Convention between the European Community and the United Nations Relief and Works Agency for Palestine Refugees (UNRWA) concerning aid to refugees in the countries of the Near East (2002 to 2005)

Articolo 1

Article 1

Scopo

Purpose

La Comunità europea (in appresso denominata "la Comunità") conclude la presente convenzione con l'Agenzia delle Nazioni Unite per il soccorso e l'occupazione dei profughi palestinesi (in appresso denominata "UNRWA") per confermare il suo impegno relativamente a un sostegno finanziario all'UNRWA sotto forma di contributi in denaro, per un periodo di quattro anni (2002-2005), destinati al fondo generale dell'UNRWA.

The European Community (hereinafter referred to as "the Community") hereby concludes this Convention with the United Nations Relief and Works Agency for Palestine Refugees in the Near East (hereinafter referred to as "UNRWA") in order to confirm its commitment to financial support to UNRWA. This funding, extending over a four-year period (2002 to 2005), shall take the form of cash contributions for use under the UNRWA General Fund.

L'impegno finanziario è subordinato alle disponibilità di bilancio e tiene conto delle prospettive finanziarie della Comunità europea fino al 2006.

The financial commitment shall be made subject to budgetary availability and with respect to the financial perspectives of the Community until the year 2006.

Community contribution

1. La Comunità versa annualmente all'UNRWA un contributo in denaro al fondo generale.

1. The Community shall pay to UNRWA annually a cash contribution towards the General Fund.

Fatto salvo l'articolo 3 della presente convenzione, l'entità del contributo non supererà 55 milioni di EUR nel 2002, 57,75 milioni di EUR nel 2003, 60637500 EUR nel 2004 e 63669375 EUR nel 2005.

Notwithstanding Article 3 of this Convention, the size of this contribution shall not exceed EUR 55 million in 2002, EUR 57,75 million in 2003, EUR 60637500 in 2004, and EUR 63669375 in 2005.

2. Il contributo al fondo generale viene erogato mediante accordi di sovvenzionamento conclusi tra la Commissione delle Comunità europee e l'UNRWA, per il periodo 2002-2005, nel pieno rispetto dell'accordo del 9 agosto 1999 fra le Nazioni Unite e la Comunità europea sui principi da applicare ai finanziamenti o cofinanziamenti da parte della Comunità di programmi e progetti amministrati dalle Nazioni Unite.

2. The contribution to the General Fund shall be made by means of grant agreements to be concluded between the Commission of the European Communities and UNRWA covering the years 2002 to 2005. The grant agreements shall be concluded fully in accordance with the provisions of the Agreement between the United Nations and the European Community on the principles applying to the financing or co-financing by the Community of programmes and projects administered by the United Nations of 9 August 1999.

3. Il contributo è soggetto alle procedure di verifica contabile interne ed esterne stabilite dai regolamenti finanziari, dalle norme e dalle direttive dell'UNRWA, il cui risultato viene debitamente comunicato alla Commissione.

3. The contribution shall be subject to the internal and external auditing procedures laid down in the Financial Regulations, Rules and directives of UNRWA, the result of which will be duly communicated to the Commission.

Aiuti alimentari

Food aid

Sulla base della valutazione annuale delle esigenze dei profughi, è prevista la possibilità di mobilitare altre risorse comunitarie per il programma alimentare dell'UNRWA onde rispondere alle esigenze specifiche dei gruppi vulnerabili. Gli importi, i quantitativi e le caratteristiche delle merci, dei contributi in denaro e dei servizi forniti e tutte le altre condizioni connesse con il sostegno a favore del programma alimentare dovranno rispettare le condizioni concordate separatamente sulla base di richieste annuali dell'UNRWA.

Taking into account the annual evaluation of the needs of the refugee population, other Community resources may also be mobilised for UNRWA's food aid programme to meet the specific needs of vulnerable groups. The amounts, quantities and characteristics of the commodities, cash and services provided and all other conditions related to support to the food aid programme will be subject to separately agreed conditions, based on annual requests from UNRWA.

Se del caso, durante il periodo di applicazione della presente convenzione le parti possono modificare di concerto alcuni elementi dei contributi altrimenti fissati dalla convenzione, sulla base di uno scambio di lettere tra la Comunità e l'UNRWA.

If necessary, during the life of this Convention, the parties may by mutual agreement increase or decrease those parts of the contributions otherwise fixed under this Convention, on the basis of an Exchange of Letters between the Community and UNRWA.

Le parti riesamineranno entro la fine del 2003 gli sviluppi politici concernenti i profughi. Si procederà inoltre ad una valutazione dei piani eventualmente formulati dall'UNRWA, di cui si terrà conto per il trasferimento delle funzioni all'Autorità palestinese e/o ad un altro ente.

By the end of 2003, political developments regarding the refugees will be reviewed by the parties, and an evaluation made of any plans UNRWA has formulated, and, if this is the case, put into effect, for the hand-over of its functions to the Palestinian Authority and/or any other body.

Qualora, durante il periodo di applicazione della presente convenzione, alcune o tutte le funzioni dell'UNRWA dovessero essere trasferite all'Autorità palestinese o ad un altro ente, saranno effettuati gli adeguamenti necessari per i corrispondenti elementi del contributo comunitario destinato all'UNRWA nel quadro della presente convenzione, sulla base di uno scambio di lettere tra la Comunità e l'UNRWA.

If, during the life of this Convention, any or all of the functions of UNRWA are transferred to the Palestinian Authority or to any other body, necessary adjustments will be made to those parts of the Community contribution to UNRWA under this Convention, on the basis of an Exchange of Letters between the Community and UNRWA.

Arbitrato

Arbitration clause

1. Le eventuali controversie o istanze concernenti l'interpretazione, l'applicazione o l'attuazione della presente convenzione, comprese la sua esistenza, validità o conclusione, che non possano essere composte in maniera amichevole tra le parti, saranno deferite per arbitrato ai sensi del regolamento arbitrale opzionale della Corte permanente di arbitrato per le organizzazioni internazionali e gli Stati, in vigore alla data della firma della presente convenzione.

1. Any dispute, controversy or claim arising out of, or relating to, the interpretation, application or fulfilment of this Convention, including its existence, validity or termination, which cannot be settled amicably between the Parties shall be referred to arbitration in accordance with the Permanent Court of Arbitration optional rules for arbitration for international organisations and States in force at the date of signature of this Convention.

2. È previsto un unico arbitro.

2. There shall be one arbitrator.

3. La lingua utilizzata durante l'arbitrato sarà l'inglese.

3. The language to be employed during arbitration shall be English.

4. In assenza di accordo tra le due parti, l'ente arbitrale sarà designato dal presidente della Corte internazionale di giustizia, previa richiesta scritta presentata da una delle parti.

4. In the absence of agreement between the two Parties, the arbitrator shall be designated by the President of the International Court of Justice following written request submitted by either Party.

5. L'arbitro deciderà secondo i termini e le condizioni della presente convenzione, sulla base dei principi giuridici generali riconosciuti dagli Stati.

5. The arbitrator shall reach his/her decision in accordance with the terms and conditions of this Convention in the light of the general principles of law recognised by States.

Accordo sulle intese globali

Agreement on global arrangements

Previo accordo nel quadro dei dibattiti tra le Nazioni Unite e la Commissione sulle intese globali che si applicano alla donazione di contributi volontari, le disposizioni pertinenti di tale accordo e la presente convenzione saranno riviste tempestivamente e saranno effettuate tutte le modifiche necessarie concordate dall'UNRWA e dalla Commissione alle disposizioni applicabili della presente convenzione.

Following agreement in the discussions being held between the United Nations and the Commission on global arrangements covering the donation of voluntary contributions, the relevant provisions of such agreement and this Convention shall be promptly reviewed, and any necessary amendments agreed to by UNRWA and the Commission shall be made to the applicable provisions of this Convention.

La presente convenzione è conclusa per un periodo di quattro anni civili (2002, 2003, 2004 e 2005).

La presente convenzione è approvata dalle parti secondo le loro rispettive procedure.

This Convention shall be approved by the Parties in accordance with their own procedures.

La presente convenzione entra in vigore il primo giorno del mese che segue la data in cui le parti hanno notificato la conclusione delle procedure di cui al primo comma.

This Convention shall enter into force on the first day of the month following the date on which the Parties notify each other that the procedures referred to in the first subparagraph have been completed.

This Convention shall be drawn up in duplicate in the Danish, Dutch, English, Finnish, French, German, Greek, Italian, Portuguese, Spanish and Swedish languages, each version being equally authentic.
