementing this Title with regard to the definitive treatment under the 9th EDF of the remaining balances and amounts to be decommitted and transferred to the 9th EDF.
Dette modalità d'applicazione sono adottate previa consultazione della BEI per quanto concerne le risorse alla cui gestione provvede e in conformità delle norme fissate nell'accordo ACP-CE, nella decisione sull'associazione d'oltremare, nell'accordo interno e nel presente regolamento. Balances remaining from previous EDFs that are transferred to the 9th EDF shall be administered in accordance with the conditions laid down in this Title and in the relevant provisions of the ACP-EC Agreement, the Overseas Association Decision or the Internal Agreement.
2. Per quanto riguarda gli Stati ACP, gli impegni relativi ai FES precedenti effettuati prima dell'entrata in vigore dell'accordo ACP continuano ad essere eseguiti secondo le norme pertinenti per tali FES, eccetto per quanto riguarda la funzione del controllore finanziario, il rendimento dei conti e la procedura per la richiesta dei contributi, ai quali si applicano le disposizioni del presente regolamento. A partire dalla data d'entrata in vigore dell'accordo ACP-CE, le rimanenze trasferite al 9o FES sono utilizzate alle condizioni previste dall'accordo ACP-CE, dall'accordo interno e dal presente regolamento.	2. As regards the ACP States, commitments relating to previous EDFs entered into before the entry into force of the ACP-EC Agreement shall continue to be implemented in accordance with the rules applicable to those EDFs, save as regards the duties of the Financial Controller, the presentation of accounts and the procedure for calling contributions, for which the provisions of this Regulation shall apply. With effect from the date on which the ACP-EC Agreement enters into force, the balances transferred to the 9th EDF shall be used in accordance with the conditions laid down in the ACP-EC Agreement, the Internal Agreement and this Regulation.
Per i trasferimenti effettuati dai FES precedenti ai programmi indicativi nazionali o regionali di cui all'articolo 130, si applica quanto segue:	However, where transfers are made from previous EDFs for the benefit of national or regional indicative programmes, as provided for in Article 130:
a) se l'importo supera i dieci milioni di euro per paese o regione, tali risorse sono gestite in conformità delle norme del FES originario per quanto riguarda l'ammissibilità alla partecipazione a gare d'appalto e all'aggiudicazione di appalti;	(a) if the amount exceeds EUR 10 million per country or region, those resources shall be administered in accordance with the rules of the EDF of origin as regards eligibility for participation in tenders and the award of contracts;
b) se le risorse trasferite sono pari o inferiori a dieci milioni di euro, si applicano le norme d'ammissibilità relative agli appalti del 9o FES.	(b) if the resources transferred are equal to or less than EUR 10 million, the eligibility rules applicable to tenders under the 9th EDF shall apply.
3. Per quanto riguarda i PTOM, gli impegni relativi ai FES precedenti effettuati prima dell'entrata in vigore dell'accordo interno e del presente regolamento continuano ad essere eseguiti secondo le norme pertinenti per tali FES, eccetto per quanto riguarda la funzione del controllore finanziario, il rendimento dei conti e la procedura per la richiesta dei contributi, ai quali si applicano le disposizioni del presente regolamento. Le risorse dei FES precedenti continuano ad essere impiegate conformemente alle disposizioni pertinenti della decisione 91/482/CE che resta in vigore a tal fine fino alla data di entrata in vigore dell'accordo interno.	3. As regards the OCTs, commitments relating to the previous EDFs entered into before the entry into force of the Internal Agreement and this Regulation shall continue to be implemented in accordance with the rules applicable to those EDFs, save as regards the duties of the Financial Controller, the presentation of accounts and the procedure for calling contributions, for which the provisions of this Regulation shall apply. Resources from previous EDFs shall continue to be employed in accordance with the relevant provisions of Decision 91/482/EC, which shall remain applicable for that purpose until the entry into force of the Internal Agreement.
4. Le decisioni relative ai FES precedenti alla cui esecuzione finanziaria provvede la BEI continuano ad essere eseguite secondo le norme pertinenti per tali FES, eccetto per quanto riguarda la funzione del controllore finanziario e il rendimento dei conti. Decisions relating to previous EDFs for which the EIB undertakes the financial implementation shall continue to be implemented in accordance with the rules applicable to those EDFs, save as regards the duties of financial controller and the presentation of accounts. The procedure for calling contributions required to implement those decisions shall be that laid down in this Regulation in the case of operations managed by the Commission.
Articolo 134	Article 134
Per garantire che l'esecuzione degli impegni assunti nell'ambito dei FES precedenti si concluda nel rispetto del principio della sana gestione finanziaria, la Commissione attua procedure che prevedono in particolare che una convenzione di finanziamento possa essere prorogata una sola volta e per un periodo non superiore a tre anni a decorrere dal termine finale d'esecuzione inizialmente previsto per il completamento dei programmi o dei progetti finanziati dalla convenzione in questione.	To ensure that commitments entered into under previous EDFs are completed in accordance with the principle of sound financial management, the Commission shall implement procedures which provide, in particular, that, after this Regulation enters into force, a financing agreement may be renewed only once and may not in any event be renewed for a period of more than three years from the deadline laid down at the time of that entry into force for the completion of the programme or project financed by the agreement in question.
CAPO 3	CHAPTER 3

1. Le procedure concernenti i contributi degli Stati membri di cui agli articoli 8, 38 e 40 si applicano per la prima volta per la prima quota di contributi proposta dopo l'entrata in vigore del presente regolamento.	1. 2. I termini di cui agli articoli 102, 103, 116 e 125 si applicano per la prima volta a titolo dell'esercizio 2005.	2. The deadlines referred to in Articles 102, 103, 116 and 125 shall apply for the first time in respect of financial year 2005.

Articolo 136	Article 136
1. Conformemente agli articoli 2 e 34 dell'accordo interno, prima della scadenza del FES gli Stati membri valutano il livello di esecuzione degli impegni e dei pagamenti. In tale occasione valutano anche il fabbisogno della Commissione nell'ambito delle risorse riservate alle spese di attuazione di cui agli articoli 4 e 9 dell'accordo interno. L'opportunità di assegnare nuove risorse al sostegno della cooperazione finanziaria e alle spese di attuazione di cui all'articolo 9 dell'accordo interno viene stabilita sulla base di tale valutazione. A tal fine si tiene debito conto delle risorse del FES non impegnate o non pagate.	1. In accordance with Articles 2 and 34 of the Internal Agreement, the Member States shall assess the degree to which commitments and disbursements have been carried out before the expiry of the EDF. On that occasion they shall also assess the Commission's needs in respect of the resources reserved for costs linked to implementation under Articles 4 and 9 of the Internal Agreement. The need for new resources to support financial cooperation and costs linked to implementation under Article 9 of the Internal Agreement shall be established in the light of that assessment. Due account shall be taken of the uncommitted and non-disbursed resources under the EDF.

Il presente regolamento entra in vigore il giorno successivo alla pubblicazione nella Gazzetta ufficiale dell'Unione europea.	This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
Esso si applica per lo stesso periodo previsto per l'accordo interno.	It shall be applicable for the same period as the Internal Agreement.

ALLEGATO	ANNEX
INFORMAZIONI FINANZIARIE SUL FES	FINANCIAL INFORMATION ON THE EDF
1. Conformemente all'articolo 1 dell'accordo interno, il FES è dotato di un importo massimo di 13800 milioni di EUR finanziati dagli Stati membri con i seguenti contributi:	1. In accordance with Article 1 of the Internal Agreement, the EDF shall consist of an amount of up to EUR 13800 million contributed by the Member States as follows:

Out of the total amount stated in Article 1(2)(a) of the Internal Agreement, an amount of up to EUR 13500 million shall be reserved for the ACP States and allocated as follows:
a) sino a un importo massimo di 10000 milioni di EUR sotto forma di aiuti a fondo perduto, di cui:	(a) up to EUR 10000 million in the form of non-repayable aid comprising up to:
i) 9836 milioni di EUR per aiuti allo sviluppo a lungo termine, secondo la programmazione di cui agli articoli 1-5 dell'allegato IV dell'accordo ACP-CE. Queste risorse potranno essere utilizzate per finanziare l'aiuto umanitario e azioni d'urgenza a breve termine, a norma dell'articolo 72, paragrafo 3, dell'accordo ACP-CE; un importo di 195 milioni di EUR di questa dotazione è destinato al finanziamento degli abbuoni di interesse di cui agli articoli 3, lettera c) dell'allegato I, 2 e 4 dell'allegato II dell'accordo ACP-CE;	(i) EUR 9836 million reserved for support for long-term development to be programmed in accordance with Articles 1 to 5 of Annex IV to the ACP-EC Agreement. Those resources may be used to finance humanitarian aid and short-term emergency aid in accordance with Article 72(3) of the ACP-EC Agreement. Out of that total allocation, EUR 195 million shall be earmarked to finance the interest rate subsidies provided for in Article 3(c) of Annex I to the ACP-EC Agreement and Articles 2 and 4 of Annex II thereto;
ii) 90 milioni di EUR per il finanziamento del bilancio del Centro per lo sviluppo delle imprese (CSI), ai sensi delle disposizioni dell'allegato III dell'accordo ACP-CE;	(ii) EUR 90 million reserved for the financing of the budget of the Centre for Development of Enterprise (CDE) in accordance with the provisions of Annex III to the ACP-EC Agreement;
iii) 70 milioni di EUR per il finanziamento del bilancio del Centro tecnico per l'agricoltura e la cooperazione rurale (CTA), ai sensi delle disposizioni dell'allegato III dell'accordo ACP-CE;	(iii) EUR 70 million reserved for the financing of the budget of the Technical Centre for Agriculture and Rural Cooperation (CTA) in accordance with the provisions of Annex III to the ACP-EC Agreement; and
iv) 4 milioni di EUR per coprire le spese dell'assemblea paritetica ACP-CE, costituita ai sensi dell'articolo 17 dell'accordo ACP-CE;	(iv) EUR 4 million for the expenditure relating to the ACP-EC Joint Assembly, constituted by Article 17 of the ACP-EC Agreement;
b) fino a concorrenza di 1300 milioni di EUR per finanziare il sostegno alla cooperazione e all'integrazione regionali degli Stati ACP, a norma degli articoli da 6 a 14 dell'allegato IV dell'accordo ACP-CE;	(b) up to EUR 1300 million reserved for the financing of support for regional cooperation and integration of the ACP States in accordance with Articles 6 to 14 of Annex IV to the ACP-EC Agreement;
c) fino a concorrenza di 2200 milioni di EUR per finanziare il Fondo investimenti secondo le modalità e le condizioni precisate nell'allegato II ("Modalità e condizioni di finanziamento") dell'accordo ACP-CE, fermo restando il finanziamento degli abbuoni di interessi, di cui agli articoli 2 e 4 dell'allegato II dell'accordo, con le risorse indicate alla lettera a), i) del presente paragrafo.	(c) up to EUR 2200 million shall be allocated to finance the Investment Facility in accordance with the terms and conditions set out in Annex II ("Terms and conditions of financing") to the ACP-EC Agreement, without prejudice to the financing of the interest rate subsidies provided for in Articles 2 and 4 of Annex II to the Agreement funded from the resources mentioned in point (a)(i) of this Section.
2.2. Dei 13500 milioni di EUR di cui al paragrafo 2.1, un importo di 1000 milioni di euro può essere mobilizzato solo dopo un riesame dei risultati che il Consiglio effettuerà nel 2004 su proposta della Commissione. Le eventuali risorse mobilizzate sono opportunamente assegnate alle dotazioni di cui al paragrafo 2.1, lettere a), b) e c).	2.2. Out of the EUR 13500 million referred to in Section 2.1, an amount of EUR 1000 million may be released only following a performance review undertaken by the Council in 2004, on the basis of a proposal from the Commission. Those resources shall, if released, be distributed as appropriate between the envelopes referred to in points (a), (b) and (c) of Section 2.1.
3. L'importo globale dell'assistenza finanziaria fornita dalla Comunità ai PTOM sul totale indicato all'articolo 1, paragrafo 2, lettera a) dell'accordo interno è pari a 175 milioni di EUR, di cui 155 milioni di EUR sotto forma di aiuti non rimborsabili, di cui un importo di un milione di EUR è destinato al finanziamento degli abbuoni di interessi di cui all'articolo 3, paragrafo 3, lettera d) dell'allegato IIA della decisione d'associazione oltremare, e 20 milioni di EUR nel quadro del Fondo investimenti. Le disposizioni che disciplinano l'attuazione dell'assistenza sono stabilite nella decisione del Consiglio sull'associazione dei PTOM alla Comunità, adottata a norma dell'articolo 187 del trattato.	3. The overall amount of financial assistance to the OCTs allocated by the Community out of the overall amount stated in Article 1(2)(a) of the Internal Agreement shall be EUR 175 million, of which EUR 155 million in the form of non-repayable aid, including EUR 1 million set aside to finance the interest rate subsidies provided for in Article 3(3)(d) of Annex IIA to the Overseas Association Decision, and EUR 20 million under the Investment Facility. The rules governing the implementation of that assistance shall be laid down in the Council Decision on the association of the OCTs with the Community, adopted pursuant to Article 187 of the Treaty.
4. Un importo di 125 milioni di EUR è destinato a finanziare le spese di esecuzione impegnate dalla Commissione nel quadro dell'accordo ACP-CE. È utilizzato conformemente ai principi stabiliti all'articolo 9 dell'accordo interno e aumentato delle risorse di cui all'articolo 1, paragrafo 3 dello stesso accordo.	4. An amount of EUR 125 million shall be reserved for the financing of costs linked to implementation incurred by the Commission in the framework of the ACP-EC Agreement. It shall be utilised in accordance with the principles set out in Article 9 of the Internal Agreement together with the resources referred to in Article 1(3) of that Agreement.
5.1. All'importo indicato al paragrafo 1, secondo comma, si aggiungono, fino a concorrenza di 1720 milioni di EUR, i prestiti concessi dalla Banca europea per gli investimenti sulle sue risorse proprie. Questi prestiti sono concessi ai fini indicati nell'allegato II dell'accordo ACP-CE e nella decisione di associazione oltremare, conformemente alle condizioni previste dagli statuti della Banca e alle disposizioni applicabili delle modalità e condizioni di finanziamento degli investimenti di cui all'allegato e alla decisione suddetti.	5.1. To the amount laid down in the second paragraph of Section 1 shall be added up to EUR 1720 million in the form of loans granted by the EIB from its own resources. Those resources shall be granted for the purposes set out in Annex II to the ACP-EC Agreement and in the Overseas Association Decision, in accordance with the conditions provided for by its statutes and the relevant provisions of the terms and conditions for investment financing as laid down in that Annex and Decision.
5.2. Questi prestiti sono destinati:	5.2. Those loans shall be allocated as follows:
a) sino a un importo massimo di 1700 milioni di EUR, ad operazioni di finanziamento da realizzare negli Stati ACP;	(a) up to EUR 1700 million for financing operations to be carried out in the ACP States;
b) sino a un importo massimo 20 milioni di EUR, ad operazioni di finanziamento da realizzare nei PTOM.	(b) up to EUR 20 million for financing operations to be carried out in the OCTs.
