Decisione del Consiglio del 5 aprile 2001 relativa alla conclusione da parte della Comunità europea della convenzione per l'unificazione di alcune norme relative al trasporto aereo (convenzione di Montreal)

Council Decision of 5 April 2001 on the conclusion by the European Community of the Convention for the Unification of Certain Rules for International Carriage by Air (the Montreal Convention)

IL CONSIGLIO DELL'UNIONE EUROPEA,

THE COUNCIL OF THE EUROPEAN UNION,

visto il trattato che istituisce la Comunità europea, in particolare l'articolo 80, paragrafo 2, in combinato disposto con l'articolo 300, paragrafo 2, primo comma, prima frase, e con l'articolo 300, paragrafo 3, primo comma,

Having regard to the Treaty establishing the European Community, and in particular Article 80(2) in conjunction with the first sentence of the first subparagraph of Article 300(2) and the first subparagraph of Article 300(3) thereof,

vista la proposta della Commissione(1),

Having regard to the proposal from the Commission(1),

visto il parere del Parlamento europeo(2),

Having regard to the opinion of the European Parliament(2),

considerando quanto segue:

Whereas:

(1) È opportuno che i vettori aerei della Comunità europea operino secondo regole uniformi e precise in materia di responsabilità per danno e che queste regole siano identiche a quelle applicabili ai vettori di paesi terzi.

(1) It is beneficial for European Community air carriers to operate under uniform and clear rules regarding their liability for damage and that such rules should be the same as those applicable to carriers from third countries.

(2) La Comunità ha partecipato alla conferenza diplomatica internazionale di diritto aereo svoltasi a Montreal dal 10 al 28 maggio 1999 che ha portato all'adozione della convenzione per l'unificazione di alcune norme relative al trasporto aereo (convenzione di Montreal) ed ha firmato tale convenzione il 9 dicembre 1999.

(2) The Community took part in the International Diplomatic Conference on air law convened in Montreal from 10 to 28 May 1999, which resulted in the adoption of the Convention for the unification of certain rules for international carriage by air (the Montreal Convention), and it signed the said Convention on 9 December 1999.

(3) Le organizzazioni di integrazione economica regionale competenti per talune questioni disciplinate dalla convenzione di Montreal possono essere parti di essa.

(3) Regional Economic Integration Organisations which have competence in respect of certain matters governed by the Montreal Convention may be parties to it.

(4) La Comunità ed i suoi Stati membri condividono competenze in questioni coperte dalla convenzione di Montreal ed è pertanto necessario che essi la ratifichino simultaneamente per garantire un'applicazione uniforme e completa delle sue disposizioni nell'Unione europea,

(4) The Community and its Member States share competence in the matters covered by the Montreal Convention and it is therefore necessary for them simultaneously to ratify it in order to guarantee uniform and complete application of its provisions within the European Union,

DECIDE:

HAS DECIDED AS FOLLOWS:

Articolo 1

Article 1

La convenzione per l'unificazione di alcune norme relative al trasporto aereo internazionale (convenzione di Montreal) è approvata per conto della Comunità europea.

The Convention for the Unification of Certain Rules for International Carriage by Air ("the Montreal Convention") is hereby approved on behalf of the European Community.

Il testo della convenzione è accluso alla presente decisione.

The text of the Convention is attached to this Decision.

Articolo 2

Article 2

Il presidente del Consiglio deposita, in nome della Comunità, lo strumento di cui all'articolo 53, paragrafo 3, della convenzione di Montreal, presso l'organizzazione per l'aviazione civile internazionale, insieme ad una dichiarazione di competenza.

The President of the Council shall deposit, on behalf of the European Community, the instrument provided for in Article 53(3) of the Montreal Convention with the International Civil Aviation Organisation, together with the Declaration of Competence.

Tale strumento è depositato contemporaneamente agli strumenti di ratifica di tutti gli Stati membri.

The instrument shall be deposited simultaneously with the instruments of ratification of all the Member States.
