Having regard to the Treaty establishing the European Community,

vista la direttiva 92/14/CEE del Consiglio, del 2 marzo 1992, sulla limitazione dell'utilizzazione degli aerei disciplinati dall'allegato 16 della convenzione sull'aviazione civile internazionale, volume 1, parte II, capitolo 2, seconda edizione (1988)(1), modificata da ultimo dalla direttiva 99/28/CE della Commissione(2), in particolare l'articolo 9 bis,

Having regard to Council Directive 92/14/EEC of 2 March 1992 on the limitation of the operation of aeroplanes covered by Part II, Chapter 2, Volume 1 of Annex 16 to the Convention on International Civil Aviation, second edition (1988)(1), as last amended by Commission Directive 99/28/EC(2) and in particular Article 9a thereof,

considerando quanto segue:

Whereas:

(1) L'articolo 3 della direttiva 92/14/CEE prevede un'esenzione per gli aerei figuranti nell'allegato purché essi continuino ad essere utilizzati da persone fisiche o giuridiche stabilite nei paesi in cui sono stati immatricolati durante uno specifico periodo di riferimento.

(1) Article 3 of Directive 92/14/EEC exempts the aeroplanes listed in the Annex thereto, provided, in particular, that they continue to be used by natural or legal persons established in the country in which those aeroplanes were registered during a specific reference period.

(2) L'articolo 9 bis della direttiva 92/14/CEE, modificata dalla direttiva 98/20/CE(3), definisce una procedura semplificata per l'adozione di modifiche dell'allegato volte ad assicurare la piena conformità ai presupposti per l'applicazione dell'esenzione.

(2) Article 9a of Directive 92/14/EEC, as amended by Council Directive 98/20/EC(3), provides for a simplified procedure for amendments to the Annex, with a view to ensuring full conformity with the eligibility criteria.

(3) Dall'entrata in vigore della direttiva 99/28/CE, che per prima ha modificato l'allegato della direttiva 92/14/CEE sulla base della procedura semplificata, alcuni aerei figuranti nell'allegato sono stati demoliti e altri sono stati cancellati dai registri dei rispettivi paesi considerati. È quindi opportuno che le voci relative a tali aeroplani siano cancellate dall'allegato.

(3) Since the entry into force of Directive 99/28/EC, which first amended the Annex to Directive 92/14/EEC on the basis of the simplified procedure, some aeroplanes included in the Annex have been destroyed, whilst others have been removed from the register of the relevant country; the corresponding entries for such aeroplanes should, therefore, be deleted from the Annex.

(4) Alcuni degli aerei dotati dei necessari requisiti raggiungeranno i 25 anni di età nel 2001 e le voci ad essi relative dovrebbero pertanto essere inserite nell'allegato.

(4) Some qualifying aeroplanes will reach 25 years of age in the course of 2001; the appropriate entries should, therefore, be inserted in the Annex.

(5) È inoltre opportuno aggiornare l'allegato alla luce di eventuali cambiamenti del codice di registrazione, o dell'operatore, di un aereo già inserito nell'allegato.

(5) It is also desirable to update the Annex in the light of any supervening changes to the registration code, or to the operator, of an aircraft already included.

(6) La natura e la portata limitate delle modifiche all'allegato e l'urgenza di tali modifiche giustificano un cambiamento nel tipo di strumento giuridico utilizzato.

(6) The limited nature and scope of the amendments to the Annex as well as the urgency justify a change in the type of legal instrument employed.

(7) È necessario che il presente regolamento entri in vigore quanto prima affinché le parti interessate possano prendere conoscenza al più presto delle esenzioni che esso prevede.

(7) It is necessary for this Regulation to enter into force as a matter of urgency, in order to make available to interested parties, without delay, the exemptions which it provides.

(8) Le misure di cui al presente regolamento sono conformi al parere del comitato per i regolamenti sulla sicurezza dell'aviazione(4) istituito dal regolamento (CEE) n. 3922/91 del Consiglio, del 16 dicembre 1991, concernente l'armonizzazione di regole tecniche e di procedure amministrative nel settore dell'aviazione civile(5), modificato da ultimo dal regolamento (CE) n. 2871/2000 della Commissione(6),

(8) The measures provided for in this Regulation are in accordance with the opinion of the Aviation Safety Regulation Committee(4) established by Council Regulation (EEC) No 3922/91 of 16 December 1991 on the harmonisation of technical requirements and administrative procedures in the field of civil aviation(5), as last amended by Commission Regulation (EC) No 2871/2000(6),

HA ADOTTATO IL PRESENTE REGOLAMENTO:

The Annex to Directive 92/14/EEC is hereby amended as set out in the Annex to this Regulation.

Il presente regolamento entra in vigore il giorno della sua pubblicazione nella Gazzetta ufficiale delle Comunità europee.

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Communities.

Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
